HomeMy Public PortalAbout19950607SCMeeting1 1 1 1995- 06 -07. Special Council Meeting Mayor James P. Locklear called the meeting to order and opened the meeting for business legally presented. The following Councilmembers were present: Katrina Hughes, William Remeta, Phil O'Dell, and Mariann Wildi. Councilmember Jack Youmans was absent because of illness and Councilmember Paul Jackson was out of town on business. City Attorney Edward Hughes was present to represent the City on legal issues. Mayor Locklear stated that the meeting was for the first reading of the zoning rewrite ordinance done by RDC, Zoning Task Force, Planning Commission and the Zoning Administrator. The Mayor said that he will open and closed the public hearing for each section, the Council will then vote on each section. Councilmember Hughes said that the turtle ordinance was left out of this draft by mistake, but has been incorporated into the new draft ordinance. Councilmember Hughes read suggestions concerning variance definitions from the City Attorney. The Mayor said that there are only 10 copies of the new draft ordinance and requested that the audience share the copies. The Mayor requested that the Council and the audience take a few minutes to look over Article I Introduction, Section 1 through 4. Mayor Locklear opened the hearing on the above. There were no comments for or against. Mayor Locklear closed the hearing. Councilmember Hughes moved to accept on first reading. Councilmember Wildi seconded. Vote by Council was unanimous. Mayor Locklear opened the hearing on Article II Definitions, Section 1 Terms and Definitions (a) and (b) - (1) through (12) listed on page 1. Comments: Rusty Fleetwood questioned (B)(11) Average adjacent grade asking if this means any clearing or grading. Zoning Administrator said it means prior to any grading. Mr. Jim Kluttz questioned (3) Air rights, public asking what reasonably means in line 3. Councilmember Hughes answered this is a requirement of DOT. Mr. Kluttz asked if there is a top limit. Mayor answered no. Mr. Kluttz said that this deals with height and should be made as clear as possible. Councilmember Hughes said that the City can put on restrictions. Mayor Locklear closed the hearing. Councilmember Hughes moved to adopt. Councilmember Wildi seconded. Vote by Council was unanimous. Mayor Locklear opened the hearing on Article II Definitions, (13) through (23) on page 2. Comments: John Hutton stated that (22) Building Envelope keeps turning up like a bad penny, building envelope encompasses the space of building, this is wrong. Jeanne Hutton said that it is trying to set the height. Mr Welker stated that the building and the envelope do not go together, it needs changing. Rusty Fleetwood said he agrees with Mr. Hutton, this will be a nightmare of enforcement. Mr. Fleetwood said that in the present ordinance the building height is defined and set at 35 feet. Mr. Hutton asked why we need this, 1 1 1 was never discussed by task force, simply appeared. Zoning Administrator Byers said that it was discussed when we looked at different ways of measuring building. Mr. Hutton said that it was taken out by task force. Zoning Administrator said that it was accepted by Planning Commission. Councilmember Hughes said that we are just trying to define words. Mr. Kluttz asked about (20) Buffers questioning whether height is important in the definition and feels it should be added. Susan Dulany said that (18) Bed and Breakfast is great for Tybee. Carl Thompson said to delete (22) Building Envelope because it doesn't make much sense anyway, (56) defines height of building. Mayor Locklear closed the hearing. Councilmember O'Dell moved to delete (22) Building Envelope and add the word height to (20) Buffer. Councilmember Hughes seconded. Vote by Council unanimous. Mayor Locklear opened the hearing on Article II Definition, (24) through (34) page 3. Comments: Jim Kluttz questioned (26) Caretakers Cottage being allowed in R -2, why not in R -1. Zoning Administrator Byers said that guest cottages are addressed on page 5 # (55). Mr. Kluttz said that he was looking at it from the size of the property. Mrs. Byers said that 4,500 square feet is required in R -1, caretaker cottages can not be rented, it is more restricted. Mr. Kluttz said this is not consistent. Councilmember O'Dell said he did not have a problem with (26). Mr. Hutton stated that Mrs. Byers and Mr. O'Dell are not talking about lot size. Councilmember Hughes read a definition for a carport - a roofed structure providing a space for motor vehicles, to be included on this page of the ordinance. Mayor Locklear closed the hearing. Councilmember O'Dell moved to adopt page 3 with the addition of the definition of a carport. Councilmember Wildi seconded. Vote by Council was 3 in favor (Hughes, Wildi, O'Dell); 1 opposed (Remeta). The Mayor asked his objection. Councilmember Remeta said he has a problem with (26) Caretakers Cottage. Mayor Locklear opened the public hearing on Article II Definitions (35) through (46) page 4. Jim Kluttz questioned the difference in fire wall in (42) (b) & (c). Councilmember O'Dell asked what is the definition of a party wall. Councilmember Hughes read the definition of a fire wall. Councilmember O'Dell said it is not consistence in these definitions. Jim Kluttz recommended using the same wording in (42) (b) & (c). Zoning Administrator Byers said that when we get into the building section of the ordinance and accept SBCCI we will adopt these definitions. John Hutton suggested taking out the words rated common in (42) (b). Attorney Hughes said that we can have the same definition in b and c. Councilmember O'Dell said (40) Drive in Window sounds great but not many lots on Tybee can handle that distance. John Hutton said that Checkers use the wrap around for the footage. Councilmember O'Dell said linear means straight line to him. Councilmember Remeta asked Rusty Fleetwood if he had any question on (41) Dunes. Mr. Fleetwood said he has no problem with the definition. Mayor Locklear closed the hearing. Councilmember Hughes moved to delete the word linear from definition (40) Drive -In Window and to delete the words rated common from 1 1 1 definition (42)(b) Dwelling. Councilmember O'Dell seconded. Vote by Council unanimous. Mayor Locklear opened the public hearing on Article II Definitions (47) through (59) page 5. Carl Thompson asked if height is covered somewhere else. Zoning Administrator Byers said yes, under general provisions. Councilmember O'Dell said there is no way to regulate guest cottage in R -1 with adding a second building. Councilmember Hughes stated that we have one now in the City. Councilmember O'Dell asked where. Councilmember Hughes answered Randy Warner on Bay Street. Mr. Welker said that it still has to comply with the square footage requirements. Councilmember Wildi asked if this was acceptable to the task force. Mayor Locklear answered yes. Mayor Locklear closed the hearing. Councilmember Remeta moved to delete (55) guest Cottage and approve the rest of page including fire wall. Vote by Council was 2 in favor (Remeta, O'Dell); 2 opposed (Hughes, Wildi). Mayor broke the tie by voting in opposition of the motion (all is accepted). Mayor Locklear opened the public hearing on Article II Definitions (60) through (65) page 6. Closed hearing. Councilmember Hughes moved to delete the hours 6 a.m. until 10 p.m. from (63) Light Business. Councilmember Wildi seconded. Vote by Council was unanimous. Mayor Locklear opened the public hearing on Article II Definitions (66) through (78) page 7. Rusty Fleetwood asked that the word commercial be added to (77) Marina. Councilmember Hughes asked about property line instead of lot lines. City Attorney Hughes said he prefers property line. Mr. O'Leary asked what is the purpose of the definition. Councilmember Hughes said the definition is needed for subdivision. City Attorney Hughes stated that it is only in subdivision regulation that it is needed, everywhere else it is in square footage. Councilmember O'Dell questioned (68) Lowest Floor. Zoning Administrator Byers said this is a FEMA definition. Mayor Locklear closed the hearing. Councilmember Hughes moved to approve page 7 by adding the definition for Lots of Record, rewording (66) to read Lot Width: The distance between the property lines measured at the building line; adding the word commercial to (77) Marina. Councilmember Wildi seconded. Vote by Council was unanimous. Mayor Locklear opened the public hearing on Article II Definitions (79) through (93) page 8. (92) Patio was questioned. Councilmember Hughes said that it is on ground and not an obstacle to the fire department. Carl Thompson asked about (83) Nesting - people? Zoning Administrator said this definition is for the turtles and it is right from DNR. The Mayor closed the hearing. Councilmember Wildi moved to approve with the change in (92) Patio by deleting last sentence and adding "Flooring for a patio rests upon the ground. Councilmember O'Dell seconded. Vote by Council was unanimous. 1 1 1 Mayor Locklear opened the public hearing on Article II Definitions (94) through (110) page 9. Privacy Fence, Recombination of Lots, and Residential Planned Unit Development are added to this page. Kathy Williams asked that resident or property owner be added to (94) Planning Commission. Also asked if the marina was considered a restaurant. Zoning Administrator answered yes. Jim Kluttz asked why (98) Principal Use is needed. Zoning Administrator Byers said that this definition came out of the old ordinance. Zoning Administrator Byers said that a recombination of lots can be 3 lots with 5000 sq. feet each, one PIN and you can reduce that to two lots. Jim Kluttz asked if a public hearing is needed. Ms. Byers answered no. City Attorney Hughes stated that PIN's are just for tax purposes and that if there is a common owner it can be recombined if you subdivide. Councilmember O'Dell asked about Fort Street. Ms. Byers answered that Mr. Trey Clark created fewer lots than they had. Councilmember O'Dell stated that they should come before Council. Ms. Byers said the lots front on an existing open street and that legal description has lots listed. Councilmember O'Dell said that you can not count marsh anywhere but on Tybee Island. The Mayor questioned (102) Recreation Vehicle Park (RV Park) stating that we have people over there at the campground on Fort Street that have been there forever - some can not be moved. Councilmember Wildi said that some belong to the owner and he rents them out. Mayor Locklear closed the hearing. Councilmember Hughes moved to add the definition for Privacy Fence, Residential PUD, and Recombination of Lots to page 9, also delete (107) Sand Dunes; amend (97) Porch by removing the words "and having no enclosed features ". Attorney Hughes will provide wording for PUD. Councilmember Wildi seconded. Vote by Council was 3 in favor (Hughes, Remeta, Wildi); 1 opposed (O'Dell). Mayor Locklear called a 10 minute recess at 9:55 P.M. Mayor Locklear opened the public hearing on Article II Definitions (111) through (113) pages 10 - top of 12. Mayor closed the hearing after comments. Councilmember O'Dell moved to approve amending (113) Signs v. Roof Sign by deleting "and extending vertically above the highest portion of the roof ". Councilmember Wildi seconded. Vote by Council was unanimous. Mayor Locklear opened the public hearing on Article II Definitions (114) through (119) page 12. Jim Kluttz asked what constitutes start of construction. Councilmember O'Dell answered the foundation? John Hutton said laying out your work. After comments Mayor Locklear closed the hearing. Councilmember Hughes moved to delete (117) start of Construction and replace with Beginning of work under permit (wording from City Attorney); delete the words single family and within a minor subdivision or less from (118) g. Councilmember Wildi seconded. Vote by Council was unanimous. Mayor Locklear opened the public hearing on Article II Definitions (120) through (132) pages 13 and 14. Rusty Fleetwood 1 1 1 questioned definition (129) Variance stating that unnecessary hardship is not defined. City Attorney Hughes wording will be added to (129). Councilmember O'Dell said that (122) Substantial improvements has been misinterpreted and needs to be addressed, 50% should be on the structure not on the land for any additions. Rusty Fleetwood said that we are here for that one thing Variance, to get a definition. There is a definition for hardship from FEMA. City Attorney Hughes said that a hardship is on the property, has to do with the lot itself. Rusty Fleetwood said it is left up to the Mayor and Council, like the variance for Tybee Market. Councilmember Remeta said that the hardship is actually the heart of the problem, we have spent money to do this ordinance, but still have the problem. Rusty Fleetwood asked when was a use variance. Attorney Hughes said it is rezoned if he got a variance stating again that the variance is related to the property not the person. Attorney Hughes said that the trouble is when you grant a variance without any standards then the next man comes for a variance knowing the first man did not show any hardship. Carl Thompson asked about (125) a. Rusty Fleetwood said not only live oaks but any tree over 6 inches. The Mayor closed the hearing. Councilmember Hughes moved to adopt Definition (120) through (132) with the amendment to (129) variance to be written by the City Attorney. Councilmember O'Dell seconded. Vote by Council was 3 in favor (Hughes, O'Dell, Wildi); 1 opposed (Remeta). Councilmember Remeta said he had problems with variances. Councilmember Hughes moved to adjourn this meeting until Thursday, June 8th after the regular Council meeting. Continued Special Council Meeting - June 8, 1995 Mayor Locklear reconvened the meeting for the zoning ordinances. Mayor Locklear opened and closed each page that was read and discussed by citizens and Councilmembers. Councilmembers Hughes, Remeta, O'Dell and Wildi were present. Article III General Provisions - Page 1 Section 1 Zoning affects every structure and use; Section 2 Continuance of nonconforming uses; Section 3 Reduction in lot area - Wildi moved to adopt as written - O'Dell 2nd. Vote by Council was 2 in favor (Wildi, O'Dell); 2 opposed (Hughes, Remeta). Mayor broke tie by voting in favor. Article III General Provisions - page 2 - Section 4 Substandard Lots of Record - Remeta moved to table with City Attorney to work on this section - Wildi 2nd. Vote by Council was unanimous. Article III General Provisions - page 2 & 3 - Section 5 Obstruction to vision at street intersections - Hughes moved to approve as written - O'Dell 2nd. Vote by Council was unanimous. 1 1 1 Article III General Provisions - page 4 - Section 6 Bed and Breakfast - Hughes to approve with the following changes, (a) from three to five rental units; from 4 foot in length and 3 foot in width to 12 square feet; delete "Permits are subject to yearly evaluation, and may be revoked at any time by the Mayor and Council for just cause" from (a); delete from (b) "because they exceed four (4) units per lot ". O'Dell 2nd. Vote by Council was unanimous. Article III General Provisions - page 5 - Section 7 Accessory structures Hughes moved to accept with amendments - (b) (1) rewrite; (b)(2 change two stories to one story; (b)(4) delete; (b)(5) change 10 feet to five feet. O'Dell 2nd. Vote by Council unanimous. Article III General Provisions - page 5 and top of 6 - Section 8 (A) & (B) - Hughes moved to accept with changes: 8 (a) delete the word paved; (B) (3) add the words "on the same lot" to end of sentence; (B)(4) change 35 feet to 25 feet; (B)(6) delete. Wildi 2nd. Vote by Council was unanimous. Article III General Provisions - page 6, 7 - Section 8 (C) Commercial off - street parking & (D) Off street parking dimensions Remeta moved to approve with accepting (D)(1) Existing method. O'Dell 2nd. Vote by Council was unanimous. Article III General Provisions - page 8 - Section 8 (D)(3) Exemptions - Hughes moved to accept changing (3) to (2). O'Dell 2nd. Vote by Council was unanimous. Article III General Provisions - Page 8 - Section 9 (a) Schedule of residential district dimensional requirements - O'Dell moved to adopt with height limit set at 35 feet. Hughes 2nd. Vote by Council was unanimous. Article III General Provisions - page 8 - Section 9 (b) Schedule of Commercial minimum yard requirements - O'Dell moved to accept as read with structure height at 35 feet. Remeta 2nd. Vote by Council was unanimous. Article III General Provisions - top of page 9 - Section 9 (c) Buildings above 35 feet - Remeta moved to delete - O'Dell 2nd. Vote by Council was 2 in favor (O'Dell, Remeta); 2 opposed (Hughes, Wildi). Mayor broke tie by voting in opposition. Hughes moved to accept as written - Wildi 2nd. Vote by Council was 2 in favor (Hughes, Wildi); 2 opposed (O'Dell, Remeta). Mayor broke tie by voting in favor. O'Dell stated that he was elected to represent the people and that the roof of building needs to be 35 feet. City Attorney asked if there was a better way to word. O'Dell moved to reconsider and look at the City Attorney's plan. Mayor Locklear said that the meeting will reconvene on June 19th at 6:30 p.m. 1 1 1 Continued Special council Meeting - Zoning - June 19/95 Mayor Locklear reconvened the meeting at 6:30 p.m. with Councilmember Hughes, O'dell and Wildi present. Each Section or page was opened and closed according to the public hearing rules. Article III General Provisions - page 9 - Section 10 Beach, Dune or Vegetation disturbance - Hughes moved to accept with changes - add the words "federal, State and local permits" after obtained add delete last line of paragraph. O'Dell 2nd. Vote by Council was unanimous. Article III General Provisions - page 9, 10, 11 and top of page 12 - Section 11 Single family residential standards. O'Dell moved to accept with changes - move (A)(5) to (B) (4)(g) page 11; delete introductory and table (B)(2) replace with (B)(5) introductory and table - Hughes 2nd. Vote by Council was unanimous. Article III General Provisions - page 12, half of page 13 - Section 12 through 16 - Wildi moved to accept with the following amendments: Section 16 (D) rewording to "a well maintained ornamental masonry wall or privacy fence - O'Dell 2nd. Vote by Council unanimous. Article III General Provisions - bottom of page 13, 14 - Section 17 through 20 - Hughes moved to approve as amended - Section 17 (A)(7) delete and replace with (A)(7) "There shall be no sign or external indication of occupation "; Section 17 (B)(3) delete; Section 18 move (B) & (C) to become (C) & (D) and insert (B) Ground dishes shall not exceed 12 feet in diameter; Section 20 add the word Carport to heading; and add definition of carport to the paragraph. O'Dell 2nd. Vote by Council was unanimous. Article III General Provisions - page 15 & 16 - Section 21 through 24 - Wildi moved to approve with changes: Section 24 (C) Existing lighting must be in compliance and delete no later than may 1, 1992; (d) change wording to must from shall and delete no later than May 1, 1992. - O'Dell 2nd. Vote by Council was unanimous. Article IV Zoning Districts - page 1 - Section 1 through 4 - Hughes moved to approve as written with the addition of (K) PUD. Wildi 2nd. Vote by Council unanimous. Article IV Zoning Districts - page 2 - Section 5 (A) R -1 Residence District - Hughes moved to accept with City Attorney Hughes sending new wording that was stated and accepted for 2nd reading - Wildi 2nd. Vote by Council was unanimous. Article IV Zoning District - page 2 - Section 5 (B) R -1 -B Residence District - Hughes moved to adopt as read - O'Dell 2nd. 1 1 1 Vote by Council was unanimous. Article IV Zoning District - page 2 top of page 3 - Section 5 (C) R -2 One and Two family residential district - Hughes moved to approve with changes - delete (2)(b) government buildings - O'Dell 2nd. Vote by Council was unanimous. Article IV Zoning District - page 3 middle - Section 5 (D) R -T residential Tourist District - Hughes moved to accept with the change in (2) b from two to six units - Wildi 2nd. Vote by Council unanimous. Article IV Zoning District - page 3, 4 top of 5 - Section 5 (E) C -1 Beach Business District, (F) C -2 Highway Business District - Hughes moved to approve with type error corrected (F)(1) C -2 highway business district - Wildi 2nd. Vote by Council was unanimous. Article IV Zoning District - page 5, 6,7 - Section 5 (G) N -M Neighborhood Marina District - (H) TBR Transitional Business - Residential District - (I) PC Public Parks - Conservation District - (J) EC Environmental- Conservation District - Hughes to approve with the following changes; add (G)(1) b. Sunday through Thursday 10 p.m. closing - Friday, Saturday and holidays 12 a.m.; (G)(2)b change the word when to with after five (5) feet; (I) City Attorney will have something clearer for 2nd reading; (J)(2) delete; add (K) PUD - O'Dell 2nd. Vote by Council was unanimous. Continued Special Council Meeting - Zoning Ord. - June 20/95 Mayor Locklear reconvened the meeting at 6:30 p.m. with the following members of Council present: Katrina Hughes, Phil O'Dell, and Mariann Wildi. Each page or section was opened and closed according to the rules of a public hearing. Councilmember Hughes stated that where public hearing appeared before Planning Commission that the word public will be deleted and the word regular be deleted from in front of scheduled meeting concerning City Council. Article V Zoning Actions - page 1, top of 2 - Section 1 Permits required for construction - O'Dell moved to accept with amendments; (A) Building permits change $500. to $1,000. in paragraph; (C) change Article IV to Article VI - Wildi 2nd. Hughes amends to $1,500. in paragraph. O'Dell 2nd. Both votes unanimous by Council. Article V Zoning Actions - page 2, 3, top of 4 - Section 2 Permits or action required by this ordinance & 3 Fees - Hughes moved to approve with the addition of Bond ordinance; Section 2 (C) Zoning Variance - change wording at end of paragraph to read at a public hearing; (I)(6) Shallow wells for Irrigation only - change Chatham County Health Department to Code Enforcement Department - Wildi 2nd. Vote by Council was unanimous. 1 1 1 Article V Zoning Action - Pages 4,5,6,7,8 and top of 9 - Section 4 Application for permits or actions under this ordinance - Hughes moved to approve with changes: Section 4 to read "Application for all Zoning Action "; (A)(9)b. change map amendment to zoning action; (B)(3) add a tentative between the words construction, date; (C)(1) addition of to include all existing significant tree.; (D) City Attorney will reword for 2nd reading; (E) City Attorney will look at this for 2nd reading; (E) (1) delete and change (2) to number (1); (G) Change the Chatham County Clerk of Courts Office to Chatham County Clerk of Superior Court, reword the last sentence to read "The information needed for each step of the land subdivision process is as follows:" - O'Dell 2nd. Vote by Council was unanimous. Article V zoning Actions - pages 9,10,11, top of page 12 - Section 5 Public notice & Section 6 Public hearing requirements - Hughes moved to accept with changes: Section 6 (A) change approve a to "consideration of a "; (A)(3,4,5) City Attorney will check on Zoning Act; (A)(6) delete more than to read aggregating to $250 "or more" to any member; (A)(7) delete; (B) delete "on Tybee Island" - Wildi 2nd. Vote by Council unanimous. Article V Zoning Actions - page 12, 13, 14, 15 - Section 7 Standards for special review (No comment), Section 8 Site plan approval (NO comment), Section 9 Variances, Section 10 Standards for variance from the Flood Damage Control Regulations (NO change from present ordinance), Section 11 Standards for Zoning Ordinance or map amendment approval (NO comment), Section 12 Sign permit approval (NO comment) - Hughes moved to approve with the following amendments: Section 9 (A) delete the words at least two of in the last sentence; (A)(3) delete; move present (B) & (C) to (C) & (D) and add (B) Use variance city Attorney will provide words; change present (C) Permit longevity to (D) Variance longevity - O'Dell 2nd. Vote by Council was unanimous. Zoning Administrator Byers said that a brochure will be printed breaking down into everyday language. Mayor announced that the meeting will reconvene at 6:30 p.m., June 21, 1995. Continued Special Council Meeting - Zoning Ord. - June 21/95 Mayor Locklear reconvened the meeting at 6:30 p.m. with Councilmembers Hughes, Remeta, O'Dell, Youmans, and Wildi present. Article V Zoning Action - page 16, 17,18, half of 19 - Section 13 Major subdivision plat procedure - Hughes moved to accept with amendments; add Bond ordinance; significant tree wording - Youmans 2nd. Vote by Council unanimous. Article V Zoning Actions - page 19 through 22 - Sections 14 through 17 - Section 13 Major subdivision plat procedure; Section 15 Standards for subdivision proposals; Section 16 Enforcement; 1 1 1 Section 17 Other city actions affected by this ordinance - Hughes moved to approve with changes: Section 16 (B) Violations - delete last sentence beginning with "Furthermore, "; Section 16 (C)(3) Change to "The zoning officer shall request the Clerk of Municipal Court of Tybee Island to issue a summons, acquisition or complaint. " "Complaint "" means a summons, citation, acquisition or statement of violation "; Section 16 (C)a add "unless continued, provided by law" to end of last paragraph; Section 16 (C) b delete "or an affidavit of service executed by any citizen of this state, other than the resident initiating the complaint "; and "sheriff or lawful deputy or the affidavit of such citizen" replace with Public officer; add to end of last sentence "to the extent provided by law "; Section 16 (C) c. delete "or such service may be made by any citizen" "or an affidavit of service executed by any citizen of this state" "sheriff or lawful deputy or the affidavit of such citizen" change by inserting the words public officer where sheriff starts, add to the extent provided by law at the end of the paragraph; Section 16 (C)g replace with wording provided by City Attorney. Youmans 2nd. Vote by Council was unanimous. Article VI Sign Regulations - pages 1 through 5 - Section 1 State code adopted; Section 2 Permit required; Section 3 Traffic safety; Section 4 Exemptions; signs not requiring a permit; Section 5 Obsolete /Abandoned signs - Youmans moved to accept with changes: Section 3 add "if" after the word location on the third line; Section 4 (C) change 16 square feet to 32 square feet, change 14 days to 7 days after the event; Section 4 (L) delete; Wildi 2nd. Vote by Council was unanimous. Article VII Tree removal regulations - page 1 through 4 - Sections 1 through 10 - Hughes moved to accept with changes; Section 3 delete the words "undeveloped" and "or vacant lots "; Section 8 (A) change shall to may and insert native between "approved species "; (D) and "or contribute to Palms Up" at the end of the sentence. Wildi 2nd. Vote by Council was 3 in favor (Hughes, Wildi, Youmans); 1 opposed (O'Dell). Article VIII Flood Damage Control - page 1 through 8 - Section 1 through 17 - O'Dell moved to approve (no changes from present ordinance). Remeta 2nd. Vote by Council was unanimous. Article IX Building Regulations - pages 1 through 5 - Section 1 1 1 1 through 5 - O'Dell moved to accept with changes - Section 3 (A)(1) Repairs less than $1,500; (2) Where the value exceeds $1,500 but not over $2,000; section 5 add (K) Life Safety Code 101 and (L) CABO 1 & 2 Family Dwellings - Remeta 2nd. Vote by Council was unanimous. Article X Subdivision Regulations - page 1 through 7 - Section 1 through Section 8 - O'Dell accept with changes - Section 8 (D)(16) change shall to "may "; (F)(6) to read Width and area requirements. Lots hereafter established within subdivisions shall conform to the area requirements as specified in the General Provisions for each Zoning District. The lot width requirements shall be sixty (60) feet at the building line. Delete the table. Wildi 2nd. Vote by Council was unanimous.
