HomeMy Public PortalAbout1969_10_22 98 MINUTES OF REGULAR MEETING OF LEESBURG TOWN COUNCIL, OCTOBER 22 , 1969. A regular meeting of the Leesburg Town Council was held in the Council Chambers , 10 W. Loudoun Street , Leesburg , Virginia , on October 22 , 1969, at 7 :30 P.M. The meeting was called to order by the Mayor, with the prayer being offered by Councilman Wallace . Those present were : Mayor Kenneth B. Rollins , Councilman G. Dewey Hill, Frederick R. Howard, Walter F . Murray, Robert A. Orr, John W. Pumphrey and John A. Wallace , Jr . ; also Town Manager James W. Ritter, Jr. and Town Attorney George M. Martin . The Minutes of the regular meeting of October 8 , 1969 were approved as written . Town Manager Ritter reported the following : (1) The Highway Department has set up a meeting on the Southwest Quadrant of the By-Pass for Wednesday, November 12th at 10 :30 A.M. , to be held in the Residency Office , to discuss the location of this segment. (2) We have received two suggested plans from the Highway Depart- ment on how we can improve the left turn situation on Route 7 East , but estimates have not been completed yet. One of these suggestions could run as much as $25 ,000 . We will have a full report for the Street Com- mittee meeting . (3) Regarding the authorization to pave the south side of Dry Mill Road, this work has been accomplished and this could be an appropriation . (4) Estimates have been made on paving Second and Fourth Streets in Waverly Heights . Second Street would cost about $2,850 to grade and pave and Fourth Street about $3,510 . The right-of-way is restricted on these streets and there is very little traffic , so it was decided to wait and do nothing at the present time for lack of money . (5) An estimate was also made on connecting Valley View Avenue across the W. & O . D. right-of-way. Curb and gutter and paving would • cost approximately $3 , 770 . It was decided to put stone on the crossing for this winter and perhaps an appropriation can be made in the spring for this work . (6) Information on how Fairfax handles the policy of extending water and sewer mains outside the corporate limits has been received and this will be discussed at the next Utility Committee meeting. (7) The possibility of buying the Myers Well was discussed by the Utility Committee . Mr. Myers is willing to sell . He said he would ap- point an appraiser and would like the Town to appoint one and these two would then appoint a third. Mr. Jesse Snyder of Sydnor Hydrodynamics has been contacted to represent the Town on this appraisal. Mr. Myers is contacting someone in Herndon. (8) Maryland Excavators has completed the Rt . 654 crossing in the last couple of days , at a cost of $5 ,343 .30 , to come from the 1969 Bond Issue . This should be approved tonight . The estimate was $3, 700, plus $18 .00 for rock excavation and $4 .00 for paving . There was much more rock than had been anticipated. There would have been even more had we not raised the grade about 3 feet . Mayor Rollins introduced, for the record, the letters from the three jurisdictions mentioned at last meeting who had not joined Che Northern Virginia Regional Planning Commission District Eight . These letters were from the Towns of Manassas and Vienna and the City of Fairfax, the latter of which did decide to join . Councilman Pumphrey called attention to the dangerous situation at the corner of Loudoun and Wirt Street where trees have been cut down. Mr. Ritter said the Town would move these if the contractor does not . Councilman Hill asked what they plan to do with this property. Mr. Ritter said we have done what they asked us to do so they could get the tenants out and go ahead with their building . He understood they gave the tenants 30 days to get out and that time is about up. 99 MINUTES OF OCTOBER 22 , 1969 MEETING. Mr. Moody reported that progress continues very good on the Sewer Plant, with the increased work force still on the job. There were about 18 to 20 men there today . The subcontractors are doing better too since our letter to the contractor . The electrical contractor is working con- tinuously and the painters are working . Joists have been erected and they are almost ready for the roof on the Control Building, they are waiting for the brick masons . They are doing some piping work. The grading is about 80 per cent complete and looks very nice. He said he feels much better about the progress , although the Plant will still not be ready when it should be, but we cannot say the contractor is not I making an effort . On motion of Councilman Wallace , seconded by Councilman Murray, the following resolution was unanimously adopted : BE IT RESOLVED by the Council for the Town of Leesburg , that the Town Manager be and he is hereby authorized and directed to have the following advertisement published in the Loudoun Times-Mirror on the 6th and 13th days of November, 1969 : . PUBLIC NOTICE p Notice is hereby given that a Public Hearing will be held by • the Council for the Town of Leesburg, Virginia on November 26 , 1969 at 7 :30 P.M. in the Council Chambers , 10 West Loudoun >� Street, Leesburg , Virginia, to consider a request by A. L. B . Ca diZerega , III and W. A. Herndon, Jr . to have rezoned from R-1 to R-3 a parcel of land consisting of 12 . 5 acres located on the northwest side of Dry Mill Road, bounded by the properties of West Loudoun Street on the north, Dry Mill Road on the east and south and George and diZerega on the west . At this hearing all interested persons desiring to be heard will be heard as to their views pertinent to said request . ' BY : Kenneth B . Rollins , Mayor Town of Leesburg , Virginia On motion of Councilman Hill , seconded by Councilman Howard, the following resolution was offered : BE IT RESOLVED by the Town Council of the Town of Leesburg , that a contract be awarded to Maryland Excavators for the construc - tion of a sanitary sewer line across East Market Street to serve the Arl Curry property , in accordance with plans prepared. by the Town of Leesburg , at a price of $4, 200, plus $18 .00 per cu. yd. for rock excavation and $4 .00 for paving . Mayor Rollins again raised the question as to how much this line will serve . Mr. Ritter said it will serve the present Highway Department Residency , but not with a basement at that location. He knows Mr. Curry will tap into this line , as well as Mr. McCann, but does not know how many others . It is estimated that the rock excavation on this line will run about $900 . We will have to put in a 2-inch water line at the same time the sewer is put in. We will do this work and lay it in the same ditch as the sewer line . The resolution was then adopted by a vote of 6 to 1 , with Mayor Rollins voting against it. On motion of Councilman Pumphrey , seconded by Councilman Howard, the following resolution was unanimously adopted : _' BE IT RESOLVED by the Town Council of the Town of Leesburg , that the Performance Bond on Sec . 1-B , Rock Spring Subdivision, be released, such work as covered by Bond having been com- pleted satisfactorily . On motion of Mayor Rollins , seconded by Councilman Pumphrey, the follow- ing resolution was unanimously adopted: BE IT RESOLVED by the Town Council of the Town of Leesburg , that an appropriation in the amount of $1 ,580 .60 be made to pay Tri- County Asphalt for the paving of a section of Dry Mill Road south of Loudoun Street . :400 MINUTES OF OCTOBER 22, 1969 MEETING. Councilman Hill said he has received favorable comment on this widening and Councilman Wallace suggested that the marking be kept as close as possible to the Texaco Station so that there will be room for cars com- ing from Town to make the turn. On motion of Councilman Orr, seconded by Councilman Murray , the fol- lowing resolution was offered: BE IT RESOLVED by the Town Council of the Town of Leesburg, that the following appropriations be made : $1,344.32 - Dewberry , Nealon & Davis , for Engineering on water and .sewer projects . Utility Fund-Engi- neering-Capital Outlays . 596 . 15 - Santmyer Electric for work on Myers Well . Utility Fund-Capital Outlays-Myers Well . Mr. Ritter explained that he had written to Dewberry , Nealon and Davis for a breakdown on their bill and reported that they arrive at their bill by the hours spent by each person working on the job. They then add up the salary costs , plus 100 per cent . There were two jobs in- volved on this bill - the Rt . 654 sanitary sewer line and the water line that has to be rearranged at the By-Pass on Rt . 7 . The resolution was then unanimously adopted. On motion of Mayor Rollins , seconded -by Councilman Pumphrey, and there being no objection to considering this tonight , the following reso- lution was unanimously adopted: BE IT RESOLVED by the Town Cduncil of the Town of Leesburg, that the sum of $5 ,343 .30 be awarded to Maryland Excavators , Inc . for the sewer line crossing Route 7 east of Leesburg . • Mr. Ritter explained that the plans drawn by Dewberry , Nealon and Davis had this line too low in order to catch anything on the north side of the road but , on investigation, it was found it could be raised three feet . They actually did no field work on this job. We are doing the field work and saving the Town a lot of money. Also, we are advertis- ing for bids on these various jobs , instead of giving them to a consulting engineer. Dewberry , Nealon and Davis are doing the office work - the design and paper work-and it is felt we are justified in having them do this . If we had the time , we could probably do the whole thing and, now that Mr. Moody has more time , Mr. Ritter thinks we can do a lot of this work . He has spent several days on the Rt . 654 job and this is saving the • Town a lot of money . Several questions were asked the Town Manager about the size , etc . of this line . A letter from the Board of Architectural Review was discussed, this letter requesting that the Council consider adopting methods of control- ling construction along the highways into the Town to conform more closely to the spirit and appearance of Old and Historic Leesburg. Councilman Howard, the Councilmanic member of this Board, elaborated on the wishes of the Board. Mr. Forbes said the Old and Historic -District is a part of the Zoning Ordinance and this would have to be amended to increase the area . Councilman Howard said he believed the Planning Commission should have something to say about this . The Board would like to know basically how the Council feels about this . Mayor Rollins said he be- lieves we should request the Planning Commission to present a proposed Ordinance on this . Mayor Rollins said he had made the announcement about the meeting with the Highway Department on the Southwest Quadrant at the joint work, session of the Council and the Planning Commission last week, but asked that the Clerk call all Council members on the 12th to remind them of this meeting . Mr. Frank Caldwell , Manager of the C & P Telephone Company presented to Council two sketches showing the proposed enlargement of the present building on Route 7 and equipment . The first step in this expansion would 101 MINUTES OF OCTOBER 22 , 1969 MEETING. be a very large micro-wave tower, which will furnish about 200 additional circuits out of Leesburg, which is rapidly becoming the communications center of Northern Virginia . This would be •erected on the present build- ing before the third floor would be built and would be 150 -feet from the ground: Councilman Howard asked if it would be possible to put this tower down in the service area : Mr. Caldwell said it could be done , but it would be more costly . Mr. Forbes said there is no Ordinance to pre - vent this tower being located on the present building . Mr. Caldwell said, if the Council feels that the people in town will object too strongly; ' they will move the structure out of Town entirely , however, the present building will never be relocated. They know they will run into problems in getting the land surrounding it for expansion, but they have to ex- pand and this is the place to do so. He said he has' been approached about the appearance of this building since it was built , but he believes it is -as good looking a building as there is in the remainder of this area . An unofficial personal poll was taken as to how Council members feel about this tower, with- three members having no objection and three others believing there will be some objection to it and one believing there will be major objection . Mr . Caldwell asked that any complaints "regarding it be directed to him, not to the Council. QD O Mayor Rollins asked that approval of a contract to list the Sewage Property with •Mr. Warner and for multiple listing be on the Agenda for ^-� - the next meeting. • Councilman Wallace asked how we handle- the penalty clause with English Construction Company at the end of the contract period. Town Attorney Martin said he would have to look at the contract to be sure, but he would assume we would withhold the penalty from the last payment .
