HomeMy Public PortalAbout1980_04_14SPEC MINUTES OF SPECIAL MEETING OF LEESBURG TOWN COUNCIL, APRIL 14 , 1980 . 219 A special meeting of the Leesburg Town Council was held on April 14, 1980 at 7 : 30 P .M. in the Council Chambers, 10 West Loudoun Street, Leesburg, Virginia, pursuant to Notice of same having been delivered to all Council members prior thereto . Present were: Mayor Kenneth B . Rollins, Councilmembers Glen P . Cole, Stanley D. Herrell, Jr. , G. Dewey Hill, Jr. , Marylou Hill, Walter F. Murray and John W. Tolbert, Jr . ; also Town Manager John Niccolls and Assistant Manager Jeffrey H. Minor . The meeting was called to order by the Mayor, who read to Council a letter from Mr. John Sleeter, President of the Chamber of Commerce, concerning leasing of the log cabin on West Loudoun Street. Mr. Murray felt the Vinegar Hill Parking Lot would be an ideal location for a farmers ', type market and a place for these people to exhibit and sell their crafts , etc. He hoped these people might agree that this would be a profitable project to the town as well . Mr. Herrell said he has had more phone calls concerning the log cabin than any item since he has been on Council . He suggested that members of the Public Works committee also be invited to attend the meeting tomor- row night. Mr. Tolbert said that, since he has been a resident of Leesburg the last 39 years, it looks like every time a "hot" issue comes up and is adopted, someone comes in to complain. Mr. Nic- CD coils explained that he had walked over to the cabin one day and CO found a group of ladies being escorted around the cabin. The ques- Ntion of the Chamber leasing the building arose and he told them w what the Chamber had offered - he did not feel this violated any rules - that is why their offer came in at $160 .00 . . Q Q Mr. Ben Jones, attorney representing the town on the annexation matter, said the petitioners filed on Friday an Amended Petition for Annexation, by which they deleted the areas to the east of the By-Pass. There has been some informal discussion concerning a pro- posed resolution, wherein the Council, in essence, takes the posi- tion that it does not oppose this reduction. This would give the town 379 . 20 acres. This resolution would authorize him to endorse an Order, along with the other lawyers, that would agree to the Amended Petition, and would authorize him to enter into a Stipula- tion of Facts, which would shorten the Court proceedings. On motion of Mr. Hill , seconded by Mr. Herrell, Council voted unanimously to go into executive session to discuss this matter fur- ther : Aye: Councilmembers Cole, Herrell , D. Hill, M. Hill , Murray, Tolbert and Mayor Rollins. Nay : None. On motion of Mr. Murray, seconded by Mr. Cole, Council voted unanimously to reconvene : Aye : Councilmembers Cole, Herrell, D. Hill , M. Hill, Murray, Tolbert and Mayor Rollins . Nay : Nay . 80-47 - RESOLUTION - CONCERNING McKINMEY, ET AL, v. TOWN OF LEESBURG, ET AL, (ANNEXATION) . On motion of Mrs . Hill, seconded by Mr. Tolbert, the following resolution was proposed and unanimously adopted: WHEREAS, the petitioner in the annexation matter known as McKimmey, et al, v. Town of Leesburg, et al, has filed a motion with the court requesting reduction of the area proposed to be annexed to exclude 107. 7 acres east of the Route 15 by-pass ; and WHEREAS, the Board of Supervisors of Loudoun County has this day unanimously adopted a motion stating that the County has no objection to the amended petition for annexation and does not desire to further oppose said annexation; and MINUTES OF APRIL 14 , 1980 SPECIAL MEETING. O WHEREAS , this Council has no objection to petitioner ' s request, this being a case instituted by petitioners, and the Council recognizes that the Rt. 15-7 by-pass is in no way to be construed as the town ' s future boundary; THEREFORE, RESOLVED by the Council of the Town of Leesburg, in Virginia, as follows : The town 's counsel in this matter is authorized to endorse an order upon petitioner 's motion to amend the petition for annexation and to file an appropriate amended answer for the town. The counsel is further authorized to enter into stipulations of facts and to endorse a final decree of an- nexation setting forth the terms and conditions upon which the area shall be annexed to the town. Aye : Councilmembers Cole , Herrell, D. Hill, M. Hill, Murray, Tolbert and Mayor Rollins . Nay : None.
