A regular meeting of the Leesburg Town Council was held in the Council Cham- bers, Leesburg, Virginia, on May 3, 1965. The meeting was called to order by the Mayor, with Councilman Pumphrey leading the group in prayer. Those present were Councilmen C. A. English Cole , C. Grey Dodd, C. Maloy Fishback, Maurice R. Lowenbach, Jr. , Robert A. Orr and John W. Pumphrey; also Town Manager James W. Ritter, Jr. and Town Attorney George M. Martin. The Minutes of the regular meeting of April 19, 1965 were approved with general consent. Mr. E. Frank Myers, III appeared before Council , requesting approval of a preliminary plat of Section 4, Dry Mill Subdivision, which plat had been tabled by the Planning Commission last fall when he first presented it to the Commis- sion. He presented it again about a month ago and the Planning Commission re- fused to approve it for two reasons, they being as follows: (1) A letter from the Highway. Department asking that no subdivisions be approved within the pro- posed location of the By-Pass , and (2) the Land Use Map of 1980, which has not been adopted by either the Planning Commission or the Council. Mr. Myers stated that he had secured the services of an attorney in Fairfax and had been advised that the fact that his land lies within the path of the By-Pass is not grounds for disapproval by the Planning Commission. He stated that he had asked the Mayor to check into the law on this and Mayor Rollins replied that he believed • the question of just where the southwest quadrant of the By-Pass is to be has not o been adopted as a part of the Master Plan of the Town. Mr. Myers said that his p attorney had been advised in Richmond that numerous requests had been received ✓ asking that this quadrant of the By-Pass be changed , but that nothing definite had • been decided. The Town Attorney stated that Mr. Myers ' next step would be to ap- peal to the Circuit Court. Town Attorney Martin also stated that the Council has no authority on a question of this kind, that it is up to the Planning Commission to approve or disapprove it. Councilman Cole asked that the Town Attorney be in- structed to meet with the Planning Commission either on their meeting night or be- fore and advise them if their reasons are valid so that a decision can be made at that time. Town Manager Ritter reminded Council members of the Public Hearing to be held before the Water Control Board in Richmond tomorrow. He urged that all mem- bers go that possibly can. He also called attention to an item on the Agenda having to do with the lowering of the grade of the road on W. Loudoun St. just west of Dry Mill Road, stating that he believed it would be a good idea to pre- sent this to the Board of Supervisors on May 18th, _the date the Highway Depart- ment budget will be presented to the Board. Mayor Rollins reminded Council that the Budget will be discussed at the next meeting on May 17th and the tax levy adopted. He announced that there will be a meeting of the Committee as a whole on May 12th at 7:30 P.M. and asked that both the Street Committee and the Finance Committee discuss all matters at that time, along with the discussion on the proposed budget. Councilman Cole asked several questions of Mr. Ritter. He asked if anything had been heard from Walter Phillips in regard to the A & P lot. Mr. Ritter said that Mr: Phillips had been in the office this afternoon and that he has prepared a. sketch showing the location of pipe and catch basins. Town Attorney Martin re- ported that Honicon Court has been dedicated as a public street. Mr. Ritter stated that all downspouts which have been found to empty into the sewer system have been disconnected. He also reported that the Attorney for the Children 's Center will meet with Mr. Martin and him on next Tuesday morning. Mr. Ritter reported that he had talked with Mr. McKenzie Downs, appraiser, and that it looked as though some of the storm drainage easements will have to be appraised and possibly some taken to Court, at least 3 on the Woodberry project and definitely one and possibly 2 more on the A & P project. Bids will be opened here on June 4th. Mr. Ritter stated that Mr. Jack Williams will be present at the hearing in Richmond tomorrow. �Mr. Ritter reported that bids for the removal of trash and garbage for the coming fiscal year were opened here in the office .this afternoon, with the bid of Sterling .Refuse, Inc . being the low bid, that being $14,560 for one year , or $13,960 for the second year , if taken on a 2-year basis, with an added $80.00 per month, or $960.00 per year , if it becomes necessary to haul refuse to the Town- 6, MINUTES OF MAY 3, 1965 MEETING. • owned landfill at Watson. Tri-County Refuse Service Co. 's bid was $18,720.00 per year , with an added $150.00 per month for the long haul. Jesse Randolph 's bid was $16,800, with 825. 00 per year for the long haul. All three bidders were present at the meeting and Council members asked various questions of all of them. Tri-County Refuse had also presented an offer by which they would operate their ' onw landfill , stating that the Company now owned land for this' purpose within the Town. Jesse Randolph also stated that he owned a landfill in the County which could be used over a long period of time. It was decided that all three com- panies should present a counter-bid proposal, including operation of their own landfill operations, before the meeting of the committee as a whole on May 12th and this matter will be discussed further at this time. Mr. George Hammerly:, Chairman of the Airport Commission, appeared before Council, requesting an appropriation and permission to borrow money to pay the general contractor. He stated that there is approximately $20,000 tied' up with the FAA, which money will not be paid until the final audit is made, and which in- volves a question over one air space easement yet to be obtained. Mr. Hammerly explained that the money borrowed would be repaid to the Town with FAA money and from profits over the next five or six years received from the operation of the Airport. He explained that the Commission 's budget had ended up approximately $5,000 to $6,000 short due to the fact that they had not expected to purchase the land for the air space easement over the Saunders land. He stated that the Airport was moving along very nicely and that the operations are growing, with the operator seeming to be very content with the situation and that he (the opera- tor) is expanding' rapidly. Mr. Martin explained that the air space easement over the Murray property has been turned down by the FAA and that this might possibly have to go to Court before it is straightened out, which could involve some at- torney fees. Mr. Hammerly stated that the total due the E. E. Lyons Co. is $29,076.20 and the American Aluminum Co. is owed $949.00, and possibly a small amount to Mr. Richard Hill in attorney fees. Councilman Lowenbach moved that the Airport Commission be empowered to bor- row $30,000.00 to meet immediate expenses, to be repaid from interest and from the FAA. This motion was dropped for lack of a second. Councilman Cole suggested that the Town Attorney be used as the Attorney for • the Airport Commission, however, Mr. Martin stated that if he did this extra work, he would have to charge the Town for it. Councilman Fishback suggested that this matter be referred to the committee as a whole at their meeting on May 12th and action taken in regard to it at the next regular Council meeting. Mr. R. K. Gheen stated that he thought the Council should be informed that any money borrowed for this purpose would have to be borrowed in the name of the Town, that the Airport Commission is not authorized to borrow money in its name. He also stated that the Loudoun Bank, holder of the Airport bonds, is willing to defer the interest installment until September, a 2 months delay, and that this • payment can be deferred for 2 months each year. Town Attorney Martin reported that the water supply at Big Springs can be acquired , but that it would have to be acquired by agreement or sale, that the lower riparian rights must be considered, you can 't just cut off the property owner 's water supply. It was decided that Johnson & Williams consider this source in their report as to possible sources of future water supply for the Town. Upon motion of Councilman Orr , seconded by Councilman Fishback, the follow- ing resolution was unanimously adopted : BE IT RESOLVED by the Town Council of the Town of Leesburg, that be- cause of a very dangerous traffic situation at the intersection of Rt. T-1004 (Loudoun St. ) and Rt. T-699 (Dry Mill Road) , due to a limited sight distance occasioned by a sharp rise in the existing road surface of Loudoun St. just west of Dry Mill Road, that the State Highway Department and the Loudoun County Board 'of Supervisors be requested to include in their Secondary Road Allocations for fiscal year ending June 30, 1966, sufficient funds to lower the existing grade , in accordance with plans prepared by the State Highway Depart- ment, which plans were prepared for a One-Way Traffic Pattern. Upon motion of Councilman Orr , seconded by Councilman Dodd, the following resolution was adopted by a vote of 6 to 1, Mayor Rollins casting the dissenting vote : 97: MINUTES OF MAY 3, 1965 MEETING. BE IT RESOLVED by the Town Council of the Town of Leesburg, that ap- propriation be made to "Police Car Maintenance" in the sum of $500.00. A discussion of various items in the proposed Budget followed. Mr. Ritter stated that he had been very conservative in preparing the budget and that he had not anticipated any raise in taxes or water and sewer service. Councilman Cole reported that the owner of the property the Town proposes to purchase for parking facilities would like to have the $50,000 paid over a 10- year period, with 6 per cent interest on the unpaid balance. Councilman Cole also suggested that the painting of the water tank be included in the Budget.
