SECOND AME}iIDMENT TO WATf,R TOWER ATTACIIMENT LEASE AGREEMENT
T}trS SECON'D AMENDMENT TO WATER TOWER ATTACHMENT LEASE
("Amendment'') is made and entered into by and between The City ofTybee Island, ("I-andlord'), ald
SunCom Wireless ?roperty Company, LLC, successor in interest to Triton PCS Property Compary LLC
("Tenant").
The parties hereto recite, declare and agree as follows:
Landlord and Tena[t (or as applisablg their respective predecesson in interest) entered into a Wder
Tower Attachment Lease Agreement dated August 1i, 1999 (including any prior amendments, ttre
'T-ease"), with respert to Water Tark located at I 1 1 Butler Avenue, Tybee Island GA 3 1328.
WHEREAS, taadlord and Teaant desire to amend tle Lease to ailow Tenant to modi! Tenant's odsting
Communications Equipment and
NOW, TTIEREFORE, in consideratiot ofthe mutual covenants and agreements herein contaiDed and
other good and valuable consideratiorq the receipt and sufficienoy ofwhich are hereby acknowledged,
Landlord and Tenant covenart and agree as follows:
1. Effective as ot E/q , 2017, Tenant will have the right to modifr its Antenn: Faeilities
as described and depicted on dxhibit A, which is attached herao and by this reference incorporated
herein, and t andlord hereby consents to and approves of the modifications described and depicted on
Exhibit A in all respects.
2. The terms ard conditions ofthe l,ease are incorporated herein by this reference, aud
capitalized terms used in this Amendment shall have &e same meanings such terms are given in the
Lease. Except as specifically set fort! herein, this Amendment shall in no way modrfy, alter or amend the
remaining terms of the Lease, all of which are ratified by the parties and shall Ernain in full force and
effect. To the extent there is any conflict b€tween fte terms and conditions of the Lease and this
Amendment, the terms and conditions ofthis Arnendment will govern and control.
3. Landlord represents and warrarts to Tenant that the consent or approval of no third party,
including without limitation, a lender, is required with respect to the execution of this Amendmen! or if
any such tlird party conseat or approval is required, Landlord has obtained any aad all such consents or
approvals.
IN WITNESS WHEREOF, the parties have executed tlis Amendment effective as of the date of
execution by the last party to sign.
