"FEES" OF CHAPTER 160 "LAND DEVELOPMENT" OF THE CODE OF
THE BOROUGH OF CARTERET CREATING A NEW ARTICLE VIA TO
BE ENTITLED "DEVELOPMENT IMPACT FEES"
BE IT ORDAINED by the Mayor and Borough Council of the Borough of
Carteret, a municipal corporation of the State of New Jersey, located in Middlesex
County, thereof, as follows:
Section 1. Chapter 160 of the Code of the Borough of Carteret entitled "Land
Development ', is hereby amended and supplemented to create a new Article VIA
to be entitled "Development Impact Fees" to read as follows:
DEVELOPMENT IMPACT FEES
Section 160-46.2. Impact fees.
A. Each square foot of new construction of warehouse space shall be
assessed an impact fee of $1.00.
B. Each square foot of new construction of retail, commercial and/or
other industrial space shall be assessed an impact fee of $2.25.
Section 2. All Ordinances and/or provisions thereof inconsistent with the
provision of this Ordinance shall be and are hereby repealed as to the extent of
any such inconsistencies.
Section 3. If any section, subsection, part, clause or phrase of this Ordinance
shall be declared invalid by judgment of any Court of competent jurisdiction, the
section, subsection, part, clause or phrase shall be deemed to be sever able from
the remainder of this Ordinance.
Section 4. This Ordinance shall take effect upon passage and publication
according to applicable law.
