A regular meeting of the Leesburg, Town Council was held in the
Council Chambers, 10 West Loudoun Street, Leesburg, Virginia, on
October 11 ,1978 at 7 : 30 P.M. The meeting was called to order by
the Mayor, with the invocation being given by Mr. Herrell, and
followed with the Salute to the Flag. Present were: Mayor Ken-
neth B. Rollins, Councilmembers Stanley D. Herrell , Jr. , G. Dewey
Hill, Jr. , Marylou Hill , Walter F. Murray and- John W. Tolbert, Jr. ;
also Town Manager John Niccolls, Assistant Manager Jeffrey H. Minor,
Director of Finance Donald 0. T ylor and Town Attorney George M.
Martin. Absent from the meeting7� ouncilmember Glen P. Cole, who
joined .themeeting later in the evening.
The minutes of the regular meeting of September 27 , 1978 were
approved as presented.

, Mayor_ Rollins presented a Certificate of Appreciation to Mr.
Allen- Miller of- Allstate Safe and Lock Service for his participation
in and his contribution of time and effort, including the use of his
equipment, to the recent "Operation Identification" project conducted
by the Leesburg Police Department in its program to eliminate bur-
glaries in Leesburg.
Mayor Rollins also presented a Certificate of Commendation to
Robert A. Bangle, member of the Leesburg Police Department, for his
concern, dedication and involvement with the "Operation Identification"
program.
Manager' s Report :
(1 ) Leesburg' s utility bills for the first quarter of this fiscal
year went out Friday. Revenue projections, based on this quarter' s
experience, are about 96 percent of what the. Budget showed. Conver-
sion to the automatic billing process was 100 percent successful -
this will save a tremendous amount of manpower. Most questions from
customers have to do with the amount of the bill, particularly the
fact that the sewage charge ishigher than the water charge. The
explanation, of course, is that it is far more expensive to operate
the sewage system than the water system at this time.
(2) The 1978 resurfacing program should begin. tomorrow.
(3) Fluoridation of the water supply began Tuesday and Wednesday
of this week. , Town forces were used to construct the control building
at the shop facility - they did an- excellent job. In addition, they
have completed reconstruction of Well House No. 2 at the shop, which
was destroyed when the old tank was taken down.
(4) The Foodmaker lot transfer was closed today and the bond
anticipation notes turned over to First Virginia Bank-First National
in exchange for the $150, 000, which is now in the Town' s account.
(5) Andy Shope and he met with members of the Fire Company
Monday to discuss several matters , including water distribution
system improvements now underway, their concern about- hydrant lo-
cations and their concern about one-way traffic on Route 7 west to
several hundred feet west of the "V" . Their suggestions will be
taken back to the Highway Department design engineer.
(6) An action was filed against the Town concerning an order
issued for the removal of a sign on the building located at the
southeast corner of King and Loudoun Streets. The suit requested
a restraining order concerning the removal of the sign and asked the
Court to declare the projecting sign ordinance unconstitutional. He
felt that this suit will be resolved amicably before and without any
more action before the Court. Thus, both parties would be winners.
(7) For the past six months an attempt has been made to re-create
the Phillips-Nickels Well. . This project came to an unsuccessful close
last week. It was thought that this could be developed into a Class
2-B facility. A very large cavern about 37 feet below the surface was
created while the contractor was pumping the well , using an air pump
system. The well is too shallow for use as a 2-B facility and will
have to be abandoned, but it is better that this happened now rather
than after it had been developed. A lot of money has been sunk into
this project, probably in the $35, 000 range. Knowing what we do now,
we would not do this again.

(8) He called attention to information distributed tonight con-
cerning the Washington Post article 'on the Sewage Treatment Plant
operations over the past 13 months. This article .reported that Lees-
burg was allowed to discharge excessive amounts of pollutants for five
months . This just was not the case. There are actual copies of re-
ports to the State Water Control Board, along with copies of letters
to the Board at the time ofthese occurences. Copies have also been
provided to the Post, 'to Mr. Noman Cole (apparently the source of this
misinformation) and Mr. Moore, the SWCB District Supervisor.
Mayor' s Report :
Mayor Rollins announced an invitation to the Fire Department' s
Open House and special dedication on Saturday, October 14th.
Council Comments :
Mr. Hill passed on to the Mayor a comment concerning the fire
hydrant situation - a suggestion to perhaps paint an insignia on the
street to identify the hydrants. He commented that the Washington
Post article is just about like others they come up with and he gives
it just about that much credence.
Mrs. Hill asked if a temporary traffic light might -be considered
iI at the Leesburg Plaza shopping center with the opening of K-Mart.
tp Mr. Niccolls said there will be a long delay between now and the
time the Highway Department project will be completed in this area -
it will probably be sometime in 1980 before the project is completed
and the signals operational . However, if we meet the Highway De-
partment' s warrants, 'we would be allowed to do' this. He said he
will get an estimated cost for a ,temporary signal . Even tho this
will be taken care of in the urbah project, Mr. " Niccolls said he
has seen no paper work on this yet and the Design Engineer said it
will require one year to complete the right-of-wayacquisition.
Town services have been offered on this and plans have been requested.
They are, pre'sumably on their way here, but we have notyetreceived
them. The cost of these acquisitions would be split, on the same basis
as the rest of the work (probably 90 - 10) and we would be reimbursed
for acquiring the rights-of-way.
Mr. Herrell felt that the Town should, take a close look at every-
thing from the Plaza all the way to Reed Johnson"s - there is a steady
stream of traffic turning right there. He felt the Town should tell
the Highway Department what it thinks - and this is without K-Mart be-
ing open.
Mr. Tolbert believed there should be both a United States flag
and a State of Virginia flag flyingover the airport. Also, the
entrance needs a little brick work and the plaque- needs cleaning up.
Mayor Rollins' said" the flagpole is there for a purpose,-., there should
be one or both flags out there.
Mayor Rollins commented on the Washington' Post. article as follows:
Mr. Noman Cole, the former Chairman of the SWCB, and he had never
seen eye to eye on a lot of things. However, this is a very complex
situation and it will have quite an effect on all of Northern Virginia
and the entire State in the very near future with regard to how much
they pay for sewage treatment. The recent publicity on the City of
Manassas Park is a good example - these people are paying' an average
of $60 per month for sewage alone. This is due to the water quality
standards imposed on that area by the Water Control Board and the
plant that has been constructed to meet these standards. The Water
Control Board, at its last meeting, made quite a departure from the
previous requirements for sewage treatment to meet the water quality
standards of Virginia - the decision was made that there will be no
more funding for advanced wastewater treatment in the State until all
communities have achieved secondary treatment. There are many places
with no treatment at all and some withonly primary treatment. Mr.
Cole was insistent that Leesburg not build its sewage• treatment plant
in this location and he was very instrumental in having funding go
toward advanced wastewater treatment. The operating costs for such

a plant are astronomical . He, therfore, disagrees very vehemently
concerning Leesburg and advised. the Washington Post that Leesburg
had violated its sewage permit. There will be a letter to the
Editor. from the Northern Virginia office of the SWCB tomorrow re:
futing these allegations and 'stating categorically that the Lees-
burg plant is, in fact, one of the best operated sewage treatment
plants in' the State of Virginia, .and that these charges were un-
founded and' were motivated for reasons other than a critical com-
mentary on sewage treatment. He felt that' there is a great body of
opinion that doubts that the enormous funds being expended for ad-
vanced wastewater treatment are, in fact, improving the water quali-
ty of the streams. This should be looked into very thoroughly and
the WCB has so directed. He said there is no-one any more dedicated
than he to water quality and to saving the users of sewage systems
needed funds when they can be used elsewhere if, in fact, these sums
are not improving the water quality. He can' t justify spending more
money for these when there are communities with raw sewage going into
the streams of Virginia. Northern Virginia is most fortunate in -hav-
ing sewage treatment facilities all over the area which are doing an
outstanding job. Our own plant ranks among the best, as will be at- -
tested

tested to by the Northern Virginia office of the SWCB.
Petitioners :
Mr. Summerfield Tillett, Jr. , who is a resident of Morven Park
Court, complained about dirty water, which was experienced in his
home and others in the area recently. He was of the opinion that
this came about as a result of the new water line' construction on
Old Waterford Road. Mr. Niccolls explained that no parts of the
new system have been cut into the system yet. However, the con-
tractor did break the service line to some of the homes and the
dirty water was a result of having to cut off the water to repair
the existing line. He explained the procedure to be followed when
the new line and the old line will be connected and said there will
probably be some more of this when this work is done. He also said
a credit will be given for 2, 000 gallons for those people who have
a problem with this and have to flush their lines before they can
use the water.
Mr. Cole joined the meeting at this time.
Mr. Tillett also asked that something be done to the sanitary
sewer line on N.; Harrison Street where his mother lives. About
five or six years ago, Southern Line Cleaning Co. cleaned out this
line and there had been no problem until this past August, when the
sanitary sewer backed up in his mother' s home (basement) during a
hard rainstorm. He also understood that some of the residents on
East North Street had a back-up on a clear day. Mr. Niccolls said
a proposal to replace this line will be included in ne,t. year' s bud-
get. Mr. Murray suggested that this line be replaced before the
street is resurfaced, as planned for this year. Mr. Hill said he
had watched the TV inspection program very closely when it was done
and that line looked like a spider' web with tree roots at that time.
It was decided that this matter will be discussed at the next Public
Works Committee meeting and, in the meantime, Mr. Niccolls would ask
Tri-County not to resurface that street at this time.
Mr. Niccolls explained in' detail the testing procedure used to
tie in' a new water line.
Mr. Cole said there had been a' well-graveled area on Fairview
Street where the school bus turned to go down the alley and the
contractor on the water line (Carman Construction) has not replaced
that gravel.
Mayor Rollins asked if the sidewalk, curb and gutter work has
been sent out for bids. Mr. Niccolls explained that no bids were
received, so the town forces did as much of the work as they could.
A master list is being prepared for all the work required, but it
will have to be "weeded down" in order to meet the budgeted funds,
but- it will probably be another month before the bids are ready to
go out. This will come back through the proper committee and the
work will probably not be done before spring.

78-0-33 - Ordinance - Amending -Sec. 10-83 of the -Town .Code re one-
way streets .

On motion of Mr. Tolbert, seconded by Mrs. Hill , the following
ordinance was proposed:
ORDAINED by the Council of the Town of Leesburg, Virginia,
as follows :
SECTION I. Sec. 10-83 of the Town Code is hereby amended
to read as follows :
Sec. 10-83. One-way streets.
(a) The following streets are hereby established and
designated as one-way streets. It shall be unlawful for
any vehicle to be driven or moved on such streets in a
direction other than as herein set forth:
• (1) Church Street, between Market Street and the
north property line of Archie Newton on Church
Street, for southbound traffic.
(2) Church Street, between Market Street and North
tc Street, for northbound traffic.
(3) Cornwall Street, between Slack Lane and Wirt
Street, for westbound traffic.

(4) Liberty Street, between North Street and Loud-
oun Street, for southbound traffic.
• (5) Wirt Street, between- Market Street. and North .
Street, for northbound .traffic.
(6) East South Street, between Harrison Street and
• ;. , the west .line of Parker. Subdivision, for east-
bound traffic.
• This: subsection shall become effective as to any one-way
street when signs have been provided therefor as set out
in subsection (b) .
(.b) The manager is authorized and directed to pro-
vide such signs on the one-way streets designated in sub-
section (a) as will apprise an ordinarily observant per-
eon of such- one-way streets.
SECTION II. This ordinance shall be effective upon its
passage. _ , .

Mr. Cole commented that East South Street is, the only change in the
ordinance. Mayor Rollins asked what will be done with' Parker Subdi-
vision traffic. Mr. Hill said a "No Thru Street" sign will be placed
on East -South Street at South. Catoctin Circle. He also said that all
but one of the residents on East South Street agreed that this should
be done. The ordinance was unanimously adopted:

78-186 - Resolution .- Authorizing -a contract with-Municipal Advisors,
Inc. for utility rate study..

RESOLVED by the Council of the Town of Leesburg, Virginia,
as follows :
SECTION I. The manager is authorized and directed to enter
into an agreement with Municipal Advisors, Inc. , P. O. Box 45,

as described in the July 31 , 1978 "Scope of Services for
Utility Rate Study" and the August 28, 1978 proposal from
Municipal Advisors , Inc. at a cost not to exceed $6, 500.
SECTION II. An appropriation is made from the Utility Fund
to Account No. 20400. 806-B, Potomac River Water Supply Rate
Study, in the amount of $6, 500. 00 for the fiscal year ending
June 30, 1979.
Mayor Rollins commented that there was a lot of criticism when the
present rates were adopted as to whether or not all the alterna-
tives had been looked into and whether or not hg' proper "scheme"
had been adopted. He asked if this rate stud�'7speak - to whether
or not' we :'should revise the existing structure. Mr: Niccolls said
not until 1981 - it will propose changes to coincide with obliga-
tions for operation, maintenance and debt service on. the .new_
plant, but not the rates to be in effect from now until then. It
will propose various alternative schemes for Council to consider.
The resolution was unanimously adopted:

78-187 - Resolution - Approving a revision to an en ineering agreement
with Bengtson-DeBell & Elkint Inc. for design
of Evergreen Mill well supplies.
On motion of Mr. Hill , seconded by Mr. ' Cole, the following reso-
lution was proposed :
WHEREAS, the Council at its meeting on June 14, 1978, author-
ized the contract with Bengtson, DeBell & Elkin, Inc. , of
Centreville, Virginia for design and preparation of plans and
specifications and contract. administration for Evergreen Mill
Well supply building and equipment as described in their June 7,
1978 proposal no. 78-48 in an amount not to exceed $25, 739.
RESOLVED by the Council of the Town of Leesburg, Virginia, as
follows :
SECTION I. The manager is authorized and directed to revise
a contract with Bengtson, DeBell & Elkin, Inc. , consulting
engineers of Centreville, Virginia, as outlined in their let-
ter dated September 18, 1978 in the amount of $1850. This
increase is due to changes in the scope of their original pro-
posal number 78-48 dated June 7 , 1978.

SECTION II. An appropriation is hereby made for the fiscal
year ending June 30, 1979 to the Utility-Restricted Fund ac-
count no. 20500. 805, Waterworks Improvements in the amount
of $1850.

Mr. Hill understood- that it was originally anticipated that there.
would be a "cut through" where old Evergreen Mill Road ,cut through
the By-Pass, but they could not find the "sleeve" under the By-Pass.
There is one so indicated on down the By-Pass, so they have had to
extend the line some 2500 or so feet down to that."sleeve." Mr.
Niccolls said Route B alternate called for a transmission main to go
north on Evergreen Mill Road to the By-Pass'. There have been meet-
ings with, the Stowers and _ they have indicated letting us go across
their property in a straight line. This has not been formulated but
it is going along this line. The resolution was unanimously adopted:

78-188 - Resolution - Requesting the Planning Couuuission to review
and recommend amendments of the Subdivision
Regulations. . •

On motion of Mr. Murray, seconded by Mrs. Hill, the following
resolution was proposed:

WHEREAS, the manager has prepared proposed Subdivision and
Land Development Regulations dated September 29, 1978; and
WHEREAS, Section 15. 1-472 of the State Code provides that
no amendment of local subdivision regulations should be
adopted without reference of the proposed amendments to •
the Planning Commission for recommendation:

RESOLVED by the Council for the Town of Leesburg, Virginia,
as follows :

The proposed Subdivision and Land Development Regulations
prepared by the manager and dated September 29, 1978 are
referred to` the Planning Commission for recommendation in
line with Section 15. 1-472 of the' State Code.
Mr. Herrell asked if this has anything to do with the Committee that
was revising the proposed ordinance: Mr. Niccolls said no report was
ever "received from that committee' so, basically, we are starting all
over again. Mr. Herrell suggested checking with the Chairman of that
Committee to see if they might have some information on this. Mr.
Hill said the• Planning. Commission was .working•'on' this when he was
Mayor. He asked if this proposed ordinance speaks to implementing
the Comprehensive Plan. Mr. Niccolls said it does'. The resolution
was unanimously adopted:

Proposed resolution authorizing water and' sewer extensions permits
for Cardinal Industrial 'ark.
On motion of Mr. Herrell (for discussion purposes) , seconded
by Mr. Murray, a resolution authorizing water' and sewer 'ektension
permits for Cardinal Industrial Park was proposed. Mr. Herrell
felt that it would be a big mistake to approve se4er 'and' water
connections out-of-town at this time for two reasons : (1) the town
would have no control over the kind 'of development since it is- in
the County and (2) he could not imagine anyone who had town water
and sewer wanting to be annexed into the town - he felt they would
fight it. Mr. Murray said this is one of the reasons that he sug-
gested the time limit in section (a) - this would put• the burden
on the developer. Mr. Hill said the PFanning' Commission would like
Council to indicate that water and sewer would be- ail-affable providing
they meet all the other requirements. Discussion continued on this
matter. Mayor Rollins handed to Mr. Niccolls a letter from Mr.
Tullius concerning an article in the •Times-Mirror recently with re-
gard to a proposed industrial park along Route 7 east. He said
Group 44 is planning to construct such a facility and requests
sewer for it. He asked Mr. Niccolls to. respond to this letter.
Mr. Rollins felt it is incumbent on the town to serve those
areas outside the-corporate limits 'that can be served: This would
be beneficial to those iaholl'ive' within the corporate limits - the
more revenue, the better it would be. His personal view is that
there would be less argument against annexation if they'are already
connected to utilities. He also said that, in the not too distant
future, Leesburg' s next annexation will be clear to Goose Creek.
This would be a tremendous economic base for Leesburg. He did
think granting utilities for this particularproject is premature
inasmuch as no plans whatsoever have been presented for it. They
should be told they must first make a Presentation- to the Town -
then if Council is ' satisfied that it is •a worthwhile''project and a
good economic base the utilities can be granted. He also felt that
the Town has just as much jurisdiction outside the town (within the
one-mile limit) as it has inside. ' Mr: Herrell said he would like
the Town staff to prepare a report as to annexation• insofar as the
policies of the Court are concerned - in other areas. 'Mayor Rollins
thought/ the' Court would say that' those ' people being served with
town water and sewer should be in the corporate limits. Mr. Martin
said the Court usually takes the position that urban areas are .urban
and rural are rural . The most important factor would be that you
must have the ability to serve these people.

Mr. Niccolls 'said that, when you are dealing with an industrial
park subdivision;. it: becomes'•difficul-t to evaluate on: alot by lot
basis what this is going for. The subdivider is trying to get fi-
nancing for all public improvements and he doesn' t know what these
lots will ' be sold .for,.:•.so it_.is_ a dilemma as to when. the• proper
time is to- gfant-the water and- sewerr-connections.-
After some further discussion, on motion of Mayor Rollins, sec-
onded-by Mr.--Hil1;' Council voted unanimously •on' the 'following:
This resolution shall be referred back to the Public Works
and Utility Committee in order that' the developer can en-
lighten the Committee, and subsequently the Council ,_ on
just what they intend to do with this parcel- of- land and
to show Council schematically' what. they' want- to• put in
there.
Mayor- Rollins said the Planning Commission will have• to hold this
as tot -final approval of subdivision plans until this has been- acted
on by the Council . - •

78-189 - Resolution - Authorizing aerial "No Right Turn on Red" signs .

On motion of Mr. Herrell-, , seconded by Mr: Tolbert, the following
resolution was proposed:
RESOLVED by the- Council for the Town of Leesburg,.••Virginia,
as follows :

The installation of 18 x 24 inch "No Right Turn- on Red"
signs- to be hung from traffic signal head support cables
is authorized at the intersections of King Street at
• Loudoun and Market Streets. . '
Mr. Cole said it is hoped that this will cut down on the illegal
right turns on red at these intersections:. The resolution was unani-

78-190 - Resolution - Accepting public improvements, releasing per-

. On motion of Mr.. Tolbert, seconded- by Mr. Cole, the following
resolution was proposed and unanimously adopted:

WHEREAS, the developer for- S & R .Chevrolet,•- located on Ft.
Evans• Road, - has completed public improvements in accordance
with town standards and, specifications, and- these have been
inspected and approved, and the as-built plans have been
submitted and approved: •
RESOLVED by the Council of the Town of Leesburg, Virginia,
as follows :
SECTION I. The public improvements at S & R Chevrolet lo-
cated on Ft. Evans Road are accepted for -public,use by - the
town. . .
SECTION II. The performance bond of Travelers Indemnity
Company for improvements at S & R Chevrolet in the amount
of $9, 607_ is released and a -maintenance bond with Travelers
Indemnity Company in the amount of $480. 35 is approved.

78-191 - Resolution - Accepting Deed of Dedication by County of
Loudoun.
On motion of Mr. Tolbert, seconded by ,Mrs. Hill, .the' following
resolution was proposed and unanimously -adopted:
RESOLVED by. the Council of the Town .of Leesburg, Virginia,
as follows :
The Deed of Dedication made the 22nd day of September, 1978,
by and between The County of Loudoun in Virginia and the
Town of Leesburg, Virginia, _for public street purposes. at
the southwesterly corner, of North Street' and Slack Lane,
and containing 4163 square feet, as shown on plat dated
February, 1978 and prepared' by DeLashmutt Associates, •
Certified Land Surveyors, is hereby, accepted and the
Mayor is authorized to acknowledge the same on behalf
of the Town.

of $2, 965.00 for the fiscal year ending June 30, 1979.

Tolbert and Mayor Rollins.

MINUTES OF OCTOBER 11 , 1978 MEETING.
Discussion on• out'-of-town utility service.
Mayor Rollins asked if it is the consensus of Council that
Mr. Niccolls- advise applicants for utility connections outside the
corporate limits that they shall 'present to Council a schematic
drawing, along with a verbal explanation, in order that Council
might' make an intelligent decision? Mr. Murray agreed, but: he
felt there could be a problem with this due to the• fact- that a
developer will not know until he can go out and look at the mar-
ket. Mr. Herrell asked, - if a portion of the lots are sold, would
the buyer of these lots have to come back to Council for approval
of his project, or can he put anything there that the County ap-
proves? Mayor Rollins said that, within the corporate limits,
the Town has no discretion as to whether they .serve a developer
with water and sewer - the town has no• say• so long as they' meet
subdivision requirements. Outside the corporate limits, . the town
does have discretion as to whether or not they serve a developer
with water and sewer. Mr. Herrell said he would• like aireport
from the staff as to Council ' s rights inside and outside the town.

oppose annexation by the town of such' industrial development -
the town would then be getting the revenue and the County would
lose it? Mayor Rollins said they would vehemently oppose it, but
if the town is furnishing water and sewer they have no argument:
Mr. Martin said one of the requirements is' that there must be a
reasonable compact area. Mayor Rollins asked if areas outside the
corporatfi limits are served with Leesburg water and sewer facilities
does this7make a• fiery strong' case' that- they: should be annexed?
Mr. Martin 'agreed. Mayor Rollins also asked if they weren' t con-
nected, wouldn' t it then be very difficult? Mr. Martin said yes,
and if the County is already serving them, it would be almost im-
possible.

Mrs . Hill asked that a committee discuss resident ' permit park-
ing on- some of the side streets. -
There followed further discussion concerning a temporary traffic
signal' somewhere on East Market Street in the vicinity of. Leesburg
Plaza Shopping Center. Mr. Herrell felt that the traffic should be
staggered so that traffic can get in and out of the various drive-
ways. -Mayor Rollins suggested that he look, at the plans and bring
this matter before Council for an official position.
On motion of Mr. Hill, seconded by Mr. Tolbert, the meeting was
adjourned at- 9 : 40 P.M.
