Terry Titu 84 MINUTES OF SPECIAL MEETING OF LEESBURG TOWN COUNCIL, OCTOBER 16 , 1974 A special meeting of the Leesburg Town Council was held in the . • Council Chambers , 10 West Loudoun Street , Leesburg , Virginia , on October 16 , 1974 at 7 :00 P.M. , pursuant to Waiver of Notice attached • hereto . Present were : Mayor G. Dewey Hill , Councilmen Charles E. • Bange , Mary Anne Newman , Robert A. Orr, Herbert L. Ridder, James A. Rock and C . Terry Titus ; also Town Manager James W . Ritter, Jr. and Deputy Town Manager E . Wesley Devero . The meeting convened at 7 :06 P.M. Mayor Hill explained that the purpose of the meeting was to discuss the proposed purchase of prop- erty from Mrs . Jan McVay . Mrs . McVay was present and the Mayor asked her if She wanted to say anything at this time . She replied that she hadYcomment at this time . On motion of Councilman Titus , seconded by Councilman Orr, the following resolution was proposed : WHEREAS, the Council has agreed to purchase from Mrs . McVay a certain parcel of land at $5 .00 per square foot and , in turn, to convey a small parcel to Mrs . McVay , and WHEREAS , the total square footage, based upon survey of McVay land, is 3 , 147 square feet and the parcel to be conveyed by the Town is 27 square feet , and WHEREAS , the purchase price is $16 ,000 , in line with Mrs . McVay 's counter offer, NOW, THEREFORE, BE IT RESOLVED, that the following sums be and they are hereby appropriated from the General Fund to complete the transaction : $16 ,000 .00 - Purchase price 56 .00 - Owner ' s title insurance premium 377 . 50 - Onehalf of survey 175 .00 - George M. Martin - Title , closing , preparation of deed to McVay and BE IT FURTHER RESOLVED, that the Town Attorney prepare a deed conveying the 27 square foot area to Mrs . McVay, and that the same shall be executed as prescribed by the Charter and delivered simultaneously with delivery of the deed to the Town from Mrs . McVay . Councilman Orr said Mr . Devero felt this money should come from Reve- nue Sharing . Mr. Devero explained his reasons for this . Councilman Titus felt that Council should reserve the right to replace this money to Revenue Sharing should there be any subsequent sale of land. Mr. Devero felt that, if this is the case , then the money should come from the General Fund, rather than confuse this for auditing purposes . Councilman Ridder questioned the difference between the $16 ,000 figure and the $15 ,600 figure . The $16 ,000 figure was arrived at by • multiplying 3200 square feet times $5 .00 , as explained by Mayor Hill. The $5 .00 per square foot figure was approximate only, with a figure of $16 ,000 intended. At this time, the entire Council , with Mrs . McVay, left the Council Chambers to view the site . Mrs . McVay pointed out on the• ground that the part that she intended to convey is that part west . • of a line extended from the concrete slab in rear of The Clothes Horse . This line , as pointed out by Mrs . McVay , does not agree with plat or description . After some discussion, the Council then pro- ceeded back to the Council Chambers . Mayor Hill asked Town Manager Ritter to read Mrs . McVay 's letter dated October 15 , 1974 . This letter was read. Mayor Hill said this is not the way he understood it . Mrs . McVay explained that there was a misinterpretation of what she intended to convey . 85 MINUTES OF OCTOBER 16 , 1974 SPECIAL MEETING. .On motion of Councilman Titus , seconded by Councilman Rock, the following amendment was proposed in the second paragraph: "approximately 2 ,850 square feet" in place of "3 , 147 square feet. " This paragraph would then read as follows : WHEREAS, the total square footage, based upon survey of McVay land, is approximately 2 ,850 square feet and the parcel to be conveyed by the Totn is 27 square feet , and The amendment was unanimously adopted. The resolution, as amended, was then adopted by a roll call vote on` 4 to .-3; as shown: Aye : Councilmen Bange , Newman, Orr and Titus . Nay : Councilmen Ridder, Rock and Mayor Hill.
