MINUTES OF REGULAR MEETING OF LEESBURG TOWN COUNCIL, MAY 24, 1967.
A regular meeting of the Leesburg Town Council was held in the Council
• Chambers, 12 W. Loudoun Street , Leesburg, Virginia, on May 24, 1967 at 7 :30 P.M.
The meeting was called to order by Mayor Kenneth B. Rollins, with prayer by
Councilman C. A. English Cole. Others present were Councilmen C. A. English
Cole , C. Maloy Fishback, Maurice R. Lowenbach, Jr. , Walter F. Murray, Robert A.
Orr and John W. Pumphrey ; also Town Manager James W. Ritter , Jr. and Town At-
torney George M. Martin.
The Minutes of the regular meeting of May 10, 1967 were approved..as written.
Town Manager Ritter reported the following:
' (1) A meeting has been set up for 9 :00 o 'clock Friday morning with Mr.
Hager , Chief Plumbing Inspector, Mr. Thomas Hatcher , member of the Plumbing
Board , and the Utility Committee to discuss the situation concerning the right
for trailer park operators to connect trailers to utilities without having to
have a master plumber to do this work.
(2) There will be a meeting at 10 on Friday morning with Mr. Wilbourn of
Tri-County Asphalt regarding Liberty and Wirt Streets, which streets they built
last year , and which we feel need rebuilding.
(3) The 136 m.g. tank is about dry, it still has about 6 inches of water
in it, and we are getting ready to paint it. We have been pumping this water
back into the system in order not to lose it. He said he found the interior of
the tank in good shape, that it would need very little repair. It will be painted
with special interior paint. He said there was about one-quarter inch of mud
and sand on the bottom of the tank, which can be expected after six years. The
painting should be started tomorrow and will probably take about a week to 10
days to complete.
(4) On the North King Street Project , pipe has been laid across King
Street and they are now in the process of putting the pipe under the sidewalk
on the west side.
(5) With regard to the Town taking over the streets for maintenance, Mr.
Bolton has confirmed our resolution and says that the State will complete the
projects they have previously promised the Town. They will send a crew in
here to log all of these streets in order to be sure they have the right mileage,
on which our payment from the State is based.
Mayor Rollins announced that the Public Hearing on the Budget will be held
at the regular meeting on June 14th. He asked the Town Manager to have it pub-
lished twice after the adoption of the proposed Budget tonight. •
Mayor Rollins announced that he would like :the following changes made in
the Agenda from now on. Item "F" will be eliminated and substituted in its place
will be "Introduction of Resolutions by Members. " Item "G" will be omitted.
If any member of Council wants to introduce a resolution not on the Agenda and
not already taken up by a committee , it may be introduced that night and will be
referred to the proper committee. If action is wished that night, then unanimous
consent for immediate action will be necessary.
The Mayor also read to Council a letter from the Mayor of Vienna concerning
a Bill introduced to Congress regarding the Dulles Interceptor Sewer. This let-
ter stated that it is hoped that this Council will take some action concerning
this legislation and will underwrite a portion of the cost of the Interceptor
Sewer. He read to Council several paragraphs from this Bill and turned this mat-
ter over to Councilman Fishback for any action by his Committee.
Councilman Cole inquired of Mr . Ritter what the inside of the water tank
looked like. Mr. Ritter said it is quite dark inthere but , from what he could
see through the manhole , the tank walls seem to be in very good shape, he did
not believe it was pitted at all.
Councilman Orr asked if anything had been decided about the road down by the
jMill. Mr . Ritter said Herbert Bryant was asked to do something about it but re-
: fused.

Discussion followed on various items in the Proposed Budget for 1967-1968,
with some changes being made. Mr . Ritter commented on the Street Resurfacing,
saying that he had gone over the streets in Town and found certain ones that
should be worked on this coming fiscal year. He gave a report on these streets,
stating that just putting a "Seal" on these streets would be x6,928.00. Mr. Doug
Pratt addressed Council regarding the streets in Exeter Subdivision, Section 1 ,
stating that he believed there were other streets in Town which needed attention
far more than these streets, especially in view of the fact that it would cost
approximately $5,000 to plant mix these streets. Question was asked as to why
these streets had not been accepted by the Highway Department. Mr . Ritter ex-
plained that the streets had not gone bad , especially considering the fact that •
no "seal" has been put on them in four years, but stated that the reason the
Highway Department did not accept them was because of defects in the concrete.
Mr. Cole asked why the Bond was released before the Highway Department accepted
these streets. Mr. Ritter said that the Town is now protected for one year after
construction is completed. Mayor Rollins also called attention to the fact that
the Standards have been changed to call for "plant mix;' rather than "surface
treating. "
This concluded discussion on the General Fund and Mayor Rollins moved that
N the proposed tax rate be 70 cents on real estate, $1.00 on personal property- and
N 80 cents on Bank Stock. This motion was seconded by Councilman Pumphrey and the
N motion was adopted by a roll call vote of 6 to 1, with Councilman Cole voting: ...
against it.
The Utility Fund and the Airport Fund Budget was then discussed.
Upon motion of Councilman Pumphrey, seconded by Councilman Orr , the Pro-
posed Budget (copy attached hereto) and tax rate were adopted by a vote of 6 to
1, with Councilman Cole voting against it.
At this time , Councilman Cole inquired of Mayor Rollins if he felt that it
is his duty to protect the votes of all members of the Council at all times.
Mayor Rollins answered Yes. Councilman Cole then referred to the last meeting
when the Westinghouse matter was brought up without being on the Agenda and said
that the Chair did not object to voting on this matter at that time and that he
felt the Chair should have objected in order to give him (Mr. Cole) a chance to
vote on this matter. Mayor Rollins explained his position on this particular
motion and stated that he has no protection to a member who is absent , even
though a matter might not be on the Agenda, that , under the rules and regulations,
a Quorum can conduct business. Mr. Cole said the Chair did not defend his right
to vote and he thinks the Chair has a legal and moral obligation to do so. Mayor
Rollins disagreed with this.
Upon motion of Councilman Pumphrey, seconded by Councilman Fishback, and
there being no objection to voting on this matter tonight , the following resolu-
tion was unanimously adopted :
BE IT RESOLVED by the Town Council of the Town of Leesburg, that the
Street Committee and the Town Manager be authorized to accept the low
bid on the sidewalk, curb and gutter on the south side of Loudoun
Street between King and Wirt , and the north side of W. Market between
Ayr and Morven Park Road , subject to comparison of the specifications
of the bidders.
Upon motion of Councilman Cole , seconded by Councilman Pumphrey, the follow-
ing resolution was unanimously adopted :
BE IT RESOLVED by the Town Council of the Town of Leesburg, that the
following appropriations be made :
To Johnson and Williams (1967 Bond Issue Fund)
(1) $ 187.50 - May 8, 1967• Easement plat across Brown Asso-
ciates property.
(2) 60.00 - May 8, 1967• Revisions to sewage treatment plant
site plat for metes and bounds description in con-
nection with the purchase of Kincaid land.
(3) 2,665.75 - April 12, 1967• Preparation of original easement
plats.

(4) $ 722.00 - January 19, 1967. Relocate sewer line through
Monroe Manor , revise plans to locate sewer line
on Railroad right-of-way by Railroad Station and
revise sewer plan on Warfield tract.
• (5) 1 ,910.10 - January 16; 1967. Design plans for extension of
Tuscarora Interceptor from existing plant to Harri-
son Street , and along Harrison Street to Catoctin
Circle.
$5 ,545.35 - Total.
Upon motion of Councilman Pumphrey, seconded by Councilman Murray, the
following resolution was unanimously adopted :
BE IT RESOLVED by the Town Council of the Town of Leesburg, that
the following appropriations be made :
1(1) $ 200.00 - Purification Supplies (Utility Fund) .
1-(2) 50.00 - Fuel (Utility Fund) .
Y(3) 1 ,200.00 - Insurance (General Fund).
,-r(4) 18.08 - Blocher Reprographics - Plans for Sewer (1967
Bond Issue Fund) .
.✓(5) 200.00 - Police Car Maintenance.
? (6) 1 ,910.00 - Walter Phillips-Street Construction Plans on
Edwards Ferry Road (General Fund - Capital Outlay) .
r(7) 300.00 - George Martin 's bill for services on Bond Issue
(1967 Bond Issue Fund ).
Upon motion of Councilman Lowenbach , seconded by Councilman Pumphrey, the
following resolution was unanimously adopted :
WHEREAS, by deed, dated :August 25 ; 1955; recorded in Deed-'Book. 348 ,
Page 265, in the Clerk 's Office .of the Circuit Court of Loudoun
County; Virginia, The Town of Leesburg in Virginia conveyed cer-
tain real property to Evelyn H. White ; and '
WHEREAS, by said deed a reservation running with the land was
created whereby The Leesburg Volunteer Fire Department was to
have sole and exclusive right to use and possession of the prop-
erty embraced within Stations A, B, 5, 6 , 7, and 8 on the survey
of R. U. Goode so long as said property be occupied and used as
the principal and main fire Station House of The Town of Leesburg,
said reservation to cease immediately upon the completion of con-
struction or the acquisition of a new or additional fire station
house for the answering of calls and/or the storage of mechanized
equipment of The Leesburg Volunteer Fire Department ; and
WHEREAS, the Leesburg Volunteer Fire Department has acquired other
property and completed construction of a new fire station house for
the answering of calls and the storage of mechanized equipment of
The Leesburg Volunteer Fire Department;
NOW, THEREFORE, BE IT RESOLVED, by the Mayor and Council of The
Town of Leesburg in Virginia, this 24th day of May, 1967 at a
regularly constituted meeting thereof , that said restriction run-
ning with the land hereinabove referred to be and it is hereby ex-
tinguished and the full right of possession and use of said prop-
erty is relinquished to Evelyn M. White.
Upon motion of Councilman Pumphrey, seconded by Councilman Fishback, the
following resolution was unanimously adopted :
BE IT RESOLVED by the Town Council of the Town of Leesburg, that the
contract for "Refuse Collection and Disposal" be awarded to Jesse
Randolph for a one-year period beginning July 1 , 1967; with an op-
tion for a two-year contract , at the same price that the Town is now
paying him, at the rate of $24,542.40 per year.
Councilman Fishback explained to Council the progress on securing the Deed
of Easement over the Alberts ' land. He explained that Council had offered Mr.
Alberts two alternatives regarding hook-ons, one to offer him two free hook-ons,

or the other to pay him $600 cash. He has elected the cash payment. Mr. Alberts
had also asked that the restrictions be modified to allow industrial waste to be
dumped into the sewage system. He has agreed to include the following: (1) That
• sewage would be pre-treated to a standard so as not to interfere or affect the
treatment of other sewage ; and (2) to pre-treat it so that it does not affect
the requirements of the Water Control Board at the point of re-entry into the
Potomac Watershed. This matter was discussed and Councilman Cole suggested that
the Department of Interior could probably shed some light on how such problems
are handled in other places. It was the general consensus of the Council that
the sewage from industry would have to meet the specifications of the State
Health Department and the Water Control Board. Town Attorney Martin suggested
that the Town Manager ask both of these agencies if they will permit sewage from
an -industrial plant. Mr. Cole suggested that we ask Johnson and Williams. Mr.
Fishback suggested that we ask both. Mayor Rollins asked the Town Manager to
write both of the State agencies and Johnson and Williams.
Town Attorney Martin said that owners along the portion of Edwards Ferry
Road proposed to be widened and paved would have to be contacted with regard
to easements for this work and suggested that Mr. Forbes talk to these owners.
He said that the Master Plan calls for a 70' right-of-way and the plans call for
Cg 50 ' . It was the general consensus of Council that we get the easements at this
time for a 50' street , and then ask for the 70' at a later date, if needed. Mr.
eg Forbes said that , technically, we would be required to get a commission permit.
Mayor Rollins referred this matter to the Planning Commission to decide how
V wide Edwards Ferry Road should be.
Council discussed a resolution providing for the acceptance by the Town
of the Sewer Line leading to the National Children 's Rehabilitation Center. How-
ever , upon motion of Mayor Rollins, seconded by Councilman Murray, it was unani-
mously voted that this matter be resubmitted to the Utility Committee, to be
brought back to the next meeting.
After explanation by Mr. Ritter , upon motion of Councilman Pumphrey, sec-
onded by Councilman Lowenbach , and there being no objection to considering this
matter tonight , the following resolution was unanimously adopted :
' WHEREAS, it has been found to be in the best interest for the Town
of Leesburg to increase the size of the proposed storm drain on
the North King Street Project over that originally proposed ,
NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Town of
Leesburg, that the Town Manager be authorized to purchase 88 feet.
of 36"x22" pipe arch at an approximate cost of $525.00.
Councilman Cole said that , at the joint meeting of the Council and the
Board of Supervisors , he made the statement that the Town is losing in excess
of one million gallons of water a week, this being the difference between what
we are pumping and what we are billing. Mayor Rollins- said he has found that
this is so and that he has discussed this matter at length with Mr. Ritter. Mr.
Ritter says he has gone back to 1961 , which is as far back as Mr. Ward has rec-
ords on metered water , and this shows a loss for some time. We know where some
of it is going and he has made a break-down of some places, but he said he had not
yet had time to complete his investigation or his report. The sewer plant and
the Town Hall are two places. Some of it can be accounted for in water main and
fire hydrant breaks , water sold at the public meter and a leak at the High School
in the vault , which leak was corrected in 1964 but which apparently started a-
round 1956, and various other places. Also , he said he finds that the chlori-
nated water at the pump station passes through the meter twice because the tap
is on the outside of the meter. He says a meter will have to be put on this
line. Also , water that is used for flushing storm sewers, sanitary sewers and
flushing streets is not metered , in addition to water used to fight fires. He
says these are only some of the places where some of the water has gone and
this does not account for a great deal of it. He said there are about 400 very
old meters in Town, some of which have tripped 1 ,000,000 gallons several times,
and a meter that old allows a great deal of water to pass through it that does
not register. About 35 meters have been replaced recently with re-built meters
and we will continue to do this. He says he knows we are losing a lot of revenue
from some of these old meters. We have a total of a little over 1200 meters al-

together .and about one-third of these should be replaced. It is general prac-
• tice , when a meter is 10 years old or trips 1,000,000 gallons , whichever is
sooner , to replace it. He said he believes we .are talking about approximately
5 million gallons a year on the chlorinated water that is being metered twice.
Councilman Cole asked if the Town had ever received any request in writing
from Westinghouse. Mayor Rollins said not to his knowledge. Mr. Cole said that
he believed a request in writing should be received by Council before they voted
on giving any money. Both Mayor Rollins and Councilman Pumphrey 'said—that it is
in writing now in the minutes. Mr . Cole said they had given us a 10 day limit
and that is long since gone and asked what the present status is. Mayor Rollin:
said he has heard nothing else , that he wrote a personal letter to the Presi-
dent of Westinghouse , but has received no reply. He said he knew that Mr. Arm-
strong had notified the County of the action taken by this Council. Mr. Cole
again asked why Westinghouse did not request this in writing. Mayor Rollins
said he did not know.
There being no further business, the meeting adjourned at 10 :30 P.M.
