HomeMy Public PortalAbout1964_08_10 1'9 MINUTES OF REGULAR MEETING OF LEESBURG TOWN COUNCIL, AUGUST 10, 1964. A regular meeting of the Leesburg Town Council was held in the Council Cham- bers, Leesburg, Virginia on August 10, 1964. The meeting was called to order by the Mayor, with Councilman Cole leading the group in prayer. Those present were Councilmen C. A. English Cole, C. Grey Dodd, C. Maloy Fishback, Robert A. Orr and John W. Pumphrey. Also present were Town Manager James W. Ritter, Jr. and Town Attorney George M. Martin. Absent from the meeting was Councilman Lowenbach. The minutes of the regular meeting of July ' 7, 1964 were unanimously ap- proved by Council. Town Manager Ritter reported that plans had been received today on the By- Pass, this being Line A and D, which they have been following all the time. He announced that there will be a utility field inspection on August 26th to deter- mine what utility lines are involved in the right-of-way, to see how they can be removed and what the cost of doing this will be. He stated that this inspec- tion usually precedes by 6 months to a year the advertisement for bids. He re- ported that he had been trying to arrange a meeting with Mr. Joseph Kincaid re his land needed for sewage treatment facilities and that this meeting would prob- ably be sometime after September 1. Mr . Kincaid suggested that we write him a letter outlining what we plan to do down there and make him an offer. Mr. Ritter reported that the infiltration studies are being made and that, 50 so far , they have found 19 places where the downspouts go into the ground, 8 of LCACD which have been. determined as going into the sanitary sewer. These studies will • be continued. He also reported that several manholes have recently been raised; U and that construction has begun on Lee Avenue and Davis Avenue. He also re- • ported that he had received a letter from the State Water Control Board refusing any financial aid for sewage treatment facilities this year. Mr. Ritter reported that the railroad crossings on Route 15 and on Catoctin Circle will be repaired very shortly, the one on Catoctin Circle being main- tained by the Town, but eventually to be taken over by the Highway Department. He also reported that Walter Phillips is working on the plans for curb and gut- ter on Woodberry Road and on revising the grade on North King Street from Colonel Fletcher 's house, where the sidewalks will probably have to be raised. Six of the easements for the Woodberry Road storm drainage project are still outstand- ing and it was suggested that these people who have not yet signed these ease- ments be given one week after the plans have been received in this office, other- wise condemnation proceedings will be started to take this land. .Mayor Rollins announced that there will be a call meeting of the Council committee as a whole on Wednesday night , August 12th at 7:30 P.M. , together with the Airport Commission, to discuss proposals concerning the Airport, which proposals were submitted on August 1st. This will not be a public meeting, but Council will probably take action at the next regular meeting on this matter. Upon motion of Councilman Pumphrey, seconded by Councilman Orr , the follow- ing resolution was unanimously adopted : BE IT RESOLVED by the Town Council of the Town of Leesburg, that the Leesburg Planning Commission be and it is hereby requested to make a study of the definition of "subdivide" as contained in the Leesburg Subdivision Ordinance; determine its adequacy or inadequacy with re- spect to future development; if found to be adequate, so report to Council ; if found to be inadequate , prepare a definition that is ade- quate and propose an amendment to said ordinance through proper pro- cedure. Mayor Rollins referred the proposed resolution to charge a license fee "For Hire Trucks" back to the Finance Committee to set an amount to be charged and where it is to go in the Code. Upon motion of Councilman Pumphrey, seconded by Councilman Dodd, the follow- ing resolution was unanimously adopted : BE IT RESOLVED by the Town Council of the Town of Leesburg, that Johnson & Williams be hired to make a survey for a Sanitary Sewer to serve houses on Sycolin Road, together with construction plans and estimate of cost of construction. 2 d_ MINUTES OF AUGUST 10, 1964 MEETING'. Upon motion of Councilman Dodd, seconded by Mayor Rollins , the following resolution was placed on the floor for discussion: BE IT RESOLVED by the Town Council of the Town of Leesburg, that the following appropriations be made in the current Budget : . General Fund Street Department Tree Removal, item F-9 $395.00 To remove the following trees: Musgrave, 12 N. Flirt - 1 Ash $100 Wenner, 54 N. King - 1 Maple 75 Leesburg Florist, 22 W. Market 1 Maple 80 Donohoe, 126 S. King - llarge Maple at driveway 140 Councilman Cole moved to amend this motion to include the Musgrave and Wenner trees and to delete the Leesburg Florist and Donohoe trees. This motion was dropped for lack of a second. Councilman Orr moved to delete the Leesburg Florist and Donohoe trees. This motion was seconded by Councilman Cole and was defeated by a roll call vote of 3 for and 3 against. Mayor Rollins moved that the Wenner and Musgrave trees be taken down, this motion being seconded by Councilman Pumphrey. Councilman Fishback moved to amend this motion to have the Town Manager have a tree surgeon examine the Leesburg Florist and Donohoe trees to see if they are diseased. This motion was seconded by Councilman Cole and was unanimously approved, as amended. The appropriation of $175.00 to re- move the Wenner and Musgrave trees was approved by a roll call vote of 5 to 1 , Councilman Orr voting against this appropriation. Upon motion of Councilman Dodd, seconded by Councilman Fishback, the follow- ing money was appropriated in the General Fund : Capital Outlay New sidewalk construction at Times Mirror $150.75 Upon motion of Councilman Pumphrey, seconded by Councilman Dodd, the fol- lowing money, was appropriated in the Utility Fund : Sewer Department Operation Pump out Digestor by Contractor $500.00 Upon motion of Councilman Cole, seconded by Councilman Dodd, the follow- ing money was appropriated in the Utility Fund : Capital Outlay Backhoe, International $7,500.00 Upon motion of Councilman Fishback, seconded by Councilman Dodd, the follow- ing money was appropriated in the Utility Fund : Capital Outlay Repair Roof on Control Building $200.00 Upon motion of Councilman Orr, seconded by Councilman Dodd, the following money was appropriated in the Utility Fund : Capital Outlay Improvements at Old Pump House $500.00 . Upon motion of Councilman Cole, seconded by Councilman Orr , the follow- ing resolution was unanimously adopted : BE IT RESOLVED by the Town Council of the Town of Leesburg, that Paragraph (8) of Humble Oil Company 's Vendor Lease Privilege be amended as follows: 8. If , during the term of this agreement or any renewal thereof , the Town shall sell , convey or lease any area within one hundred MINUTES OF AUGUST 10, 1964 MEETING. feet (100 ft. ) of Humble 's permanently installed facilities on the Airport to a party or parties whose activities are such that they may be expected to consume aviation and motor fuels and other petroleum products, the Town shall make it a condition precedent to such sale, conveyance or lease, that such transferee or Lessee shall enter into an agreement with Humble for the purchase from Humble of aviation and motor fuels and other petroleum products at the prices herein provided to be paid therefor by the Operator, and which agreement shall be co-extensive with the balance of the term of this agreement or any renewal thereof. Upon motion of Councilman Fishback, 'seconded by Councilman Cole, the fol- lowing resolution was unanimously adopted : BE IT RESOLVED by the Council for the Town of Leesburg, Virginia, that the request of Walter L. Phillips for a rearrangement of prop- erty line and utility easement of Lots 17, 18 and 19, Section One, Exeter Hills Subdivision, as shown on a plat of the same prepared by Walter L. Phillips and dated August 6, 1964, be and the same is hereby-referred to the Leesburg Planning Commission for recommenda- tion and report. Mayor Rollins announced that he was trying to set up a meeting in Richmond ur) C with the State Water Control Board on plans to be followed on sewage treatment m facilities.
