INTERLOCAL AGREEMENT
THIS INTERLOCAL AGREEMENT made by and between the Board of Public
Works and Safety of Richmond, Indiana, hereinafter referred to as "City" and Board of
Commissioners of Wayne County, Indiana, hereinafter referred to as "County".
WITNES SETH:
WHEREAS, City and County each have statutory duties as to enforcement of
laws of the State of Indiana governing weights and measures, and
WHEREAS, City has appointed an inspector who conducts weights and measures
inspections in addition to other inspections and which inspector has been approved by the
state division of weights and measures, and
WHEREAS, City has acquired and provides the necessary apparatus and supplies
for its approved inspector, and
WHEREAS, by the terms of I.C. 24-6-3-3 it is not obligatory upon
Commissioners, in a county containing a city which has already provided an inspector of
weights and measurers, to make such an appointment of an inspector, and
WHEREAS, by the terms of I.C. 24-6-3-4 (c) the same person may be employed
as a city and county inspector of weights and measures and further in the event the same
person is so employed the compensation and expenses of the inspector shall be divided
between the City and County as agreed upon in accordance with L.C. 36-1-7.
NOW, THEREFORE, in consideration of the mutual promises and covenants
herein contained, City and County agree:

1. The terms and conditions of this agreement shall be in full force and effect
until December 31, 2008.
2. The State approved inspector of weights and measures appointed by City shall
perform all duties required of County pursuant to the laws and regulations
governing weights and measures of the state of Indiana and of the City.
3. City shall, at its expense, provide all necessary apparatus and supplies for its
duly appointed inspector to provide services.
4. City inspector shall make all annual inspections required by County by statute
or regulation on or before December 31' of each year and confirm to County
in writing the making of same.
County shall pay City for such services the sum of Twenty -Five Thousand
Dollars and Zero Cents ($25,000.00) on or before the 30th day of March of
each year.
