HomeMy Public PortalAbout12-17-2007PROCEEDINGS OF THE COMMON COUNCIL OF THE CITY OF RICHMOND, INDIANA, MONDAY, DECEMBER 17, 2007 The Common Council of the City of Richmond, Indiana met in regular session Monday, December 17, 2007, in the Council Chambers in said City. PLEDGE OF ALLEGIANCE PRAYER BY COUNCILOR PAPPIN President Pappin presided and the following business was conducted: ROLL CALL Councilors present were Howard "Jack" Elstro, Etta Lundy, Bruce Wissel, Karl Sharp, Bing Welch, Larry Parker, Al Glover, Gil Klose and Diana Pappin. APPROVAL OF MINUTES Councilor Klose moved to approve the minutes of the regular meeting of December 3, 2007 and Memorandum of Proceedings for a special meeting on December 11, 2007, with a second by Councilor Glover. Upon a vote viva voce, the motion passed. PRESENTATIONS, MEMORIALS OR REMONSTRANCES, PETITIONS AND INTRODUCTIONS, MOTIONS, RESOLUTIONS ■ DR. ALLEN BOURFF, SUPERINTENDENT OF RICHMOND COMMUNITY SCHOOLS Dr. Bourff invited members of the Common Council to a joint meeting with the Richmond Schools Board of Trustees. He thanked Council for enacting the new Curfew Ordinance and for consistently working with Richmond Community Schools. He has also asked the Mayor to reinstate the Youth Council. This would enable the group to partner with the City on a community project, i.e., the Whitewater Gorge. COMMUNICATION FROM THE MAYOR ■ City personnel responsible for clearing streets during the snow storm last week were commended. ■ Condolences were extended to the family of Cpl. Jonathan Lahman who was killed in Iraq. REPORT FROM BOARD OF PUBLIC WORKS AND SAFETY Minutes of the November 29 and December 6, 2007 meetings were accepted as presented. Councilor Parker asked if the fuel prices were for the entire Year of 2008. City Attorney Chidester will report back to Council at the next meeting. REPORTS FROM DEPARTMENT HEADS - None REPORTS FROM STANDING COMMITTEES Tax Abatement Committee: Letters were mailed to Yukiya USA Gasket & Sealing Co. Ltd. regarding Ordinance No. 89 -2005 and P & M Holdings, LLC regarding Ordinance No. 86 -2006. Both are Tax Abatement requests. Both companies were notified their requests will be stricken from the Richmond Common Council Agenda due to inactivity. Common Council Minutes December 17, 2007 Page 2 of 4 REPORTS FROM SPECIAL COMMITTEES - None REPORTS FROM ORGANIZATIONS - None MISCELLANEOUS BUSINESS ■ Council President Pappin announced there will be a ceremony for Council members - elect, the Mayor, Clerk and City Attorney to take their Oath of Office on December 31, 3 PM in the Council Chambers. ■ RESOLUTION NO. 12- 2007 —A RESOLUTION HONORING OUTGOING COUNCILOR LUNDY This Resolution was a tribute to Councilor Lundy for her years of service to the citizens of Richmond — 1988 -2007. Councilor Wissel moved to adopt Resolution No. 12 -2007 with a second by Councilor Sharp. Upon a vote viva voce, the motion passed. ■ RESOLUTION NO. 13- 2007 —A RESOLUTION HONORING OUTGOING COUNCILOR SHARP This Resolution was a tribute to Councilor Sharp for his years of service to the Citizens of Richmond — 2000 -2007. Councilor Parker moved to adopt Resolution No. 13 -2007 with a second by Councilor Welch. Upon a vote viva voce, the motion passed. ■ RESOLUTION NO. 14- 2007 —A RESOLUTION HONORING OUTGOING COUNCILOR GLOVER This Resolution was a tribute to Councilor Glover for his years of service to the Citizens of Richmond — 2004 -2007. Councilor Parker moved to adopt Resolution No. 14 -2007 with a second by Councilor Welch. Upon a vote viva voce, the motion passed. ■ RESOLUTION NO. 15- 2007 —A RESOLUTION HONORING OUTGOING COUNCILOR KLOSE This Resolution was a tribute to Councilor Klose for his years of service to the Citizens of Richmond — 2004 -2007. Councilor Welch moved to adopt Resolution No. 15 -2007 with a second by Councilor Wissel. Upon a vote viva voce, the motion passed. ORDINANCES ON FIRST READING Councilor Elstro moved to suspend the rules and read Ordinance Nos. 55, 83, 86, 88 & 89- 2007on first reading by title only with a second by Councilor Lundy. Upon a vote viva voce, the motion passed. ORDINANCE NO. 55 -2007 — A GENERAL ORDINANCE AMENDING CHAPTER 91: ANIMALS OF THE CITY OF RICHMOND CODE The Clerk read Ordinance No. 55 -2007 on first reading by title only. This Ordinance would amend Chapter 91 of the Municipal Code. Chapter 91 contains provisions regarding animals and animal control. The proposed amendments relate to Sections 91.17- Trapping of Animals Prohibited, 91.18- Breeding Regulations and 91.19 -Free Roaming Cats. Ordinance No. 55 -2007 will be the topic of a meeting of a Committee of the Whole January 28, 2008, 7 PM. Common Council Minutes December 17, 2007 Page 3 of 4 ORDINANCE NO. 83 -2007 — A SPECIAL ORDINANCE AMENDING THE ZONING MAP FOR A CERTAIN PARCEL FROM R -4 (Multi - family residence district) to C -2 (Commercial District) (2100 Chester Boulevard) The Clerk read Ordinance No. 83 -2007 on first reading by title only. This Ordinance is a petition to rezone the property at 2100 Chester Boulevard from R -4 Multi - Family District to C -2 Commercial District to facilitate commercial development at that location. Ordinance No. 83 -2007 was referred to Plan Commission for public hearing at its meeting on December 20, 2007. ORDINANCE NO. 86 -2007 — A SPECIAL ORDINANCE AMENDING THE ZONING MAP FOR A CERTAIN PARCEL FROM M -1 LIGHT INDUSTRIAL DISTRICT TO C -3 CENTRAL BUSINESS DISTRICT (213 n 3RD St) The Clerk read Ordinance No. 86 -2007 on first reading by title only. This Ordinance is a petition to rezone the property at 213 North 3rd Street from M -1 Light Industrial District to C -3 Central business District so the owner may develop the site from commercial uses to recreational opportunities developing in the area. Ordinance No. 86 -2007 was referred to Plan Commission for public hearing at its meeting on December 20, 2007. ORDINANCE NO. 88 -2007 — AN APPROPRIATION ORDINANCE AMENDING THE 2007 BUDGET (Law) The Clerk read Ordinance No. 88 -2007 on first reading by title only. Presenting was City Attorney Walt Chidester. This Ordinance would transfer money from Regular Salaries to Contract Services within the 2007 Law Department Budget. Councilor Welch moved to advance Ordinance No. 88 -2007 to second reading and to suspend the rules and read by title only with a second by Councilor Parker. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 88 -2007 on second reading by title only. Council President Pappin declared Ordinance No. 88 -2007 on second reading and public hearing. There being no comments for or against the Ordinance, Councilor Elstro moved for engrossment of Ordinance No. 88 -2007 with a second by Councilor Lundy. Upon a vote viva voce, the motion passed. Councilor Lundy moved to advance Ordinance No. 88 -2007 to third and final reading and suspend the rules and read by title only with a second by Councilor Elstro. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 88 -2007 on third reading by title only. Ordinance No. 88 -2007 was adopted with a 9 -0 roll call vote. ORDINANCE NO. 89 -2007 — AN APPROPRIATION ORDINANCE AMENDING THE 2007 BUDGET (Park) The Clerk read Ordinance No. 89 -2007 on first reading by title only. Presenting was Park Superintendent Sonia Brock. This Ordinance would transfer money from available surpluses in the contractual services accounts (3000 series) in the Park Reverting Fund to the Park Non - reverting Fund to cover that fund's 2007 cash deficit. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 89 -2007 on second reading by title only. Council President Pappin declared Ordinance No. 89 -2007 on second reading and public hearing. There being no comments for or against the Ordinance, Councilor Lundy moved for engrossment of Ordinance No. 89 -2007 with a second by Councilor Elstro. Upon a vote viva voce, the motion passed. Councilor Wissel moved to advance Ordinance No. 89 -2007 to third and final reading and suspend the rules and read by title only with a second by Councilor Sharp. Upon a vote viva voce, the motion passed. The Clerk read Ordinance No. 89 -2007 on third reading by title only. Ordinance No. 89 -2007 was adopted with a 9 -0 roll call vote.
