T- rry/•" us • v 135 MINUTES OF SPECIAL MEETING OF LEESBURG TOWN COUNCIL, DECEMBER 31, 1974. A special meeting of the Leesburg Town Council was held in the Council Chambers, 10 West Loudoun Street, Leesburg, Virginia at 12 Noon, December 31, 1974, pursuant to Waiver of Notice attached hereto. Present were Mayor G. Dewey Hill, Councilmen Mary Anne Newman, Herbert L. Ridder, James A. Rock and C. Terry Titus ; also, Town Manager James W. Ritter, Jr. , Deputy Town Manager E. Wesley Devero and Town Attorney George M. Martin . Absent from the meet- , ing were Councilmen Charles E. Bange and Robert A. Orr. Mayor Hill stated that the purpose of this meeting is to dis- cuss a legal matter - a law suit filed in the Circuit Court for Loudoun County by Mechem Flying Service, Inc . , Complainant, vs. Town of Leesburg, Transamerican Airports, Inc . , Blue Ridge Air- craft, Inc . and Chantilly Aviation, Inc . , Defendants - and to empower the Town Attorney to proceed on behalf of the Town. Town Attorney Martin explained that this/an anti-trust suit, an unusual one in the State of Virginia, and he felt there would havgpto e S:ye agili �; Aggl�flggdCB s� @ilmAgtRbciis- cussion, a of owing resp u ioii was propos d an unanimous t adopted, as shown : BE IT RESOLVED, that the Town Attorney be directed to de- fend the Town in the case of Mechem Flying Service, Inc . vs. Town of Leesburg, Virginia, et als, and that appro- priate Town officials are authorized to execute the nec- essary documents to defend this action, and BE IT FURTHER RESOLVED, that the Airport Advisory Com- mittee be directed to work with the Town Attorney in the preparation of any defense he may deem necessary. Aye: Councilmen Newman, Ridder, Rock, Titus and Mayor Hill. Nay : None. A letter from Town Manager Ritter to Mr. Clay Gilley, dated De- cember 23, 1974, copies of which had been distributed to Council members, was discussed at length, with Town Manager Ritter explain- ing the circumstances under which he wrote this letter. Council members felt that this is a potential legal matter and that the letters received from Mr. Gilley should have been referred to Town Attorney Martin for reply. Mr. Ritter said his letter stated facts only. Town Attorney Martin brought Council up-to-date on the problem involved and said they are actually dealing with Grayson Hanes, Trustee , on this matter. He felt that this should have been dealt with by spelling out the fact that the Town has an irrevocable license for the sewer line in light of the money that has been spent by the Town . After further discussion by Council, it was decided that nothing should be done at this time and that, if Mr. Gilley wants to talk about a refund, he should come talk to Council.
