MINUTES OF REGULAR MEETING OF LEESBURG TOWN COUNCIL, NOVEMBER 9, 1964.
A regular meeting of the Leesburg Town Council was held in the Council
Chambers, Leesburg, Virginia on November 9, 1964. The meeting was called to
order by the Mayor , with the Mayor leading the group in prayer. Those present
were Councilmen C. A. English Cole , C. Grey Dodd, Maurice R. Lowenbach, Jr. ,
Robert A. Orr and John W. Pumphrey; also Town Manager James W. Ritter, Jr. and
Town Attorney George M. Martin. Absent from the meeting was Councilman Fishback.
Town Manager Ritter explained several items on the Agenda. Councilman Cole
stated that he had a request from a resident of the Sycolin Road area requesting
that something be done to have Mr. Arthur Harding clean'. up the junk pile in his
yard.
Councilman Cole corrected the minutes of the meeting of October 26 on Page
2, Paragraph 3 , next to last sentence in said paragraph to read : "Mr. Cole said
that in all the testimony given he had not heard anyone say it would not have to
be resurfaced in 20 years. " With this correction, the minutes of the meetings of
October 26, 1964 and October 29, 1964 were approved with general consent.
Mayor Rollins read a "Thank You" note from Councilman Fishback for the
flowers thent him by the Council members and the Town Attorney during his recent
stay in the hospital.

Attorney Donald W. Devine presented to Council a lease from South Central
CD 110Attorney
to lease a small portion of the new Airport. After a great deal of
discussion regarding this matter, the Mayor ordered that this matter be brought
before Council again at their next meeting on November 23rd and instructed Mr.
U Devine to present more information regarding the activities and nature of this
organization.
Mayor Rollins stated that he would like to see the lease with Chantilly
Aviation for the new Airport culminated just as soon as possible.
Upon motion of Councilman Orr , seconded by •Councilman Pumphrey, the follow-
ing resolution was adopted, with Councilman Cole abstaining, the money to be ap-
propriated out of the Utility Fund :

BE IT RESOLVED by the Town Council of the Town of Leesburg, that the
low bid of Maryland Excavators, Inc . in the amount of $5,250.00 for
construction of the Sycolin Road Sewer be awarded. This bid being
the lowest of four bids received and is in accordance with the adver-
tisement for bids dated Oct. 19, 1964.
Town Manager Ritter explained that Tri-County Refuse Service Company has
requested that changes be made in trash pick-up on Thanksgiving and Christmas
holidays, trash to be picked up in the business area on Wed. evening before
Thanksgiving Day, and in the residential district, trash to be picked up on
Saturday following Christmas Day. It was the general consensus of opinion
that these changes would be approved, providing proper advertisement is given
to all citizens affected by these changes. _
Upon motion of Councilman Orr , seconded by Councilman Dodd, the following
resolution was placed on the floor for discussion:
BE IT RESOLVED by the Council for the Town of Leesburg, that when-
ever an owner proposes to dedicate or convey an area for street pur-
poses not subject to the Subdivision Ordinance, the Council may re-
quire, before accepting such dedication, that said street' be con-
structed in accordance with Town and State Standards and Specifica-
tions, and that the said dedicator shall furnish a Performance Bond
with surety approved by the Council to insure the installation and
construction of said street , in accordance with said Standards.
After explanation by Planning Director Robert C. Forbes, and after a great deal
of discussion, Mayor Rollins moved that this resolution be tabled. This motion
was seconded by Councilman Cole and was unanimously carried, thus tabling the
above resolution.
Upon motion of Councilman Cole, seconded by Councilman Lowenbach, Council
voted unanimously to make the following appropriation :
Walter Phillips for Survey and Plat of Right-of-Way
on Old Waterford Road $217.00

Upon motion of Councilman Cole, seconded by Councilman Lowenbach, the fol-
lowing appropriation was unanimously made :
Stanton, Minter & Bruner for Airport Audit $100.00
Upon motion of Councilman Pumphirey, seconded by Councilman Orr, the fol-
lowing appropriation was unanimously made :
Downtown Lighting Fund, toward the expense of construct-
ing the proper weatherhead, weatherproof convenience
outlet and 6 foot of conduit on steel poles in the down-
town section, to be used for Christmas lighting $100.00
Upon motion of Councilman Cole , seconded by Councilman Orr , the follow-
ing appropriation was unanimously made :
Va. Department of Highways, for legal work involved in
change-over of maintenance agreement on Catoctin - W. &
0. D. Grade Crossing, from Town of Leesburg, to Va. De-
partment of Highways $ 99.00
Upon motion of Councilman Pumphrey, seconded by Councilman Lowenbach, the
following resolution was placed on the floor for discussion:
BE IT RESOLVED .by the Town Council of the Town of Leesburg, that
Performance Bond #N434392 of Frank Schaefer on Section 5, Pros-
pect Hills , be released. Letter has been received from State High-
way Department stating that "no discrepancies were found which
would disqualify these streets for acceptance by the Virginia De-
partment of Highways. "
Mr. Pumphrey moved to amend this resolution to read that this bond be released
'.'upon acceptance by the State Highway Department of these streets for mainte-
nance. " This amendment to the resolution was seconded by Councilman Lowenbach and
Council voted unanimously for this amendment. A vote was then taken on the entire
resolution, as amended, and-unanimously carried, thus making the resolution read
as follows: '
BE IT RESOLVED by the Town Council of the Town of Leesburg, that
Performance Bond #N43k392 of Frank Schaefer on Section 5, Pros-
pect Hills, be released upon acceptance by the State Highway De-
partment of these streets for maintenance. Letter has been re-
ceived from State Highway Department stating that "no discrepan-
cies were found which would disqualify these streets for accep-
tance by the Virginia Department of Highways."
Mayor Rollins asked Attorney George Martin to investigate the records on
Potter 's Field at his earliest possible convenience in order that this property
might possibly be sold at a later date.
The matter of installing a meter to measure water at the National' Children's
Rehabilitation Center was disucssed by Council. Mr. Ritter told Council that the
contractor had finished donnecting the last building to the sanitary sewer line
today and that it is now up to the Center to install the 2-inch meter to measure
this water.
A general discussion took place at this time with regard to the sewer line
on the east end of Town along Route 7 known as the "Parker Sewer Line. "
Council discussed the matter of constructing or repairing the street which
runs in front of Leesburg Grain and Feed Company. Attorney George Martin said
he believed a survey would be needed to determine who owns what part of this
land. Upon motion of Councilman Cole , seconded by Councilman Dodd, Council
voted unanimously to have Mr. Ritter secure estimates on what an actual physi-
cal survey would cost to determine the property lines in this area and to tie
this survey into the existing right-Of-way of Loudoun Street, South Street and
Buick Street.
Upon motion of Councilman Lowenbach, seconded by Councilman Dodd, Council
voted unanimously to enter into the following letter of agreement with VEPCO:

Gentlemen :
Application has been made to you by the Council of this' Town
for the privilege of attaching to a number of your poles along King
and Market Streets, certain wires and other fixtures necessary. to
provide decorative lighting for the Christmas holiday period.
In consideration for your agreement to permit said attachments,
the Town of Leesburg hereby assumes all responsibility for such instal-
lation and agrees to save Virginia Electric and Power Company harmless
from any loss, cost , injury or damage to persons or property resulting
out of or arising from the installation, operation, use, non-use or re-
moval of such installations.
The Town of Leesburg further. agrees to assume responsibility
for the payment to you for all electric energy used through said
installations, with the understanding that billing will be made under
the existing municipal contract between said Town and Virginia Electric

This guarantee was authorized by the Council of the Town of
Leesburg at a meeting held on the 9th day of November, 1964, at
which meeting a majority of the members of said council voted in
favor of the resolution authorizing and directing the execution
of this guarantee.

Councilman Cole remarked that he understood Attorney Penn was appearing
before the Equalization Board of the County requesting a reduction in taxes
. for the property owned by the Fort Evans Gardens Apartments. Attorney
George Martin stated that he also understood that there was another prop-
erty within the corporate limits being considered for this purpose. It
was suggested that Mr. Ritter be instructed to write to the Equalization
Board to determine if any changes in assessments have been made on real
• estate in the corporate limits.
Upon motion of Councilman Cole, seconded by Councilman Dodd , the meeting
was adjourned at 9:55 P.M. . 411110
