1, INITIATION: The regular meeting of the City Council was called
to order by Mayor Tyrell at 7:30 P. M. The Mayor the led the

3, INVOCATION: Invocation was given by Rev. Roger Hillis of the
Westminster Presbyterian Church, 9642 Live Oak Ave., Temple
City.
4, ROLL CALL:
PRESENT: Councilmen - Dickason, Fitzjohn, Merritt, Munamaker,
Tyrell
ABSENT: Councilmen -None
ALSO PRESENT: City Attorney Shatford, Administrative Assistant
Karl Koski
5. APPROVAL OF MINUTES:
Councilman Dickason referred to page 4 of the minutes of Dec.
20 regarding placing key man insurance on Mr. Woollett during
his vacation, and amended the minutes to include his opinion
in opposing the motion as follows: "Councilman Dickason opposed
the motion on the grounds that the City finances were sound
and that a perpetuation of this City's operation was not de-
pendent upon this type of thing, and that in his opinion this
was tantamount to gambling with public funds." Also he felt
in split votes the various opinions of the Councilmen should
be stated in the minutes. In additionand following the vote
he added "the motion failed to carry" Councilman Merritt
moved to approve the minutes of December 20, 1962, as amended,
Councilman Fitzjohn seconded, and roll call vote as follows:
AYES: Councilmen - Dickason, Fitzjohn, Merritt, Nunamaker,
Tyrell
NOES: Councilmen -None
ABSENT: Councilmen -None
At this Time Mayor Tyrell requested Mrs. Russell Ludwig to come
forward and presented a Certificate of Recognition for services
rendered the City by Russell Ludwig as a Commissioner on the
Planning Commission, which Mrs. Ludwig accepted on behalf of
her husband who was unable to be present.
8. STATUS REPORT OF CIVIL DEFENSE COMMITTEE:
Councilman Dickason reported on the second meeting of this Com-
mittee. Consideration was given to change from Area D to Area'
B as most of the City services are from the County. However
after checking it was found to be not feasible at this time so
we will align ourselves very strongly with Area D, As the sur-
vey is completed a written inventory will be prepared of the
following: public shelters, food, blankets, storage, Doctors,
Pharmacists, nurses, and heavy equipment within the City. Mr.
Dick Sale reported on the existing alarm system, that present
siren would have to be increased by 2/3 of what it now is in
order to cover the City. He suggested the Council ask for bids
for a warning system for the City,to be considered in next an-
nual budget. fie recommended to the Council that as soon as
possible the light warning system be installed at City Hall
by the Telephone Company and that there was money in the budget
to pay for this installation, Councilman Nunamaker moved to
have the stafF investigate costs of a warning system for the

6. ORDINANCE NO. 62 -97: Urgency Ordinance.
City Attorney Shatford read in full Ordinance No. 62 -97

CONTINUANCE OF THE CITY COUNCIL IN THE EVENT OF GREAT PUBLIC
CALAMITY. Councilman Fitzjohn moved to adopt Ordinance No.
62 -97, Councilman Dickason seconded, and carried by the followin,-

CITY OF TEMPLE CITY. Councilman Nunamaker moved to adopt Ordi-
nance No. 62 -99, Councilman Dickason seconded, roll call vote
adopting the ordinance as follows:

9, APPOINTMENTS TO FILL VACANCIES ON PLANNING & PARKS AND RECREA- -
COMMISSIONS: Following discussion Councilman Fitzjohn mov-
ed to adjourn this meeting to a personnel session of the Council
on Wednesday, Jan. 16, 1963, at 7:30 A. M. at Sugar's Restaurant,
Councilman Merritt seconded, and carried.
10, PUBLIC HEARING: 8 :00 P. M. Appeal on Zone Variance Case #62 -41.
Planning Advisor Ray Cushman advised the Council that this appeal
concerned a property at 10048 Olive St. and the request was for
3 building sites each with less than the required area of square
footage. Also the area from Baldwin Ave. to Arden and Olive to
Green Sts, are all zoned A -1 -1 acre and there is not one one
acre lot in the area,
Mayor Tyrell declared the Public Hearing opened and asked if
anyone in the audience wished to speak against granting of this
variance.
Robert Ingram, 5317 Zadell St„ requested the Council to consid-
er a delay in granting this variance stating the majority of -
property owners in the area desire a study of the possible de-
velopment oF the entire area with proper drainage, dedicated
streets, -and would improve the entire area to mutual benefit of
all land - owners'in the area. -
Dick Lucas, 530) Zadell St., was opposed to back -yard building
and felt it would cause all their properties to decrease in value
Mayor Tyrell read a letter dated Nov. 26, 1962, in Favor of the
protestants for the record signed by the following:
Robert J. Ingram, 5317 N. Zadell Ave.
Richard Janda, 5325 N. Zadell Ave.
Richard Eben Lucas, 5301 M? Zadell Ave.
W. R. Boren, 5311 N. Zadell Ave.
Mrs. W. R. Boren, 5311 N. Zadell Ave., also was in favor of de.
laying the variance approval to give the property owners an
opportunity to have a subdivider prepare a proposed development
of the entire area.
No one else came forward to speak in favor of the appeal and the
Mayor asked if anyone wished to speak in favor of the variance.
Mrs. Tolbert, owner of the property involved which is in escrow -
with the Van Pettens' the purchasers, spoke in favor oF the pro-
posed developments,.

Thomas Mcllroy, 10014 Olive St., spoke in favor of the variance.
Mrs. Van Petten, 11752 Coldbrook Ave., Downey, purchaser and
developer of the property advised they proposed to build Fine
homes of 3 bedrooms and 2 baths with a patio, landscaped and wit:
plenty of play area for children, and also meeting the parking
requirements, and felt their plan would be a great improvement
to the area.
Wm. Harker, Chairman of the Planning Commission, explained the
procedure of the Planning Commission lc arantirg his variance,
and also advised the Council that t :e Commission was not made
aware of any efforts to develop a subdivision or any ^ther use
of the land..The Commission felt these people had the right to
develop their property, and felt these properties could be de-
veloped nicely on an individual basis. Also allegations that
this area might be re -zoned to R -1, R -2, or R -3, had no founda-
tion as at the present time
City Attorney Shatford advised that based on this development
the Council might like to hold the Public Hearing open. At the
Public Hearing before the Planning Commission no suggestions
were made as presented to the Council tonight. Also the people
appearing here tonight about developing their own property were
adamant in retaining their property as it was, and are appealing
the decision rendered by the Planning Commission and therefore
would have to have some sound basis for appeal. One sound ob-
jection is the Master Plan which you can consider, and the other
basis for appeal is that they want to develop their property
and denial may assist their development, and these are the only
reasons for reversal of the decision of the Planning Commission.
The reason for holding this Hearing open is if these people do
have sincere intent to develop their property you could fore-
stall your decision for 30 or 60 days and request them to bring
in a plan by a developer and present to you something by which
you can logically determine whether this particular piece of
property could be included in any development.
Councilman Fitzjohn felt if there was any possible chance of a
development such as the Weber tract east of this property that
it would be good for the community and good for Temple City.
Councilman Merritt felt that there are some areas that could not
be developed in any other way, but in this area there is a possi,
bility of developing in a larger manner and for this reason he
would like to see it held over for a larger development with
dedicated streets, etc.
Councilman Dickason favored holding it over for 60 days if it
did not cause undue preseure on people presently involved.
Councilman Punamaker was in favor of holding over for 60 days
and for a development plan to be brought in for the area.
Councilman Dickason moved to hold the Public Hearing over for
,60 days until March 11, 1963, at 8:00 P. M. at the City Hall
Councilman Nunamaker seconded, roll call vote carrying the motio
as follows:

11e PLANNING COMMISSION RECOMMENDATIONS:
Tentative Tract #27787, north side or Broadway between Sultana
& Noel.
Planning Advisor Ray Cushman advised this tract was presented
to the Planning Commission who approved with the following
conditions, and recommended the Council so approve:
Design Item 3--The Street will be 36 ft. wide with a 43 foot
dedication.
Design Item 6- Provide standard three Foot sidewalks on both side:

of the street.
Design Item 7 -Add to the existing standard that the turnaround
be relocated approximately 30 ft. southerly.
Design Item 7a -Allow the backyard setbacks to be reduced to 12
feet, rather than the standard 15 -toot requirement.
Advisor Cushman also stated these lot sizes were 5000 sq. ft.
which are permitted and consistent with the area.
P. L. McNutt, subdivider, asked the Council to consider lots
8, 9, 10, and 11, on the cul de sac, and that the setback for
these lots be reduced to 15 ft. to align these houses with the
houses built on down the street.
Councilman Nunamaker moved to approve the request for set back
for the houses on lots 8, 9, 10, and 11, to align these with
the other houses to be built down the street, Councilman Fitzjohi:

Councilman Punamaker moved to approve the tentative tract map
subject to the conditions recommended by the Planning Commission
and including the above approved request, Councilman Dickason
seconded, and carried by the following roll call vote:

12. TRAFFIC COMMISSION RECOMMENDATIONS:
Item 5. Recommend 105 ft. of red curb be placed on west side of
Cloverly from the north curb line of Broadway northerly.
Item 9. Placement of "STOP AHEAD" sign on La Rosa Dr. westerly
in advance of intersection of Arden Drive.
Councilman Dickason moved to approve item 5 and item 9, Council-
man Fitzjohn seconded, roll call vote carrying the motion as
follows:

COMMUNICATIONS: Installation of DIP signs and pavement markings
on Olive St. at Temple City Blvd. Councilman Fitzjohn moved to

13. PETITION FOR CURB & GUTTER: WEST SIDE OF LOMA AVE. BETWEEN LAS

Councilman Dickason moved to set a Public Hearing for 7 :L.5 on -
January 28, 1963, at the City Hall, 9664 E. Las Tunas Dr., Coun-
cilman Nunamaker seconded, and carried by the following roll call
vote: - --

14. REQUEST FOR SALE OF MERCHANDISE DURING CAMELLIA FESTIVAL:
a. Women's Dept. of Re- Organized Church of Latter Day Saints for
baked goods sale in front of Cool's Candy Store.
b. Mens Committee, Boy Scout Troop #174, for sale of peanuts and
popcorn before and during the Camellia Festival Parade.
Councilman Fitzjohn moved to approve requests a and b, Councilman
Dickason seconded, and carried.
15. TRACT #26522, A letter from the County Engineer recommended the
City Council accept the work in the matter of the construction
of a wall on Tract No. 26522, and that the Faithful Performance
Bond in the amount of $320. for this purpose be authorized for
cancellation. Councilman Dickason moved to accept the work and
authorize the cancellation of the Faithful Performance Bond No:-
C- 7037503 for the amount of $320. in conjunction with this con-

16. RESOLUTION 'IO. 63- 258: WARRANTS & DEMANDS
Councilman Fitzjohn moved to adopt Resolution No. 63 -25n, warrar.
& demands Nos. 2154 through 2177 and 2196 through 2228, in the
sum of $20.703.93, Councilman Merritt seconded, carried by the
following roll ca-1-1 vote:

17. COMMUNICATIONS:
a. Karl Koski, Administrative Assistant, presented a letter
from the Board of Supervisors regarding the proposed incorpora-
tion of the City of South San Gabriel. Councilman Fitzjohn
moved to receive and file, Councilman Merritt seconded, and
carried.
b. Mr. Koski next presented letters from the Los Angeles County
Boundary Commission regarding proposed annexations #308, 310,
311, 312, City of El Monte. Councilman Dickason moved to receive
and file, Councilman Merritt seconded, and carried.
18. TIME FOR THOSE I M THE AUDIENCE WHO WISH TO SPEAK:
No one came forward at this time to address the Council.
19. MATTERS FROM CITY OFFICIALS:
Councilman Dickason referred to publication of temperatures in
various cities and wondered what procedure was to get a record
of the City of Temple City and what tale equipment would cost.
Following discussion it was referred to the staff for investiga-
tion.
Councilman Nunamaker referred to the beer license application oF
the Jolly Coachman. Following considerable discussion Council-
man Nunamaker moved that the City Manager be directed to inform
the Alcoholic Beverage Control Dept. that the Council request a
Hearing on this application, if any, be held within the City of
Temple City, Councilman Fitzjohn seconded, and carried by the
following roll call vote:
AYES: Councilmen - Dickason, Fitzjohn, Merritt, Nunamaker,Tyreil
NOES: Councilmen -None
ABSENT: Councilmen -None
Mayor Tyrell requested the staff also get an indication as to
what the consequences of this license would be.
Councilman Merritt recommended the staff consider traffic dip
signs on La Rosa west of Temple City Blvd. Also he commented
on the improvement of the new microphones.
Mr, Koski, Adminstrative Assistant, presented a letter from the
County Administrative office concerning deeding Temple City Park
to the City.
Mr. Koski next presented a letter from the County Engineer re-
garding the proposed street name of Craiglee St, to a street
easement running west of Golden West Ave. the alignment of which
conforms to existing Craiglee St. Councilman Fitzjohn moved to
approve, Councilman Merritt seconded, and carried by the follow-
ing roll call vote:

Mr. Koski presented a letter from the City Engineer regarding
sanitary sewers in Tract #20748 and recommended the Council
approve the work and accept for public use the sanitary sewers

constructed for said tract #20748, and to cancel the bond For
faithful performance for the construction of said sewers in the
amount of $3,000., Councilman Merritt so moved, Councilman
Nunamaker seconded, and carried by the following roll call vote

Mr. Koski then presented a letter from the City Sngineer recom-
mending the Council accept and approve the work for public use
of the sanitary sewers under private contract #6264. Councilman
Dickason so moved, Councilman Nunamaker seconded, and carried by
the following roll- call vote:
AYES: Councilmen —Dickason, Fitzjohn, Merritt, Nunamaker, Tyrell
NOES: Councilmen -+one
ABSENT: Councilmen -None
Councilman Nunamaker spoke regarding the "Good Humor" man saying
he packed his truck on Olive and several times children have
been nearly hit, and he wondered if we can move them out of the
City. Also he felt their music boxes were annoying, and he
advised he understood Arcadia had ruled them out of the City.
It wos decided to have the staff investigate and find on what
basis this can be done,
City Treasurer stated the final date for payment of the assess-
ment on the sewers on Woolley St. was Saturday the 12th and he
had nothing further. He was advised a meeting was being set--
up for the City Manager, City Engineer, City Auditor and him-
self as City Treasurer to take the necessary action to set up
the bonds for the properties remaining unpaid.
20. ADJOURNMENT: Councilman Merritt moved to adjourn to January 16,
1963, at 7:30 A. M. at Sugar's Restaurant, 600 Las Tunas Dr., --
Arcadia, Councilman Fitzjohn seconded and carried. Council ad-
journed at 10:00 R. M.
