Your response to my recent public record request, forwarded herein and copied below for your reference,
fails to produce the requested record or provide a statutorily required reason for withholding it.
I specifically asked for: The last pay check or billing statement for the person who substantially
authored the following paragraph; as used in your recent response to record requests for text
message records: Please note that these records you requested are considered transitory
records. Transitory messages are not intended to formalize or perpetuate knowledge and do not
set policy, establish guidelines or procedures, certify a transaction, or become a receipt.
Examples of transitory messages include, but are not limited to, reminders to employees about
scheduled meetings or appointments; most telephone messages (whether in paper, voice mail, or
other electronic form); announcements of office events such as holiday parties or group lunches;
and recipient copies of announcements of agency sponsored events such as exhibits, lectures,
workshops, etc. These documents are retained until obsolete..

Be advised that no such records exist. Pursuant to the public records laws, the duty of the Town
of Gulf Stream is to provide access to or copies of public records at a reasonable time in

Please disregard this most recent request and instead I ask for the following public record:
Any record that would identify the person who originally created, wrote or otherwise provided
to the Town or on behalf of the Town certain words used to respond to my recent public record
request. These words are: Please note that these records you requested are considered
transitory records. Transitory messages are not intended to formalize or perpetuate knowledge
and do not set policy, establish guidelines orprocedures, certify a transaction, or become a
receipt. Examples of transitory messages include, but are not limited to, reminders to employees
about scheduled meetings or appointments; most telephone messages (whether in paper, voice
mail, or other electronic form); announcements of office events such as holiday parties or group
lunches; and recipient copies of announcements of agency sponsored events such as exhibits,

PUBLIC RECORDS REQUEST
I make this public records request of your agency pursuant to Article 1, Section 24 of the Florida
Constitution and Chapter 119.07 of the Florida Statutes.
If any records that would have been responsive to this request have been destroyed, then please provide
any and all records identifying the destruction or other means of disposition of records that would have
been responsive to this Public Record Request.
If you contend that any of the records I am seeking, or any portion thereof, are exempt from inspection or
disclosure please cite the specific exemption as required by 6119.07(1)(e) of the Florida Statutes and
state in writing and with particularity the basis for your conclusions as required by §119.070 )(f) of the
Florida Statutes.
Please take note of 6119.07(c) Florida Statues and your affirmative obligation to (1)
promptly acknowledge receipt of this public records request and (2) make a good faith effort which
"includes making reasonable efforts to determine from other officers or employees within the agency
whether such a record exists and, if so, the location at which the record can be accessed." I am,
therefore, requesting that you notify every individual in possession of records that may be responsive to
this public records request to preserve all such records on an immediate basis.
If the public records being sought are maintained by your agency in an electronic format please produce
the records in the original electronic format in which they were created or received. See 6119.01(2)(f),
Florida Statutes.
If you anticipate the production of these public records to exceed $1.00 please notify me in advance of
their production with a written estimate of the total cost. Please be sure to itemize any estimates so as to
indicate the total number of pages and/or records, as well as to distinguish the cost of labor and
materials.
