HomeMy Public PortalAbout1969_04_09 19 MINUTES OF REGULAR MEETING OF LEESBURG TOWN COUNCIL, APRIL 9, 1969. A regular meeting of the Leesburg Town Council was held in the Council Chambers. at 10 W. Loudoun Street , Leesburg, Virginia , on April 9, 1969 at 7 :30 P.M. The meeting was called to order by Mayor Rollins , with Councilman Howard offering the prayer. Those present were : Mayor Kenneth B . Rollins , Councilmen C. Maloy Fishback, G: Dewey Hill, Frederick R. Howard, Walter F. Murray, Robert A. Orr and John W. Pumphrey ; also Town Manager James W. Ritter, Jr. and Town Attorney George M. Martin. The Minutes of the meeting of March 26, 1969 were approved as written. Mrs . Helmi Carr, representing the Chamber of Commerce and the Tour- ism and Restoration Committee , asked Council for permission to use cer- tain streets , to be designated at a later date , for the purpose of hold- ing an antique "Flea Market" in October for one day during the week-end of the Waterford Festival. She explained that antique dealers would be invited to come here and set up carts and station wagons along the curbs and sell from them. They would charge these dealers for space to park their wagons , etc . and this money would be added to the Restora- tion Fund. Authorities of the Waterford Foundation have been approached regarding this and they would welcome something of this type in order to o draw some place for all the tourists to go. Also, the antique dealers in Town are very enthusiastic about this and do not feel this would be any competition to them. It would be proposed to try this in Leesburg for one day to start with and, if successful , it might be possible to expand to other towns in the County . Various clubs in the County could have booths at the same time , giving them an opportunity to make some money for their various projects . She asked that someone be appointed to work with them on plans for this project , if this meets with Council approval. Councilman Murray said he thought this a good idea •'and that the Town should do whatever it can to encourage it . Councilman Hill asked if there would be any legal hitch in connec- tion with the fees normally charged for permits . Town Attorney Martin said he believed the fees set by the Town Code could either be waived or collected and turned over to the Chamber. Councilman Fishback sug- gested that the Town Manager work with them, also the Town Attorney, and that they then present the Council with an over-all plan for this . undertaking . Mayor Rollins appointed Mr. Forbes to take care of this for the Town and to contact either the Town Manager or the Town Attorney when needed. Councilman Hill also asked if they have any further plans for the log cabin and the other building . Mrs. Carr said that part of the funds derived from this project would be used toward this . They want to take out the tree stumps and level off the ground between the two buildings . Mr. Bozel is to check on the location of the water and sewer mains before any excavation is started. The Washington Gas Light Company is giving free estimates on air conditioning. She said they plan to do as much as they can this year. At this time , Mrs . Moody , on behalf of the officers and directors of the Chamber of Commerce , presented to Council a plaque of Honorary Membership in the Chamber, this being the first honorary membership ever presented. Mayor Rollins expressed the appreciation of the Council and said that, since Mrs . Carr has been President of the Chamber and Mrs . Moody such an active participant , the Chamber has exceeded any achievements expected. Mrs . Moody reported that, in connection with Oatlands Day, each Town had an exhibit and these are now in the Museum. She said she had received letters from the Mayors of the various Towns , expressing their appreciation to Leesburg . Mayor Rollins thanked Mr. Forbes for helping with Leesburg 's display. Mr . Forbes , in turn, thanked Mrs . Moody . Mr. Lucien Rawls reported to Council that the Court has now reached the point of recess regarding the appointment of a Receiver for Chan- tilly Aviation. He said there has been discussion as to whether the jurisdiction should be in this Court or in Fairfax County. The case has been postponed at this time . He said he .would anticipate a date being set for further hearing sometime next week. 20 .MINUTES OF APRIL 9, 1969 MEETING. Town Manager Ritter reported the following : (1) The plans for the Potomac River 16-inch water line have been received from Johnson. and Williams . These are construction plans and could be put out to bid any time . This is our first step and these are being submitted for our review and comment . The Utility Committee will look at them next week. All water line plans are complete, with the ex- ception of the line from Speek 's gate down to the .River. .Both Rust and Speek were against it being on their land, however, Rust agreed to our running a survey further down. A man named Scheetz is handling this for the Rusts and he is keeping in close touch. There are two ways to go from Edwards Ferry Road, one would be to parallel the overhead power line - the other to keep straight down Edwards Ferry Road .to the pri- vate road, then to a 90° angle and then to a point where we plan to put it in the River. The estimated cost on this portion of the project (Washington Street to Speek 's gate) would be $306 ,000 , or $ 1,000 ,000 for the complete package . We did receive a letter from the State of Mary- land extending our permits . We have to go through this process each year and must show some progress each year . (2) The plans on the 24-inch sanitary sewer on Route 15 have also been received from Johnson and Williams . These , too, are final con- struction plans and could be put out to bid any time . A 24-inch line all the way would plan for any possible future growth in this gravity area . There is one question on this , how large a line do we need be- yond the last manhole to go up to Dry Mill Road. Mr. Crickenberger will meet with the Utility Committee on Monday to discuss this and to decide what portion of the cost the Town will pay. He said he believed we decided to pay the cost of the additional size of the pipe . The estimated cost of this project is $46 ,000 complete . (3) The 9 '. x 4 ' box culvert on South Street will be started on Friday. The Gas Company will get their line out of the way tomorrow. (4) There will be a Field Inspection on the Southeast Quadrant of the By-Pass on Friday at 10 A.M. There has still been no word from the Highway Department on the Southwest Quadrant. (5) The building of the new Post Office is being held up pending assurance from the contractor that he will construct certain things . We want a 24-inch storm sewer and the sanitary sewer is to be either re- laid, or the rear footing lowered to an elevation close to the sanitary sewer. (6) On the financial picture on the sewer construction, we have $250,000 due April 12th from the Bank (this is the money from the Fede- .ral Government that we invested for 60 days) : We feel this should meet the contractors .' payments until June 1st . This means we will probably have to sell our bonds the latter part of May or have short-term bor- rowing from the bank, in anticipation of the bond sale . Councilman Hill asked how the money market is at this time . Mr. Ritter said he has heard nothing in the past week, but it was no better a week ago . The State of Virginia bonds sold for 4 . 7 . Mr. Hill said perhaps we might be kidding ourselves in putting off the sale of our bonds , the market could be going up even more . Mr. Ritter said he would check with Richmond on this . - Councilman Fishback asked if it is possible that we might get some financial assistance on the line out Route 15 also, the portion on Wage Drive later on. Mr. Ritter said he believes this will conform and he will check on this . Edwards Ferry Road from Washington Street out to .the By-Pass was discussed. However, this is not the only unpaved road in the corporate limits . We also have one on Sycolin Road and the one going to the Reha - bilitation Center. Councilman Fishback said we got a price once on Edwards Ferry Road, but we can 't get it in the Budget now. Perhaps it can be put in next year for surface treatment . Councilman Hill said he understood storm drainage out there was also a question. We have to negotiate with Mrs . Carr, among others , for this purpose . Councilman Murray said there .was a question as to the width of the right-of-way . When plans were drawn up, they were for a 60-foot right-of-way and the Planning Commission recommended that it be 70 feet . These plans are to be redrawn. 21 • MINUTES OF APRIL 9, 1969 MEETING. Mayor Rollins asked the estimated amount of the proposed General Obligation Bond. Mr. Ritter said it is for $600,000 - $500,000 for the Sewer and the other $ 100,000 for other purposes - part for the Route 15 sewer_ project and part for the Potomac River Water Line . Mayor Rollins asked Mr. Martin if the Bond Issue Resolutions are worded to cover this . Mr. Martin said they are . Mayor Rollins asked if there is any comment as to whether anything should be added to this Bond Issue . Council- " man Fishback said that going further down the River would add to the .- cost of this project . Councilman Pumphrey said Federal assistance might help on this . Mr. Ritter said this would mean about a half mile more I of line and it would cost more for the construction of this line due to the fact that there is a lot of rock there and the land is very irregular. g. Councilman Hill commented that Johnson and Williams have said that the island itself will protect against ice flows . Mayor Rollins asked how .4. : high this facility would be . Mr. Ritter said it would be about 15 feet' '' above water. Further discussion continued regarding damage to the land and the view from the house. Ten acres was mentioned, but there is noth- ing definite on this yet . Mr. Moody reported on progress of the sewer projects as follows : On S-I, they have finished pouring the walls and the floor on the _ . " secondaryrecirculating pumping station ; also the roof deck on the mprimary sludge station. That structure is now nearly complete, al- though there is some polishing to be done. The pumps , motors and pipe G work are installed. They are now working on the walls for the two south' digestor tank segments , and they will pour the west wall of the control building too, so progress is being made on S-I, although they are still . having some trouble with personnel. On S-II , they are still checking the top section of the line for leaks and trying to get the infiltration down to where it will pass ther final test . This should be ready for final tests in the next two weeks. On S-III , they are past the Ball Park and close to Dry Mill Road. The fence will be replaced with new fencing - the contractor and the Town to split the cost . This should be up in the next week. They lack only Manholes 25 and 26 and crossing the creek until they are at the end of the project ; then they have to pick up the leave-out on Route 15 and then back to Catoctin Circle and across to Harrison Street up to the plant to tie into Contract S-IV. They may run into a little trouble on Route 15 . On S-IV , they are making satisfactory progress , although they have run into a little rock on this line . The big job is to construct the manholes . Councilman Pumphrey asked if they are watching the cut on Route 15 and keeping it filled in. Mr. Moody said they are trying to watch this . Mayor Rollins asked how much damage there was to the old line behind the Ball Park. Mr. Moody said they had to replace about 8. sections of that old line, it was laying right on the rock. On motion of Councilman Murray, seconded by Councilman Howard, the following resolution was unanimously adopted: BE IT RESOLVED by the Town Council of the Town of Leesburg, that the following appropriations be made : $62 .52 - George Martin - Expenses to Richmond in handling Potters Field Case. 15 .20 - Johnson and Williams - Printing for month of Feb. Councilman Fishback said that , with regard to our closing off streets for this "Flea Market," he believes we do not have entire charge of our streets , that we have to do certain things as required by the State. Mr. Ritter said he would investigate this . Councilman Murray said he did not think there would be any objection as long as they don 't use Routes 7 or 15 .
