A regular meeting of the Leesburg Town Council was held in the Council
Chambers, Leesburg, Virginia on November 10, 1965, the meeting being called to
order with a prayer by Mayor Rollins. Those present were Councilmen C. Maloy
Fishback, Maurice R. Lowenbach, Jr. , Walter F. Murray and Robert A. Orr, with
Councilmen Cole and Pumphrey being absent. Also present were Town Manager James
W. Ritter, Jr. and Town Attorney George M. Martin.
The minutes of the meeting of October 27, 1965 were approved with general
consent.

Mr. Frank Caldwell , Manager of the C & P .Telephone Company addresed Council
relative to the resolution passed by Council asking that the addresses of resi-
dents of Leesburg be placed in: the next Telephone Directory. Mr. Caldwell ex-
plained that his Company will be glad to place addresses in the Directory if the
customers so desire and advise the Company just exactly how they wish to be
listed. Councilman Murray suggested that notices might be included with bills
asking the customers their wishes in this matter. Mr. Caldwell stated that he
would be glad to contact the telephone users in Leesburg and ask their wishes
in the matter for the Directory to come out approximately 18 months hence.
Town Manager Ritter reported that he has been working on the feasibility
• study of the Town maintaining its own streets, along with information secured
• from the Highway Department , and that he expects to have this report ready in
Q the near future. He also reported that the bond referendum was approved last
^.-a week, with 433 votes being cast in favor of the issue and 144 against. Certificates
on said election have been received from the Electoral Board and are attached
hereto. He said he had discussed with Mr. Williams a progress report as to
what they plan on preparation of plans, etc. Mr. Williams said their target date
for advertising bids was around the middle of March. Mr. Williams also said that
the easements on the interceptor lines should be ready in about six weeks and they
will have a recommendation on either Site A or B at the next meeting.
Mr. Ritter explained that a request has been received from the Downtown Mer-
chants asking for a $100.00 donation toward the Christmas lighting. He explained
that $100.00 was given last year towards the installation of weatherproof connec-
t tions and the Town also paid the bill for electricity used during the Christmas
season, which bill was a great deal higher than those usually paid for this pur-
pose, even though the bill was greatly reduced through the courtesy of VEPCO.
He said he believed ,that Council decided at the time that bill was paid that a
top amount would be set for Christmas lighting for another year. Also, the
agreement signed each year with VEPCO has been received and , according to that
agreement , the Town is responsible for any liability in connection with the
Christmas lights and is also responsible for the electric bill for same.
Mr. Ritter also reported that one of the most amazing and gratifying things
to happen in the past week or so was the finding of cut-off valves for water
mains. Mr. Fishback found an old map, dated in 1938, which shows the original
water lines in the downtown section, together with the location of certain valves.
There are approximately 45 valves shown on this map and, so far, we have found 22
of them and 21 are working (they move up and down) , but it is not known yet whether
they will cut off the water. They have been found 6 inches to 10 inches below
street grade, which means that they have been covered up for some time. It will
take some time to raise these, which will be done after all of the valves are
found. Although money has already been appropriated to put in 6 inserting valves,
this money will be needed for other locations in the future. This matter will be
discussed at the Utility Committee meeting.
Councilman Fishback said he would like to see a copy made of these plans and
put in a fireproof place. It was the general consensus of Council that this be
done.
Councilman Fishback also remarked that he believed Johnson and Williams' ,.
target date of the middle of March to advertise for bids on the sewer project
is late to get good prices, that bids should be opened by that date. •
Councilman Murray said that one of the downtown merchants had approached
him with regard to removing the No Parking signs in front of the old fire house,
so that these spaces may be used for parking; also the space reserved for Dr.
Morrison in front of his office. It was the consensus of Council that this be
done, but that Dr. Morrison be contacted before the sign in front of his office
is removed.

Councilman Orr expressed his pleasure with regard to the completion of side-
walk from M & G Motors down to South Street. Mayor Rollins said he thought the
Highway Department should be requested to pave the street from the 'existing
pavement over to the sidewalk.
Mayor Rollins also asked how long it is expected that Route 7 will be closed
to through traffic. Mr. Ritter said he hoped it would be closed only about a week.
A Public Hearing was held at this time with regard to the request for rezon-
ing of 11.3496 acres on Fort Evans Road from R-2 General Residence District to
R-3 Town House Residence District. Mr. Frank Morelli- one of the owners of this
property, addressed Council, stating that at the time this land was purchased,
it was planned to build multi-family housing, but, after watching the Town grow
and believing that there is adequate multi-family housing available in the Town
at this time, he believes that town houses would be more advantageous to the Town
and to the builders. He said that they had no plans as yet, but were thinking
in terms of $20,000 town houses in a colonial design. He said it would take from
3 to 6 months to get engineering and architectural work done after the rezoning
and that they would certainly give thought to recreation areas and other neces-
sary items to make it an attractive community of approximately 125 units. There
was no-one present to oppose this rezoning.
Upon motion of Councilman Orr, seconded by Councilman Murray, Council unani-
mously adopted the following Ordinance :

WHEREAS, the Council for the Town of Leesburg, Virginia, hitherto, at
a regular meeting held on August 25, 1965, referred the question of
amending the Leesburg Zoning Ordinance as follows to the Leesburg Plan-
ning Commission for the purpose of holding a Public Hearing on such
question and making recommendations, as provided by Chapter 11, Sec-
tion 15.1-493 of the 1950 Code of Virginia, as amended; and
WHEREAS, the said Leesburg Planning Commission caused a notice of a
Public Hearing on the question submitted to it to be published' on the
16th day of September , 1965 and the 23rd day of September , 1965 in the
Loudoun Times-Mirror , a newspaper published in and having a general cir-
culation in the Town of Leesburg, a notice in accordance with the pro-
visions
of Chapter 11 , Section 15.1-431 of the 1950 Code of Virginia,
as amended, that the. said Commission would hold a Public Hearing on
the question referred to it , which Public Hearing would be held on the
' 7th day of October , 1965, and which notice designated the time and place
of such hearing; and
WHEREAS, the said Leesburg Planning Commission did hold such Public Hear-
ing and heard all persons desiring to be heard on the question of adopt-
ing the following amendment; and
WHEREAS, the said' Leesburg Planning Commission thereafter considered
the question of adopting the following amendment and, at a regular meet-
ing held on the 7th day of October, 1965, duly adopted and recommended
the enactment of the following amendment to the Leesburg Zoning Ordi-
nance; and
WHEREAS, the said Council for the Town of Leesburg, Virginia, caused
a notice of a Public Hearing on the following amendment to be pub-
lished on the 21st day of October, 1965 and the 28th day of October ,
1965 in the Loudoun Times-Mirror, a newspaper published in and having
a general circulation in the Town of Leesburg, a notice in accordance
with the provisions of Chapter 11, Section 15.1-431 of the 1950 Code
of Virginia, as amended, that the said Council would hold a Public Hear-
s ing on the following amendment , which Public Hearing would be held on
the 10th day of November, 1965, and which notice designated the time
' and place of said hearing; and
WHEREAS, the said Council for the Town of Leesburg, Virginia, did hold
such a Public Hearing and heard all persons desiring to be heard on the
question of enacting the following amendment to the Leesburg Zoning
Ordinance; and
WHEREAS, it is to the best interest of the Town of Leesburg that the fol-
lowing amendment be adopted:

NOW, THEREFORE, BE IT ORDAINED by the Council for the Town of Leesburg,
Virginia, that the Leesburg Zoning Ordinance be and the same is hereby
amended by amending the land use as designated on the Leesburg Zoning
Map as follows:
That certain tract or parcel of land containing 11.3496 acres owned by
Frank Morell and Gasper F. Morell , located on the north side of Fort
Evans Road, bounded by the properties of John A. Wallace, et al on the
north, Carneal Estate on the east, Fort Evans Road on the south, and
J. I. Humphrey , et al on the west, from R-2 , General Residence District
to R-3, Town House Residence District.
Upon motion of Councilman Orr, seconded by Councilman Murray, the follow-
ing resolution was unanimously adopted :
BE IT RESOLVED by the Town Council of the Town of Leesburg, that Tri-
County Asphalt 's Estimate No. 2 in the amount of $46,431.01 be appropri-
ated from the Public Improvement Fund on the Storm Sewer Project.
Upon motion of Councilman Orr', seconded by Councilman Fishback, the follow-
ing resolution was unanimously adopted :

Upon motion of Councilman Orr , seconded by Councilman Lowenbach, the follow-
' ing resolution was unanimously adopted :
• BE IT RESOLVED by the Town Council of the Town of Leesburg, that be-
cause of the narrowness of the pavement on Ayr Street (Rt. T-1006)
and Dry Mill Road (Rt. T-699) between Rt. 7 and the Loudoun County
High School, and because of the increased traffic on these streets
due to the development of Prospect Hills Subdivision, and because traf-
fic conditions will worsen after the completion of the new Elementary
School now being built ,
NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Town of
Leesburg, that the Highway Department be requested to widen the exist-
ing pavement 10 feet on the west side of Rt. T-1006, between Rt. 7
and Rt. T-699, and
BE IT FURTHER RESOLVED, that the pavement on Rt. T-699 be widened to
the existing sidewalk, from Rt. T-1006 to the Loudoun County High
School.
Upon motion of Councilman Lowenbach, seconded by Councilman Fishback, the
following resolution was unanimously adopted :
BE IT RESOLVED by the Town Council of the Town of Leesburg, that the
two offers made by William W. Denlinger at the Council meeting on Oc-
tober 27, 1965 for the purchase of the Town-owned landfill site at
Watson be turned down. ,
Upon motion of Councilman Fishback, seconded by Councilman Murray, the fol- I
lowing resolution was unanimously adopted :
BE IT RESOLVED by the Town Council of the Town of Leesburg, that the
following rules and regulations shall apply to the picking up of brush
and tree limbs which are not normally picked up by garbage trucks dur-
ing the regular pick-up schedule :

(a) Brush and tree limbs not exceeding 6 feet in length will be
picked up on Friday of each week, provided the material is ;
stacked odor near the front property line.
(b) Discarded furniture , old stoves, refrigerators and discarded
building materials will not be picked up..
Upon motion of Councilman Murray, seconded by Councilman Orr, the follow-
ing resolution was placed on the floor for discussion :
• BE IT RESOLVED by the Council for the Town of Leesburg, that all
resolutions introduced by committees be initialed by all members
of said committees either for or against and presented to the Town
Manager before the meeting.
After discussion, the motion was withdrawn.
Mayor Rollins asked that the Committee as a whole meet after the next
Council meeting to discuss Police salaries. The Mayor also called attention to
the fact that the building and vacant lot on the corner of Loudoun and Wirt
Streets is for sale and asked that the Utility Committee discuss this matter
to see if the .Town would be interested in purchasing this property.
The Christmas lighting matter was discussed but no action taken at this time.
Councilman Orr spoke with regard to the need for a Police Car to replace
the old one, stating that the Department of Purchases and Supply in Richmond had
notified the Manager that a new car would cost approximately $1,825.00, give or
take $25.00, but that the order for same would have to be received by November
15th in order to get in on this purchase of State cars. Upon motion of Council-
man Orr , seconded by Councilman Murray, and there being no objection to consider-
ing this matter tonight , Council unanimously adopted the following resolution:
BE IT RESOLVED by the Town Council of the Town of Leesburg, that the
Town Manager be authorized to order a 1966 Police car from the State
Department of Purchases and Supply.
There being no further business, the meeting adjourned at 8 :30 P.M.

This is to further certify that as a result of the election
being held on November 2, 1965, the Special Commissioners of Election
met in the Clerk's Office on November 4, 1965 and carried out the
duties of their appointment.
Therefore, I further certify that as a result of this election,
433 votes were cast in favor of said question and 144 votes were cast
against said question. This certification is in compliance with
Section 15.1-183 of the Code of Virginia.

TOWN OF LEESBURG, VIRGINIA -
SPECIAL ELECTION HELD ON
NOVEMBER 2, 1965
SHALL the Town of Leesburg issue, in accord-
ance with an ordinance adopted by the Town
Council of the Town of Leesburg on October 2,
1965, its general obligation bonds of the aggre-
gate maximum amount of $900,000 to finance
the cost of improving the combined water supply
and sewage disposal system maintained by the m'
Town by• the modernization of the existing
sewerage treatment plant,' the extension of a
line running two miles east to the site of a pro-
posed holding pond containing approximately
fifteen acres, the addition of a holding pond, and
the installation of an interceptor sewer along Dry
Mill Road in said Town, such bonds to bear in-
terest at a rate which shall not exceed 4% per
annum, payable semi-annually on June 15 and
December 15, and to be payable in annual install-
ments of $45,000 each on June 15 in each of the
years 1967 to 1986, inclusive, and to be issued
under and in compliance with the provisions of
Clause (b) of Section 127 of the Constitution of
Virginia, and, subject to the conditions prescribed
by said Clause, not to be included within the •
otherwise authorized indebtedness of said Town.
