290 MINUTES OF SPECIAL MEETING OF LEESBURG TOWN COUNCIL, SEPTEMBER 7, 1977 .
A special meeting of the Leesburg Town Council was held, at the
call of the Mayor, in the Council Chambers, 10 West Loudoun Street,
Leesburg, Virginia on September 7, 1977: The meeting was called to
order by the Mayor at 9 : 37 P.M. Present were: Mayor Mary Anne
Newman, Councilmembers Glen P. Cole, Stanley D. Merrell, Jr. ; James
A. Rock, C. Terry Titus and John W. Tolbert.. Jr..; ..also Town Manager
John Niccolls, Assistant to the Manager Jeffrey H. Minor, Director
of Engineering Andrew G. Shope and Town Attorney George M. Martin.
Absent was Councilmember Charles E. Bange.
All members present acknowledged consent to this special meet-
ing.
Mayor Newman stated that the purpose of this meeting is to con-
sider
a resolution consenting to water use restrictions.
Mr. Niccolls gave an in-depth report on the serious condition
-of :the- Town';s water supply and the emergency measures being con-
sidered by the staff to provide water to the Town' s water customers.
Inaddition, flyers have been delivered to all residences asking
cooperation in new restrictions.
77-158 - Resolution - Consenting to water use- restrictions.
On motion of Mayor Newman, seconded by Mr. Tolbert, the follow-
ing resolution was proposed:
RESOLVED by the Council for the Town of Leesburg, Virginia,
as follows :
Pursuant to Section 19-5 of the Town Code, consent is given
to the following water use restrictions :
1 . No water users shall use water from the town water
system for lawn, shrubbery, garden or tree watering
or irrigation.
2. No water users shall use water from the town water
system for patio, driveway or parking lot washing.
3. No water users shall use water from the town water
system for car, truck or other vehicle washing.
4. Users of water from the town water system shall take
measures necessary and appropriate to reduce use of
water by one-third.
On motion of Mr. Titus, seconded by Mr. Tolbert, Council voted
5 to 1 to amend the resolution by addin at the end of No. 2 the
words "or the filling of swimming pools
Aye: Councilmembers Cole, Herrell,_ Titus, Tolbert and
Mayor Newman.
Nay: Councilmember Rock.
On motion of Mr. Titus, seconded by Mr. Cole, Council voted
unanimously to amend the resolution by deleting 'No. - 4:
Aye: Councilmembers Cole, Merrell, Rock, Titus , Tolbert and
Mayor Newman.
Nay: None.
The resolution, as amended, was unanimously adopted and reads
as follows :
RESOLVED by the Council for the Town of Leesburg, Virginia,
as follows :
Pursuant to Section 19-5 of the Town Code, consent is given
to the following water use restrictions :
1. No water users shall use water from the town water system
for lawn, shrubbery, garden or tree watering or irrigation.

2. No water users shall use water from the town water

Aye: Councilmembers Cole, Herrell , Rock, Titus, Tolbert and
Mayor Newman.
Nay: None.
Proposed ordinance establishing excess water use charges.
On motion of Mr. Rock, seconded by Mr. Titus, a proposed ordi-
nance establishing excess water use charges was moved for discus-
sion. Mr. Herrell voiced objection since this item has not been to
workshop. On motion of Mr. Rock, seconded :by Mr. Tolbert,. it was
proposed to refer this ordinance to the next workshop. .. On :motion
of Mr. Titus , seconded by Mayor Newman, a substitute motion was :pro-
posed and adopted by a vote of 5 to 1 that this ordinance be heard
at the next Council meeting as a regular agenda item:
Aye: Councilmembers Cole, Rock, Titus, Tolbert and Mayor Newman.
Nay: Councilmember Herrell .
77-159 - Resolution - Authorizing a contract for a submersible pump
assembly at Phillips-Nickels Well.
On motion of Mr. Herrell , seconded by Mr. Cole, the following
resolution was proposed and unanimously adopted:
RESOLVED by the Council of the Town of Leesburg, Virginia,
as follows :
SECTION I. The manager is authorized and directed to
enter into a contract for the purchase and installation
of one 50 horsepower/500 gpm submersible motor and pump
assembly for the Phillips-Nickels well at a cost not to
exceed $10, 000.
SECTION II. An appropriation is made to Account No.
10300. 217 , Repairs to Wells , for the fiscal year end-
ing June 30, 1978 in the amount of $10, 000.
Aye: Councilmembers Cole, Herrell , Rock, Titus, Tolbert
and Mayor Newman.
Nay: None.
77-160 - Resolution - Authorizins Town Attorney to prepare an ordi-
nance for issuance of up to $7 , 000, 000 in bonds.
On motion of Mr. Rock, seconded by Mr. Tolbert, the following
resolution was proposed:
RESOLVED by the Council of the Town of Leesburg, in Virginia,
as follows :
The Town Attorney is directed to prepare for Council con-
sideration, at its September 28 meeting, an appropriate
ordinance as described in the Code of Virginia to provide
for issuance of up to $7 , 000, 000 in bonds, for a term of
up to 25 years at a maximum rate of interest of six percent,
for construction of the Potomac River Water Treatment Plant
and necessary storage and transmission facilities.
After lengthy discussion, the resolution was adopted by a roll call
vote:
Aye: Councilmembers Cole, Rock, Tolbert and Mayor Newman.
Nay: None.
Abstention: Councilmember Titus. -
Pass : Councilmember Herrell.

On motion of Mr. Rock, seconded by Mr. Cole, the meeting was
adjourned at 11 : 25 P.M.
