HomeMy Public PortalAbout1973_08_22 129 MINUTES OF REGULAR MEETING OF LEESBURG TOWN COUNCIL, AUGUST 22 , 1973. A regular meeting of the Leesburg Town Council was held in the Council Chambers , 10 West Loudoun Street , Leesburg , Virginia , on Au- gust 22 , 1973 at 7 :30 P.M. ' The meeting was called to order by the Mayor, with Councilman Ridder offering the prayer. Those present were : Mayor G. Dewey Hill, jCouncilmen Walter F . Murray, John W. Pumphrey, Herbert L. Ridder, C. Terry Titus and John A. Wallace, Jr. ; also Town Manager James,W. Ritter, Jr. and Town Attorney George M. Martin . Absent from the meeting was Councilman Robert A. Orr. The Minutes of the meeting of August 8 , 1973 were approved as written. Town Manager Ritter reported as follows : (1) We have hired a new Assistant Chief Operator at the Sewer Plant , who goes to work next Monday at $10,000 per year. He worked with Ken Bedford in Pennsylvania as a technician and his references check out very good. Ken recommends him. (2) The State Highway Department has set a Public Hearing on CThursday, October 11th at 7 : 30 P.M. in this room on the Urban Proj - M ect on Rt . 7 and Catoctin Circle . c (3) He explained the proposed appropriations , recommending that the first item be deferred until he talks with Mr. Williams , and Q changing the amount of the bill owing to Southern Line Cleaning . (4) The turbine pump for the Myers Well at $6 ,880 is the last quotation we received from Sydnor Hydrodynamics and was decided upon at the Utility Coumjittee meeting and after meeting with Mr. Haber- lien of the Children ' s Center. This pump could, at some future• date, serve the Children 's Center'. (5) The resolution concerning the water tank site prepared by the Town Attorney pretty well follows the recommendations of the Utility Committee . There is also a copy of the Deed of Dedication attached, which should be reviewed and approved, in order that he can present it to Mrs . Carr for her signature. There are a few dif- ferences in the resolution from the Deed. (6) The appropriation to pay C. E . Nance & Sons $5 ,483 :00 to cover installation of inserting valves came in after the Committee meetings. We need to put in some more inserting valves and hydrants, and this will be discussed with the Committee shortly . (7) The Virginia Municipal League meets in Norfolk beginning September 16th and ending Tuesday , the 18th. He asked those who plan to attend to please let him know so that he can secure pre-registra- tion . He has 4 rooms reserved at the Holiday Inn-Scope . (8) All equipment has been ordered for the interim chemical treatment at the Sewer Plant. The::estimated cost to purchase this equipment and install it is $22 ,000 . The annual cost of chemicals will vary between $6 ,000 and $ 11 ,000, depending upon the quantity and the degree of treatment desired. (9) He tried to reach Jack Williams today to discuss the pro- posed $16 ,734.00 appropriation mentioned above , as well as to get his opinion as to whether the Dickerson plant in Maryland would af- fect our intake tower in the Potomac - .he had read in the paper that Johnson and Williams is investigating this . He also wants to find out if he has sent a survey party up here yet oh the Carr tract, and he wants to talk with him about the 275 ,000 gallon water tank which Jeffrey Sneider is to build . There was an agreement in 1968 that the tank would be built by 1973 and, when Jeffrey Sneider bought this land, they inherited this agreement . It is obviously impossible to do it in this time and we have increased the tentative size of the tank to • 1.5 million gallons . Sneider had given an estimate of $72 ,000 to e- build the tank and he had asked Mr. Williams to check this out , as well as anynoptions regarding a cash payment . 130 MINUTES OF AUGUST 22, 1973 MEETING . Councilman Titus said he had called Mr . Bengtson of Dewberry, Nealon & Davis regarding the study on the Town Branch and had re- quested a letter. A letter has been written to Mr. Ritter and he (Mr. Titus) would like to bring this up later and reintroduce the motion that was deferred at last meeting . Also , Councilman Titus called attention to the fact that no work has been done for the last two or three months on the comple- tion of Catoctin Circle by Crestwood. He recalled that this was to be completed upon approval of Sections 2 and 2-A of Crestwood Hamlet. Their bond becomes due on September 27th and he thought perhaps this should be brought to their attention. The road should be in some kind of shape before school starts and that is impossible now. It definitely should be done before the winter season so there is access to the Catoctin Elementary School. Mayor Hill said he understood the realtor wants to delay completion of the street, he feels that traffic could cause injury to people in the area . However, Mayor Hill still wants this road completed and believed a letter should be written to Crestwood concerning this . In fact , he suggested that Mr. Garrett of Crestwood be requested to meet with the Street Committee next week to firm this up . Mr. Titus said he could not see that the realtor has anything to do with this and also believed it paramount that this street be completed. Councilman Titus also wondered if the joint meeting with the County . on the phased growth program could be set up sometime soon . The night of September 11th at 8 :00 P.M. in the Council Chambers was set and to be checked out with Mr. Bolen . Councilman Pumphrey asked Mr . Ritter if he planned to contact Mr . Williams tomorrow. Mr. Ritter said it is hard to catch him in, but he will make every effort to do so . Mr. Pumphrey said, if the proposed resolution concerning the water tank site is adopted and Mrs . Carr is in agreement with the Deed of Dedication, the next move is up to Mr . Williams . Mayor Hill asked that the Clerk read a letter from Mr . Haberlein, Director of the National Children 's Rehabi=litation Center, a copy of said letter being attached hereto . Councilman Titus suggested that a letter would be in order to the Center, acknowledging receipt of this one and telling them we will be glad to serve them with water if the need is there in the future .. He was still somewhat concerned about what might happen if we pump the Myers Well . Mayor Hill agreed with this and thought the letter should say that the pump will be large enough to take care of this . Mayor Hill asked Mr. Chaves what is happening on the storm drain- age problem in Brandon - is K & M Engineering taking any corrective measures on this? Mr. Chaves said he was out there this morning with members of K & M, but their plans do not show any corrective measures . He discussed with them the fact that water flowing over the sidewalk is not good engineering practice . They are proposing to meet with Mr. Jaeger and talk about building a catch basin and a grate on the low point behind the houses that are affected, which should take care of the problem. They are also going to rework the ditches to keep the water from flowing onto other property . Mayor Hill asked if this should be dedicated before we approve a plat . Mr. Chaves said it should be - the plans on Virginia Knolls were submitted in 1971 before the Town had approved all the Standards and Specifica- tions , so it was borderline . He said Mr. Moody had these plans for approval - they were just for utilities and not complete grading plans . Mayor Hill asked if this would have been caught the way we are handling it now. Mr. Ritter explained that Mr. Moody did investi- gate it and there was a plan by K & M, prepared by deLashmutt Associ- ates , which showed a drainage ditch between Section 2 and 3 , however, the plans we have do not show this ditch and we do not know what hap- pened. Mr. Titus said it is going to be a touchy problem to work in there with all the utilities tha are there, but it needs to be done . Mayor Hill said our main concern that we have it "shored up" now: Mr. Chaves said if they do what they plan to, this will take care of the problem. 131 MINUTES OF AUGUST 22 , 1973 MEETING. Mr. Summerfield Tillett thanked Council, on behalf of his mother, for the work done in repairing the sewer lines in the vicinity of North and Harrison Streets . On motion of Councilman Titus , seconded by Councilman Wallace, the following resolution was offered: RESOLVED, that the following appropriations be. made : $36 ,834 .05 - Southern Line Cleaning for cleaning and sealing sewer lines (Utility Fund-Capital Outlays-T .V. Inspection & Sealing of Sewers) . 1, 42 . 18) _ Sydnor Hydrodynamics (2 invoices) - Repairs to 8,601 . 6) Myers Well (Utility Fund) . 6 .06 - Exspeedite Blueprint Service - Printing for month of July (1972 Bond Issue) . 0 4,500 .00 - Town Shop Improvements (General Fund-Capital CM Outlays) . . CG '� Mr. Ritter explained what had been done by Southern Line Cleaning, C74 stating that 13 , 114 feet of sewer line had been inspected, some of Q which will have to be replaced. He explained in detail just which lines had been done and which ones needed further attention. The inspection and cleaning of more lines will be discussed at the next meeting of the Street Committee . It was also pointed out that the work done on these lines has helped the situation at the Sewage Treatment Plant a great deal . The resolution above was then unani- mously adopted. On motion of Councilman Pumphrey, seconded by Councilman Ridder, the following resolution was unanimously adopted : iRESOLVED, that the Town Manager be authorized to purchase a Fairbanks-Morse Figure 6977 Water Lubricated Vertical Tur- bine Pump , as shown in Sydnor Hydrodynamics ' Quotation #08133-12 , dated August 13 , 1973, at a cost of $6 ,880 .00, to be used at Myers Well , and BE IT FURTHER RESOLVED, that an appropriation be made for this amount , to be paid from Utility Fund'-Capital Outlays . Councilman Pumphrey said this pump is capable of pumping water to the Children 's Center, and Councilman Titus said it would serve a dual purpose if we have to pump to the tank in Country Club Subdivision. Mr. Ritter said the quotation shows that it will pump 405 gallons per minute at 339 foot head TDH. With no objection voiced to considering tonight , on motion of Councilman Pumphrey, seconded by Councilman Titus , the following resolution was offered : BE IT RESOLVED, that the Town Manager be and he is hereby directed to inform Mrs . Helmi Carr, in response to her let- ter of July 17 , 1973 and after discussion regarding the de- tails , that her generous offer to donate a site to the Town I for the installation of a water tank, with a 20-foot ease- ment generally at right angles to Rt . 773 for (1) ingress and egress to that site and (2) installation and maintenance of a water main to that site , is accepted on behalf of the citizens of the Town , and BE IT FURTHER RESOLVED, that she be advised that, at this time , the precise height of the tank cannot be determined, and BE IT FURTHER RESOLVED, that Carrvale Subdivision be placed on the forthcoming priority list for water and sewer, for which the criteria for establishing priority has not yet been adopted by the Council , and 432 MINUTES OF AUGUST 22 , 1973 MEETING. BE IT FURTHER RESOLVED, that Mrs . Helmi Carr, her heirs and assigns , may establish an alternative access to the site on which the water tank is erected, and the easement for ingress and egress will become null and void, however, a 15-foot ease- ment for the installation and maintenance of the water line shall continue in full force and effect in the original lo- cation, as stated above, and BE IT FURTHER RESOLVED, that the Town will adequately fence the water tank site and erect a gate at the entrance to Route . 773 . On motion of Councilman Titus , seconded by Councilman Pumphrey, the following amendment was unanimously adopted, to be added at the end of the above resolution: and, BE IT FURTHER RESOLVED, that whenever the site is discontinued for the purpose specified, the parcel of land will revert to the dedicator, her heirs , devisees and assigns , and the Town of Leesburg will remove therefrom, at its expense , all struc- tures and installations if requested to do so by dedicator . Councilman Wallace questioned the reference to Carrvale Subdivision and the priority list in connection- with Mrs . Carr ' s gift of the water tank site, particularly , when no criteria for such a priority list has yet been established - he did not think the two subjects are re- lated . Mayor Hill said that Town Attorney Martin believed we should answer her letter in this resolution and she had stated in her letter that she understood Carrvale Subdivision was first on the list . On motion of Councilman Wallace , seconded by Councilman Pumphrey, the following further amendment was offered : "that Carrvale Subdivision will receive its appropriate place" . Councilman Pumphrey stated that Mrs . Carr has never asked for any special consideration she would have asked that this be placed on a priority list even if there had been no water tank site on her property . She has asked that they keep the tank to a minimum height. Mr. Martin wanted the record to show that she is not in first place on the priority list, as stated in her letter. It was also pointed out that the road for ingress and egress will be the most direct line to the tank. Councilman Titus asked that Mr. Williams be advised to include this road in the topo. He said Mrs . Carr would prefer that the tank be as well hidden from the road as • possible. Mayor Hill pointed out that this site and the DeMik site, which was under consideration for the tank, would have cost about the same amount of money. The above amendment was then unanimously adopted. CD On motion of Councilman Wallace , seconded by Councilman Pumphrey, C^ and after a great dealof discussion, the following resolution was Q unanimously adopted : BE IT RESOLVED by the Town Council of the Town of Leesburg , that the firms of Armfield, Harrison & Thomas and Moore, Clemens & Company be appointed as insurance consultants to the Town of Leesburg and , as such, that they be and are hereby authorized to proceed immediately with a review of all in- surance policies now in force , and BE IT FURTHER RESOLVED, that the consultants give a report to the Laws and Administration Committee of the Town Council at their earliest convenience on any recommended additions , com- binations or deletions in present coverage , and BE IT FURTHER RESOLVED, that should, during the course of their review, the consultants find that coverage is badly lacking in a particular area , the consultants are hereby authorized to issue binders to provide the necessary cover- age until such time as that coverage can be consolidated with other policies . It was noted that copies of the above resolution should be sent to both insurance companies . On motion of Councilman Pumphrey , seconded by Councilman Ridder, the following resolution was offered : WHEREAS, $5 , 925 .00 was budgeted fiscal year ending June 30, 1973 for the installation of Inserting Valves , of which $1 ,814 . 94 was spent, and WHEREAS , $2,000 .00 was budgeted fiscal year ending June 30, 1974 for this purpose, and WHEREAS , C . E. Nance & Sons has completed its contract with the Town of Leesburg , with an outstanding invoice of $5 ,483 .00 covering final payment, NOW, THEREFORE, BE IT RESOLVED, that an appropriation be made in the amount of $5 ,483 .00 to pay Nance for this work, to be appropriated from Utility Fund-Capital Outlay-Valve and Fire Hydrant Installation . There was some question concerning the amounts budgeted for the past fiscal year, as well as the amount spent , therefore, on motion of Councilman Wallace , seconded by Councilman Ridder, Council voted unanimously to strike the first two paragraphs of the above . The resolution, as amended, was then unanimously adopted . Mr. Ritter pointed out that it will take several years to complete this valve insertion program. 13 4 MINUTES OF AUGUST 22 , 1973 MEETING. On motion of Councilman Titus , seconded by Councilman Pumphrey, Council voted unanimously to take out of tablement the following resolution : RESOLVED, that Dewberry , Nealon & Davis ' proposal #983, July 30, 1973 , concerning Engineering Study of the Required Drain- age Improvements on Town Branch from Tuscarora Creek, to a point beyond Morven Park Road, at a cost of $12 ,000 be ac- cepted , and BE IT FURTHER RESOLVED, that this be financed from Revenue 111 Sharing Funds . A letter received frau Dewberry, Nealon and Davis today was read by Councilman Titus , who offered amendments to the first paragraph, with Councilman Wallace seconding them. The amendments were unanimously adopted and the resolution, as amended, was unanimously adopted, read- ing as follows : RESOLVED, that Dewberry, Nealon & Davis ' proposal #983 , July 30 , 1973 , and further clarified by their letter of August 22 , 1973 , concerning Engineering Study of the Required Drainage Improvements on Town Branch from Tuscarora Creek to the west corporate limits , at a cost of $12 ,000, be accepted, provided that any final recommendations include consideration of the forthcoming Land Use Plan and Flood Plain Study, and BE IT FURTHER RESOLVED, that this be financed from Revenue Sharing Funds . Town Attorney Martin, as an interested participant in Leesburg, asked if Council would give some consideration to putting benches in front of the Town Office . He said he has noticed that a number of people visit the Town and there is no place to sit except the few benches on the Court House lawn , or else go to a restaurant . The two govern- ing bodies control any space that can be utilized for this purpose. Mayor Hill referred this matter to the Utility Committee , along with the help of Mr. Forbes . Mr. Martin said perhaps one of the service clubs might donate the benches . Mayor Hill reported, as a matter of interest, that he took a trip to Morgantown, West Virginia last week and that we have no problems here , compared to what he saw there . They have one-way and congested traffic and it took him 20 minutes to go five blocks . This community has a student population of 18,000 . When he finally got parked, they had to walk on cobblestones - if Leesburg had such streets , we would have somebody complaining constantly . Also, insofar as sewage is concerned, Morgantown has only primary treatment - the rest of it is dumped into the River. Another city about 30 miles away has no treat- ment at all. His point was that , although we have problems here in Leesburg , he feels we are making progress and he is proud to be a part of the Town .
