HomeMy Public PortalAbout1966_04_27 212 MINUTES OF REGULAR MEETING OF LEESBURG TOWN COUNCIL, APRIL 27, 1966. A regular meeting of the Leesburg Town Council was held in the Council Chambers, Leesburg, Virginia. on April 27, 1966, the meeting being called to order by Mayor Rollins, and with a prayer by Councilman Orr. Those present were Mayor Rollins, Councilmen C. A. English Cole, Maurice R. Lowenbach, Jr. , Walter F. Murray, Robert A. Orr and John W. Pumphrey; also Town Manager James W. Ritter, Jr. and Town Attorney George M. Martin. Absent from the meeting was Councilman C. Maloy Fishback. The minutes of the call meeting of April 9, 1966 were approved with one cor- ' rection, that being to add that Mayor Rollins was present at this meeting. The minutes of the regular meeting of April 13 , 1966 were approved as written. Town Manager Ritter reported that the Route 15 widening project on N. King Street will be considered, along with other projects, at a public hearing in Richmond on June 8th. Also included will be additional money for rights- of-way for the By-Pass and money for dual-laning Route 7 from the Loudoun County line to Tyson 's Corner. • With regard to securing bids for the paving of parts of Liberty and Wirt Streets, Mr. Ritter reported that he and Councilman'Fishback had looked at these streets with representatives of 'Tri-County Asphalt, and it is felt that it would be foolish to-spend money on repairing these streets until the curb and gutter and sidewalk are repaired. This matter will be discussed at the Street Com- mittee meeting. • With regard to the request for an additional $500.00 for the Street De- partment , Mr. Ritter said that there are outstanding bills in the amount of $215.00, which will leave only 5285.00 to spend and that he will probably have to ask for an additional appropriation for this Department. With regard to the 60 new parking meters needed to replace the 15-year old ones, Mr. Ritter explained that the new ones can be ordered now and paid for after July 1 out 'of the new Budget. Mr. Ritter reported that the condition of the digestor at the sewer plant is very bad and that it must be pumped out. He said costs of this operation have been discussed with several people, along with places where sludge might be dumped when it is pumped out. He has had several people look at the digestor and all agree that something must be done. Mr. Lakin of J. B. Ferguson Co. has looked at it several times and has made tests and has presented an approximate cost of 512,000.00 to clean out the digestor thoroughly, this being a tremendous job, since there is a thick crust on both the top and bottom of the digestor. Along with pumping out and cleaning the digestor, Mr. Lakin has presented plans for other work which should be done at the same time to make its operation more effective, but these other items would cost approximately another $12,000.00. This matter has been discussed with Mr. Lakin and with Mr. Williams of Johnson and Williams, and both gentlemen are present tonight to answer questions and discuss this matter. Mr. Cole asked about the status of the Chantilly Aviation Lease. Mr. Martin said Chantilly 's attorney, Mr. Frank Cowles, had called and left a message that this matter has all been worked out with the FAA and that he was sending him two copies of the corrected lease, but these copies have never been received. Mr. Martin said he had tried many times to reach Mr. Cowles, but has heard noth- ing from him. He said Mr . Caulkins had also been pressuring Mr. Cowles, and had tried to reach Mr. VanGulick to ask him to be present tonight , but was unable to reach him. Mr. Martin said that we may have to inform Chantilly that they have no lease in effect. Councilman Cole also asked Town Attorney Martin what action is being taken with regard to the real estate brokers ' back taxes. Mr. Martin said he is pre- paring injunctive proceedings to enjoin them from practicing until these taxes are paid, this being the best method we have to follow in such cases. Mr. Lakin of the J. B. Ferguson Co. addressed Council, explaining the pro- cedures that would have to be followed in cleaning out the digestor, calling attention to the fact that there would have to be a place to pump out the sludge that will be acceptable to both the local Health Department and the State Health Department. A period of questions and answers between Council members, Mr. Lakin and Mr. Williams followed, with a motion being made by Councilman Lowenbach that this matter be referred to the Utility Committee. This motion was seconded by Councilman Orr and unani- mously adopted. Upon motion of Councilman Orr , seconded by Councilman Lowenbach, the follow- ing resolution was unanimously adopted : • BE IT .RESOLVED by the Town Council of the Town of Leesburg, that the • following supplemental appropriation be made : $500.00 - Street Dept. , Equipment Maintenance. • Upon motion of Councilman Orr , seconded by Councilman Lowenbach, the fol- lowing resolution was unanimously adopted: BE IT RESOLVED by the Town Council of the Town of Leesburg, that the Town Manager be authorized to place an order for 60 new Parking Meters, with a trade-in of 60 old Parking Meters that are 15 years old, and JO BE IT FURTHER RESOLVED, that payment for said meters be paid out of next year 's budget, it being understood that the net cost will be O $3,106.50. Z Mr. Williams of Johnson and Williams turned over to the Town the easement plats for the property over which the Interceptor Sewer will run, there being four other property owners affected other than Mr. Kincaid. He also turned over sample easement agreements to be used as a guide in preparing the agree- ments to be signed by these property owners. He suggested that all easements be acquired before any contracts are let and said that he had met with success in securing these easements by contacting the property owners in person. Town Attorney Martin said he would need the profile plans to-be filed with the Pe- tition for Condemnation on the Kincaid land , if this suit becomes necessary. He also pointed out that an easement plat would be needed for the Washington and Old Dominion Railroad property. Mr. Williams said that the preliminary plans are completed. Mayor Rollins suggested that Mr. Ritter contact the four property owners involved in the easements and try to arrange a meeting with the Utility Committee in order that this might be explained to all the property owners at the same time. It was suggested that Mr. Williams be present at this meeting if at all possible. Upon motion of Councilman Lowenbach , seconded by Councilman Murray, Council voted unanimously that the Town Manager be authorized to hire John William Clemens and N. McKenzie Downs to appraise the property to be utilized for sewage on the Kincaid property, as well as the easements and road leading to the sewage treat- ment facilities. Mayor Rollins instructed the Town Attorney to make an offer of $1,000 per acre to Mr. Kincaid for his land needed for the sewage treatment facilities when Mr. Martin has secured all the items necessary to make this offer. Mr. Williams said that bids would be ready to go out after the easements are secured, probably about the latter part of May. He inquired what procedure would be necessary as far as the Loudoun County Sanitation Authority is concerned. Town Attorney Martin said that the Town would have to apply to the County Planning Commission and Mr. Ritter was authorized to handle this application to the Plan- ning Commission. h+r. Ritter said that the Town is applying for a Federal grant in the amount of iS252,000 for this project. Mr. Williams said that he believed there was a good possibility of the Town receiving the $252,000 grant , that the Town is high on the priority list. Upon motion of Councilman Lowenbach, seconded by Councilman Murray, the fol- , lowing resolution was unanimously adopted: .214 MINUTES Or APRIL 27, 1966 MEETING . BE IT RESOLVED by the Town Council of the Town of Leesburg, that the license fee required to hold a Carnival by the Lower Loudoun Little League on May 23-28, 1966 be waived, it being understood that the funds derived therefrom are used to improve the playing conditions and equipment for the boys involved. . Mayor Rollins reminded members that the Budget will be presented at the next regular meeting.
