A special meeting will be held by the Council
on June 14, 1966 at 12:00 Noon at the Council Chambers
to consider the adoption of an ordinance providing for
the authorization of the issuance of $900,000 of bonds
of the Town of Leesburg to finance the cost of improving
and extending the towns water and sewer system and
providing for the submission of the question of issuing
said bonds to the qualified voters of the Town of Leesburg.
The said ordinance provides for the issuance of bonds
to finance the costs of the same interceptor sewer line,
approved by referendum in 1965, but deletes the use
thereof to finance improving the existing sewer treat-
ment plant and construction of a holding pond and
includes the construction of a new sewer treatment
•
plant.

MINUTES OF SPECIAL MEETING OF LEESBURG TOWN COUNCIL, JUNE 14, 1966.
A special meeting of the Leesburg Town Council was held in the Council
- Chambers, Leesburg, Virginia on June 14, 1966 at 12 Noon, personal service of
notice of this special meeting having been made to all Council members on June
11, 1966. (A copy of said Notice is attached hereto) .
Those present at this meeting were 'Councilmen C. A. English Cole, C. Maloy
Fishback, Maurice R. Lowenbach , Jr. , Walter F. Murray, Robert A. Orr and John W.
Pumphrey; also Town Manager James W. Ritter , Jr.
In the absence of Mayor Kenneth B. Rollins, Mayor Pro-Tem Robert A. Orr
presided and explained to Council members that the purpose of this meeting was
to consider the adoption of an ordinance providing for the authorization of
the issuance of $900,000 of bonds of the Town of Leesburg to finance the cost
of improving and extending the Town 's water and sewer system and providing for
the submission of the question of issuing said bonds to the qualified voters of
the Town of Leesburg, said Ordinance providing for the issuance of bonds to fi-
nance the costs of the same interceptor sewer lines approved by referendum in
1965, but deleting the use thereof to finance improving the existing sewage
treatment plant and construction of a holding pond, but to include the construc-
tion of a new sewage treatment plant.
Upon motion of Councilman Fishback, seconded by Councilman Pumphrey, Council
voted by unanimous roll call vote of all members present to adopt the following
Ordinance.
AN ORDINANCE AUTHORIZING THE ISSUANCE OF $900,000 OF BONDS
OF THE TOWN OF LEESBURG TO FINANCE THE COST OF IMPROVING AND
' • EXTENDING THE TOWN'S WATER AND SEWER SYSTEM AND PROVIDING
FOR THE SUBMISSION OF THE QUESTION OF ISSUING SAID BONDS TO
THE QUALIFIED VOTERS OF SAID TOWN.
WHEREAS, the Town of Leesburg has, for some years, maintained and
operated a combined water supply and sewage disposal system suitable
to provide a supply of water to the Town and its inhabitants and to
collect and dispose of sewage; and -
WHEREAS, said system is not now adequate for the needs of said Town
and the Town Council deems it desirable to enlarge and improve said
system and to continue to maintain and operate such system as a
specific undertaking from which said Town may derive a revenue within
the meaning of Seddon 127 of the Constitution of Virginia; and
WHEREAS, the qualified voters of said Town approved on November 2,
1965 the issuance of $900,000 of bonds to finance the cost of im-
proving said combined system, pursuant to an ordinance adopted by
the Town Council of said Town on October 2, 1965, and none of said
bonds have been issued and it is now desired to rescind said bond
ordinance and to authorize the issuance of $900,000 bonds for the
purpose of improving said combined system, said bonds to be issued
in lieu of and not in addition to said $900,000 of bonds authorized
by the voters on November 2, 1965 : NOW, THEREFORE,
BE IT ORDAINED by the Town Council of the Town of Leesburg as follows:
Section 1. The Town Council of the Town of Leesburg has ascertained
and hereby determines that the public interest requires that the com-
bined water supply and sewage disposal system maintained by the Town
shall be improved by the extension of a sanitary- sewer line running
two miles east to the site of a new sewerage treatment plant and sewer-
age treatment facilities and the construction of such sewerage treatment
facilities including a sewerage treatment plant and the installation of
an interceptor sanitary sewer line from the existing plant to the Dry
Mill Road in said Town, and that it is expedient that said Town shall
borrow money and issue its bonds as hereinafter provided to finance the
cost of such improvements. The aggregate principal amount of said bonds
shall be Nine Hundred Thousand Dollars ($900,000.00).
Section 2. Said bonds shall be serial bonds and shall be payable as
follows : $45,000 on June 15 in each of the years 1968 to 1987 inclusive.

6% par annum, and such interest shall be payable semi-annually on June
15 and December 15. In the discretion of the Town Council, any one
or more of said bonds may be made redeemable prior to its maturity
upon the terms and conditions set forth in such bond.
Section 3. Said bonds shall be general obligations of the Town of •
Leesburg _and shall be issued upon the credit and in the name of said
Town and shall be issued pursuant to and in compliance with the Pub-
lic Finance Act of 1958 (Chapter 5 of Title 15.1 of the Code of Vir-
ginia, 1950) and shall be issued under and in compliance with the pro-
visions of Clause (b) of Section 127 of the Constitution of Virginia
and, subject to the conditions prescribed by said clause, shall not
be included within the otherwise authorized indebtedness of said Town.
From and after a period of five years from the date of the election at
which the Qualified voters of said Town approve said Bonds, whenever
and for so long as such combined water supply and sewage disposal sys-
tem fails to produce sufficient revenue to pay the cost of operation
and administration (including interest on bonds issued therefor) and
the cost of insurance against loss by injury to persons or property,
and an annual amount to be covered into a sinking fund sufficient to
pay, at or before maturity, all bonds issued on account of such com-
70 bined water supply and sewage disposal system, all such bonds outstand-
ing shall be included in determining the limitation of the Town 's
power to incur indebtedness.

() _ Section 4. Bonds shall not be issued pursuant to this ordinance until •
said bonds shall have been approved by the affirmative vote of the
majority of the qualified voters of the Town of Leesburg voting upon
the question of their issuance. The Clerk of Council is hereby di-
rected to present forthwith a certified copy of this ordinance to the
Circuit Court of the County of Loudoun, or to the Judge thereon in va-
cation, and the said Court or Judge is hereby requested to enter an
order directing the proper election officers to take such steps and
to prepare such means as may be necessary .to submit to the qualified
voters of said Town the question of whether said bonds shall be
issued, and to make such order as may be proper to give due publicity
to such election.
Section 5. The ordinance entitled "An Ordinance authorizing the issu-
ance of $900,000 of bonds of the Toro of Leesburg to finance the cost
of improving and extending the Town 's water and sewer system and pro-
viding for the submission of the question of issuing said bonds to the
qualified voters of said Town, " adopted by the Town Council of the Town
on October 2, 1965 be and the same is hereby rescinded.
Section 6. This ordinance shall take effect immediately upon its adoption.
Town Manager Ritter presented to Council a resume of estimated costs in-
volved in the Taxiway Extension at the Leesburg Municipal Airport and explained
that the FAA is requesting that the Town give them (the FAA) assurance that the
Town will be responsible for one-half of the?additional cost involved, or ap-
proximately $5,500.00, the FAA being willing 'to absorb their one-half of this
additional cost. Mr. Ritter explained that he had talked with the State of-
ficials and the State cannot allocate any more funds for the next bi-ennium,
therefore, this $5,500 would be the Town 's responsibility. This matter was
discussed and referred to the Leesburg Airport Commission for further study.
