HomeMy Public PortalAbout1971_06_09 MT, -327 MINUTES OF REGULAR MEETING OF LEESBURG TOWN COUNCIL, JUNE 9, 1971 . A regular meeting of the Leesburg Town Council was held in the :s. Council Chambers , 10 West Loudoun Street, Leesburg , Virginia on June 9, 1971 at 7 :30 P.M. The meeting was called to order by the Mayor, with Councilman Howard offering the prayer. Those present were : Mayor Ken- neth B. Rollins , Councilmen G. Dewey Hill , Frederick R. Howard, Walter F . Murray, John W. Pumphrey and John A. Wallace , Jr. ; also Town Manager James W. Ritter, Jr. and Town Attorney George M. Martin. Absent from the meeting was Councilman Robert A. Orr. The Minutes of the regular meeting of May 26 , 1971 were approved as written. 111 Town Manager Ritter reported the following : (1) Mr. Chester Williams owns the property adjoining the old Sewer Plant property and expects to have a proposition to offer on our prop- erty very shortly, he is interested in buying it . (2) We received a proposition from the Highway Department on the sale of their land at the old Residency . This will be considered by the Finance Committee at its meeting . ' (3) With regard to our application to HUD for funds for the Potomac River Water Project, a copy of a letter to Johnson and Williams has been az received, which states that the Town failed to meet the criteria of cer- : tain categories in the application. We have to meet this criteria before L7 the project can be considered for funding . He feels that some of this is ridiculous , but they are working on it and trying to come up with enough points . In connection with this , Mayor Rollins read a letter re- ceived by him from Johnson and Williams, outlining this problem. He asked what we are lacking in our application . Mr. Ritter explained that it is rather technical, but includes such items as need for housing ; planning , zoning and welfare . He said it is amazing that they should take these things into consideration . This information will be furnished to the engineers when it is completed. Councilman Hill suggested that perhaps a copy of the letter considering this an impoverished area might IIIbe included, however, it was brought out that this dealt:. with Loudoun County as a whole , not just the Town of Leesburg . Mayor Rollins read a letter from Mr. Kenneth L. Lawson, a resident at 11 West Cornwall Street, who voiced his objections to the experi- mental light in front of Leesburg Restaurant on King Street and asked that the present lights be retained in keeping with the colonial atmos- phere of Leesburg. Councilman Wallace asked if the Bank is going along with the increase in interest rate .on the Airport Bonds . . Mr. Ritter said they are . Mr. Wallace also asked if any more thought has been given to the investment of the money in the Airport Account . Mr. Ritter said he believed we should wait until we adopt the Budget. • Councilman Wallace also asked how many cuts will be necessary to run the water and sewer lines to the town houses being erected by Buddy diZerega on Dry Mill Road. Mr. Ritter said there have been two cuts so far and there will be one more , with a 6-inch line , this making three al: together. It took all day to make one cut due to the fact that they had to go across the road and the sewer is deep there . It is the responsi- bility of the Town to bring the line to the property line . They will have to go perhaps 25 feet on the water line . Councilman Pumphrey asked if we have received any bids on the cement work yet. Mr. Ritter said the contractors say they cannot get anybody to break out the present concrete , so the Town has asked for the concrete work only and the Town will do the breaking out . We can save money on this but there is the question of the time that will be involved. Mr. Pumphrey also asked about the Yates project, for which the money has been ap- propriated. Mr. Ritter said Mr. Moody said today that it will be done as soon as possible . • Mayor Rollins asked the progress of Dewberry, Nealon and Davis on the Hospital Road. Mr. Moody reported that Mr. Bengtson said they would have plansreadyby the end of the week. x g 328. . ' • MINUTES OF JUNE 9, 1971 MEETING . Mayor Rollins asked Town Attorney Martin if he has all the informa- tion he needs to file the condemnation proceedings on the Rust property. Mr. Martin said he was trying to determine just who to sue in this case . He also asked if Council did not feel that the land for the road should be bought , rather than asking for just an easement. Mr. Ritter said that, generally, an easement is all that is required for a road, but he saw no reason why we should not buy it - it would not serve anyone else. Mr. Martin recommended that the Town buy it outright and suggested that Mr. Kline , the low appraiser on this property, be asked to reappraise it , in- cluding the land for the road. He also believed the resolution would have to be changed to consider the new offer. Councilman Hill said this,` would just mean another delay. It was suggested that the condemnation suit be instituted and concluded and then, if the Town is still inter- ested in buying this land, an offer can be negotiated at that time. Mr. ' Martin said he would proceed with the condemnation on an easement basis then. Mayor Rollins asked Mr. Moody for a progress report on the project on Edwards Ferry Road. Mr. Moody reported that they have proposed a chain link fence to surround the swale . Mr. Ritter has talked with Mr. Monahan and told him that the Town has not decided anything definitely yet. Representatives of this project will appear before the Utility Committee next Monday. Mr. Moody said he will recommend against accepting this . Mayor Rollins voiced his objections to any storm drainage on top of the ground - he believes this construction should abide by other construction in Town, even though it is not a subdivision, and he hopes the Town will require them to put this water underground. Mr . Moody said he believed they have taken the position that, if they put the pipe underground, the soil will settle underneath because of the unstable situation. He thinks they must prove this by a geologist or an engineer. Mayor Rollins said that, on this theory, then the building would sink. Mr. Moody explained that the buildings are 50 feet away from this proposed swale ; also that any settlement would take place during a 90-day period. Parking is to be on both sides of the apartments, so we are not requiring any more fill than what they are putting on the parking areas . Councilman Howard asked if the Town would be responsible if the building collapsed. Mr. Moody explained that they have hired very good engineers and told them what they must do to protect this project, otherwise , he did not believe FHA would approve it . Councilman Hill said he believed that, if the Town has responsibility on soil erosion, it would certainly have responsibility on this too. Mr. Moody said they have gone to considerable expense to make sure this is safe - the cavern is about 20 feet deep. Mayor Rollins recognized and welcomed Mr. Henry C. Mackall, a candi- date running for State Senate . Mr. Mackall responded by saying he merely was in attendance to observe the Council in action. A Public Hearing on the Proposed Budget for fiscal year ending June 30, 1972 was held at this time , with no-one appearing for or against the Bud- get. Motion was made by Councilman Murray, seconded by Councilman Wallace, that the Budget be adopted as proposed. Councilman Pumphrey moved to amend the Police Clerk 's salary from $5 ,300 to $5,600 . This motion was seconded by Councilman Howard. Mr. Ritter explained that this was a mistake on his part, most of the employees were raised $500 . He explained that she does work for him at times , keeps all leave records on all employees , as well as taking testimony at night when needed and attending Court twice a month at night . He recommended that her salary be increased to $5 ,500. The mo- tion to amendithis salary to $5 ,600 was defeated and, on motion of Coun- cilman Pumphrey seconded by Councilman Howard, the Police Clerk 's salary was amended to $5,500 . This motion was unanimously adopted and the Budget, as amended, was then unanimously adopted. A copy is attached hereto . On motion of Councilman Howard, seconded by Councilman Murray, the following Ordinance was unanimously adopted : V'BE IT ORDAINED by the Town Council for the Town of Leesburg, that the following taxes be and they are hereby levied for the fiscal year beginning July 1, 1971 and ending June 30, 1972 for the support of the municipal government, the payment of inter- . est on municipal debts and other municipal purposes as follows : XRR 329 MINUTES OF JUNE 9, 1971 MEETING. 1. The tax on all taxable real estate shall be at the rate of Ninety Cents ($ . 90) on every One Hundred Dollars ($100.00) of the assessed value thereof. 2 . All tangible personal property, including the tangible per- sonal property separately classified by Sections 58-829. 1, 58-829.2 and 58-829.3 of the Code of Virginia , excepting there- from household goods and effects, shall be taxed at the rate of One Dollar ($1.00) on every One Hundred Dollars ($100.00) of the assessed value thereof. 3 . All tangible personal property of all railroad, express , telegraph, telephone, power and other public service corpora- tions shall be taxed at the rate of One Dollar ($ 1.00) on every One Hundred Dollars ($100.00) of the assessed value thereof, and taxable real estate of said public service corporations shall be taxed at the rate of Ninety Cents ($ . 90) on every One Hundred Dollars ($100 .00) of the assessed value thereof. 4. The tax on all bank stock subject to taxation within the Town of Leesburg shall be at the rate of Eighty Cents ($ .80) on each One Hundred Dollars ($100 .00) of the taxable value of O the share of the stock in any bank located in the Town of Lees- ,. burg , subject to the provisions of Section 58-476 .2 of the 1950 Code of Virginia , as amended. Mr. Harrison Williams , III , First Lieutenant of the Loudoun County Rescue Squad, addressed Council, stating that the members present tonight - Mr. Fred Myer, Mr. Howard Willis and Mr. Ed Kitts - were appointed to try to find land in the area of Leesburg on which to erect a building to house the equipment of the Squad. Leesburg has been chosen as the area in which to build since most of the calls are in this area . He pointed out that, as the population of the County expands, so the calls become more numerous and frequent. Using a chart prepared by members , Mr. Williams pointed out the areas in which calls have been answered, as well as the types of calls . The area which this particular Squad covers is the largest in the area, having handled around 600 calls last year, and expected to exceed 1,000 calls this year. This committee has been given 90 days in which to bring back to the Squad a recommendation for expanding their operations . They asked that the Town consider donating one-half acre on which the old Sewer Plant was located. They are now operating out of the County Build- ing , which is very small and which the County expects to take over soon. Also, they can get only one vehicle in the building. They are completely a voluntary and non-profit Squad, depending on the Town and the people living in it to help them keep the people alive . They would like to erect a building which would be an addition to the community and that will serve everyone as well. Mr. Fred Meyer then presented a sketch of the old Sewer Plant property, pointing out the portion they wish to utilize, which would run down the old fence in the southwest corner of the property. In this way, they would be saving the Town as much frontage as possible . They feel that a mini- mum of one-half acre would be required to house their equipment and for future expansion. Their members are scattered all over Town and it would take a little longer to get to the vehicle , but this would be a pretty central location from all points . The building, as now planned, would consist of a minimum of three (3) bays , plus a wash rack, which could be used for a 4th bay, plus recreational area . This would be necessary since they feel it will be necessary for them to operate 24 hours a day before long and to have the Squad headquarters manned for a 24-hour period. Mayor Rollins asked Mr. Ritter if Mr. Chester Williams had made the the Town a proposition on this land. Mr. Ritter said Mr. Williams had been to see him and expected to have a proposition very shortly. Councilman Wallace asked if the Squad members have checked into the possibility of using a portion of the Fire Department 's land. Mr. Meyer said the Fire Department wants to sell their land as a single tract. Councilman Wal- lace also asked if the intersection at Route 7 and Catoctin Circle does not concern them. Mr. Myer said it does , but they have a bad situation where they come out now too. Councilman Hill said they had this problem when he was active in the Squad and he feels the Police Department could control traffic at this location. He also said he has seen the area draw- ing more and more to the center of Leesburg , although he is an inactive member of the Squad now, and he would certainly be in favor of helping the Squad in any way they can . Max 330 MINUTES OF JUNE 9, 1971 MEETING. Councilman Howard asked Mr. Ritter if he has checked this location insofar as the use of the rest of the land is concerned. Mr. Ritter said he had not seen the drawing until tonight , but they have a total of 4. 27 acres , with a lot of it being in the flood plain. Mr . Meyer pointed out that they picked this particular location because they felt it would be the piece the least valuable to the Town. They would probably be in a position to start construction by the end of the year and be in it by this time next year. Councilman Hill said he has other reservations about this property - he thinks perhaps the Town should hold onto this property and perhaps make it a park and recreational area and he feels that the Squad mem- bers would help with such a project. Mr. Ritter pointed out that the Town now has a lot which is projected as a recreational area, this be- ing the lot donated to the Town by Mrs . Lorraine A. Fletcher for this purpose . Rgesaid the Town forces have hauled a lot of brush from this property an /has written to the Department of Parks and Recreation to see if they would be interested in operating it, with the Rotary Club to equip it. Mayor Rollins asked if the Town has ever accepted this Deed by formal resolution . Mr. Ritter said it has been recorded and a plat re- corded with it, but there has been no formal resolution. He said he would send a copy of this Deed to all Council members . There was some further discussion concerning the use of the old Sewer Plant property by the Rescue Squad and the Chair referred this matter to the Laws and Administration Committee for its meeting next Tuesday at 4 :00 P.M. He also asked that Mr. Ritter contact Mr . Williams to see what proposition he might have so that it can all be brought out at this meeting. On motion of Councilman Murray; ._seconded by Councilman Wallace , the following resolution was unanimously adopted: BE IT RESOLVED by the Town Council of the Town of Leesburg , that the following appropriations be made : $249. 96 - Supplemental Appropriation - Town Council 83 .33 - Supplemental Appropriation - Mayor 183 .33 - Supplemental Appropriation - Town Attorney 100 .00 - Supplemental Appropriation - Police Judge 37 .50 - Supplemental Appropriation - Fire Marshal 500.00 - Supplemental Appropriation - Other Services & Supplies . On motion of Councilman Hill , seconded by Councilman Pumphrey, the following resolution was offered: BE IT RESOLVED by the Town Council for the Town of Leesburg, that English Construction Co . be paid $100,000 on Contract S-I, and BE IT FURTHER RESOLVED, that they be advised that there are several items yet to be completed on the project, and BE IT FURTHER RESOLVED, that the penalty provision be invoked, as provided for in the Specifications, for not completing the project on time . Mr. Ritter explained that we owe English $138,000. The penalty figures out to $13,860 from October 31, 1969 until September 4, 1970, when we took over the Plant . There is roughly $12 ,000 in work that he has not done . These two items would be around .$26 ,000 and, even if we apply the penalty and he does the other work, we would still owe him about another $12 ,000 . Mr. Moody outlined the items to be completed and straightened out . There was some discussion regarding the penalty clause, with Town Attorney Martin suggesting that the contractor be advised that we expect to invoke the penalty clause , how much it is and how it was ar- rived at . The above resolution was then unanimously adopted. Mayor Rollins asked Mr. Ritter to look at the contract and see if any Notice is required. ��9C�5tx 331 MINUTES OF JUNE 9, 1971 MEETING. • On motion of Councilman Pumphrey, seconded by Councilman Hill, the following Ordinance was adopted by a roll call vote of 5 to 1, with Mayor Rollins casting the dissenting vote : BE IT ORDAINED by the Town Council of the Town of Leesburg, that a new Section be added to the Town Code , Sec . 15-56 . "It shall be unlawful for any person, firm or corporation to place or cause to be placed any circulars, bills , posters or any advertising matter on or in any vehicle while parked in the municipal parking lot or on any street in the munici- pality, nor on any tree , electric or telephone pole within the public right-of-way. " On motion of Councilman Wallace , seconded by Councilman Murray, the following resolutions were unanimously adopted: WHEREAS, the TOWN OF LEESBURGL-is the maker of a certain bond numbered 6 in the principal amount of $27 ,400.00, bearing interest at the rate of 4% per annum, which is due and pay- able July 1, 1970 ; and U WHEREAS, the FIRST & MERCHANTS NATIONAL BANK, Leesburg, Vir- ginia is the holder and owner of said bond; and na WHEREAS, the TOWN OF LEESBURG has requested an extension to July 1, 1972 for the payment of the principal amount of this note ; and WHEREAS , the said holder is willing to extend the payment of said bond until July 1, 1972 if the interest thereon is in- creased to 5k% per annum; and WHEREAS, the TOWN OF LEESBURG is willing to pay this addi- tional interest of lk% for such extension . This Extension Agreement then witnesseth that the TOWN OF LEESBURG agrees that there is due on the bond whose maturity date is July 1, 1970 the sum of $27 ,400 .00, plus interest at the rate of 4% per annum, and in consideration of an extension thereof to July 1, 1972 , the TOWN OF LEESBURG agrees to pay same , plus lk% additional interest until fully paid, and the FIRST & MERCHANTS NATIONAL BANK accepts this agreement on the terms and conditions for such extension. WITNESS the following signatures and seals . TOWN OF LEESBURG, VIRGINIA By (SEAL) Mayor - .
