Section K in the amount of $1 ,000.00 was unanimously adopted. Upon motion of Councilman Fishback, seconded by Councilman Lowenbach, Council voted unanimously to adopt the Total General Fund in the amount of $182,897.00. • Upon motion of Councilman Orr, seconded by Councilman Dodd, Council unani- mously adopted Section L in the amount of $28,425.00. Upon motion of Councilman Orr , seconded by Councilman Pumphrey, Council unanimously adopted Section M in the amount of $22,148.00. Upon motion of Councilman Orr , seconded by Mayor Rollins, Council unani- mously adopted Section N in the amount of $33,470.00 and Section 0 in the amount of $1,000.00. Upon motion of Councilman Orr , seconded by Councilman Dodd, Council unani- mously adopted the Total Utility Fund in the amount of $85,043.00. There being no further business, the meeting adjourned with general consent at 9:30 P.M. 410, Mayor Clerkif the Council MINUTES OF SPECIAL MEETING OF LEESBURG TOWN COUNCIL, JUNE 3, 1964. A special meeting of the Leesburg Town Council was -held in the Council Chambers, Leesburg, Virginia on June 3, 1964 at 8 :00 P.M. The meeting was called to order by the Mayor , with Councilmen C. A. English Cole , C. Grey Dodd, C. Maloy Fishback, Maurice R. Lowenbach, Jr. , Robert A. Orr and John W. Pumphrey all being present. Also present were Town Manager James W. Ritter , Jr. and Town Attorney George M. Martin. In the absence of the Clerk, Mr. James W. Ritter, Jr. 'was appointed Clerk Pro Tem. On motion of Councilman Orr , seconded by Councilman Pumphrey, the follow- ing Agreement was approved : THIS AGREEMENT, made this 3rd day of June , 1964, by and between . THE TOWN OF LEESBURG, a municipal corporation, Party of the First Part; and VALLEY. DRILLING CORPORATION, Party of the Second Part ; 1. The Party of the Second Part shall at its own expense , cost and charges forthwith begin to bore and drill a well upon the property of the Party of the First Part , designated as the Lees- burg Godfrey Airport on and at its location as the Party of the First Part may designate , said drilling to include casing, grout- ing and to be drilled, cased and grouted according to the Virginia State Department of Health regulations for Public Water Supplies. 2. The work shall be executed in a good, substantial, and work- manlike manner and the Party of the Second Part shall commence drilling within ten (10) days from date hereof. 3. The Party of the Second Part shall not be liable , as regards the completion of the work, for any delay which may be caused by reason or on account of any strike of workmen, an act of God, un- avoidable accident , or any circumstances beyond his control , other than the lack of funds, and no such delay as aforesaid shall be deemed a default and agrees to complete the drilling within twenty- one (21) days of commencing or when a flow of eight (8) gallons per minute of water is obtained. 299 Minutes of June 3, 1964 Special Meeting. 4. The Party of the Second Part , as soon as work is completed , shall at its own expense clear away all machinery, shrubbery, and any materials and things which may be lying about the work or on the property, and shall do everything necessary to finish drilling in a complete and businesslike manner, both in appearance and fact. 5. Upon the completion of said work the Party of the Second Part shall give notice to the engineer of the Party of the First Part, John W. Paxton. 6. The Party of the First Part shall pay to the Party of the Sec- ond Part , in consideration of the faithful execution of said drill- ing and completion of conditions herein contained the sum of Four Dollars ($4.00) per foot in dirt and the sum of Five Dollars ($5.00) per foot in rock, shale or other hard substance , to be paid upon completion of drilling. • 7. The Party of the First Part reserves the right to stop drill- ing at any time , paying for depth drilled at the time the Party of the Second Part is instructed to cease drilling, and then select a new drilling site on said property. The Party of the Second Part shall not be required to drill in excess of 400 feet in any one site. 00 8. The. Party of the Second Part does not warrant or agree to find water. 9. The Party of the Second Part shall be responsible for all acci- dents and damages of any kind which may occur during the time and consequent upon the performance of any work under this contract , and shall indemnify the Party of the First Part against the same. Martin Town Attorney On motion of Councilman Pumphrey, seconded by Councilman Orr, the follow- ing resolution was adopted : BE IT RESOLVED by the Town Council of the Town of Leesburg, that Perry Engineering Company's invoice in the amount of $2,257.24 be appropriated, which will complete the work on the altitude valve box. Mr. Cole presented the following resolution for consideration by the Council : BE IT RESOLVED by the Town Council of the Town of Leesburg that it has been conclusively determined that the sewerage facilities from Raflo 's Store on King Street in the Town of Leesburg is directly connected to a storm drain, and which is in conflict with the Town ordinance, NOW BE IT THEREFORE RESOLVED, that because of the health hazard which exists and because of the violation of the Town ordinance, Sec. 19-10, a notice shall be given to Mr. Frank Raflo, that the sewerage facilities at the store shall be disconnected from the storm drain, and a rearrangement of sewer lines made so that the sewage will flow into the Town sanitary sewer located in front of the store on King Street, such connection shall be made by July 15, 1964. AND BE IT FURTHER RESOLVED, that the Town Manager of the Town of Leesburg is hereby authorized and directed to install a sewer ser- vice line between the sewer main and the property line at Raflo's Store, the cost of which is to be borne by the Town of Leesburg. After considerable discussion as to the places which are connected to the storm sewer , on motion of Councilman Orr, seconded by Councilman Cole , this matter . was turned over to the Utility Committee for study and to be placed on the Agenda at the next Council meeting. After considerable discussion as to a tax rate for the coming year, Council- man Pumphrey moved .that a tax of $.55 be set on real estate and $.85 be set on personal property, which motion was seconded by Councilman Lowenbach. On a roll call vote, the motion was defeated by Mr. Cole , Mr. Fishback, Mr. Dodd and Mayor Rollins. Councilman Fishback then moved that a real estate tax of $.50 be set and a tax of $1.00 on personal property, which motion was seconded by Councilman Dodd. On a recorded vote, the motion carried, with Councilmen Lowen- bach and Pumphrey voting against it. On motion , duly seconded, the meeting was adjourned. A special meeting of the Leesburg Town Council was held in the Council Chambers, Leesburg, Virginia on June 4, 1964 at 4:30 P.M. The meeting was called to order by the Mayor , with Councilmen C. A. English Cole, C. Grey Dodd, C. Maloy Fishback, Maurice R. Lowenbach, Jr. , ,Robert A. Orr and John W. Pumphrey all being present. Also present was Town Manager James W. Ritter, Jr. , who was appointed Clerk Pro Tem in the absence of the Clerk. I Mayor Rollins made a motion to rescind the rate which was set at the Council meeting on June 3, 1964, which motion was seconded by Councilman Fish- back and unanimously rescinded. Councilman Fishback then made a motion, seconded by Councilman Pumphrey, that the real estate tax be set at $.60 and the personal property tax at $1.00. A recorded vote showed all in favor , with the exception of Councilman Lowenbach. On motion, duly seconded, the meeting was adjourned. y. The Party of the Second Part shall at its own expense, cost and charges forthwith begin to bore and drill a well upon the property of the Party of the First Part, designated as the Leesburg Godfrey Airport on and at its location as the Party of the First Part may designate, said drilling to include casing;; grouting and to be drilled, cased and grouted according to the Virginia State Department of Health regulations for Public Water Supplies. 2 . The work shall be executed in a good, substantial, -111 and workmanlike manner and the Party of the Second Part shall commence drilling within ten (10 ) days from date hereof. 3 . The Party of the Second Part shall not be liable, as regards the completion of the work, for any delay which may be caused by reason or on account of any strike of workmen, an act of God, unavoidable accident, or any circum- stances beyond his control, other than the lack of funds, and no such delay as aforesaid shall be deemed a default and agrees to complete the drilling within twenty-one (21) days of commencing or when a flow of eight ( 8 ) gallons per minute of water is obtained. 4. The Party of the Second Part, as soon as work is completed, shall at its own expense clear away all machinery, shrubbery, and any materials and things which may be lying about the work or on the property, and shall do everything necessary to finish drilling in a complete and businesslike HILL.DIZEREGA B DEBUTTS manner, both in appearance and fact. 91111894 8 Y03H3Z10•wH 5 . Upon the completion of said work the Party of the Second Part shall give notice to the engineer of the Party of the First Part, John W. Paxton. 11 6 . The Party of the First Part shall pay to the Party of the Second Part, in consideration of the faithful ex- ecution of said drilling and completion of conditions here- in contained the sum of Four Dollars ($4 . 00) per foot in dirt and the sum of Five Dollars ($5 . 00) per foot in rock, shale or other hard substance, to be paid upon completion of drilling. 7 . The Party of the First Part reserves the right to stop drilling at any time, paying for depth drilled at the time the Party of the Second Part is instructed to cease drilling, and then select a new drilling site on said property. The Party of the Second Part shall not be required to drill in excess: of 400 feet in any one site. 8 . The Party of the Second Part does not warrant or agree to find water. 9 . The Party of the Second Part shall be responsible for all accidents and damages of any kind which may occur during the time and consequent upon the performance of any work under this contract, and shall indemnify the Party of the First Part against the same.
