A regular meeting of the Leesburg Town Council was held in 4 9
the Council Chambers , 10 West Loudoun Street, Leesburg, Virginia,
on August 22 , 1979 at 7 : 30 P.M. The meeting was called to order
by tbi Mayor, with Mr. Tolbert giving the invocation, and followed
with gdlute to the Flag led by Mr. Hill. Present were : Mayor
Kenneth B. Rollins, Councilmembers Glen P . Cole, Stanley D. Herrell,
Jr. , G. Dewey Hill, Jr. , Marylou Hill , Walter F. Murray and John W.
Tolbert, Jr. ; also Town Manager John Niccolls, Assistant Manager
Jeffrey H. Minor, Director of Finance Donald O. Taylor and Town At-
torney George M. Martin.
The minutes of the regular meeting of August 8 , 1979 were ap-
proved as submitted.
MANAGER' S REPORT:
Mr. Niccolls called attention to the written Activity Report
distributed tonight, with particular attention to several items .
Bids will be opened Monday on the Normandy Village storm drainage
project - they are expected to be in the $50 , 000 range . Repairs
to the Royal Street reservoir are going very well - they have poured
the concrete ring on top of the old reservoir this week - next week
CD they will begin forming up and arranging for the new joists and the
CO new roof. This facility should be back to pumping the normal 250 ,000
N to 300 , 000 gallons into the system by October 1 . Both Evergreen Mill
wells are operating normally - 350, 000 and 470 , 000 gpm - we have re-
ceived the final written report from the Health Department.

Q One of our employees is going to Chicago to be trained on the
new sewer jet vector machine at the factory and to drive it back,
at the expense of the company. He is expected to be back with it
on Friday so next week we will be demonstrating this machine.
Paving of Old Waterford Road began today and should be finished
this week. With the exception of a short piece on Fort Evans Road,
this will close out the street resurfacing program for this year.
COUNCILMEMBER INQUIRIES AND COMMENTS :
Mrs. Hill has received a request for a street light at the end
of East North Street. Residents of this area report vandalism to
their cars and trash left at the end of the street, as well as the
noise. She said spacing of lights on this street would put one at
this location.
Mr. Herrell asked what the contingency is in connection with
the approval of the Parcel M, Virginia Village site plan? Mrs. Hill
explained that the Town Attorney was to check the bonding and make
sure it is all right. Mr. Herrell also asked what the 282 lot sub-
division is? Mrs. Hill said this is the Carr property and was just
an information item.
Mr. Tolbert asked Councilmembers to try to attend the demonstra-
tion of the town ' s fire/crash truck at the Airport this weekend.
MAYOR' S REPORT:
Mayor Rollins distributed copies of a letter from Mechanical
Constructors , Inc. received this afternoon. This concerns the re-
vised bid submitted by this firm on the Potomac River Water Plant
and intake structure. He suggested that Council schedule a special
meeting to act on these bids since it is anticipated that discussion
will be somewhat lengthy. There followed lengthy discussion con-
cerning this matter, with particular attention to just how large" a
plant should be built. It was the consensus of Council that there
be a committee meeting of the whole on Monday night to discuss this
matter thoroughly, with the engineers , town staff and perhaps Mr.
Wales of Municipal Advisors. It was felt that the Finance Director
should have available the tax rates necessary to finance different
amounts. Mr. Niccolls said they have been working on this and it
will be available. It is proposed to then have a special meeting
of the Council on Tuesday night at 7 : 30 to consider a decision on
this matter.

50 It was the consensus of Council that a meeting with Mr. Don
Wagner of the Highway Department concerning the Route 7 West urban
project be rescheduled.
79-0-15 - ORDINANCE - AMENDING SECTION 10-149 OF THE TOWN CODE.
On motion of Mrs. Hill, seconded by Mr. Cole, the following
ordinance was proposed:
BE IT ORDAINED by the Council of the Town of Leesburg,
Virginia, as follows :
SECTION I . Section 10-149 of the Town Code is hereby amended
to read as follows :
Sec. 10-149 . Stopping on Highways Generally.
(a) No vehicle shall be stopped in such a manner as
to impede or render dangerous the use of the highway by
others, except in the case of an emergency as the result
of an accident or mechanical breakdown, in which case a
report shall be made to the nearest police officer as
soon as practicable and the vehicle shall be removed from
the roadway to the shoulder as soon as passible and re-
moved from the shoulder without unnecessary delay . If
such vehicle is not promptly removed, such removal may be
ordered by a police officer at the expense of the owner, if
the disabled vehicle creates a traffic hazard.
(b) No person shall leave any vehicle, attended or
unattended, upon the paved, improved or main traveled por-
tion of any highway , outside of a business or residence
district, when it is practicable to leave such vehicle
standing off the paved, improved or main traveled portion
of such highway.
(c) Except upon one-way streets and when actually load-
ing
or unloading merchandise, no vehicle shall be stopped
except close to and parallel with the right-hand curb. In
no instance shall such vehicle be parked with the near wheels
farther than six inches from -the curb.
(d) No person shall park or store any vehicle, whether
operative or inoperative, or attended or unattended, upon
any highway for a continuous period of more than 120 hours .
(e) The provisions of this section shall not apply to
any vehicle owned or controlled by the state department of
highways or the municipality, while actually engaged in the
construction, reconstruction or maintenance of highways.
SECTION II . This ordinance shall be in full force and ef-
fect from and after its passage.
Mrs . Hill explained that Paragraph (d) is the only new item - this
is to prevent long-term storage of vehicles on the street. Mayor
Rollins asked what the penalties are? Mr. Niccolls said the general
penalty applies - this is a parking violation. This would be $5 . 00
if compromised within the time before the next Court date. Mrs .
Hill asked if they would continue to ticket such a car or tow it?
Mr. Niccolls said the Chief notifies the owner and, if the car has
not been moved within the specified time, it is towed. We do not
normally pile up tickets on a car. The ordinance was unanimously
adopted:

79-118 - RESOLUTION - AUTHORIZING ACCEPTANCE OF A GRANT FROM THE J 1
DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT
UNDER TITLE I OF THE HOUSING AND COMMUNITY ]
DEVELOPMENT ACT OF 1974 .
On motion of Mr. Herrell , seconded by Mr. Tolbert, the follow- -
ing resolution was proposed :
RESOLVED by the Council of the Town of Leesburg, Virginia, .
as follows :
The manager is authorized and directed to execute HUD Form
7082 (8-78) evidencing acceptance by the Town of Leesburg
of U. S . Department of Housing and Urban Development funds
in the amount of $81, 100 under qitle I of the Housing and
Community Development Act of 1974 under Grant No. B-79-DS-
51-0010 for construction of the Fairview Subdivision Storm
Drainage Project.
Mr. Niccolls said this is the final application - the next document
from them will be the formal acknowledgment of acceptance of the
Grant and authorization to proceed with spending the money. Bids
CO will be opened 3 to 4 weeks from today - it has not been adver-
QO tised yet. The plans are in the office. Mr. Minor said there are
CO some changes in the contract documents and it will be about a month.
w Mr. Hill inquired as to what will happen if the bids come in high?
Q Mr. Niccolls said it is expected that it will come in higher than
the grant . HUD can go no further - if the amount over the grant
Q is minimal it will be no problem but, if it is quite a bit, then
a decision will have to be made . Mr. Minor said HUD will not grant
money in two different program years. It was suggested that the
cost be escalated at the time of submission of the application. Mr.
Hill asked if HUD would accept doing only fifty percent of the
project? Mr. Minor said they are interested in spending the full
amount of the grant and spending it as quickly as possible. The
resolution was unanimously adopted:

Tolbert and Mayor Rollins.
Nay : None .
79-119 - RESOLUTION - MAKING AN APPROPRIATION FOR THE FISCAL YEAR
ENDING JUNE 30 , 1980 .
On motion of Mr. Hill , seconded by Mrs . Hill , the following
resolution was proposed:
RESOLVED by the Council for the Town of Leesburg, Virginia,
as follows :
An appropriation is made from the Utility Fund to Account
No. 20400 . 804-B, Royal Street Facility Improvements in the
amount of $7 , 000 . 00 for the fiscal year ending June 30 , 1980 .

Mr. Niccolls/there should be water pumping from this facility by
October. He thought Mr. Chaves gave us a 12-week estimate on this
work. The resolution was unanimously adopted:
Aye : Councilmembers Cole , Herrell , D. Hill, M. Hill, Murray,
Tolbert and Mayor Rollins.

On motion of Mr. Hill, seconded by Mr. Cole, the meeting was
adjourned at 8 : 52 P .M.
