MINUTES OF REGULAR MEETING OF LEESBURG TOWN COUNCIL, FEBRUARY 10, 1971 .
A regular meeting of the Leesburg Town Council was held in the
Council Chambers , 10 West Loudoun Street, Leesburg , Virginia, on Febru-
ary 10 , 1971 at 7 :30 P.M. The meeting was called to order by the Mayor,
with the prayer by Councilman Howard. Those present were : Mayor Ken-
neth B . Rollins , Councilmen G. Dewey Hill , Frederick R. Howard, Walter F.
Murray, Robert A. Orr, John W. Pumphrey and John A. Wallace , Jr. ; also
Town Manager James W. Ritter, Jr. and Town Attorney George M. Martin .
The Minutes of the meeting of January 27 , 1971 were approved as
written .
Town Manager Ritter reported the following :
(1) The supplemental appropriation being asked for for Sewer
Plant Maintenance is due to the fact that it was impossible to estimate
how much it would take to operate the Plant for a year, plus the fact that
there has been a considerable amount of material bought that was necessary
to get the Plant started.
(2) The appropriation to Perry Engineering Co . on the Valley View
Sewer Line will make a total paid to Perry of $13 , 986 .05 , with the Town
retaining 10 per cent of the contract price ($1,554 .00) until permanent
paving of the street has been completed. The total cost of the Sewer Line
is $15 ,540.
(3) The supplemental appropriation being requested for Vehicle
Maintenance is to be applied to the complete overhaul of the truck, which
is six years old and has never had anything done to it .
(4) The supplemental appropriation requested for gas at the Sewer
Plant is due to the fact that not enough gas has yet been built up in the
digestors to furnish any for the Plant - the approximate cost per month;
is $350 .
(5) The $3 ,000 certified check from Mr. Crickenberger will be re
tained until such time as all work has been completed in Sec . 1 of
Country Club Subdivision.
(6) He explained just how the proposed l'k% monthly servicecharge
would apply to overdue water bills .
(7) Mr. Moody and he met with Colonel Valentine at the Hospital
the other day to discuss the possibility of the Hospital contributing
toward the cost of the storm drain from Market Street to a point below
Loudoun Street . While there , Col. Valentine discussed this briefly with
two members of the Board and they are willing to discuss this at their
next Board meeting, however, they were not too optimistic .
Councilman Orr said he had talked with Colonel Valentine today and
he told him that the Hospital certainly wants to do its part. He men-
tioned a figure of $18 ,000, but this was no commitment. He indicated
that they want to go along with the Town and it sounds like the Board
will be cooperative.

Councilman Hill expressed to Mayor Rollins and his wife the con-
gratulations of the Council on the birth of their daughter.
Councilman Hill also talked with Col. Valentine this morning and,
although he made no commitment , it was implied. He said he was anxious
to see the Town get started on the road to the Hospital.
Councilman Howard said he understands there is a possibility of
negotiating a settlement with the Purcellville Bank and the State on
the Potters Field case in order to bring this case to a close, rather
than dragging it out over a long period of time and running up Court costs .
Town Attorney Martin said he understands this is a possibility and that
he has written a letter, stating that he would go along with certain parts
of the Stipulation of Facts filed by the other side , however, he cannot
agree with it in whole. He has not yet heard from this letter. Council-
man Howard asked that Council give this matter some thought and perhaps
the Town Attorney and he can work up a resolution to be considered at the
next meeting.

Councilman Pumphrey asked the status of the Hospital Road at this
time . Mr. Ritter said Mr. Downs was here last week and they went over
the site for the Hospital Road and also the site needed for the Filtration
Plant on the Rust property . He will have a report for us within the next
couple of weeks . Mr. Ritter said the Town still has some design work to
be done on the Hospital Road, but they have been waiting on the weather
in order to do the work on the ground. Mr. Kline has finished his ap-
praisal on the Hospital Road, but not on the• Rust tract yet. Town At-
torney Martin said we will have to have complete construction plans be-
fore a condemnation suit is filed.

Councilman Pumphrey also asked about the site for the Water Treat-
ment Plant. Mr. Ritter said VEPCO has said we could have 25 feet of their
easement on the Rust property, but he believes we should give this some
thought . We still have to go back to the Rusts anyway for other land and
it appears that we might just as well go ahead and get the 50 feet from
them. We have no way of knowing what VEPCO- might do over the next several
years . This should be• decided pretty quickly though so the appraisers
can complete their appraisals .
Mayor Rollins commented that it doesn ' t look as though the treatment
c.0 put on Catoctin Circle was of too much benefit, it is already breaking up.
Mr. Ritter said he believes we will have to' tear up the old pavement .
When this street was put in in approximately 1960, there were no CBR-10
,� requirements and the Town had no Standards - it looks like it was a de-
fective subgrade . This is the worst winter weather we have had for a
long time too - the ground is saturated and, together with the constant
freezing and thawing, it is really working on the roads .
On motion of Councilman Orr, seconded by Councilman Wallace, the
followingSresolution was unanimously adopted:
BE IT RESOLVED by the Town Council of the Town of Leesburg ,
that the following appropriations be made :

$1,000.00 - Supplemental Appropriation for Sewer Plant
Maintenance .
3 ,604. 95 - Perry Engineering Co. - Payment #2 on Valley
View Sewer. Utility Fund-Capital Outlay.
On motion of Councilman Wallace , seconded by' Councilman Murray, and
there being no objection to considering this tonight, the following reso-
lution was unanifnouslyadopted:
BE IT. RESOLVED by the Town Council of the Town of Leesburg, that
the following appropriations be made :
$ 500 .00 - Supplemental Appropriation for Vehicle Mainte-
nance - Water & Sewer Department .
1,000.00 - Supplemental Appropriation for Gas at Sewer Plant.
Mr. Moody said we will probably be able to use gas from the digestors
at the Plant by spring , but it is at least two months off.
Mayor Rollins asked Councilman Murray if he had any report from
either the Eight District Planning Commission or the Leesburg Planning
- Commission. Mr. Murray had no report to make'.
' Mayor Rollins also asked if we have replaced the last Police Officer
yet. Mr. Ritter said we' have not, we have no applicants . He said he
talked with an officer from Arlington the other day who is anxious to come
here. He graduated fourth in a class of 24 from the Northern Virginia
Police Academy. He said he had not really tried to get anyone yet.
The Mayor also asked if any schedule on sidewalk, curb and gutter
projects has been worked up yet. Mr. Ritter said they will work on this
pretty quickly now in order that they might get started on them when we
get good weather.

Councilman Howard asked what the problem was with water bubbling
up out of Edwards Ferry Road the other. morning. Mr. Ritter said the
sanitary sewer was stopped up at the corner of Edwards Ferry Road and.
Catoctin Circle . This has been stopped up numerous times , with damage
to the Rollison residence one time , but he has heard nothing about any
damage this time . Councilman Howard said he was referring to a spot at
approximately Mayfair Drive or a little further down . Officer Kidwell
said he had called Mr. Keyes about this when he saw it , it was a sewer
stoppage and was repaired very quickly .
On motion of Councilman Howard, seconded by Councilman Hill, the
following resolution was offered:
WHEREAS, Winston M. Crickenberger has deposited with the Town
of Leesburg the following notes :
(1) Notes Nos . 3 , 4, 5 , 6 , 7 , 8 and 9, each dated April 27 ,
1966 , and each in the amount of $4,500.00, secured on Lots
26 through 37 inclusive, Section One , Country Club Hills Sub-
division, Loudoun County , Virginia, each note executed by Bow-
man & Boley, Inc . Each of the above described notes is pay-
able to James E . Hoyle and Winston M. Crickenberger, and as-
signed by James E. Hoyle to Winston M. Crickenberger.
(2) Note dated July 12, 1966 , in the principal amount of
$22 , 100.00, executed by Bruce F . Lipes and Whitney R. .. Lipes ,
secured by deed of trust on real estate in Loudoun County,
Virginia , said note being payable to James E. Hoyle and Vir-
ginia P. Hoyle , his wife, and Winston M. Crickenberger and
Julie M. Crickenberger, his wife, and assigned by. James E.
Hoyle and Virginia P. Hoyle , his wife, to Winston M. and
Julie M. Crickenberger, and
WHEREAS, the above notes were deposited with the Town to
cover physical improvements on 40 lots in Sec . 1 of Country
Club Subdivision, and
WHEREAS, all physical improvements have been made, with the
exception of the laying of approximately 100 feet of 8-inch
water line and building driveway into pump house lot, and
WHEREAS , Mr. Crickenberger has deposited with the Town of
Leesburg a certified check in the amount of $3 ,000.00 to
cover estimated costs of work yet to be done ,
NOW, THEREFORE, BE IT RESOLVED by the Town Council of the
Town of Leesburg , that the Town Treasurer be instructed to
turn the above notes over to Mr. Crickenberger, and
BE IT FURTHER RESOLVED, that the Town Treasurer retain the
certified check in the amount of $3 ,000 .00 until the outstand-
ing improvements have been made , and not release it until
proper resolution has been passed by the Town Council.
Mayor Rollins asked when the stand tank is to be put in. Mr. Ritter
said this is covered by another Bond and will not be put in until he
starts on the next Section, it is included as a part of Section 2 . Mayor
Rollins also asked what the solution was to the pressure problem in the
present section. Mr. Ritter said the installation of the 100 feet of
8-inch line will be 'the solution and this is covered in the certified
check held by the Town. Councilman Hill asked if this was not dis-
cussed by Johnson and Williams previously . Mr. Ritter said he did not
recall, but this is being done entirely at Mr. Crickenberger's expense
The resolution was then unanimously adopted.
On motion of Councilman Pumphrey, seconded by Councilman Howard, the
following Ordinance was placed on the floor for discussion :
BE IT ORDAINED by the Town Council of the Town of Leesburg,
that Sec . 25-27 of the Town Code be amended to provide for a
127. monthly service charge on delinquent water bills .

Sec . 25-27 Water bills are due and payable within 30 days
from date of billing . A 1A7 monthly service charge shall
be applied to water bills not paid by the - lst of the -month
following the 30-day period, with a minimum charge of 50c ,
which service charge shall continue monthly as long as the
bill remains delinquent . A final notice shall he mailed,
together with a second billing, at the end of the -60-day -
period from date of billing , and-water service discontin-
ued if not paid in full within 10 days from date of notice ,
and
BE IT FURTHER RESOLVED that this amendment shall be effec-
tive July 1, 1971.
Mayor Rollins asked just what the present billing procedure is and Mr.
Ritter explained. A great deal of discussion followed on this proposed
Ordinance , with the result being that Council generally felt that the
service charge should go on when the .bill became 30 days old. On motion
of Councilman Wallace , seconded by Councilman Orr, Council voted unani-
mously that this Ordinance be recommitted to the Utility Committee, to
be redrafted and reported back at the next session.
Councilman Wallace mentioned the bad condition of the old Hotel
Building. Mayor Rollins asked that a resolution be prepared for considera-
7 tion at the next session of Council regarding this .
On motion of Councilman Murray, seconded by Councilman Orr, the meet-
ing was adjourned at 8 :20 P.M.
