A RESOLUTION AMENDING THE POLICE MERIT COMMISSION RULES
REGARDING THE PROCEDURES FOR PROMOTIONS
WHEREAS, Pursuant to State law the City of Richmond has previously established a
Merit System for its Police Department, including the use of a Police
Merit Commission; and
WHEREAS, the creation and administration of this system is currently set forth in
Chapter 31.52 of the Richmond Code; and
WHEREAS, pursuant to the Code, over the years the Police Merit Commission has
adopted various rules and regulations to administer the Merit System;
and
WHEREAS, the Police Merit Commission desires to pass a resolution changing a
certain provision of the Merit Commission Rules and Procedures; and
WHEREAS, it is in the desirous to amend section m.1.1 through section m.1.4, to
reflect the new provision.
NOW, THEREFORE, be it resolved by the Police Merit Commission of the City
of Richmond, Indiana that the Merit Commission Rules be amended to read as follows:
(m) Rules and Procedures for Promotions
(1) The rules and procedures shall provide that all promotions to
any rank be from the next immediate lower rank and that the person
shall have qualified in time of service required by this plan. A police
officer must have served at least one year in permanent rank by
January 1 st of the year immediately following the test before being
eligible to take the promotional test for the next higher rank. These
requirements may be waived by the Commission in that rare instance
where by departmental reorganization, resignation, or attrition; the
ranks have been depleted of officers meeting promotional
requirements. This waiver shall not be construed as to amend, or
waive any other promotional requirements in this plan. (Ord. 99 -1990)
Rule m.1.1
Once an officer is offered the promotion to a higher rank and the
officer refuses it, he or she will be removed from the eligibility list,
until the list expires.
Rule m.1.2
Should the eligibility list for any rank not contain an officer
eligible for that rank, the commission may establish a new
eligibility list.
Rule m.1.3
No officer shall be allowed to test alone. It shall take two (2) or
more officers testing to make a competitive list.
Rule m.1.4
An officer must have five (5) years seniority to test for Sergeant,
seven (7) years to test for Lieutenant, and ten (10) years to test for
Captain. An officer must have three (3) years to test for
Investigator. All seniority must be met by January 1 St of the year
immediately following the test.
(2) Service time required for eligibility for next rank
(A) A police officer must have been a patrolman of the
Police Department for a minimum of five (5) years before
he /she is eligible for the rank of sergeant. (Ord. 3187 -1977)
(B) A sergeant must have been a member of the Police
Department for a period of not less than seven (7) years before
he /she is eligible for the rank of lieutenant. (Ord. 3187 -1977)
(C) A lieutenant must have been a member of the Police
Department for a period of not less than ten (10) years before
he /she is eligible for the rank of captain. (Ord. 3187 -1977)
(D) The requirement of one (1) year in permanent rank as
set forth in (m) (2) (B) and (C), may be waived in that rare
instance where by departmental reorganization, resignation, or
attrition, the ranks have been depleted of officers meeting
promotional requirements of (m) (2) (B) and (C). This waiver
shall not be construed as to amend or waive any other
promotional requirements in this plan.
Rule m.2.d.1
Immediately upon vacancies in rank, the Chief shall notify
the President of the Merit Commission for the said vacancy
to be filled no later than the next regularly scheduled
meeting.
(3) It shall be the discretion of the Chief of Police to assign those
promoted ranks within the Department's command structure. (Ord.

(4) The Commission, with approval of the Board, may create rank
classification for patrolmen. (Ord. 3187 -1977; Ord. 99 -1990)
