HomeMy Public PortalAbout1967_07_26 95 MINUTES OF REGULAR MEETING OF LEESBURG TOWN COUNCIL, JULY 26, 1967. A regular meeting of the Leesburg Town Council was held in the Council Chambers, 12 W. Loudoun Street , Leesburg, Virginia, on July 26, 1967 at 7:30 P.M. The meeting was called to order by Mayor Rollins, with prayer by Council- man Orr. Those present were : Mayor Kenneth B. Rollins, Councilman C. A. English Cole , C. Maloy Fishback, Maurice R. Lowenbach, Jr. , Walter F. Murray, Robert A. Orr and John W. Pumphrey; also Town Manager James W. Ritter, Jr. and' Town At- torney George M. Martin. The Minutes of the regular meeting of July 12, 1967 were approved as written. Mr. Fulton Want, Senior Warden of St. James Episcopal Church, presented to the Mayor and Council members a letter requesting that better Police protection be given to the St. James Church properties, both the Church and the Janney prop- erty. He cited recent incidents of burglary and vandalism, as well as fire, and . asked for better protection on the part of the Police Department. Mayor Rollins i asked that the Police give an extra amount of watch around this area. Mayor Rollins asked that Mr. Ritter explain just what has happened regard- ing the cave-in of the storm drain behind Mrs. Herbert Howard's house in Honicon 2 Court. Mr. Ritter explained that the top of the storm drain has caved in, a sec- tion about 16 feet lohg immediately adjacent to the concrete walk behind Mrs. Cq 01 Howard's house. He said he sent a crew to clean out the ditch so the water Ck2 would run through, but that this is the extent of work that has been done up to 0 this time. There is a stone wall on each side of this ditch about 2 feet high, U a concrete slab on the bottom and a 3-inch concrete' slab on the top, then about (..) 6 or 7 inches .of dirt over the top of this. The concrete on the top slab looks like it contained a very poor grade of sand. He said he and members of the Utility Committee have looked at this situation and they are trying to determine if the Town has ever had an easement for this storm drain. So far, they have found they have an easement on the sanitary sewer , but not on the storm drain. Councilman Fishback confirmed Mr. Ritter 's remarks and said this is a very unsanitary situ- ation. Mr. Frederick R. Howard , Mrs. Howard 's son, remarked that the storm water from the Hospital comes down through this drain and he thinks it should be rein- forced as far as the Town is concerned , as well as for his mother. .. Councilman Fishback. pointed out that this is a natural drain for the flow of water through I . this section and it has always gone through there. He asked if these property owners would be willing to give easements for the Town to take the proper measures to correct this situation. Mr. William F. Peach, a property owner in this Court, pointed out certain problems that have always 'existed in this Court and wondered if it would not be feasible for the Town to relocate this storm drain entirely. He said he believed all of the owners in this development would be willing to co- operate. Councilman Lowenbach said that perhaps Mr. Bozel and Mr. Ritter could observe the situation more closely and come up with some suggestion and he felt sure the Utility Committee would do everything it can to handle this situation. He said it was discovered this afternoon. that Mrs. Howard '.s. kitchen sink drains . into this ditch. Mr. Thomas Hutchison, anotherproperty owner, addressed Council regardingthe problem andpointed out 'the fact that all of this water comes into . . . hisbasement and .he- has a -sump .pump, .which pumps this water into the Town sewer. There is no otheplace to put it. He said he thinks the Town should consider blacktopping the street down in the Court, that there are seven units in the Court, with a total assessed valuation of $56,000. These people all pay Town taxes and, since .he has lived there (which was either 1957 or 1958) , only one load of gravel has been put on this road. Miss Connie Welsh, another resident, said she has just about the same problem too, that she also has a sump pump in her basement. . 'Mr. Peach said he would like to know what kind of. a proposition the Town would come up with before he would say he would give an easement. Councilman Orr asked if anyone would mind the Town going in there to solve this problem, that they wouldn't want to run into the same problems encountered in Woodberry Subdivision. Councilman Cole suggested that we have an engineer look at the situation and make a III recommendation and then discuss it with the property owners before anything is done. Mr. Howard asked for some stop-gap operation in the meantime. Mr. Riiter said he had made a study of this drainage system to see what size pipe it would take. He. reported what could be done as a stop-gap measurement, but also pointed out that it would not be an easy job to 'get in there because the existing struc- ture is not large enough. Mayor Rollins said if it would be feasible to relocate it , he would like to see this done. Mr. Hutchison said he had seen it in the worst rains and he had never seen it run full. Finally, Mayor Rollins said that Council would look at this and see what is the most feasible way to handle the situation and then have a special meeting. Mr. Ritter said that we can cover it over with boards until we can correct it permanently. • • C 96 MINUTES OF JULY 26, 1967 MEETING. • Town Manager Ritter reported on the following: (1) At the last meeting, an Agreement between the Town and W & L Corporation . was adopted by Council concerning the I.G.A. sidewalk problem. However,' W & L objected to the wording, whereby they would be responsible for maintaining the planter.. Since that time, another method has been worked out and Mr. Ritter pre- sented .a sketch and pointed out just what would be done. W &' L agreed to this, except that, if it would ever be necessary to put up' a guard rail (in case some- body fell over the step and sued the Town) , they would not agree to this. In this case, the Town would have to put in the planter , as originally agreed upon. This has been incorporated into a new Agreement, which should be approved tonight so Mr. Ritter can get the contractor back to work on this project. (2) _ He said that at last meeting he had announced that the Federal Water Pollution Control Agency had advised that the Grant Agreement Offer would be here within a few days.. Since that time, he has received a telephone call, saying they needed additional information from Johnson and Williams (they wanted the computations of how they arrived at 95% BOD removal). He said that the Health Department and the State Water Control Board are satisfied, but now the Federal Government is questioning it. Johnson and Williams are preparing this informa- tion now, so we don 't know how long it will take. (3) On the street surfacing program, the Street Committee made changes in ' this the other day. The cost would be about $15,000.00, which is in the Budget but not yet appropriated. This is just an estimated cost. • (4) On the proposed tie-in 'to the Potomac River, Johnson and Williams say they have an appointment set up with a man from the State of Maryland, and they will let us know the result of this meeting. (5) We have another problem, concerning an 8-inch water line on Route 7 east where the new Ford Garage is going in. Last Saturday, we became aware of the fact that, included in the plans of the building, he is also building 'a storm drain in front of the building, which will be in the way of our 8-inch water line. The Utility Committee feels that now is the time that we should make a start on this 8-inch water line, to take it to a point just east of his constru tion. This can be coordinated with the building of the storm drain. It would take 1700' of 8-inch line, which would cost about $10,000. He said he didn 't know how long this might take. Mayor Rollins asked that something be done on this Hoeltzel problem. Council- man Fishback presented the plans and said that the Utility Committee is in agree- ment to go ahead with this. In their opinion, this would save the Town consider- able money if we run this section- of the lineto about 50 feet beyond Hoeltzel 's property before he puts in .this storm drain, otherwise, we will have to work under this storm drain to put in our water line. If we go ahead with this now, we will be clear of any further complications.. •. He .said that tile Committee 's recommenda- tion to Council is that they authorize the Town Manager to advertise for bids for this 8-inch water line. Councilman Lowenbach said that Mr. Hoeltzel is willing to contribute what he had planned to contribute towards a temporary line to this permanent line. Councilman Fishback pointed out that this is not much though. Mayor Rollins said Mr. Hoeltzel has requested that they have a fire plug close to his property and that he will pay for the hydrant. Council had no objection to this. Upon motion of Councilman Fishback, seconded by Councilman Pumphrey, Council unanimously adopted the following resolution: BE IT RESOLVED by the Council of the Town of Leesburg, that the Town Manager be authorized to advertise for bids on 1700 feet of 8-inch water line, extending from Route 654 to a point at Station 17 beyond the property belonging to the Ford Motor Company. ' Mayor Rollins submitted the following letters, all to be placed in the record : (1) Copy of letter from Johnson and Williams to Senator Spong, explain- ing reasons for the Town riot connecting to the Potomac Interceptor • Sewer. (2) Copy of letter from JoHnson and Williams to Editor of Loudoun Times- Mirror regarding editorial published on the above. 97 MINUTES OF JULY 26, 1967 MEETING. (3) Letter from Colgan Airways, Corp. , advising that they are not interested in any negotiations with Chantilly Aviation, Inc. - - . (4) Letter from George Hammerly, in which he calls attention to items at Airport which need to be corrected. (5) Letter from the Post Office Department regarding site for new Post Office facility. Mayor Rollins read this letter to Coun- cil in its entirety. The location of the Post Office facility was discussed at great length, with both Councilmen Fishback and Pumphrey stating that they wished to go on record • • as not being in favor of this site on Catoctin Circle. It was pointed out by Mr. Pumphrey that, at a previous Public Hearing, the Post Office Department had agreed to locate the new facility within the downtown area, and also that the heaviest mail volume is in the downtown area. He also pointed out -that the inter- section at Rt. 15 and Catoctin Circle is a bad one'. It was pointed out by Mr. Cole (who talked to Post Office Department representatives this week) that they were unable to find a suitable location within the downtown section and that they want to go either east or south, where the growth is. Cv Cd Upon motion of Councilman Pumphrey,p p y, seconded by Councilman Fishback, the following motion was adopted by a 4 to.-2 roll call vote, with Mayor Rollins and Councilman Murray voting against it and Councilman Cole abstaining: U That the Post Office Department be. requested to hold a Public Hearing on this proposed site. Mayor Rollins asked that Mr. Ritter write Mr. Chesser of the Post Office Depart- ment, quoting this action of the Council. Councilman Cole asked if any discussion had taken place as to which incoming member of the Council is going to serve on which committee. Mayor Rollins said very little and that it has not been decided. Mr. Cole said he would like to pass along what information he has on the Finance Committee. Councilman Lowenbach pointed out that the W & L Corporation did not object to the installation of the planter in front of the IGA Building, but they did not feel it their responsibility to maintain it- since it would be on public property. Also, Mr. Marr wanted $400 or more to plant the shrubbery and both Mr. Ritter and he felt that this was entirely too much money to spend for this purpose. He wanted it clear that they did not object to the planter itself though, only to the maintenance of it. Councilman Pumphrey asked that Mr. Ritter give permission to Mr. Benjamin McDonald, the Manager of the Trailer Park, to shoot ground hogs that are burrow- ing under the fence down there. Upon motion of Councilman Fishback, seconded by Councilman Pumphrey, Council unanimously adopted the following resolution: BE IT RESOLVED by the Town Council of the Town of Leesburg, that the Agreement between the Town and W & L Corporation approved on July 12, 1967 be rescinded and that the following Agreement be adopted: THIS AGREEMENT, made and entered into this 12th day of July, 1967, by and between the TOWN OF LEESBURG, State of Virginia, a municipal corporation, Party of the First Part, and W & L CORPORATION, a pri- vate corporation, Party of the Second Part; WITNESSETH: That whereas, the Town of Leesburg has undertaken to construct a sidewalk on the South side of Loudoun Street, in front of the I.G.A. ' store building owned by the Party of the Second Part in the Town of Leesburg, Virginia, which construction has been enjoined by the Cir- cuit Court for Loudoun County due to the prospective damage to the property of the Party of the Second Part , resulting from the grade thereof, and MINUTES OF JULY 26, 1967 MEETING. Whereas, the Parties hereto have agreed to a method of. construction which is agreeable to both parties, and the Party of the Second Part is willing to move for dismissal of the injunction, and waive any claim for damages resulting from the construction that the Party of the Second Part may have suffered and grant an easement on its prop- • erty for surface drainage to the Party of the First Part. This Agreement Then further. Witnesseth, that for and in consideration of the premises, the Party of the First Part agrees to construct the sidewalk in front of the Z.G.A. building according to the plan attached hereto marked Exhibit 1, and made a part hereof by reference and the Party of the Second Part agrees to execute an easement for surface drainage to the Party of the First Part in the following terms : An easement forty feet long and five feet wide, for the drainage of surface waters fed by a surface grate to drain the surface water from the sidewalk across the front (north) side of W & L Corporation's property on West Loudoun Street in the Town of Leesburg, Virginia . • Said easement shall consist of an eight inch storm drain set in the public sidewalk at or near the Northwest corner of the existing I.G.A..,Building and an underground eight inch . storm drain, buried at a .suitable depth and as close to the. west wall of said existing I.G.A. Building as practicable and extending from said NW corner Southerly parallel to said wall, a sufficient distance to discharge said surface water at grade at the end of eight inch pipe 'over the existing park- ing lot adjacent to said building on the west side thereof, The town shall have a right to so discharge said surface water for so long as the sidewalk and appurtenances across the front (north) side of said property remain below the general grade of the 'connecting sidewalks to the immediate east and west, but no longer. Said easement is for the purpose of collecting water which II/will fall on said sidewalk. It is further stipulated and agreed that should the Party of the First Part be required at some future date by its liability insurance car- rier to install a barrier above the curb line, in the interest of pub- - lic safety, the party of the first part will at that time build a planter as shown on Exhibit 2. The Party of the Second Part will move for dismissal of said injunc- tion and does further waive any and all claim for damages against the Party of the First Part arising from construction of said sidewalk in its present stage and when completed, and by this agreement releases the Party of the First Part from any liability therefor. Upon motion of Councilman Lowenbach, seconded by Councilman Fishback, Council unanimously adopted the following resolution: WHEREAS, Summerfield B. Tillett , Jr. and Jo Ann Bodmer, Judges, and Betty F. Greene and Pauline R. Allison, Clerks, of the Town of Lees- burg Election held on June 13, 1967, have certified that Kenneth B. Rollins received 526 votes for Mayor; George Babson received 1 vote for Mayor ; Oden Semones, 1 vote for Mayor; English Cole , 1 vote for Mayor, Elliott Ward, 1 vote for Mayor; Paul Ellis, 1 vote for Mayor and George Reynolds, 1 vote for Mayor; Michael C. Grenata received ' 179 votes for Councilman; G. Dewey Hill received 281 votes for Coun- cilman; Frederick R. Howard received 471 votes for Councilman; Paul McDonald received 250 votes for Councilman; Robert A. Orr received 370 votes for Councilman; Leonard Parker received 31 votes for Coun- cilman; Leonard Parker received 31 votes for Councilman; Currell S. Tiffany received 249 votes for Councilman and C. A. English Cole re- . ceived 1 vote for Councilman; NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Toirn of Leesburg, that Kenneth B. Rollins having received the highest num- ,v ber of votes for the Office of Mayor, he is hereby declared duly C4 elected for a two-year term beginning September 1, 1967 and ending CQ August 31, 1969. L� BE IT FURTHER RESOLVED, that the following persons having received the highest number of votes for the Office of Councilmen, they are hereby elected for a four-year term beginning September 1, 1967 and ending August 31, 1971 : G. Dewey Hill , Robert A. Orr and Frederick R. Howard. BE IT FURTHER RESOLVED, that a copy of this resolution be sent to the successful candidates by the Clerk. Upon motion of Councilman Orr , seconded by Councilman Cole, the following resolution was unanimously adopted : BE IT RESOLVED by the Town Council of the Town of Leesburg, that an appropriation of $195.00 be made to pay Walter L. Phillips for de- sign and conferences on I.G.A. Sidewalk (his bill dated July 1 , 1967). General Fund - Capital Outlay - Engineering. Councilman Cole was asked to look into Item No. 3 on the Agenda, with action to be taken by Council in regard thereto at a Special Meeting .to be held at 2:30 P.M. on Thursday, August 3. Discussion of hospitalization for Town employees was had at this time, with Mr. Ritter explaining the proposed change from. the American Casualty Company, with which benefits the employees are not satisfied and only 12 are covered, as compared to the added benefits to be derived from a proposed policy with Blue Cross-Blue Shield, in which 18 of the Town employees would. definitely be inter- ested. However , he explained that there would be a difference in cost to the Town of approximately $1,800 more as their one-half share of the cost. Dr. Orr explained the difference in benefits of the two policies and spoke very much in favor of Blue Cross-Blue Shield. After more discussion, it was suggested that . Mr... Ritter .and Dr. Orr draw up a set of specifications and ask several companies for cost. figures for these services. Upon motion of Councilman Cole; seconded by Councilman Lowenbach, the fol- lowing resolution was unanimously adopted: 111 BE IT RESOLVED, that the First and Merchants National Bank of Leesburg, Leesburg, Virginia, be authorized to pay out any funds in its hand in the account of "Town of Leesburg, Virginia, 1967 Bond Issue" over the I ' signatures of any two of the following persons, to-wit: J. W. Ritter, .! Town Manager; George E. Ward, Town Treasurer , and Dorothy B. Rosen, Clerk of the Council , but this shall in nowise affect the resolution adopted on the 8th day of September, 1965, except as herein set out. 100 MINUTES OF JULY 26, 1967 MEETING. Councilman Orr asked again if something could .not be done about the condition of the street that runs around by the Leesburg Grain and Feed Company. Town Attorney Martin pointed out that the only action would be to condemn it. Upon motion of Councilman Lowenbach, seconded by Councilman Pumphrey, Council ' voted unanimously that the Town Manager be authorized to secure bids on the pro- posed surfacing schedule for 1967, including Edwards Ferry Road from the Brad- field residence to .Woodberry Road. Councilman Fishback reported that the Utility Committee met with the Sani- tation Authority members on the Westinghouse situation and they (the Sanitation Authority) presented a preliminary outline of a contract to be entered into with the Town and asked .that this committee go over it, mark it up and come back for another meeting. Councilman Fishback said there had been no time to go over this contract,yet and Councilman Lowenbach concurred in this. Mayor Rollins said that Westinghouse had asked him today to please hurry with some type of decision on this matter; that they would like to advertise for bids in September on this building. He also said that Johnson and Williams will be here for the special meeting on August 3rd and perhaps this matter could be discussed with them at that time. ' Councilman Fishback said he would like to have a chance to discuss the feasibility of the .Towh .doing this work and that he would like to have a meeting to discuss this before the next meeting with the Sanitation Authority. Councilman Lowenbach said he believed that if the Town and the Sanitation Au- thority could reach some suitable agreement, Westinghouse would go along with it immediately. Councilman Fishback pointed out the fact that the Sanitation Au- thority. apparently wants this to be a mutual agreement and he, personally, does not like a mutual agreement. Box 88 Leesburg, Virginia Dear Kenny: On the surface, things appear to be running fairly smoothly at Godfrey Field. - I am sure Mr. Ritter is convinced things are going along all right. However, I must call to your attention several things that are not all right and it is reflecting very much upon our community, upon you, upon the Town Council and the Town of Leesburg. I have had many people come to me with little complaints and I am not going to touch on them because I don' t want to be petty about things; however, there are three things that exist that came to a final heading just recently that I cannot overlook. A glider owned by a man named Scott blew away out there and was destroyed while it was under the care of Chantilly Aviation. They have ignored their obligations of making any restitution to him and he came to me. I told him to contact the Town. I do not know what they have done; however, I do know that had Chantilly been properly insured, the damage to the glider would have been protected. The policy that I had on Chantilly before I was forced to cancel it would have covered such, and there is no reason that Mr. Scott should not be reimbursed for his loss which I understand is some $1500. This has left a horrible taste in the people' s mouths who know about it, and it is not helping the airport at all. • • The Honorable Kenneth B. Rollins , Mayor Page Two July 12, 1967 Mr. Lynn C. Loomis , who is a captain with Pan American Air Lines , has just bought his son an airplane to continue his flying education. When he arrived at Godfrey Field a day or two ago with it, his greeting was that he should furnish his own tie-down ropes, as they weren't furnished. This is contrary to all airport activities in the area. When an airplane goes into an airport, it is supposed to have reasonable care taken of it, the same as a parking lot operator takes care of an automobile, and I don' t meantto insinuate that an automobile should be tied down. It is normal course of business for an operator to furnish the appropriate equipment to operate an airport. Chantilly Aviation is not doing this. The crowning blow is the fact that I had an airplane licensed by Mr. Hadley W. Libbey who is an employee of Chantilly Aviation . This was done on June 12th. I sold this airplane to Mr. Walter R. Hurtt of Pasadena, Maryland. The relicensing of an airplane theoretically puts it in as near perfect condition as is humanly possible for safety's sake. Upon landing at Baltimore, Mr. Hurtt went to use the brakes on the airplane and he had no brakes. It ran off the runway and he had quite a problem with it. He immediately turned this over to the Federal Aviation Agency in Baltimore, they impounded the logbooks and I understand there has been a charge made against Mr. Libbey, for negligence in his duties, I believe. Mr. Hurtt has not yet accepted my airplane as he is still in the hands of the Federal Aviation Agency safety people; and I don' t know whether or not there will ever be a sale of the airplane to Mr. Hurtt as a result of this. Accordingly, there is not much more I can do but call this to the attention of the Town Council and to your attention to see if Action can be taken to straighten out the Chantilly matter. I have constantly been lied to by Mr. Zebley. Over two weeks ago he was in my office with Mr. McVeigh, and he assured me that "come Monday morning" everything would be in order, and that they would pay me what they owed me. Chantilly is still indebted to many people, they are not working out their problems, and the Town of Leesburg is becoming a party to this situation by condoning their continuing existence at the field. _. :., • . Rollins, Mayor Page Three , July 12, 1967 I am of the opinion that if you continue to do this, sooner • . or later the Town of Leesburg will be named as a defendant in some of the action against Chantilly, as it is apparent that the Town of Leesburg is condoning their activities. I have only to recall the Airport Commission and Mr. Caulkins' and my statements to you last October that it was our opinion that this matter could not be resolved and it has not been resolved. All that is happening in the courts is the continuing delay of action that injures everybody involved. Our banks are involved, many business firms are involved, and the good name of Leesburg and Godfrey Field has been impugned as a result of the careless and negligent action of our Town Council.
