HomeMy Public PortalAbout1947-05-31 Special Meeting18 MAY 31, 1947 A special meeting of the council of Bal Harbour Village was held. in the Administration Building, Bal Harbour, at 8:00 o'clock P. M., May 31, 1947. There were present the Messrs. Webb, Massnick and Whittaker. The Mayor end Village Attorney, J. Julien Sout.herland and Mary. Wetterer, Village Clerk were also present. The president of the council reported that all members were present, as due to the resignation of two of the members, namely, Ray Sesames, Jr. and Charles Graham, there are now only three members of the council. Consideration was given the matter of whether the two vacancies in the council caused by the resignation of Messrs. Semmes and Graham should be filled by the council st this tire. After discussion, it was the con - census of opinion of the members of the council that in view of the fact that an election will shortly be held to select, all five councilmen to serve under the terms of the legislature charter for the Village, it would serve no good purpose for the council to fill the vacancies because the members so selected would serve only about thirty days. The Village Attorney reported to the meeting that the charter for the Village which had been approved by the counoil had been passed by the legislature and is now or shortly will be on the governor's desk for his approval and if it is not approved or disapproved within five days, after reaching the governor, it will become a law without his approval. The Attorney stated that under the terms of the charter five council- men are to be elected at an election to be held within sixty days from Passage of the charter, and he suggest that a notice should be posted at once requesting the, registration of the qualified voters residing within the territorial limits of the village at the Village offices at 10,000 Collins Avenue on or before the date of the election and that this notice provide that the: election be held on the 30th day of June from 9:00 o'clock A. M. until. 9:00 o'clock F. M. Thereupon on motion of Mr. Massnick, seconded by Mr. Whittaker, it was voted that the election for councilmen under the charter granted Bal Harbour pillage by the 1947 session of the Florida iebislature, be held at the Administration Building, Bal Harbour, on Monday, June 30th, 1947, on which day votes may be cast from 9:00 o'clock A. M. until 9:00 o'clock P. M., the residents of the Village tc register for the election at any time up to that day preceding the election; and that accordingly there be posted at three places in the Village, to wit: (1). The Admi.nio- trati.on Building. (2). The telephone booth adjacent to the watchman's building at 9800 Collins Avenue and (3). at the equipment shed (also known as the workshop) a notice reading substantially as follows: "TO ALL RFSILI,FTS OF BAL HARBOUR VILLAGE: You are hereby notified that on Monday, June 30th, 1947, an election will be held in Bal Harbour Village to elect five (5) council- men under the terms of the charter granted to the Village by MAY 31. 1947 t.F the 1947 session of the Florida legislature. "You are requested to register at the Village offices in the Administration Building, 10,000 Collins Avenue, before June 29, 1947. "The voting place will be the Administration Building, located at 10,000 Collins Avenue, and votes may be cast at any time between 9:00 o'clock A. M., and 9:00 o'clock F.M., on Monday, June 30, 1947. "By Order of the Village Council." Upon motion of Mr. Massnick, seconded by Mr. Whittaker, it was voted that all candidates for the five councilmen offices to be filled at the election June 30th shall file an application endorsed by 25 registered voters with the Village Clerk on or before June 10, 1947, to have their names appear on the ballot. On motion of Mr. Massnick, seconded by Mr. Whittaker, it was voted that on or before the day of election, June 30, 1947, notice should be given to the electors that under the terms of the charter granted by the 1947 legislature the two councilmen receiving the highest number of votes will serve for six years and the three members receiving the next high— est number of votes will serve for four years. There being no further business the motion was duly made, seconded and carried, that the meeting be adjourned. M. There were present the Messrs. Webb, Massnick and Whittaker. Mr. J. Julien Southerland, village attorney and Mary Wetterer, village clerk, were also present. Mr. Southerland, as village attorney, brought to the attention of the meeting that under the instructions of the council at its meeting held May 9, 1947, he had submitted to the Dade County delegation of the 1947 Florida JUNE 23, 1947
