HomeMy Public PortalAbout1968_05_081198 MINUTES': OF REGULAR MEETING OF LEESBURG TOWN COUNCIL , MAY 8, 1968. A regular meeting of the Leesburg Town Council was held in the Council Chambers , 12 W. Loudoun Street, Leesburg , Virginia , on May . 8, 1968.:at 7: 30 P.M. The meeting was called to order by the Mayor , with Councilman Fishback offering the prayer. Those present were: Mayor a Kenneth B. Rollins, Councilmen C. Maloy Fi•shback , G. Dewey Hill , Frederick R. Howard , Walter F. Murray , Robert A. Orr and John W. Pumphrey; also. Town Manager James W. Ritter , Jr . and Town Attorney George M. Martin . The Minutes of the regular meeting of April 24 , 1968 were approved as written . Mr . B. Powell Harrison addressed Council , presenting and reading a Petition prepared by The Loudoun Protection Committee, a committee only recently formed for the purpose of seeking better Police protec- tion for the entire County . A copy of this Petition , which was signed by approximately 86 citizens and merchants , is attached hereto. Mr . Harrison stressed the recent crime wave in Leesburg itself and asked that Council .give _serious consideration now to the enlargement of its Police Department . Town Manager Ritter reported 'that word has finally been received from the Federal Water Pollution Control Administration giving the Town the go-ahead on awarding the sewer project contracts and authority to proceed with construction. A representative of English Construction Co . , ,. the low bidder on two of the projects , was here today and states that he •' : expects to get started around June 1st . He called attention to a letter setting forth his comments- on two proposed ordinances regarding the complaint on dump truck noise. Regarding the request for "No Parking" on the west side of King Street between Loudoun and Royal , he said this is also dangerous to pe- destrians. • On the Washington and Old Dominion Railroad easement , the easement is in hand and has been approved by the Town Attorney. He commented regarding a referral from the Planning Commission on a proposed Census to cost approximately $875.00, stating that a letter from the State says the study would cost the Town only about 40 to 50% of this amount , or .approximately $450.00. He added that this Census would furnish a lot of good planning informationand he would like to see this done . Mr. Ritter also stressed the importance of all Council members keep- ing the copies of the Proposed Budget for future reference. Mayor Rollins read a letter from Mr. R . K. Gheen , Vice President of First & Merchants National Bank , in which Mr . Gheen complimented the Town Police , State Police and the Sheriff 's Department for prompt pro- tection recently when the burglar.?alarm sounded at the Bank. He also read a letter from Mr . R . C. Riemenschneider , in which he stated that Leesburg Real Estate Investment Trust would accept the re- sponsibility for straightening out any encroachment on State Highway Department right-of-way resulting from the present remodeling of a build= . ing located at 6 West Market Street . Mayor Rollins also presentetj for the record, a Petition signed by several residents of the East Cornwall Street and Church Street area , which Petition is in reply to the complaint about the noisy dump truck in that area . He announced that the annual Budget meeting will be held next Tuesday night , May 14th at 7:00 P.M. Councilman Hill thanked Mr . Harrison for his presentation regarding the increase in Police protection , saying that this has been of great con- cern to him for several months . He assured Mr. Harrison that this mat- - 199 MINUTES OF MAY 8 , 1968 MEETING. ter will be given very strong attention in the next three or four weeks and that he feels it is a vital concern to everyone. Councilman Howard added that he believed that the citizenry is going to have to help in this matter in reporting anything suspicious to the Police immediately. Councilman Orr invited Mr. Harrison to be present at the meeting of the Laws and Administration and Finance Committees on next Tuesday morning at 11 A .M . , when this matter will be discussed . Mayor Rollins called attention to the correspondence from the Plan- ning Commission regarding the use of the lot at the corner of Cornwall Street and Slack Lane as a parking lot, and also the proposal from the Bureau of the Census to furnish certain information to the Town. Both of these matters were referred to Committee. Mayor Rollins read the following proposed Ordinances with regard to the parking of vehicles over 5,000 pounds in residential areas and re- ferred this matter to the Laws and Administration Committee: (1 ) BE IT ORDAINED, that the Code of the Town of Leesburg , Virginia be amended by adding to Sec . 13-95 of Article IV of Chapter 13 thereof the following subsection , to be desig- Cq N nated subsection ; (c ) and to read as follows: CQ It shall be unlawful for any person to park or place any truck, motor carrier or other commercial vehicle , other than a pick- up or panel truck not exceeding a gross weight of 5,000 lbs. , in any residence district as defined in Sec . 13-1 of this Code, except for such time as is reasonably necessary for: (1) the discharge or reception of passengers , or' (2) the consummation of commercial 'functions . (2) BE IT ORDAINED ,. that the Code of the Town of Leesburg, Virginia be amended by adding to Sec . 13-95 of Article IV of Chapter 13 thereof the following subsection , to be desig- nated subsection (c ) and to read as follow : It shall be unlawful for any person to park or place any truck, motor carrier or other commercial vehicle , other than a pickup or panel truck not exceeding a gross weight of 5,000 lbs. , in any residence district as defined in Sec . 1371 of this Code , between the hours of 9:00 P.M. and 9:00 A .M. However , he said he would hear anyone present tonight in regard to this controversy. " Mrs . Preston Shugars , wife of the truck driver in the case in question , addressed Council , voicing her opinions on. the subject , as did both Mr. and Mrs . Archibald Aiken , the complaining parties . Dis- cussion followed between these individuals and several Council members , and Councilman Orr suggested that Mr . Shugars park his truck somewhere else until this matter can be straightened out . During this discussion , the matter of the proposed parking lot at the corner of Cornwall Street and Slack Lane was mentioned . There seeming to be some concern over this,proposed parking lot from some of the audience , Mayor Rollins asked if Council wished to take any action on this matter . On motion of Coun- cilman Murray, seconded by Councilman Orr , the following motion was passed by a roll call vote of 6 to 1 , with Mayor Rollins casting the dis- senting vote: That a Public Hearing be held on the use of the parking lot located at the end of Slack Lane and Cornwall Street on the regular meeting night of June 12th , and that appropriate noti- fication of said Hearing appear in the local newspaper' one • week prior thereto. On motion of Councilman Fishback, seconded by Councilman , Pumphrey, 7 and after discussion of the map, the following' resolution was unani- ipously adopted: WHEREAS, the consulting firm of' Walter L. Phillips was in- structed to determine a fixed location for future Catoctin Circle , between Rt . 7 and Edwards Ferry Road , as shown on the Major Thorofare Plan , and 200 MINUTES OF MAY 8, 1968 MEETING. WHEREAS , that firm has presented a map showing this location , together with bearings and distances , which fixes the loca- tion bf Catoctin Circle , NOW, THEREFORE, BE IT RESOLVED by the Town of Leesburg , that ' this map entitled "Plat Showing Extension of Catoctin Circle," dated April 17 , ' 1968 , be adopted by the Town of Leesburg. On motion of Councilman Murray , seconded by Councilman Howard , the following resolution was unanimously adopted: ' WHEREAS, vehicles have been parking on the west side of King Street , between Loudoun Street and Royal Street , and , in do- ' ing so , occupy a part of the sidewalk, thus creating a dan- gerous traffic condition , NOW; THEREFORE, BE IT RESOLVED by the Town Council of the Town of Leesburg , that "No Parking" signs be erected on the west side of King Street , between Loudoun Street and Royal Street . On motion of Councilman Fishback , seconded by Councilman Murray , the -- following resolution was unanimously adopted : WHEREAS, Washington and Old Dominion Railroad has presented to the Town of Leesburg an Agreement covering easements for a • Sanitary Sewer, dated April 25, 1968, and WHEREAS, the Agreement provides for the Town to pay the Rail- road $1 ,200 for the easement , and a $100 fee for preparation of Agreement and supervision , and WHEREAS , the Town Attorney has reviewed said Agreement and has ' acknowledged his approval of the same, NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Town • of Leesburg , that this Agreement be accepted by the Town, and BE IT FURTHER RESOLVED , that $1 ,200 be appropriated for the easement' and $100 be appropriated for the preparation of the Agreement . Town Attorney' George' Martin suggested that it would be wise• for the Town to try to acquire all permanent easements across W. &' O.D. pioperty, rather than licenses. On motion of Councilman Howard , seconded by Councilman Hill , the following resolution was unanimously adopted : • BE IT RESOLVED by the Town Council of the Town of Leesburg, that the following appropriation be made: $253.08 - Johnson and Williams - Printing at A & E Blue- printers . 1967 Bond Issue Fund . On motion Of Councilman Pumphrey, seconded by Councilman Hill , and after discussion and recommendation from Utility Committee members , the following resolution was unanimously adopted : ` BE IT RESOLVED by the Town Council of the Town of Leesburg , that Ted Moody be employed as Engineer-Inspector on the new Sewer Projects as of June 1 , 1968, at an annual salary of $9,000 per year. Councilman Murray asked Mr . Ritter if he would prepare a break- down of the break-ins in the Town in the last year for the committee meeting next Tuesday. Mayor Rollins again reminded all Councilmen to go over the Budget thoroughly before the meeting next Tuesday night. There being no further business , the meeting was adjourned at 8:45 P.M. f Mayor Clerk of 'e Council 11 • • May 3, 1968 1 • The Loudoun Protection Committee Leesburg, Virginia .. • We the undersigned believe that our personal safety and our property are threatened by the rising crime which is originating within our communities as well as without. Consequently we call now, in this period of unquestioned crisis, upon our elected officials, the Loudoun County Board of Supervisors and the Councils of Incorporated Towns within the County, to recognize the crisis and take such immediate steps as will restore safety and order. ' ' Specifically, we beleive the following: (1) That the maintenance of law and order is the primary function of government. - (2) That the securing of those rights, benefits, and privileges ) .which a democratic government offers, is only possible if I • • government maintains order and respect for its laws. . (3) That crime in Loudoun continues to increase at an alarming rate. It could soon get out of hand. Citizens are finding , it necessary to arm. ' • Therefore, we ask our governing bodies to: - • (1) Double the size of their respective sheriff and police depart- ments at the earliest possible date. (2) Increase the salaries of law enforcement personal to a level' consistent with their honorable, important, and dangerous calling. (3) Provide adequate hinds for modern equipment and training. (4) Support the police through all trouble. Criminal brutality and depravity frequently require equal and opposite force to master it.
