RESOLUTION AMENDING PROFESSIONAL SERVICES
MCMANIMON & SCOTLLAND RE: REFUNDING BOND ORDINANCE
WHEREAS, the Mayor and Council adopted Resolution #99-389 on December 16,
1999, attached and incorporated herewith; and
WHEREAS, pursuant to said Resolution the Firm of McManimon and $cotlland,
L.L.C., Newark, New Jersey was retained to provide specialized legal services in
connection with the possible privatization of the Borough's Sewer System pursuant
to an existing contract with the Borough with an initial of Thirty Thousand Dollars
($30,000.00) for said services; and
WHEREAS, the Borough has retained the specialized legal services of the law firm
of McManimon & Scotlland, L.L.C., in connection with the aumo~Jzation and
issuance of bonds and bond anticipation notes of the Borough of Carteret and in
connection with the establishment of the Carteret Redevelopment Agency; and
WHEREAS, the Chief Financial Officer has certified that funds are or will be
available ['or the necessary legal services related to bond matters and Carteret
Redevelopment Agency matters should the original authQrization for the Firm of
McManimon & Scotlland, L.L.C., provided for pursuant to Resolution #99-389 be
amended to provide for the same.
NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the
Borough of Carteret that the authorization for the Law Firm of McManimon &
Scotliand, L.L.C., pursuant to Resolution #99-389 is hereby amended to include all
bonding work and Redevelopment Agency matters.
IT IS FURTHER RESOLVED that the authorization provided for herein is
awarded without competitive bids in accordance with N.J.S.A. 40A: 11-5(1)(a) due to
the specialized and professional nature of the services provided.
