HomeMy Public PortalAbout1970_06_24 MOM 197 MINUTES OF REGULAR MEETING OF LEESBURG TOWN COUNCIL, JUNE 24, 1970. A regular meeting of the Leesburg Town Council was held in the Council Chambers , 10 -West Loudoun Street , Leesburg, Virginia , on June 24, 1970 at 7 :30 P.M. The meeting was called to order by the Mayor, .with Councilman Orr offering the prayer. Those present were : Mayor .Kenneth B . Rollins , Councilmen G. Dewey Hill, Frederick R. Howard, Wal- ter F. Murray, Robert A. Orr and John W. Pumphrey ; also Town Manager James .W. Ritter, Jr. and Town Attorney George M. Martin . Absent from the meeting was Councilman John A. Wallace , Jr. Mr. John Wine, Attorney , spoke on behalf of Mr. Jack Robinson (who I was also present) , requesting a variance to place a trailer on a lot owned by Mr. Robinson in Waverly Heights. He explained that Mr. Robin- son is 70 years of age and has recently been injured and can no longer work. He , therefore, must live on a small Veteran 's pension and Social Security , which is not enough to build a house. He could, however, buy a second-hand trailer for a small amount down and monthly payments, and he would like to place this trailer on the lot that he owns . Mr. Wine also asked that the Availability Charges for water and sewer connections recently adopted by the Town Council be waived in this case. He said that Mr. Robinson is a man who has worked hard all his life and never asked anything of the Town, and he is submitting this request in his be- ;fl half on a hardship case. Councilman Murray stated that he had recently appeared before the County Board of Zoning Appeals in behalf of- a blind • — woman, certainly believing this was .a hardship case , and the County turned it down . This matter was discussed by Council and Councilman Howard sug- JBested that perhaps a packaged home from Barber and Ross could be erected on this lot at no .more cost than the trailer would be and this would be within the zoning laws of the Town. Mr. Wine said he would look into this possibility before hemade any further plea to the Council for relief for Mr. Robinson. Town Manager Ritter reported the following : . _ (1) He explained several items on the Agenda , among them the pro- posed appropriations and the credit to the Treasurer for delinquent per- Isonal property taxes . (2) . The letter from Greenhorne & O 'Mara, Inc . was received yester- day. It looks like their price has gone up. . Mr. Lake called today and said he had talked with someone in the State Agency and they have $150,000 appropriated for the current year for four (4) municipalities and three (3) Planning Districts . He was not too optimistic about our getting a grant this year. (3) Two bids were received on the Resurfacing Schedule for 1970, with Sam Finley , Inc . submitting a bid of $16 ,813; which was $2 ,200 more than Tri-County Asphalt 's bid of $14 ,462. 15 . . (4) He talked with Mr. Williams today about theproposedwater and sewer rate study . Mr. Williams expects to have it here by the middle of next week. Also, they plan to start the test borings on the Filtra- tion Plant site this week. - . (5) All the necessary work has been done on the Bond Issue . The Petition was presented to the Court, the Notice has beenpublished in the Times-Mirror, the wording for the ballots received from Reed, Hoyt , Washburn & McCarthy and the ballots are being- printed. _ Councilman Orr asked about the change in trash and garbage pick-up. Mr. Ritter explained that Mr. Herbert Lee Randolph will handle this con- I tract with just two men, and which will give him a better. schedule , with one day off during the week to work on his equipment, . if necessary. Business pick-up will not change and everyone in Town .will still have collection twice a week. Councilman Murray commented that Fairfax County 's cost to use the Dulles Interceptor Sewer has doubled in the last six months and he be- lieves we are fortunate not to have chosen that method of sewage disposal. 198 MINUTES OF JUNE 24 , 1970 MEETING. - • Mr. Moody reported that they are moving ahead on the raw sewage pumping station at the Sewage Treatment Plant, the roof is on and the . building cleaned up. They are working inside now and this should move very rapidly . The walkway . in front of the chlorine room is still to be done - they are waiting on a hoist to move the one-ton chlorine cyl- inders into the room. The .eye beam is in place . There has been some little hold-up on the lab equipment for the Control Building. He hopes to do pressure tests on six or seven. pressure lines next week. All pipe line work has been done and all structures are about ready to start test- ing equipment, except for the centrefuge room, and it will .probably be six months or more before they are ready to use this after the Plant goes into operation, so there is no rush on this . The electrical work yet to be done is holding up testing the equipment and he will call VEPCO tomorrow. He still feels the Plant can be ready for operation by July 15th or before . They are still trying. to find a Superintendent for the Plant . On the Route 15 By-Pass, this line must be flushed out again by the Fire Department before he can check it again and he will keep after Mr. Nicholson until this is done . The Route 654 job has been waiting on Tri-County Asphalt to do two jobsfor him and they expect to do these next Wednesday -. then this line . will be ready for checking out . Mr. Moody said he has started checking Arl Curry 's work in Prospect Hillsand, so far, •he is doing good work on this. Mayor. Rollins said Mr. Ritter was to ask Dewberry, Nealon and Davis for better wording on the sizing of sewer lines, to be incorporated in the Sewer Ordinance. Mr. Ritter said he got this information this after- noon and it will be taken up at the next Committee meeting. The Mayor also said he had complaints from developers regarding the availability charges adopted by Council, particularly, where a developer has already contracted to build a house for a .certain price. This new charge would be considered a "hardship. " He asked that the Utility Committee consider this to see if thosepeople who had already secured Building Permits should be excluded. On motion of Mayor Rollins , seconded by Councilman Pumphrey, the following amounts were appropriated from the 1970-1971 Budget by a vote of 5 to 1, with Mayor Rollins voting against the appropriation to the Northern Virginia District Planning Commission for dues : $ 9,300.00 - Director & Assistant to Town Manager 300.00 - Advertising & Printing 300.00 - Other Services & Supplies 25.00 - Board of Architectural Review 500 .00 - No. Va . . Planning Comm. -Dues $10,425 .00 - Total Planning & Zoning On motion of Mayor Rollins , seconded by Councilman Howard, the fol- lowing amounts were unanimously appropriated from the 1970-1971 Budget : $ 1,200.00 - Police Judge 800.00 - Issuing Justice 1,500 .00 - Maintenance of Prisoners $ 3 ,500.00 - Total Administration of Justice - CD Mayor Rollins said that, with regard to the appropriation for Per- -t sonal Services in the Police Department, he believed it was Council 's intention to make appropriations for individual positions . After some discussion, it was moved by Councilman Murray that the $60,400 be ap- Q propriated to the Police Department for Personal Services . This motion was dropped for lack of a second. On motion of Mayor Rollins , seconded by Councilman Pumphrey, the following appropriations were unanimously adopted for Personal Services to the Police Department Budget for 1970- 1971: $ 8 ,500 7 Chief of Police , 8 ,100 - Lieutenant 7 ,900 - One Sergeant Position 7 ,900 - Second Sergeant.. Position , 7 ,200 - One Corporal 7 ,200 - Second Corporal 7 ,000 - One Private First Class 6 ,600 - Second Private First Class $60 ,400 - Total' Town Manager Ritter asked Council to consider raising the Police Clerk 's salary to $5 ,200 in view of the fact that she is being requested to attend Court hearings and be responsible for collecting the money at these Court hearings. This matter was discussed, but no action taken. On motion of Mayor Rollins, seconded by Councilman Orr, the follow- ing additional amounts were unanimously appropriated from the 1970-1971 Budget : $ 3 ,800 .00 - Police Car Maintenance . 300.00 - Radio Maintenance 350 .00 - Ammunition 2 ,500 .00 - Uniforms 300 .00 - Training School 600 .00 - Miscellaneous 2 ,400.00 - Police Car 5 ,000 .00 - Police Clerk 100.00 - Travel $15 ,350 .00 - Total Other Police Department On motion of Mayor Rollins , seconded by Councilman Pumphrey, the fol- lowing amounts were unanimously appropriated from- the 1970-1971 Budget : $ 5 ,450 .00 - Town 's Operating Payment 450.00 - Fire Marshal . $ 5 , 900.00 - Total Fire Department 200 MINUTES OF JUNE 24 , 1970 MEETING. • On motion of Mayor Rollins , seconded by Councilman Orr, the follow- ing amounts were unanimously appropriated from the 1970-1971 Budget : $55 ,000:00 - Personal Services 12 ,000.00 - Materials 7 ,000 .00 —Equipment Maintenance 3 ,500.00 - Snow Removal 1,000.00 - Sidewalk Maintenance 6 ,800 .00 - Street Lighting 500.00 - Parking Meter Maintenance - • • 600.00 - Traffic Light Maintenance • $86,400 .00 - Total Streets , Sidewalks & Sanitation • Mayor Rollins called attention to thefact that the Town Manager is al- lowed to increase or decrease salaries of the personnel in the Street and Utility Departments by 15% of appropriations , as he sees necessary. He is justified in coming back to Council for supplemental appropriations up to 15 per cent , if necessary, during the fiscal year. -. Councilman Hill asked if it is planned to surface Second Street. Mr . Ritter said this will require surface treatment and Tri-County does not have this equipment . We will do some preliminary work first, then try to rent a distributor when there is one in the area to -place the surface treatment on this street.On motion of Councilman Orr, seconded by Councilman -Howard, a $1,000 contribution to. the Thomas -Balch- Library was appropriated from Capital Outlays-General Fund by a vote of 5 to 1, with Mayor Rollins casing the dissenting vote . • On motion of Councilman Orr, seconded by Councilman Howard, the " amount of $717 .00 for surveying instruments was appropriated from Capital Outlays-General Fund by unanimous vote. Discussion followed re the purchase of and appropriation of $9,500 for an International Tractor and Backhoe , with the 'present one tofteth& ded on this . On motion of Mayor Rollins , seconded by Councilman Howard, the fol- lowing amounts were appropriated from the 1970-1971 Budget : $30,500.00 - Personnel 2,500.00 - Chemicals • 6,000.00 - Electricity . 300.00 - Telephone .750 .00 - Gas 1,500.00 - Maintenance . • 500.00 - Vehicles $42 ,050:00 - Total Sewer Plant Maintenance & Operation Councilman Hill asked if we can hire a Plant Superintendent within the amount we have set. Mr . Ritter said he .hopes so. They have talked to a man from Hagerstown today , who is instructing a class there now and who has had extensive experience . He wants $9,300 and possibly could go to work about the 1st of . September. There is another man from Manassas that Mr. Moody has talked to , who also wants $9,300, but we do not know enough about him 'yet. We can get by for a while . Councilman Hill asked if the 15 per cent leeway is meant to apply on these salaries also. Mayor Rol- . lins said it is . No appropriations were made from Capital Outlays in the Utility Fund, however, Mr. Ritter said we need the Whacker Tamper as quickly as possible , citing an incident just yesterday where traffic was tied up much longer than would have been necessary had we had one when we put in a new service line on Route 7 . Mayor Rollins asked about the water and sewer lines on Valley View Avenue . Mr. Ritter said we have secured no prices from contractors yet , but this will be discussed at the next Utility Committee meeting . Councilman Pumphrey said he had called Mr. Williams on Monday regarding the $500 .00-bill for their work on the Dewberry, Nealon &. Davis report and Mr. Williams agreed to reduce this bill by -one-half to $250.00, which was pretty close to his actual cost . On motion of Councilman Pum' phrey, seconded by Councilman Orr, Council voted unanimously to amend Item (a) to $250.00 . Councilman Howard said he thought Council owed Councilman Pumphrey a vote of thanks for his action regarding this bill. • The resolution, as amended, was then unanimously adopted. On motion of Councilman Murray , seconded by Councilman Orr, the fol- lowing resolution was offered for discussion. WHEREAS, Dulles International‘ Aircraft Corporation has noti- fied the Town of Leesburg that it wishes to assign its lease at Leesburg Municipal Airport to Transamerican Airports , Inc . , and WHEREAS, Transamerican Airports , Inc . has agreed to such as- signment, NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Town of Leesburg, that the Town Council gives its approval to the as- signment of the lease, effective July 1, 1970, in accordance with Sec . 15 of the current lease between Dulles International Aircraft and the Town of Leesburg , dated October 26, 1966 , the term of which is for a ten-year period. Mr. Lucien Rawls , President of Transamerican Airports , Inc . , stated that his Company is very interested in this lease for future expansion. Mr. Ritter said the Town Attorney has looked at Section 15 of the Leas which provides for subleasing to another party without advertising. The resolution was then unanimously adopted. On motion of Councilman Pumphrey, seconded by Councilman Howard, the following resolution was unanimously adopted: BE IT RESOLVED by the Town Council of the Town of Leesburg, that the Town Manager be authorized to sign the application form for "Federal Assistance for Public Works and Facility Type Projects ," in connection with application for grant on Potomac Water Facilities Project. On motion of Councilman Pumphrey, seconded by. Councilman Howard, the following resolution was unanimously adopted: BE IT RESOLVED by the Town Council of the Town of Leesburg, that the Town Treasurer be credited with $1,346 .35 for De- linquent Personal Property Taxes over five (5) years old. Mr. Ritter commented that some of these delinquent accounts will still be collected. - On motion of Councilman Orr, seconded by Councilman Murray, the following resolution was offered: . 111BE IT RESOLVED by the Council for the Town of Leesburg, Vir- ginia , that the firm of Greenhorne and O 'Mara, Inc . be and it is hereby retained, at a sum not to exceed $2 ,400.00, to pre- pare and-apply for Comprehensive Planning Services and an Over- all Program Design Report, in accordance with the requirements of the Virginia Division of State Planning, as proposed in a letter to the Mayor and Council, dated June 22 , 1970, by Robert B . Bissell, Contract Manager, Greenhorne and O 'Mara , Inc . Mr. Ritter said he talked to Mr. Lake today and it is possible that we could spend this money and not get any grant this year, and we have no positive assurance that we will be able to get any State or Federal money at all. We can keep trying each year and the same application would be used each year. Mr. Lake pointed out that , through political pressure, we might be successful . The resolution was then unanimously adopted. 203' MINUTES OF JUNE 24, 1970 MEETING. On motion of Councilman Pumphrey, seconded by Councilman Orr, the following resolution was unanimously adopted: BE IT RESOLVED by the Town Council of the Town of Leesburg , that the 1970 Resurfacing Contract be awarded to Tri-County Asphalt Co. , in accordance with their low bid of $14,462. 15 . There was some discussion regarding the widening of the street over to the sidewalk on Edwards Ferry Road. Mr. Ritter said this will be put in by the Town to receive the plant mix. I On motion of Councilman Pumphrey, seconded by Councilman Murray , the following resolution was unanimously adopted: • BE IT RESOLVED by the Town Council of the Town of Leesburg , that $34,560 .00 be appropriated to pay English Construction Co. for Est . -#21, Project S-I .
