MINUTES OF REGULAR MEETING OF LEESBURG TOWN COUNCIL, APRIL 14, 1976. 23
' A regular meeting of the Leesburg Town Council was held in the
Council Chambers , 10 West Loudoun Street, Leesburg, Virginia on
April 14, 1976 at 7 : 30 P.M. The meeting was called -to order by the
Mayor, with Councilman Rock offering the invocation, and . followed
with the Salute to the_ Flag. Present were: Mayor -G. Dewey Hill ,
Councilmen- James H. Chamblin, Robert A. Orr, James A. Rock, and C.
Terry Titus. `Councilman Mary Anne Newman joined the meeting at
7 : 50 P.M. Absent from the meeting was Councilman Charles E. Bange.
Also present were Town Manager John Niccolls and Town Attorney
George M. Martin.
The minutes of regular meeting of March 24, 1976 were approved
II as written.
Mr. Robert C. Forbes presented to Council Phases I and II of •
the consultants ' report on the Old and Historic District, Phase I
encompassing a physical survey: of the District and Phase II being
an economic study and analysis of the District. Phase III will
be forthcoming very soon. Mr. Forbes exhibited and explained sam-
ples of a form used in the survey of three blocks in the District,
along with eight maps that tie into information compiled from these
forms . These will be for the use of the Board of Architectural
Review in considering applications . Mrs. Teckla Cox, a member of
the team that worked on the survey and a resident of the Old and
Historic District, said that this was a very interesting and re-
rad warding job and she hoped it will help preserve the old and his-
toric buildings in this District. .
Mayor Hill called attention to a .Petition from some 55 resi-
dents of Valley View Avenue from Dry Mill Road to the abandoned
W & 0 D Railroad bed for removal of the "No Parking" signs erected
on the south side of Valley View Ave: Town Manager Niccolls re-
ported that he had ordered the erection of these signs several
weeks ago for the purpose of relieving a hazardous condition with
cars parked on both sides of the street. He• had received only
one complaint other than this petition. There is adequate park-
ing in this area for the residents and he felt that the movement
of traffic is improved by this action. There was no-one present
to speak in behalf of the Petition. Therefore, Mayor Hill declared
the petition null and void, however, Council would listen to these
people if they decide to"follow it up at a later time. .

Repealing Sec. 11-39 of Town Code re Nuisances
Weeds and other foreign growth on property and
their removal therefrom.
On motion' of Councilman Newman, seconded -by Councilman Rock, the
following ordinance was proposed: '
BE--IT- ORDAINED by the Council of the Town of Leesburg,
Virginia, as follows :
SECTION I. That a new chapter is added to the Town Code
to read as follows :
CHAPTER 5 •
' BUILDINGS -AAD GENERAL BUILDING- REGULATIONS
ARTICLE I. UNSAFE, ETC. , CONDITIONS
`- . - Sec. 5-1 : Abatement or removal of nuisances.
• “(a) - As used in this article, the meaning of the -word
"nuisance"- shall include- but not be limited to anything dan-
• gerous , -unwholesome, unsanitary,- -offensive- or unhealthy, or
any building, structure, or addition thereto which by reason
- of dilapidation, defect of"structure, - or other causes which
may have become dangerous to life or- property or' which may be
erected contrary to law, or- any substances -allowed to -accumu-
- late in -or on any- place or premises , - or any'-portion- of a lot

adjacent to a street where the difference in levelbetween
the lot and the street constitutes a danger to life and
limb, or any grounds subject to be covered by stagnant water,
or any unsafe, dangerous or unsanitary public or private
building, wall or structure which constitutes a menace to the
health and safety of the occupants thereof or the public.
(b) Upon information and determination that any person
is creating, maintaining or permitting to exist on his prem-
ises any nuisance, the Town Manager shall cause written no-
tice of the specific nature of the nuisance to be served on
the owners or the occupants of such land andshall issue at'

order to be sent by certified mail to the last known ad-
dress
of the owners or occupants . The time allowed the owner
to abate and obviate the nuisanceshall include a reasonable
period necessary to permit correction and elimination of the
violation taking weather conditions and the actual time re-
quired for completion of the work into account as well as
the extent of hazard to the public caused by the nuisance.
(c) If the owners of the properties or premises af-
fected by the provisions of this section fail to comply with
the notice and order in the time allowed, the Town Manager
shall cause the minimum work required to abate or obviate
the nuisance to be done at the expense of the Town and - the
amount of money so expended shall be recovered from the own-
ers or occupants as provided herein.
(d) In the event the Town has abated or obviated the
nuisance, the owners or occupants shall be notified that
the Town has done so and shall be given an itemized cost
thereof by certified mail . If the sum due to the Town has
not been paid within 15 •days from receipt of such notice,
the Town Manager shall and is authorized to distrain there-
for goods or chattels within the Town to collect the sum
due, or to treat the unpaid sum as a lien against the prop-
erty
superior to the interests of any owner, lessee or ten-
ant, and next in succession to the Town real estate taxes
thereon and to add the charges to the amount due for the
current Town real estate taxes on- said. property.
Sec. 5-2. Weeds and other foreign growth-on property.
The owners or occupants of property in the Town shall
cut the grass, weeds and other growth on the areas of such
property within 200 feet of an improved public right-of-way
or property line adjoining a developed lot whenever such
grass, weeds and other growth have reached a height of 12
inches or more, or in any event at least twice every year,
once between May 1 and June 15 and once between August 1
and September 15.
Upon information that grass , weeds and other growth ex-
ists in violation of this section, the Town Manager shall
cause written notice to be served by certified mail on the
owners or occupants of the property that such grass , weeds
and growth exist in violation of this section and requiring , .
such owners or occupants to cut "such grass, weeds and growth
within ten days after receipt of such notice and order.
If the owners or occupants of such lands fail to comply
with the notice and order in the time allowed, the Town Mana-
ger shall cause the work required to cut the grass, weeds and
other growth at the expense of the Town by its own agents or
employees and the amount of money so expended shall be re-
covered from the owners or occupants as provided herein.
In the event the Town has cut-the grass, weeds and other

growth on such land, the owners or occupants shall be noti-
fied that the Town has done so and shall be given an itemized
cost thereof by certified mail . If the sum due to the Town
has not been paid within 15 days from receipt of such notice,

the Town Manager shall_ and is -authorized -to distrain there-
for goods or chattels within the Town to collect the sum

SECTION II . That Section 11-38 of the Town Code is
hereby amended to read as follows :
Sec. 11-38. Dangerous, offensive, etc. , conditions on
property generally.
(a) It shall- be unlawful- for any -person to create,
maintain or permit to exist on his premises anything dan-
gerous, offensive or unhealthy, or any nuisance, building,
structure or addition thereto, which by reason of dilapi-
dation, defect of structure, or other causes may have be-
come dangerous to life or property or which may be erected
contrary to law.
(b) On complaint - of any police officer or citizen of
the municipality, the proper officer shall issue a warrant
,".1 summoning the person responsible for the condition or situ-
ation which is in violation of this section on a date desig-
nated in such warrant.
(c) If, after trying a case upon a warrant issued as
provided in this section, the court shall find the defendant
guilty of violating this section, the court shall give the
defendant a reasonable time, not to exceed 30 days, in which
to place his property in such condition as will not involve
a violation of this section, if in the judgment of the Court,
the violation is not corrected within the time prescribed in
the judgment, the court shall impose. a fine of not less than
$5. 00 nor more than $25 . 00 per day, such fine to commence at
the expiration of the time allowed in the judgment of the
court for the correction of the violation..
SECTION III . That Section 11-39 of the Town Code is
hereby repealed. • •
SECTION IV. That an emergency is declared and this
ordinance shall be - in full force and effect -from and after
its passage.
After explanation by Mr. Niccolls and some little discussion, the
ordinance was unanimously adopted, as shown:

On motion of Councilman Rock, seconded by _Councilman Orr, an
ordinance concerning parking_iri Or obstructing fire lanes and the
penalty for this and other parking violations was proposed. After
some discussion, Council voted unanimously, as shown, to accept this
on first reading, with Sec. 7-38.7 to be -advertised in full text and
Sec. 10-161 and 10-162 to be advertised in brief form, all for a
public hearing to be held by the Council on May 12, 1976 at 7 : 30 P.M.

76-0-7 • - Amendment of Sec. 6-2 of Town•. Code re Voting Places.
-On- motion -of Councilman Rock, .seconded by Councilman Orr, the
following ordinance was proposed and unanimously adopted, as shown:

Building, and the election of municipal officials
and the voting place for such election in the east
precinct shall be at the Loudoun County Rescue Squad
building. '

76-0-8 - Ordinance - Authorizing quit-claiMOits rights in and to
a parcel' of' land fronting on S. Wirt Street
' and adjoining' the lands of John -S. Paul, et ux.
On motion of Councilman Newman, seconded by Councilman Rock,
the following ordinance was proposed: •
' BE IT ORDAINED' by the' Council ' of' the' Town of Leesburg,
Virginia, as follows : '
SECTION I. That the Town hereby releases and quit-claims
unto John S. Paul and Betty A. 'Paul; _his'.wife, all of its
right's, title and' interest 'in and to Parcel .1 and Parcel 2
as shown on the plat of the John S. ' and Betty A. Paul
property in the Town of Leesburg, Leesburg Magisterial
District, 'L'oudoun County;' Virginia,.' made by' C. .Terry' Titus ,
C.L'. S. , dated April 7, 1976, copy of which is on record
in the Office of the Clerk of the Council .
SECTION' II. " That the •Mayor is hereby •authorized' and di-
rected to authenticate a quit-claim deed' granting and' con-

Mayor Hill pointed out' that 'this property has been used as a drive-
way for the property owner and the Town has never exercised its
right's' to ' it. Mr. Niccolls pointed out that' -Mr. Paul has' accepted
this property in exchange for $350. 00, which is the cost of research-
ing this claim and preparing the deed. On motion 'of Councilman Rock,
seconded by Councilman Orr, Council voted 5 to 1 abstention (Coun- "
Gilman Titus) ' to amend Section IF by adding at .the ''end the following:
", contingent upon the payment of $350. 00 for' legal fees . "
The Ordinance, as amended, was then adopted as shown: •

76-56 - Resolution - Approving General Plan for intersection
improvements at Market Street-Loudoun Street
and Morven Park Road. '

On motion of Councilman Newman, seconded by Councilman Rock,
the ' foll'owing resolution was proposed arid adopted 'by a vote of 5
to 1 , as shown: •
WHEREAS, the Virginia Department of Highways and Transpor-
tation has prepared a preliminary plan for Project #007-253-103-
PE101 , for intersection improvements at Market Street-Loudoun

Street and Morven Park Road ' and -submitted the plan for re-
view and approval by the Town; and '
•
WHEREAS, the plan calls for reconstruction of the above
mentioned intersection, one-way traffic eastbound on Loud-
oun Street and westbound on Market Street between the said
intersection and Ayr Street, as well as correction of the
sight distance problems existing on Loudoun- and Market
Streets between Morven Park- Road and Ayr Street:
NOW, ' THEREFORE, BE IT RESOLVED by the Council of the Town
of Leesburg. as follows :
That the general plan described above for inter-
section'Jmprovements at Market- Street-Loudoun -Street
and Morven Park Road are hereby approved with the
understanding the Town will be given an opportunity
to review and approve final plans after the Depart-
- ment ' s public hearing.

On motion -of Councilman , seconded by Councilman Orr, the fol-
r -lowing resolution was proposed:
BE IT .RESOLVED by the Town Council of the Town of Leesburg,
Virginia, as follows :
That the requirements contained in Article 9 (Site
Plan) of the Leesburg Zoning Ordinance be waived for
C. Herbert Pearson for the addition of a porch and
conversion of the interior of the building to five
individual stores, for the structure -located at 5 West
Loudoun Street (formerly known 'as the IGA building) .
' Mr. Pearson explained his ' plans for this building 'and'made 'sugges-
tions for amendment of the Town' s Site Plan Ordinance. Mr. Niccolls
felt it unnecessary for. Mr. Pearn on to ask for waiver of the entire
Site Plan Ordinance but, rather, 7should stick to the :applicable sec-
tions of the ordinance. Council had many questions and discussed
this at length, with -most members feeling that there is no point in
having a Site Plan Ordinance if a site plan is going to be waived,
as has been done many times in the past. The resolution was defeated
by a roll -Call -Vote, as . shown:

Abstention: Councilmen Chamblin' and Titus .'
Mr. Niccolls said that he and Mr. Forbes are starting work
this week on new subdivision and land development regulations for
the Town. This will incorporate many of the things now found in
this site plan section. The project will be divided into four
phases : (1') subdivi§ion and land development requirements ; (2)
rewriting of 'Subdivision Ordinance; (3) rewriting of sign ordinance,
providing they 'are not included in the Zoning Ordinance; - (1.) Thoro-
fare Plan. Along-with this, they will continue to ' look at the De-
sign Criteria and Construction Standards imposed by these ordi-
nances . This is about a one-year operation; with the-first ele-
ment to be ready for review and approval - by the Planning Couunis-
' Sion and then the Council in about ninety 'days or less . Thererfol.n
lowaldiscussion on this, with some members of Council feeling that
this job should be done -by the Director of Community Development
and the Planning Commission - the Town Manager should not have to
spend his valuable time on this . However, ' Councilmen Chamblin,
Rock and Titus ' offered their help when needed on this project.
On motion of Councilman Newman, seconded by Councilman Rock,
the following resolution was proposed:
BE IT RESOLVED by the Town Council of the Town of Leesburg,
Virginia, as follows

That the Town ,Manager is •hereby authorized and directed
to enter into an agreement with VEPCO for installation
of a separate line to the sewerage treatment plant as an
-alternate .power source at .a cost to .the 'town not to ex-
- ceed $16,440. 00 for- the- installation, .:plus- $100, per. month
maintenance fee for a period- of five years . •
There was lengthy discussion on the installation of an alternate
power source:at this time, with Mr. Niccolls^pointing out that this
requirement will have to be met in the future, regardless of how
many appeals are made. The resolution •was then unanimously defeated,
as shown: --

Mayor Hill. •
On motion of Councilman Rock, seconded by Councilman Chamblin, Council
voted unanimously that the Town Manager be. directed• to again object
to the requirement of an alternate power., source ,in the Town' s permit,
and that• he take whatever steps are necessary to appeal -to -the State
Water Control Board for reconsideration of this ;requirement.
• Councilman Orr left the meeting at this time. •

76-57. - Resolution - Acceptance of School Board Deed 'of Easement. '
On motion of Councilman Titus, seconded by Councilman Rock, the
following resolution was proposed: •
BE IT RESOLVED by the Town Council of the Town of Leesburg,
Virginia, as follows : . ,
That the Deed of Easement made the , 16th day of.March,,
1976 by-.and between the . School :Board of Loudoun County
and the Town of Leesburg for the construction and-main-
tenance of a sanitary sewer line across the new Leesburg
Middle School property is hereby accepted, and the Mayor
is authorized to acknowledge the-same on behalf of- the
- Town. .

Town Manager Niccolls 'explained that this is just-tone of the rer -
qui-rements..for the ultimate acceptance, of _the sewer system at ,the
Middle School . The resolution was then unanimously adopted, as
shown: -

76-58 - Resolution - Acceptance of Dedication of- Babson Land for
Public Streets, etc: and Vacation of Utility
Easement. -
On motion of Councilman Titus, seconded by Councilman Rock, the
following resolution was proposed: •-
WHEREAS, :the George Jason Corporation 'by deed dated April 2,
1960, and recorded- -in the -Clerk' s Office of the Circuit
Court of Loudoun -County, Virginia, in -Deed Book 396, . at page
466, granted and conveyed- to the :Town. perpetual rights-- of-
way., or easements -20- feet in width- for- the-construction and
maintenance of sanitary sewer and/or water lines; including
manholes , . on the western- half- of land .of the said :George
Jason Corporation; and '
WHEREAS, by deed made April 9, 1976, George J. and Elizabeth
. C. Babson,dedi-cated to the Town ascertain strip, or parcel of
land shown on a plat prepared 'by DeLashmutt Associates , Cer- -
tified .Land Surveyors, in December, 1975, :.entitled"Area to
be dedicated for public street purposes" , on which land the
sanitary sewer line and manhol'e; is located,
NOW, THEREFORE, BE IT RESOLVED by the Town Council of the
Town of Leesburg, Virginia, as follows :

SECTION I. That the dedication made by George J. and
Elizabeth C. Babson to the Town for all of a certain
strip or parcel of land shown on a plat prepared by
DeLashmutt Associates, C.L. S. ;" in December, 1975, en-
titled "Area to be dedicated .for public street purposes, "
is hereby accepted and the Mayor is authorized to ac-
knowledge the same on behalf of the Town.
SECTION II . That the Council hereby vacates and releases
to George J. Babson all of -its rights -granted and conveyed
to it for the construction and maintenance of sanitary sewer
and/or water lines, including manholes, by the -George Jason
Corporation insofar as the easement may affect the remain-
der of the land of George J. Babson after the said dedica-
tion, and the Mayor is hereby authorized and directed to
execute a quit-claim deed on behalf of the Town releasing
the said easement to George J. Babson to this extent.
After a brief explanation by -Mr. Niccolls and an explanation of the
• reverter provision by Town Attorney Martin, the resolution was unani-
mously adopted, as shown:

• 76-59 Resolution - Granting Encroachment on' Town Right-of-Way
on W. Loudoun Street tb C. Herbert :Pearson.
On motion of Councilman Newman, seconded by Councilman Titus,
the following resolution was proposed: -

That C. Herbert Pearson be and he is .hereby granted per-
mission to encroach on the Town right-of-way in front of
4 -West.toudoun `Street with a brick :stoop 46 ' .x:90" • simi-
lar to one at the Other- entrance to the same building:

Mr. Pearson explained that he wishes to : replace the wooden steps
in this location with a brick stoop similar to the one at the other
entrance to -this -building. Mr.- Niccolls advised that::the Highway
Department is not concerned with'an encroachment if .it does not -
impede traffic on the travelled part of the street. The resolu-
. tion was -then' adopted by a .vote of. 4 'to 1 abstentionr :as shown:

76-60 - Resolution -Granting Waiver of Business License Fee for

BE IT RESOLVED by the Council of the Town of Leesburg, Vir-
ginia, as follows : "
That Sec. 17-75 of the Town Code pertaining to Retail '.r . . ' -
Merchants is hereby waived for LARC and ECHO, non-profit
organizations, for -the purpose of -operating the Blossom
and- Bloom Thrift Shop, inc. through June 30, 1976.

76-61 - Resolution - Making Appropriations for 1975-76.
On .motion of Councilman Rock (for .the purpose of 'asking a ques-
tion) , seconded by Councilman Titus, the following resolution was
proposed:

There was -a question as to the $600. 00 appropriation for special
equipment for the Police Department. Mr. Niccolls advised that he
would furnish this information for the next meeting, however, it was
decided to go ahead and appropriate the amount at this time. Coun-
oilman Titus explained that the' McVay condemnation suit -was settled
last night for the amount of $18, 000. 00. It was suggested- that, as
soon as the deed is on record, Town employees will remove the fences
along this property. The resolution was then unanimously adopted,
as shown:

Nay: None.
Councilman Rock-also called attention to the fence that has
been erected around the rear of the property On-South--Kinr.Street
owned-.by Reynolds Jewelers . It was felt that this poses a fire
hazard. It was suggested that the Fire Marshal check into this.
'Town Manager Niccolls reported that word -has -.been received
that a Step I Facilities Planning Grant in the amount of $46,000
has been approved. This will allow the consultants to begin work
on the Wastewater Management Planning Study, Step I.
Mr. Niccolls also called attention to his note stating that he
will be in attendance -at - the Virginia Managers ' meeting next week.
Councilman Chamblin calledattention to the announcement made
by the School Board and the Board of Supervisors on the site for a
community swimming pool - this to be at the J. Lupton Simpson Middle
School . He asked if the Town has been approached on availability of
sewer for this purpose. Mr. Niccolls -said there has been no request
on this . It was felt that perhaps a copy of the moratorium resolu-
tion should be sent to -these bodies, reminding . them that the Town
will not ,be serving residents outside the corporate limits . Coun-
cilman Titus said he has received comments&concerning the spending of the
Towns money for this recreational facility. Mayor Hill said he is_
already on record as to such an 'expenditure outside the corporate
limits and that this mightpose a legal problem.
Councilman Titus called attention to a proposal from Frank Raflo
to write a history of the Town government in connection with the Bi-
centennial Celebration.
76-62 - Resolution - Accepting Proposal of Mr. Frank Raflo for
Preparation ofBookleton Town of Leesburg
• in Connection with National Bicentennial.
On motion of Councilman Titus, seconded by Councilman Rock, the
following resolution was proposed and unanimously adopted after some
discussion, as shown:
WHEREAS, Mr. Frank Raflo •has presented to the Town Council a
proposal to preparea booklet telling the story of the Town of

WHEREAS, the Council is desirous of having such a booklet
available for sale in connection with the National , Bicentennial,

NOW, THEREFORE, BE IT RESOLVED by the Council of the Town
of Leesburg, Virginia, as follows :
That the Council accepts Mr; Raflo ' s proposal of
April 12, 1976 toproduce 5, 000 copies of such.a
booklet at a cost of $4, 500. 00, to be delivered
to the Town- prior to July 4; 1976, and with• the
stipulation that all resource materials taken from
the Town Office shall be returned before final pay-
ment is made.
Councilman Newman asked that everyone mark his calendar for
May 14th from 5 : 00 to 7 : 00 P.M. , at which time the Council will be
giving a reception for the new Town Manager at the Rescue Squad
Building. All residents and members of the business community will
be invited as well .
Mayor Hill publicly apologized to Councilman Newman for the con-
fusion which arose concerning an event to honor Lady Loudoun. By
the time he was able to reach Mr. Lawrence, it was too late to plan
something for the allotted time. It seemed that Mr. Harris already
had her itinerary well planned. Therefore, the Town will be doing
nothing officially for Lady Loudoun.
Zt' Mr. Pearson requested that Council :consider the waiver of four
specific sections of the Site Plan Ordinance in order to allow him
to proceed as quickly as possible on the IGA Building. Mayor Hill
suggested that he present his proposition to the Town Manager and
it will be considered at the next meeting. Councilman Newman sug-
gested that perhaps he would like to bring these suggestions to the
Workshop session next Wednesday night.
On motion of Councilman Newman, seconded by Councilman Rock,
the meeting was adjourned at 10: 03 P.M. _
