MINUTES OF REGULAR MEETING OF LEESBURG TOWN COUNCIL, FEBRUARY 1, 1965.
A regular meeting of the Leesburg Town Council was held in the Council
Chambers, Leesburg, Virginia, on February 1, 1965. The meeting was called to
order by the Mayor , with Councilman Pumphrey leading the group in prayer.
Those present were Councilmen C. A. English Cole , C. Grey Dodd, C. Maloy Fish-
back, Maurice R. Lowenbach, Jr. , Robert A. Orr and John W. Pumphrey; also Town
Manager James W. Ritter, Jr. and Town Attorney George M. Martin.
The Minutes of the regular meeting of January 18, 1965 and the call meet-
ing of. January 27, 1965 were approved with general consent.
Town Manager Ritter reported that Johnson and Williams are still looking
for a site for a holding pond if one is required and that they plan to walk
from the present plant downstream looking for a site on Thursday morning, Febru
ary 4th, at 9:00 A.M. if any member of Council would care to join the group.
He also reported that Mr. Lee Phillips will be present on Thursday night for the
Utility Committee meeting to discuss the bond issue and the two storm drainage
projects. He will bring along with him a. copy of the specifications and materials
that he believes necessary for. the advertisement.
Mr. J. Lynn Cornwell, a member of the Board of Trustees of Loudoun Memorial
Hospital, addressed the Council, requesting, on behalf of the Board of Trustees,
that Gibson Street between Old Waterford Road• and the Hospital be closed. He
stated that this street is unpaved and the dusty condition that exists in the
summer months is not good in the vicinity of a hospital , and that the Board feels
that something should be done about this street, that it should be paved or closed
as a public thorofare. Dr. Orr apprized Mr. Cornwell .of the fact that • "Thru
Traffic Pr.ohibi.tecl!signs. had been placed at the entrance of Gibson Street from-
the Old Waterford Road by the Town approximately 6. months ago. Councilman Fish-
back brought out the fact that this street had been dedicated to public use by the
Town at the request of the Hospital several years ago. Mr. Cornwell stated that
the Hospital would certainly.be open to any alternative suggestions the Town
might have and that- they had no objection to the Town using this as an access
road to the water tank. Dr. Orr asked if there were any other alternative route •
to the Hospital during bad weather. Dr. James T. Jackson said he did not believe
this road should be closed, he was definitely not in favor of it.
Upon motion of Councilman Fishback, seconded by Councilman Lowenbach, the
following resolution was placed on the floor for discussion:
BE IT RESOLVED by the Town Council of the Town of Leesburg, that Gib-
son Street, between Old Waterford Road and the Loudoun Memorial Hos-
pital, be closed in accordance with the request of the Board of Trus-
tees of the Hospital.
AND BE IT FURTHER RESOLVED, that the vacation of Gibson Street be
done in accordance with Sec. 15-766.1 of the Code of Virginia.
Dr. William Frazer and Dr. John Wynkoop also stated that they were in favor of
leaving this road open, but they believed that it should be blacktopped by the
Town. After more discussion, a roll call vote defeated the above resolution
unanimously.
Upon motion of Councilman Pumphrey, seconded by Councilman Orr , the follow-
ing resolution was unanimously adopted :
BE IT RESOLVED by the Town' Council of the Town of Leesburg, that a
supplemental appropriation be made to Equipment Repairs in Utility
Fund in the amount of $300.00.
Upon motion of Councilman Pumphrey, seconded by Councilman Orr , the follow-
ing resolution was unanimously adopted :
BE IT RESOLVED by the Town Council of the Town of Leesburg, that a
supplemental appropriation be made to Street Repairs in Utility
Fund in the amount of $200.00.
Upon motion of Councilman Fishback, seconded by Councilman Dodd, the follow-
ing resolution was unanimously adopted:

BE IT RESOLVED by the Town Council of the Town of Leesburg, that the
Town accepts the proposition as outlined in Carleton Penn 's letter
of January 19, 1965 , which is quoted as follows :
(1) The Town will construct, at its expense, as soon as the weather
permits, a six inch curb and four foot .concrete sidewalk with curb
returns at the eastern extremeties around the lot, as per plat.
(2) There will be a forty foot concrete entry ,on Edward's Ferry
Road extending from my cross-walk to the arc of the turn created,
as shown on plat.
(3) I will dedicate, without charge to the Town, a strip of land
one foot wide around the entire lot, and will also dedicate, with-
out charge, the triangle containing approximately 339 square feet,
as per plat. I will also pay the Town $175.00 in cash in advance
of the work.
• (4) Such dedication is subject to any footings or other slight
encroachments thereon by the areaways or any portion of present
improvements, and I also reserve the right to run drains under the
sidewalk and through the curb on the Edward's Ferry side.

O (5) It is understood that we will make appropriate arrangements
for bridging approximately one foot at the corner of the south
areaway or areaways should it be necessary, and I will have the
U right to curb it to keep water from entering the areaway. In this
connection, all sidewalk is to be tilted away from the building.
(6) I agree to proceed with the completion of the rock wall at
the westerly end of the premises as soon as weather permits after
the Town . Engineer has located the new property line, as per plat.
AND BE IT FURTHER RESOLVED, that a sum of $687.00 be appropriated
to "Capital Outlay - Sidewalk Construction" for this work.
• Mr. Roy Swayze, representing American Aluminum Company, addressed Council,
stating that his interest was in collecting the balance of $4,000 due under the
contract with the Leesburg Airport Commission. He stated that, according to the
information he had received, all the work is completed at the Airport, with the .
exception of some little difficulty over some of the electrical outlets, which,
as he understands it, should be made explosion proof in order to meet the re-
quirements of the Loudoun County Electrical Code. Mr. Swayze proposed that the
best way to accomplish this would be to have American Aluminum Company put in the
• explosion proof plugs, which he understood would cost somewhere around $350.00
to $500.00, and to split the cost with the Town of Leesburg, or at a cost not to
• exceed $250.00 as the Town's portion. He then read the section of the Loudoun
County Electrical Code having to do with the hazardous location of plugs.
Councilman Fishback asked at whose instigation the door in the back of this
hangar was installed, which door was not in the plans. Mr. Brice replied that
• his company was instructed to build the hangar so that there would be access to
the other building, said instructions coming from Mr. Paxton and the Airport Com-
mission. Councilman Fishback stated that this door would also have to be changed
in order to have it comply with the regulations. Mr. Hammerly said that the Com-
mission. was well aware of this situation and would have this matter taken care of,
that it had nothing to do with the controversy between the Airport Commission and
American Aluminum Company.
Mr. Martin presented and read the following statement that Mr. George Joy,
Loudoun County Electrical Inspector, would have the Airport Commission and the
Town sign. If this were signed, then Mr. Joy would issue a certificate of ap-
proval on these buildings.

"The Airport Commission undertakes to insure that the hazards in the
hangar buildings will be held under control so that the building as
wired will meet the Code requirements of the National Electric Code.
This building will be limited in its use by no painting, storing of
flammable liquids and that all aircraft power plants, aircraft fuel
tanks or aircraft structures containing fuel shall be kept 5 ' away
from electrical outlets, heaters, etd. We also realize that all wir-
ing within 18" of deck will be explosion proof. We will display signs
to this effect inside the hangar. " ,r .

Mr. Hammerly stated that the American Aluminum Company had a contract to
comply with the electrical ordinances of Loudoun County and that he believed
they should comply with this contract. He stated that Mr. Joy had lead them to
believe that sockets 14 feet above the floor were feasible and that the Airport
Commission could not go along with this. He did state that other parts of the
contract had been very well met. He stated that Mr. Joy had dubbed the maintenance
hangar as being safe as long as no painting was done in it and signs have been
placed in it, but he felt that some provisions of the National Electric Code
could be waived, but Mr. Joy would not do this. It was decided to table this
matter until later in the meeting when Mr. Joy could be present.

Upon motion of Councilman Fishback, seconded by Councilman Cole, the fol-
lowing
resolution was -placed on the floor for discussion:
BE IT RESOLVED, THAT WHEREAS, Robert Perkins, is the contract pur-
chaser from Leonard W. Parker of Lots No. 10 through 23 of L. W. Par-
ker Subdivision located in the Town of Leesburg, Loudoun County, Vir-
ginia, these being the same lots that a certain Trailer Camp Permit
was issued to the said L. W. Parker by this Council on June 23, 1959,
and
WHEREAS, •the said Robert Perkins wishes to put in certain improve-
ments as more particularly set forth in a certain letter from his at-
torney dated January 21 , 1965, with plat attached and is desirous
of clarification of the status of said permit, now therefore,
BE IT RESOLVED that said Council considers that said Robert Perkins,
upon the closing and purchase of said property, has a vested interest
in and to said permit provided that all fees due the said Town of
Leesburg are paid prior to his purchase, and that he execute a bond
approved by the Town Attorney, guaranteeing the construction of said
improvements as set forth in aforesaid letter January 21, 1965, and
as substantially shown on a certain plat of Walter L. Phillips, Cer-
tified Civil Engineer showing said lots, said plat being dated Novem-
ber 25, =1964, and upon payment of said fees, said Town Attorney is
authorized to dismiss a certain suit now pending in the Circuit Court
for Loudoun County, Virginia styled Town of Leesburg in Virginia vs.
Leonard W. Parker, In Chancery No. 2347, as settled.
Upon motion of Councilman Orr, seconded by.Councilman Lowenbach, the fol-
lowing amendment to this motion was unanimously adopted:
And that Paragraph (6) of the enclosed letter be amended to read that
he is to mark off six (6) spaces for playground purposes, the location
• of said spaces to be determined by the Manager of the Town of Leesburg.
A vote on the entire resolution, as amended, showed all in favor. •
Mr. George Joy, the Electrical Inspector, came in at this time and was
asked to explain just what is wrong and what is required in the buildings at the
Airport. He stated that explosion proof fittings should be installed and that
the door between the hangar and the small building would have to be corrected.
He stated that this was strictly in the maintenance hangar, that the wiring in
the large hangar meets all the requirements of the Code. He said that the little
room attached to the back of the maintenance hangar is just as hazardous as the
hangar itself because of the fact that the door is constructed so as to have a
vent which allows gases to escape into this room. The standard practice is to
have a fire-rated door to separate these two rooms. He would recommend that yel-
• low lines be painted in this hangar also in order to keep all gasoline or fuel
oil 5 feet away from sockets.
Mr. Hammerly asked Mr. Joy to tell what is wrong with the electrical part
of this Airport and to tell them what has to be done in order for him to issue
a certificate of approval. He suggested that all explosion proof fittings be
installed in both hangars and that all devices and equipment be explosion proof.
He would suggest that in the large hangar the conduits be extended down and put
plugs in at a reasonable height above the floor and paint yellow lines; that in
the small hangar, all fixtures be made explosion proof and that the door be cor-
rected.

Councilman Lowenbach moved that this matter be referred to the Airport Com-
mission and their attorney, Mr. Hill, to Mr. Brice and his attorney, and to Mr.
• _Martin, representing the Town of Leesburg, so that we can resolve the question
and that it be presented to Council for their consideration. This motion was
dropped for lack of a second.

Mr. Hammerly stated that the Airport Commission 's attorney says they have an
enforceable contract and that he sees no point in this matter coming back to the
Airport Commission again; that it is up to Mr. Brice to complete the buildings.
Upon motion of Councilman Pumphrey, seconded by Councilman Lowenbach, the
following motion was adopted by a roll call vote of 6 to 1, with Councilman Cole
voting against it :

That the Town authorize a sum not to exceed 3250.00 toward the in-
stallation of explosiveproof fittings and equipment in the hangars
• in question, • to comply with the Loudoun County Electrical Code ; that
there shall be three (3) -110 volt outlets, one located on each wall in
./the storage hangar , and there shall be one (1) 2204olt outlet on the
south wall near the entrance door of theistorage hangar; that in the
maintenance shop there shall be two (2) 110 volt outlets on the east
wall, one each on the south and north walls and one (1) 220 outlet .
on the east wall.
qMr. Charles Wight of Alex Brown and Sons was introduced by Councilman Fish-
back. Mr. Wight presented to Council methods which could be followed in regard
6.7 to financing improvements in the Town.
A resolution regarding parking on South Street was referred to the Street
Committee by the Mayor.
Mayor Rollins asked Mr. Ritter to direct Mr: Ward to set up a separate ac-
count in the Loudoun National Bank for the rent received for the Airport prop-
erty.
Mayor Rollins informed Council that Mr. Raflo is trying to work out a situa-
tion whereby he can install a gas line and the sewer line for his property at the
same time.

Upon motion of Councilman Fishback, seconded by Councilman Lowenbach, the
meeting adjourned at 10:25 P.M.
