MINUTES OF REGULAR MEETING OF LEESBURG TOWN COUNCIL, APRIL 28; 1976.
A regular meeting of . the Leesburg Town Council was .held in the
Council Chambers, 10 West Loudoun Street, Leesburg, Virginia on
April 28, 1976 at 7 : 30 P.M. ; The meeting- was called to order by
the Mayor, with Councilman Titus offering the invocation and fol-
lowed with the Salute to the Flag. . Present were: Mayor G. Dewey
Hill , Councilmen Charles E. Bange, " James•.H. ..Chamblin, " Mary Anne
Newman,.- James- A. Rock and C. -.Terry Titus ; . also Town Manager John
Niccolls and Town Attorney George M. Martin. Absent. from the meet-
ing was Councilman Robert A. Orr.
The minutes of regular. meeting of April 14, 1976 were approved
as written.; . . . . •
76-63. -..Resolution. - Authorizing Release of Easement on Hakim
Associates Property to Washington-Lee .Sav-
ings & Loan Association.
On motion of Councilman Titus, seconded by Councilman Rock, the
following resolution was proposed: and. unanimously adopted, as shown:
WHEREAS, . the Town. of Leesburg acquired an easement by deed
dated May 22, 1975, recorded in Deed Book 618, .Page 420,
from Washington-Lee Savings & Loan Association for the con-
struction, repair, reconstruction, . enlargement .and mainte-
nance of a. water main and other utility lines under and
across .the ,land of the grantor situate, lying and: being
in the Town .of Leesburg; and `-•

WHEREAS, the easement is. no longer, necessary since- the .
Town has abandoned its suit to acquire by condemnation. a-
well site on the land of Hakim Associates adjoining the
said easement and which easement was vitally necessary
for the utilization of the well initially• proposed •to..be
drilled on the lands of Hakim Associates ; and
WHEREAS, the Council wishes to relieve the land of the
grantor of the servitude of said easement;
NOW, THEREFORE, BE IT RESOLVED by the Town Council of the
Town of Leesburg, Virginia, as follows :
That the Mayor be and he is hereby authorized to execute
a deed on behalf of the Town releasing and extinguishing
any and all rights unto Washington-Lee Savings & Loan As-
sociation acquired by the Town under the terms of the
aforesaid Deed of Easement and the Town Attorney is di-
rected to prepare a deed appropriate for this purpose.
Aye: Councilmen Bange, Chamblin, Newman, Rock, Titus and
Mayor Hill .
Nay: None.
76-64 - Resolution - Awarding Workmen' s Compensation, General "
Liability and Umbrella -Liability Insurance
Policies .
Town Manager Niccolls distributed and explained to Council a
tabulation of proposals received from two firms on the Town' s in-
surance needs . It was his recommendation to continue the present
coverage with the present agents . Mr. B. Powell Harrison, Jr. of
Armfield, Harrison & Thomas spoke briefly, voicing assent to Mr.
Niccolls recommendation. - Councilmen Titus and Bange had talked
with the partners in Moore, Clemens & Co. - they too recommended
that the Town continue with its present insurance,policies. On
motion of Councilman Rock, seconded by Councilman Titus, the fol-
lowing resolution was proposed and unanimously adopted, as shown:
BE IT RESOLVED by the Town Council of the Town of Lees-
burg, Virginia, as follows :
That the Workmen' s Compensation, General Liability and
Umbrella Liability insurancecontracts for the Town re-

main with the present carriers, i. e. , Workmen' s Compensa-
tion and General Liability with Armfield, Harrison & Thomas
and the Umbrella Liability with Moore-Clemens and Company.
Aye: Councilmen Bange, Chamblin, Newman, Rock, Titus and
Mayor Hill .
Nay: None:
76-65 - Resolution - Making Appropriation for 1975-76.
On motion of Councilman Rock, seconded by Councilman Titus,
the following resolution was unanimously adopted; as shown:
BE .IT RESOLVED by the Town Council of the Town of Leesburg,
Virginia, as follows :
That the following appropriation is made for the fiscal
year ending June 30, 1976:

n Town Manager Niccolls said the Proposed Budget for the fiscal
year ending June 30, 1977 will be distributed to Council members
• on Friday of this week. Also to be discussed at Workshop session
is the schematic design for the Town Office remodeling, along with
cost estimates . This should be reviewed andisome direction given
to the architect. Public Hearing on the Budget and Tax Rate is
scheduled for the June 9, 1976 meeting. Mr. Niccolls also reported
that Mr. Jeffrey Minor has reported for work as the Assistant to
the Town Manager.
IlLCouncilman Rock called attention to the old abandoned and par-
tially burned building next to McKimmey' s Feed Store = •children are
playing inside it and it is a hazard. He also called attention to the
pot-holes in Valley View Avenue between Prospect Drive and Belmont
Drive - they are sinking. Mr. Niccolls said Mr. Minor will be start-
ing an orderly survey of such situations in Town next week - he is
familiar with the procedures in such cases .
Councilman Titus asked about the traffic situation at the inter-
section of Catoctin Circle and King Street. Mr. Niccolls advised

Mayor Hill suggested that Council members stop by the Town Office
and meet Mr. Minor, the new Assistant to the Manager.
A letter from Mr. C. Herbert Pearson was readby the Clerk, this
letter requesting reconsideration of the site plan waiver recommended
by the Planning Commission, thus enabling him to proceed with the
remodeling and addition to the front of the old IGA building recently
purchased by him. Mr. Pearson said he is offering square footage for
rent in this building and the better looking the building, the better
tenants he can get. The building is not being enlarged, he is creat-
ing no more drainage and there ars §l pAy adgquate water and sewer
facilities. He is proposing

ant. On motion of Councilman Rock, seconded by Councilman Bange,
Council voted 5 to 2 abstentions, as shown,. to refer this matter to _
the Workshop session:

On motion of Councilman Rock, seconded by Councilman Titus, the
meeting was adjourned at 8 : 15 P.M.
