MINUTES OF REGULAR MEETING OF LEESBURGTOWN COUNCIL, FEBRUARY 28, 1968.
A regular meeting of the Leesburg Town Council was held in the Council Cham-
bers, 12 W. Loudoun Street, Leesburg, Virginia on February 28, 1968 at 7 :30 P.M.
• The meeting was called to order by Mayor Rollins, with Councilman Orr offering
the prayer. Those present were Mayor Kenneth B. Rollins, Councilmen G. Dewey
Hill, Frederick R. Howard, Walter F. Murray, 'Robert A. Orr and John W. Pumphrey;
also Town Manager James W. Ritter , Jr. and Town Attorney George M. Martin. Ab-
sent from the meeting was Councilman C. Maloy Fishback.
The Minutes of the regular meeting of February 14, 1968 were approved as
written.

Town Manager Ritter reported the following: '
(1) The sales tax seems to be climbing a little each month. We have re-
ceived nearly $13,000.00 already, so it looks as though we will certainly exceed
the anticipated amount of $16,000 for the fiscal year.
(2) Regarding the Westinghouse water and sewer proposal , he has been work-
ing with Mr. Clark of Westinghouse and with Johnson and Williams and they should
reach some mutually agreeable formula very soon. Westinghouse is being kept
up-to-date on developments.
(3) On the Washington and Old Dominion Railroad easement, he talked with
Mr. Dudley, Superintendent, yesterday just as soon as official word was received
on the Federal Grant. Mr. Dudley said the W. & 0. D. is still in the same posi-
tion as before, 'it can issue -no permits or 8eements. Mr. Ritter said he told
him condemnation proceedings would have to/started since we have to assure the
Federal Government that everything is in shape before we can receive the Federal
Grant. Mr. Dudley said he expected this. Mr. Ritter said that the Town of
Herndon is having the same problem and they are instituting condemnation proceed-
ings. He asked for some expression to authorize the Town Attorney to proceed
with this.
(4) Regarding Item 2 on the Agenda on raising the parking ticket fine from
$.50 to $1.00, he reported that 2,000 parking tickets had already been ordered
before this matter came up and these have been shipped, so, if this Ordinance
is adopted, new parking tickets would have to be ordered. He estimated those
already ordered to cost around $50.00 and they, of course, have the 500 fine
printed on the face of the tickets. A study was made over a period of several
months and it was determined that approximately 76% of the people receiving tick-
ets pay the 500 fine.
(5) Council members have , within the last week, seen films on asbestos pipe
and vitrified clay pipe, both possibilities to be used in the construction of the
new sewage treatment plant. Tonight, Mr. G. Y. Carpenter , of Portland Cement
Company, will show a film on concrete pipe.
Mayor Rollins asked what the attitude of Westinghouse seems to be. Mr.
Ritter said they are in-no immediate hurry for the sewer line, but they are
anxious to talk to us about the water because of .the well situation, as well
as for fire protection. He said that the Utility Committee asked Johnson and
Williams to advise us the proper size pipe needed in Edwards Ferry Road so that
this line could serve a dual purpose. This could provide a link in the trans-
mission line between the Potomac River and the Town at the time the Town goes
to the Potomac River for water, or about 6500 feet. We will have to wait for
this information from Johnson and Williams before we can go to Westinghouse
with a proposal. Mr. Ritter said Mr. Clark gave him a projected population
figure of 2,000 and said he didn't think it would ever grow beyond this, they
are not as optimistic about the total growth as they were earlier.
Councilman Hill said that a citizen who lives outside the corporate lim-
its
asked today about trash falling off of our truck as it goes out Evergreen
Mill Road. Mr. Ritter said this was the first complaint ever received about
this, but that he would warn the men not to overload the truck. Mr. Hill also
said that .a citizen had reported that he had noticed one of the Town trucks travel-
ing at a high rate of speed down in the Virginia Village section and that he did
not even stop at the Catoctin Circle intersection. Mr. Ritter said he would in-
vestigate this.

Councilman Howard said that the Board of Architectural. Review,. of which he
is the Councilmanic member, made a motion at a meeting last night to call to
Council 's attention Article 10A on the Old and Historic District. He quoted a
portion of this Article and said that the Board would like Council to reaffirm
its support of the Board and to let the public know that a Certificate of Ap-
propriateness is required for any changes within the Old and Historic District.
Councilman Howard asked that a Memorandum be sent to all Department heads and
possibly to the Building Inspector 's Office. Also, he said the Board wished to
purchase- some stationery, but that there was enough money in the Budget for this
purpose.
Mayor Rollins said that he felt sure that yesterday, February 27th, was a
day that would long be remembered in the accomplishments in Leesburg. After a
long, hard battle, the Federal Grant for the sewage treatment plant has finally
been approved. Also, permission to withdraw water from the. Potomac. River has
-been approved by the State of Maryland. The Town will have to accept-and send
back to the State of Maryland a report on this. He said that, being Mayor , he
gets a lot of criticism, as well as praise and inquiries, and he believed he
would be remiss if he didn't say how much he appreciates the way the Council
has acted throughout this controversy over the sewage treatment plant. He said
that it has meant a lot that both the old and new Councils have stood unanimous
Cq on this situation and that he believed they could all take pride in this for many
Nyears to come.
(,) Councilman Murray said he..understands Radio Station W A G E Will celebrate
U its 10th year on the 6th of March and, in recognition of this, he offered the
following resolution, which was seconded by Councilman Hill and unanimously
adopted:
BE IT RESOLVED by the Town Council of the Town of Leesburg, that con-
gratulations be extended to Radio Station W A G E on its Tenth Anni-
versary for outstanding service to the citizens of Leesburg and the
surrounding community.
On motion of Councilman Howard , seconded by Councilman Orr, the following
resolution was unanimously adopted:
BE IT RESOLVED by the Town Council of the Town of Leesburg, that the
Board of Architectural Review be reaffirmed by the Town Council and
that proper notices be sent to any Department heads which might facili-
tate better public knowledge of the existence and purposes of said Board.
Mr. John R. Wright introduced to Council Mr. John Marshall, Consulting Engi-
neer on the water and sewage facilities for the development of the Mary Ann Farm
tract on Route 15. Mr. . Marshall said that Johnson and Williams were to have sent
a letter with their recommendations on this project about a week ago last Friday,
and that they were presenting the amendments recommended by Johnson and Williams
and hoping to get approval of the Council in order that they might go ahead with
their plans. He read to Council the document prepared by them, explaining, as
he went along, their plans for a water distribution system to serve the approxi-
mately 160 houses to be built in Phases I and II of this Subdivision, and also
the long-range plans proposed for the remainder of the Subdivision in the future.
He exhibited to Council a topographical map and pointed out the proposals they
were making. Discussion followed on this matter for quite some while, and Mr.
Wright explained that they hope to start on the golf course construction in about
three weeks, with it being proposed to take about a year for construction. Also,
they would like to start construction on the first section of houses concurrently
with the golf course, these houses to be of contemporary architecture and to be
in the $40,000 bracket and up. He also said that there would be a motel and res-
taurant in connection with the development of this land. Mr. Wright 's attention
was called to the fact that, after approval by the Town of the plans for this
subdivision, approval will also have to be gotten from the County Board of Super-
visors and a commission permit from the County Planning Commission. Mr. Forbes
said he was holding the plat on this subdivision until approval of water and sew-
age facilities by Council. Further discussion. followed, but no decision was made,
pending recommendation from Johnson and Williams.
On motion of Councilman Pumphrey, seconded by Councilman Orr, the following
Ordinance was unanimously adopted:
BE IT ORDAINED by the Town Council of the Town of Leesburg, that Sec-
tion 13-112 of the Town Code be amended to include "George Washington's
Birthday" and "Veteran 's Day. " The new section would read:

Sec. 13-112. When parking meters in operation.

Parking meters installed under the provisions of this division
shall be in operation at all times between the hours of 9:00 A.M.
and 6:00 P.M. all days, except Sundays, New Year 's Day, George Wash-
ington's Birthday, Memorial Day, Independence Day, Labor Day, Vete-
ran's Day, Thanksgiving Day and Christmas Day.
On motion of Councilman Orr, seconded by Councilman Howard, the following
Ordinance was placed on the floor for discussion : •
. BE IT ORDAINED. by the Town Council of the Town of Leesburg, that
Section 13-121 of the Town Code be amended to read :
Sec. 13-121. Generally.
Any person accused of a violation of any provision of this chap-
ter or other ordinance of the municipality prohibiting parking a ve •
-
hicle in a designated area or restricting the length of time a vehicle
may be there parked, or parking in a metered area without putting a
coin in the meter to cover the required time, may settle and compro-
mise the charge against him for such illegal parking by paying to the
municipality the sum of one dollar , before the next court• date, which
is on the first and third Mondays of each month at 8 :00 P.M.; pro-
vided, however, that this provision shall not be construed to apply
to persons parking their vehicles, so as to obstruct the entrance or •
exit of any place where police or fire department apparatus or other
emergency equipment is kept or housed or so as to block an emergency
entrance to a hospital. Nor shall such provision apply to any person
charged, with parking a vehicle soas to entirely obstruct traffic in
any street or alley, or parking in such a way so as to reduce traffic
on an arterial street to one-way traffic only, nor to any person who
refuses to remove a vehicle illegally parked- at the request of any
member of the police department.
After:a great deal of discussion, motion was made by Mayor Rollins, seconded by
Councilman Pumphrey, that this Ordinance be tabled. However, on call of the
roll, this motion was defeated by a tie, with Mayor Rollins and Councilmen
Howard and Pumphrey voting for it and Councilmen Hill, Murray and Orr voting
against it. Councilman Orr then moved to close, debate on this matter,• with
Councilman Hill seconding the motion, but this was defeated by a roll call
vote of 4 to 2, with Mayor Rollins and Councilman Pumphrey voting against it.
A roll call vote was then taken on the Ordinance itself and it was defeated by
a tie vote , with Councilmen Hill , Murray and Orr voting for it and•Mayor Rollins
and Councilmen Howard and Pumphrey voting against it.
On notion of Councilman Hill , seconded by Councilman Howard, the following
resolution was unanimously adopted by roll call -vote :
BE IT RESOLVED by the Town Council of the Town of Leesburg, that "No
Parking" be permitted on the north side of Royal Street between King
Street and Church Street.
On motion of Councilman Orr, seconded by Councilman Pumphrey, the following
resolution was unanimously adopted:

BE IT RESOLVED by the Town Council of the Town of Leesburg, that the
following appropriations be made :
(a) $1,327.08 - William B. Dew, for professional services from De-
cember 10 through February 9.
(b) 600.00 - William S. Alberts, consideration for Sanitary Sewer
Easement, in lieu of two sewer taps. 1967 Bond Issue
Account.
(c) 500.00 - Town Shop Improvements:
(d) 122.40 - Evening Star Newspaper Advertisement for Bids -
1967 Bond Issue Account.
It was pointed out that the Alberts easement should be signed by Mr. and Mrs.
Alberts, then approved by the Town Attorney before the money is paid to Mr. and
Mrs. Alberts.

On motion of Councilman Howard, seconded by Councilman Orr, the following
Ordihahoe . was unanimously adopted: ?
BE IT ORDAINED by the Council for the Town of Leesburg, Virginia, pur-
. suant to Section 15.1-11.1 of the 1950 Code of Virginia, that a new
section be added to the Town Code titled Sec. 13-104.1 - Unlawful to
park junked cars on property zoned for Residential purposes.
It shall be unlawful for any person, firm or corporation to keep,
except within a fully enclosed building or structure, on any property i.
so located within the corporate limits of the Town of Leesburg zoned
III for residential purposes,. any automobile, or automobiles, .the condition - I
of which is such that it is economically impractical to make it (them)
operative ; and any person, firm or corporation violating this Ordinance
shall be fined not less than $25.00, nor more than $500.00, for each
day that such automobile , or automobiles, is (are) kept on any property
so located and so defined.
On motion of Councilman Howard, seconded by Councilman Pumphrey, the follow-
ing Ordinance was unanimously adopted:
Cq BE IT ORDAINED by the Town Council of the Town of Leesburg, that the fol-
CQ lowing sub-section be added to the .Town Code under Sec. 13-95 - Parking
L5 prohibited in specified places :

V (15) Park or keep any automobile or other vehicle, the condition
of .which is such that it is economically impractical to make it operative,
for a period longer than seventy-two hours on any street within the Town
of Leesburg.
Mayor .Rollins called attention to complaints received about rough places
in the road just before you cross the bridge on Evergreen Mill Road and sug-
gested that this be included in next year 's Budget.
Mr. Ritter explained to Council that, before bids can be awarded on the
-, construction of the sewage treatment facilities, all easements .must be either
secured .or some proof of steps being taken to secure them must be given before
the Federal Government will 'release its Grant, this certification to be given
. by the Town Attorney. He explained the problem that exists in securing the ease-
ment along the Washington and Old Dominion Railway right-of-way and the chain of
events •that has transpired in trying to secure this easement, with no success.
On motion of Mayor Rollins, seconded by Councilman Murray, the following resolu-
tion was unanimously adopted :
BE IT RESOLVED by the Town Council of the Town of Leesburg, that the
Town Attorney is authorized to proceed with condemnation suits for
Sanitary Sewer Easements on the Washington and Old Dominion Railroad
right-of-way.
Mr. Ritter said he had talked with Mr. Dew and that the changes in the plans'
for the new Town Office Building should be here in a few days. In the meantime,,`
they are trying to figure out floor space and cost of moving into the old Ford'
Garage Building.

Mayor Rollins stated that Council members had viewed films on asbestos and
vitrified clay pipe and he thought it' only fair that one on concrete pipe be
shown also. _ However , the meeting was adjourned at 9:30 P.M. before this film
was shorn.

A regular meeting of the Leesburg Town Council was held in the Council
Chambers, 12 W. Loudoun Street, Leesburg, Virginia on March 13, 1968 at 7:30
P.M. The meeting was called to order by Mayor Rollins, with Councilman Fish-
back offering the prayer. Those present were Mayor Kenneth B. Rollins, Council-
men C. Maloy Fishback, G. Dewey Hill , Frederick R. Howard, Walter F. Murray,
Robert A. Orr and John W. Pumphrey; also Town Manager James W. Ritter, Jr. and
Town Attorney George M. Martin.
The Minutes of the regular meeting of February 28, 1968 were approved as
written.
Mr. C. A. English Cole was recognized by Mayor Rollins and addressed
Council regarding an article published in last week's Loudoun Times-Mirror, in
• which article County Supervisor Charles Waddell reprimanded the Town Council fo
its action in deciding to build its own sewage treatment facilities, rather than
go to the Dulles Interceptor Sewer. A copy of Mr. Cole 's statement is attached
hereto.
Town Manager James W. Ritter reported the following:
(1) It looks as though we have finally gotten the W. & 0. D. easement.
VEPCO called yesterday afternoon and said that we would get a permanent ease-
ment, which is more than we expected. This is, of course, if the Railroad is •
abandoned. If it is not, then the W. & O. D. has agreed to do the same thing.
This will cost $1,200.00, which was previously agreed upon for this purpose,
plus $100.00 for preparing the easement. This includes the easement just east
of Route 15, as well as the one between the Alberts and Kincaid land.
(2) We have not yet received the Alberts easement. The money for it was
.appropriated at the last meeting, and the Easement Deed has been sent back to
Mr. Harrison in order that he might secure Mr. Alberts ' signature. This would
clear up all the easements and enable the Town Attorney to give a statement that-'
all easements have been secured.
(3) The Utility Committee decided to ask Westinghouse if they are going to
build a plant. It has been found that the best plan to serve this plant would
be a 16-inch line, which line would continue on to the Potomac River. About
6500 feet of line would be involved to go to Westinghouse. This would, of
course, require a survey and profile and a full report before we would proceed.
We, therefore, asked Westinghouse if they are going to build before we go to the
. expense of all of this. We have not yet received an answer from them.
(4) Regarding the additional appropriation for Paxton Well, the original
appropriation was too small. We are not using this Well any more than we have
to since we pay 30 per thousand gallons but, because of painting and filling the
tank in October, we used a good deal more water.
(5) On the $3,000 asked for Materials for Streets, the Budget was a guess
as to what it would cost to maintain the streets. After one year of maintaining
the streets, we will be in a better position to know how much to. set up in the
Budget.
Councilman Howard asked what progress is being made on the Edwards Ferry
Road storm drainage, stating that Mrs. Bishop had inquired of him. Mr. Ritter
said that a survey was run day before yesterday consisting of 600 feet of line.
There are about half a dozen properties involved. The weather has held up the
survey on this, but will continue when weather conditions permit. •
Mr. Howard also asked about the Town 's application for a Certificate of Ap-
propriateness on the new Town Office Building. Mr. Ritter said he did not think
we would be ready to do this until a decision is reached to go- ahead on this ,
project.
Mr. Howard also said that the Fire Department has requested "Fire" zoning
signs in the area of their Fire House and a street light.
A Public Hearing was held at this time, as advertised, for the purpose of
considering proposed amendments to the Leesburg Zoning Ordinance, as follows:
To provide definitions for a one-family detached dwelling; a two-
family detached dwelling; a two-family semi-detached dwelling; to
change the definition of a town house dwelling; change the table of
requirements to provide for a minimum lot size of 10,000 square feet
