HomeMy Public PortalAbout1970_11_11 245 MINUTES OF REGULAR MEETING OF LEESBURG TOWN COUNCIL, NOVEMBER 11, 1970. A regular meeting of the Leesburg Town Council was held in the Council Chambers , 10 West Loudoun Street , Leesburg , Virginia, on No- vember 11, 1970 at 7 :30 P.M. The meeting was called to order by the Mayor; with Councilman Howard offering the prayer . Those present were : Mayor Kenneth B . Rollins , Councilmen G. Dewey Hill, Frederick R. Howard, Walter F . Murray , Robert A. Orr, John W. Pumphrey and John A. Wallace , Jr. ; also Town Manager James W. Ritter , Jr. and Town Attorney George M. Martin. The Minutes of the meetings of October 14, 1970 and October 28, 1970 were approved as written. Mr. Ronald Fuller appeared before Council, stating that he wanted to know if there had been any interference with his drain field and sep- tic tank during the new construction on Edwards Ferry Road. He said he had been told that he might have trouble in the future and he wanted to know if the Town would take care of any problems that might develop as a result of this construction. He said his sump pump runs more often than it formerly did . Mr. Ritter explained that he felt sure we had not interfered with the drain field and septic tank, however , before we built the new road, the drainage from the drain field ±an in a ditch and we more than likely put a barrier there that keeps it from doing this now, o so perhaps this is why his sump pump runs more than usual .' There was a soft place in the road in front of his house and a better and imper- q vious material was placed in this location, however, he knows we did :'Z not cut into his drain field. This matter was discussed further. and it was decided that Mr. Ritter would provide Mr. Fuller with a copy of the sketch showing just how the road was built . Mayor Rollins thanked Mr. Fuller for giving the easement the Town needed for this construction and assured him that, if we have done anything to interfere with this drain field; the Town will correct it . Town Manager Ritter reported the following : (1) Regarding the Edwards Ferry Road Project , Tri-County Asphalt is not anxious to be paid any more this year for tax reasons , but the appropriation for the final payment should be made so that this can be paid when the time comes . We do not yet have Mrs . Carr ' s final check. The total cost of the Project was a little less than what we had. esti- mated, which was $ 138 ,492 . The actual cost was $135 ,235 , or a differ- ence of $3 ,257 less than estimated. Mrs . Carr is paying $69,650 and Mr. Wallace $18 ,448 ( he has made his payments) . The Town 's cost was $47 , 136 . (2) The Resolution on the borrowing of $125 ,000 has been prepared by Reed, Hoyt , Washburn & McCarthy , along with several other documents . The Banks have suggested that we date the notes November 12, and to be payable on November 12 , 1971 . (3) We have hired a fourth man for the Sewer 'Plant . He has had two years of college, with a major in chemistry and biology , and has been doing lab work at the Manassas Plant . Mr. Moody reported that we should be getting Mrs . Carr 's check soon on the Edwards Ferry Road Project - the canal has been straightened out now. The status at the Sewage Treatment Plant remains about the same , they still have not been able to get Mr. Rockecharlie from Dorr Oliver here . They have advised Mr . Williams to try to get him here as quickly as possible so they can get the "bugs" cleared up. Mr. Williams said he would be here with his men when they do get Mr. Rockecharlie here in order that they might compile a "punch list ' of items that English Con- struction has to clear up. They are still having trouble with the flow meter and some of the circuit breakers are still going out . The electri- cal 'contractor is supposed to be here tomorrow morning. The reading shows about 900,000 gallons of sewage coming into the Plant at the pres- ent time , which is probably due to infiltration from the heavy rains , and this is as high as it has been so far, however, we are not positive the flow meter is registering correctly . We still need the hinges for the chlorine room doors . The last three BOD tests were 95 , 96 and 97 , but he would not want to say these readings are 100 per cent correct. 246 MINUTES OF NOVEMBER 11 , 1970 MEETING.- Mr. Moody also reported that they were supposed to get started on the Valley View Avenue Sewer Line yesterday, but bad weather has kept them from working . They are moving along on "the John Wright apartment project and he is keeping a check on this job. Councilman Wallace asked if anything is being done to bring the Town-Code up-to-date. Mr . Ritter explained that this is being worked on, but it is a tedious job and requires complete concentration, but we are are working on it when possible . Mr. Wallace also asked if we have received the tax returns on the Airport. Mr. Ritter said we have received the one from last year, which shows a loss , and he is still working on this year ' s . Mr. Wal- lace said Mr . Rawls is doing nothing on the Cable TV at this time . Councilman Murray briefed Council on the activities of the Northern fer a ipp al st is Pl]anning Commission, of which he is a member, pa1ssonr6pdrteed tooudoun'County" is the only body in the area which has not joined the Commission and Council discussed the County 's posi- tion in this regard. Mr. Ritter reported that he has received a letter from HUD stating that they are reviewing our application for a Federal Grant on our Water Project as quickly as possible before advising that we make a formal ap- plication for same . Mayor Rollins turned over for the files copies of various papers from the Hospital, whereby they are applying for Federal funding. On motion of Councilman Pumphrey, seconded by Councilman Orr, the following resolution was unanimously adopted, after explanation by Councilman Pumphrey that it appears that Rev . Hite is jdstified in this request, and Councilman Hill also expressed his views on this situation : WHEREAS, a request was made by Holy Trinity Lutheran Church to change the centerline marking on Route 7 in front of the Church to provide a No Passing zone , and WHEREAS, a subsequent study was made by the State Highway Department , whose report stated that, because of the 35 mile posted speed limit and ample sight distance from the Church entrance both east and west, no change could be made in the centerline marking , and WHEREAS , the Church has requested that the Town reopen the matter because of a continuous dangerous traffic situation caused by traffic coming onto Route 7 from. the Church, NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Town of Leesburg , that the State Highway Department be re- quested to re-study this matter to determine if some change can be made in the passing zone , or, by the erection of suit- able warning signs , the traffic hazard can be lessened. On motion of Councilman Howard, seconded by Councilman Hill, the following resolution was unanimously adopted: WHEREAS , the Leesburg Garden Club recently undertook a land- scaping project in front of the Town Office Building, and WHEREAS, the project has been completed with the assistance of Charles L. Otey, Resident Manager of the Westmoreland Davis Foundation, Mr. and Mrs . W. Hugh Peal and Mr. Frank Marr, NOW, THEREFORE, BE IT RESOLVED by the Town Council of the Town of Leesburg , that the Council wishes to express its thanks to the Leesburg Garden Club, Mr. Otey , Mr. and Mrs . Peal and Mr. Marr for the time , effort and interest shown in this beau- tification project, which has greatly improved the entrance into the Municipal Building, and is a project that the citi- zens of Leesburg are proud of. 247 MINUTES OF NOVEMBER 11 , 1970 MEETING. On motion of Councilman Wallace , seconded by Councilman Murray, the following resolution was unanimously adopted : BE IT RESOLVED by the Town Council of the Town of Leesburg, that an appropriation be made in the amountof $23 ,501. 11 to pay Tri-County Asphalt Co . for final payment on the Edwards Ferry Road Project . On motion of Councilman Wallace , seconded by Councilman Howard, the following resolution was unanimously adopted, after explanation by Tow') Attorney George Martin that the Banks ' attorneys did not wish to -111 ' handle the papers on these loans and that it should be done by the Bonding Attorneys : WHEREAS , the Town Council as of June 15 , 1970 adopted an ordi- nance entitled "An Ordinance authorizing the issuance of $1 ,500 ,000 of Bonds of the Town of Leesburg to finance the cost of enlarging , extending and improving the Town ' s Water and Sewer System and providing for the submission of the question of issuing said Bonds to the qualified voters of said Town" , authorizing the issuance of $1, 500,000 Water Bonds of J the Town of Leesburg ; and the Town Council desires to borrow CD money in anticipation of the issuance of said bonds ; NOW, THEREFORE, CZ BE IT RESOLVED by the Town Council of the Town of Leesburg as follows : (1) The Town of Leesburg shall borrow, pursuant to the Public Finance Act of 1958 of Virginia , the sum of $125 ,000 in anticipation of the issuance of $1 ,500,000 Water Bonds authorized by an ordinance entitled "An Ordinance authoriz- ing the issuance of $ 1,500,000 of Bonds of the Town of Lees- burg to finance the cost of enlarging, extending and improv- ing the Town ' s Water and Sewer System and providing for the submission of the question of issuing said Bonds to the quali- fied voters of said Town" , adopted by the Town Council on June 15 , 1970 and approved by a majority of the qualified voters of the Town at an election duly called and held on July 14, 1970, to finance the purposes specified in such ordi- nance . In order to borrow said sum the Town of Leesburg shall issue its negotiable notes of the principal amount of $125 ,000 dated November 12 , 1970 and payable November 12 , 1971 . Each of said notes shall be designated "Water Bond Anticipation Note" . (2) Said notes shall consist of two notes of the denomination of $62 ,500 each, numbered 1 and 2 , bearing interest at the rate of 42% per annum payable at maturity. Note numbered 1 shall be payable at First & Merchants National Bank, Leesburg , Virginia , and Note numbered 2 shall be payable at Peoples National Bank, Leesburg , Virginia . (3) Said notes shall be issued in such form as may be deter- mined by the Mayor. and Clerk of Council of the Town who are hereby authorized and directed to cause said notes to be pre- pared and to execute said notes . (4) Said $62 ,500 Water Bond Anticipation Note , numbered 1, when it has been prepared and executed, shall be delivered to 111 the First & Merchants National Bank, Leesburg , Virginia , which has agreed to purchase said note at a price of par and inter- est accrued to the date of delivery thereof . (5) Said $62 ,500 Water Bond Anticipation Note , numbered 2 , when it has been prepared and executed, shall be delivered to the Peoples National Bank , Leesburg , Virginia , which has agreed to purchase said note at a price of par and interest accrued to the date of delivery thereof. '248 MINUTES OF NOVEMBER 11 , 1970 MEETING. There was some discussion as to whether this money should be placed in a separate account , but no action was taken with regard to this . On motion of Councilman Wallace , seconded by Councilman Pumphrey , the following resolution was unanimously adopted: BE IT RESOLVED by the Town Council of the Town of Leesburg , that the following appropriations be made : • (a) $ 240 .00 - Edwin E. Beaver for hanging new guttering and downspouts at Town Office Building. ' Capital Outlay - Town Office Building. (b) 603 . 90 - Eastern Water Works Supplies for two (2) 12" valves for new water line at By-Pass . 1969 Bond Issue . (c) 10,797 . 96 - Lynchburg Foundry Co. for 12" pipe at By- Pass . 1969 Bond Issue .
