Segurola Interim Village Manager Olarles R Press \VlLLAGE OF KEY BlSCA YNE Ferreira Construction Hector Blanco, Project Manager 9455 N.W. 1 04th Street, Medley, Fl. 33178 P 305.805 .6900 II M 786.868.5323 April29,2021 Attn: Mr. Hector Blanco: As you are aware, the Village of Key Biscayne (the "Village") and Ferreira Construction (the "Ferreira") entered into a contract for construction, dated February 24, 2021 for the Beach Renourishment Maintenance Event Project within the Village (the "Contract"). Pursuant to Section 2.2 of the Contract, Ferreira was required to complete the work within 60 calendar days of the Notice to Proceed. The Village is in receipt of your letter, dated April 14, 2021, requesting an extension of time to complete the scope of work as a result of the challenges that Ferreira has faced in obtaining dune plantings materials to complete the dune restoration tasks within the Contract. The Village acknowledges the industry wide shortage of plant material and the delay that it has caused in reaching 1 00% completion on the project within the specified time frame provided in the Contract. Accordingly, the Village agrees to a no cost extension, pursuant to the Contract, for a period not to exceed 6-months from the date of this letter in order to secure and complete the required dune planting. Please be advised that the Village acknowledges final acceptance of the beach and dune profiles consistent with the post-construction surveys provided to the design engineer (Moffatt & Nichol) with the exception ofthe dune plantings to be completed upon procurement of said materials. Please note, if exotics take root in areas prior to deploying dune plants, Ferreira will be responsible for removal of invasive species within the dune area prior to planting. This may increase the area shown in the contract for invasive removal. This should be done at no additional cost to the Village. Plant material shall conform to previously accepted project specifications and planting activity must conform to turtle season requirements for working on or in the dune line and transiting on the beach. Dune planting during the turtle nesting season cannot proceed without daily clearance from the Miami-Dade County turtle monitor. Ferreira is to notify the Village Project Manager (Dr. Roland Samimy) five working days in advance of initiating dune planting and will first plant out the newly created dune at the southern-most extent of the project area to stabilize sediment as soon as possible.
