A regular meeting of the Leesburg Town Council was held in the Council Chambers, 10 West Loudoun Street, Leesburg, Virginia, on • October 13, 1976 at 7 : 30 P.M. The meeting was called to order by the Mayor, with the invocation being offered by Mr. Cole, and fol- lowed with the Salute to the Flag. Present were: Mayor Mary Anne Newman, Councilmembers Charles E. Bange, Glen P. Cole, Stanley D. Herrell , Jr. , James A. Rock, C. Terry Titus and John W. Tolbert, Jr. ; also Town Manager John Niccolls , Assistant to ,Town Manager Jeffrey H. Minor and Town Attorney George M. Martin. The minutes of regular meeting of September 22, 1976 and special meeting of September 28, 1976 were approved as written. Mayor Newman presented to Mr. Dick A. Richards a Certificate of Appreciation for his ten years of service as a member of the Leesburg Board of Architectural Review. Mr. Richards -responded with appre- ciative remarks. • 76-0-19 - Ordinance - Regarding the dissemination of criminal history record information for the purpose of general investigation of applicants for municipal em- ployment. On motion of Mr. Bange, seconded by Mr. Cole, the following ordi- nance was proposed and unanimously adopted: BE IT ORDAINED by the Council of the Town of Leesburg, Vir- ginia, as follows : SECTION I. That the Town Code is hereby amended by adding a new section to be numbered Section 14-7 , which shall read as follows: Sec. 14-7. Officers to provide record information of applicants for municipal employment. (a) As used in this section the words "criminal his- tory record information" shall mean records and data collected by Criminal Justice Agencies on adult individuals consisting of identifiable descriptions and notations of arrest, deten- tions, indictments, informations, or other formal charges, and any disposition arising therefrom. The term shall not include juvenile record information which is controlled by Chapter 8 of Title 16. 1 of the Code of Virginia. (b) The chief of police, police clerk and such other police officers as the chief of police may designate are authorized and directed to furnish criminal history record information to individuals authorized by the town tanager to perform personnel functions, for use during general in- vestigations of applicants for employment by the municipality, to determine if the past criminal conduct of such applicants is compatible with the nature of the employment. SECTION II. That an emergency exists' and this ordinance shall be in full force and effect from and after- its passage. iv Aye: Councilmembers Bange, Cole, Herrell , Rock, Titus, Tolbert and Mayor Newman. Nay: None. 76-158 R Resolution - Revising the Leesburg Personnel Manual by in- corvoratin a posifion classification for the position of Parking Meter Attendant. On motion of Mr. Cole, seconded by Mr. Herrell, the following resolution was proposed: BE IT RESOLVED by the Town Council of the Town of Leesburg, Virginia, as follows : That an additional position classification is hereby added to the Leesburg Personnel Manual for the position of Parking Meter Attendant to be shown on page 50-A to read as follows: 117:: MINUTES OF OCTOBER 13, 1976 MEETING. Law Enforcement Group Grade 5 PARKING METER ATTENDANT GENERAL DUTIES : Identifies and tags vehicles in violation of overtime parking regulations and provides information to superior officers regarding other parking violations as necessary in accordance with Section 10-180 of the Town Code. DISTINGUISHING FEATURES : Maintains pleasant attitude with public while identify- ing and tagging as appropriate vehicles in violation of park- ing regulations. Has little discretion in performance of duties. Works under direction of Chief of Police dr other superior officer. Position is part-time. REPRESENTATIVE EXAMPLES OF TASKS : (Illustration only) 1. Identifies and tags motor vehicles in violation of parking meter regulations as found in Article 6, Division • -a 2 , of the Town Code. 2. Obtains warrants from District Court as necessary to insure enforcement of above regulations. _ 3. Provides information regarding other parking vio- lations to superior officers as required. 4. Performs related work as required. MINIMUM EXPERIENCE AND TRAINING: High School diploma, age 18 or over, and of good health and character. Mr. Niccolls explained that this person would not be a member of the police force, but will be assigned to that department —This person' s duties will be to identify and tag motor vehicles in vio- lation of overtime parking regulations. No gun will be carried by this person. Mr. Titus moved to amend the age limit to 21, how- ever, there was no second - the amendment therefore died. It was determined that the legal age is now 18. The resolution was adopted by a roll call vote of 6 . to 1 : Aye: Councilmembers Bange, Cole, Merrell, Rock, Tolbert and Mayor Newman. Nay: Councilmember Titus. 76-159 - Resolution - Authorizing a contract with Kamstra, Dickerson and Associates for the 1976 Old and Historic District Planning Program On motion of Mr. Cole, seconded by Mr. Tolbert, the following resolution was proposed: BE IT RESOLVED by the Council of the Town of Leesburg, Vir- ginia, as follows : That the manager is hereby authorized and directed to enter • into an agreement with Kamstra, Dickerson and Associates, 1608 Washington Plaza, Reston, Virginia, for planning and architectural services as described in the work program for the 1976 Old and Historic District Planning Program and the August 5, 1976 proposal submitted by Kamstra, Dickerson and Associates at a cost not to exceed $15, 000. There followed discussion, during which it was revealed that some Council members were not satisfied with the work of the previous con- sultant on this project. Mr. Titus expressed his dissatisfaction with : x18 MINUTES OF OCTOBER 13, 1976 MEETING. that consultant and said he was not 100 percent sold on the project, however, this consultant is more acceptable to him and for that rea- son he will support the resolution. Mayor Newman felt this is a recommended study under the Comprehensive Plan and it must be done eventually - the longer you wait the more expensive it will be. Mr. Bange inquired as to whether there would be overlapping work involved with the change to another consultant. Mr. Niccolls felt there would be no problem with this - this firm has prepared a De- sign Manual for another area and this would be the only problem. Mr. Titus suggested a discussion with KDA concerning what the town really wants from this study. Mr. Herrell was not in favor of this work at all, he felt that sidewalks and safety of pedestrians was more important than this. The resolution was then adopted by a roll call vote: Aye: Councilmembers Cole, Rock, Titus , Tolbert and Mayor Newman. Nay: Councilmembers Bange and Herrell. - 76-160 - Resolution - Authorizing purchase of a cab and chassis and making an appropriation for same. On motion of Mr. Bange, seconded by Mr. Rock, the following reso- lution was proposed and unanimously adopted: BE IT RESOLVED by the Council of the Town of Leesburg, Vir- ginia, as follows : SECTION I. That the manager is hereby authorized and di- rected to purchase a new 1977 cab-chassis from Bishop & Criste Pontiac-GMC, Inc. equipped in accordance with the specifications issued by the Director of Public Works at a cost not to exceed $7, 953. 29, and also to proceed with the remounting of the bed and salt spreader. • SECTION II. That the following additional appropriation is made for the fiscal year ending June 30, 1977 : Account No. and Name Appropriation 10110. 807 Street Division, Equipment $1 ,253. 29 • Aye: Councilmembers Bange, Cole, Herrell, Rock, Titus, Tolbert and Mayor Newman. Nay: None. - • 76-161 - Resolution - Authorizing purchase of one 1977 intermediate size station wagon. On motion of Mr. Cole, seconded by Mr. Bange, the following reso- lution was proposed: BE IT RESOLVED by the Town Council of the Town of Leesburg, Virginia, as follows : That the town manager is authorized and directed to purchase one 1977 Chevelle station wagon from S & R Chevrolet, Inc. , 149 East Market Street, Leesburg, Virginia, in line with their bid opened September 16, 1976, at a cost not to exceed $4, 649. 00. Mr. Bange requested that this wagon have "Community Relations" painted on the side. Mr. Niccolls advised that this would be done, it is felt that this is very important. The resolution was adopted by a roll call vote of 6 to 1 : Aye: Councilmembers Bange, Cole, Rock, Titus, Tolbert and Mayor Newman. On motion of Mr. Bange, seconded by Mr. Rock, the following resolution was proposed and adopted by a vote of 6 to 1 abstention: BE IT RESOLVED by the Council of the Town of Leesburg, Vir- ginia, as follows : That the following additional appropriation is hereby made for the fiscal year ending June 30, 1977 : Account No. and Name Original Approp. Revised Approp. 1010. 262 - Election Expense -0- $ 413.00 ' 9010. 247 - Hypertension/ Heart Disease Tests -0- 1, 200. 00 Aye: Councilmembers Bange, Cole, Herrell , Titus, Tolbert and Mayor Newman. Nay: None. Cr.) Abstention: Councilmember Rock. r Mr. Niccolls elaborated on a report presented to Council concern- s ing sewer plant sizing. After extensive discussion of this matter, it seemed to be the consensus of Council that the engineer should proceed on a five percent growth rate with an assumed 75 percent I/I removal to the year 1985. Mr. Niccolls reported that he had met with a group of citizens from the Waverly Heights section on October 5 concerning numerous problems in that area. A follow-up on these matters will be pre- sented to Council at a later date. Mayor Newman reported that she had visited the Sewage Treat- ment Plant to see the new piece of equipment "Big Wheels." She asked that others go down and take a look at it - it is a tremendous piece of equipment. Mayor Newman also reported that the scheduled showing of community relations films by the Police Department will be rescheduled since none of the Council members wereable to be present. Mr. Bange publicly congratulated the Fire Department and the Res- cue Squad, along with Town forces, for their excellent work over the week-end during the storm. Mr. Titus asked that the School Board be requested to move poles that guard against traffic at the high school back from where they have floated next to the pavement. He also requested that safety measures be taken at the intersection of Catoctin Circle and Dry Mill Road for the protection of school children. Mr. Titus also felt that there should be some understanding as to Council ' s intent with regard to furnishing sewer service for the proposed swiuiuing pool on the Simpson Middle School property. Mr. Rock reported that water covers a manhole at the end of his fence -line and suggested that raising the manhole might help. He also noted that the report on the Waverly Heights problems included the fact that sidewalk construction would be included in the 1977-78 budget. He suggested that perhaps a small bond issue should be con- sidered to include a sidewalk construction program and the completion of the storm drainage problem from Hirst' s to the end of the water- shed. This suggestion generated rather extensive discussion, with Mr. Bange asking if Revenue Sharing funds could not be applied -against a bond issue. Mr. Niccolls agreed that this could be done, but it would not be a significant amount of money compared to the need, how- ever, the town could retire a debt from these funds. He also said that next year' s budget will include a short-term capital outlay program. Mr. Rock also called attention to a small Highway Depart- ment project east of town - this is the only one he has ever seen that did not have a sign posted "Your tax dollars at work." 121 MINUTES OF OCTOBER 13, 1976 MEETING. Mr. Titus asked if the award has been made on the Rt. 15 urban project: Mr. Niccolls advised that it has been - it is included under New Business. Mr. Titus said he had been informed that the town has been approved 'for a substantial sum in the next fiscal year for a new sewage treatment plant. Mr. Niccolls said this is Step II money for design - he did not think the final allocation had been confirmed. Mr. Bange inquired as to whether the contractor on the water line in Edwards .Ferry Road is required to repair the road as he goes. Mr. Niccolls explained that there are funds in the contract for re- doing the area that they disturb, but the pipe job id not far enough along to smooth outand overlay the entire road this year. The town Will have to add funds to do this road properly. -The Public Works Department is making sure the facilities in the road are low enough. Mr. Niccolls also said that the 1977 budget will make recommendations for "safety-related" sidewalks. Agreement with Highway Department concerning Route 15 improvements. On motion of Mr. Bange, seconded by Mr. Herrell , a resolution authorizing approval of an agreement with the Highway Department concerning Route 15 improvements was proposed. Mr. Titus objected to consideration tonight - he was desirous of knowing where funds for this project would come from. Mr. Niccolls explained that the greater part of this money would come from the 1977 budget. He also stated that the town has already paid approximately $20, 000 on this • project. He said he would prepare a summary of General Fund expendi- tures based on the first quarter' s operations. Since there was ob- jection to considering tonight, this matter will be discussed at the next workshop session of Council.
