A regular meeting of the Leesburg Town Council was held in 243 the Council Chambers , 10 West Loudoun Street, Leesburg, Virginia on June 11, 1980 at 7 : 30 P.M. The meeting was called to order by the Mayor, with Mr. Tolbert giving the invocation and followed with the Salute to the Flag led by Mr. Murray. Present were: Mayor Kenneth B. Rollins , Councilmembers Glen P. Cole , Stanley D. Herrell, Jr. , G. Dewey Hill, Jr. , Marylou Hill, Walter F. Murray and John W. Tolbert, Jr. ; also Town Manager John Niccolls , Assistant Manager Jeffrey H. Minor, Director of Finance Donald O. Taylor and Town Attorney George M. Martin. The minutes of the regular meeting of May 28, 1980 were ap- proved as written. RECEIPT OF BIDS FOR CABLE TELEVISION FRANCHISE . Mayor Rollins explained the procedure to be followed in the receipt of bids for a cable television franchise. He will request that they be referred to the Finance and Administration Committee for consideration and, if necessary, the staff will consult with specialists in the field. If the bidders wish to make a presenta- tion concerning their bids , it should be made to the Committee. CD Any bidder may make a presentation to the full Council when it CD considers the award of the franchise - in fact, he encouraged it. N He asked Mr. Niccolls to inform the bidders as to the time Council will act on this matter. A recess was declared for the opening of LLl the bids. Council reconvened at 7 : 47 P.M. , with Mr. Niccolls an • Q nouncina that bids have been received from the following : Q ( 1) Pinebelt Cablevision of Gulf Breeze, Florida,. submitted by Mr. R. Calvin Sutliff, Jr. The $1, 000 bid fee is at- tached. ( 2) Catoctin Cable Communications, Inc. , represented by Mr. Charles A. Ottinger, Vice President. The bid fee is attached. ( 3) Midatlantic Network, Inc. , Winchester, Virginia, repre- sented by John P. Lewis. Bid fee is attached. ( 4) Leesburg - Loudoun Cable TV, Inc. , with proposal fee at- tached, and represented by Mr. John Lubetkin. The bid fee checks were turned over to the Director of Finance. Mr. Niccolls said a tentative schedule has been prepared. A bid summarization form will be completed and copies of the bid pro- posals will be distributed to councilmembers during the week of June 13 . Proponents will be given the opportunity to exchange their proposals among those who offer that. The town will see that they are distributed. The object 'here is to receive com- ments concerning each other' s bids. The town will formally ask for such comments by July 11 . Every effort is being made to make sure our procedure is open and honest - we don 't want complaints and accusations as have occurred in other communities. This is a very competitive business - the people in it are well qualified and they can actually assist us. Mr. Hill said the town has asked most of these people to help with preparation of the resolution. Mr. Niccolls said the committee will either consider this on July 22nd or August 5th - they could be prepared to make a recommenda- tion at the August 13 meeting. Mayor Rollins asked that the mana- ger contact the four bidders to tell them when the committee will consider these bids and to inform these bidders when the Council will act on this matter. At this time, any or all of the bidders may present further information before the Council acts . Mr. Hill was somewhat concerned about this procedure and felt that these comments should perhaps be made to the committee and not to the full council in public session. Mr. Niccolls said they will ask that such comments be made known to the town in writing by a date roughly half way through the procedure - these will be distributed before the whole council acts . Mayor Rollins said this matter can be continued as long as Council wishes . nq MINUTES OF JUNE 11, 1980 MEETING. * t PUBLIC HEARING ON PROPOSED BUDGET AND TAX RATE FOR 1980-81. A public hearing on the proposed budget and tax rate for 1980-81 was opened by Mayor Rollins . There was no-one present to speak on this budget and tax rate. The public hearing was, therefore, closed. PUBLIC HEARING ON INCREASE IN TAX REVENUES. A public hearing on an increase in tax revenues due to in- crease in assessments was opened by Mayor Rollins . There was no- one present to speak on this matter. The public hearing was, therefore, closed. PETITIONERS: Mr. Harvey Berger, representing the Downtown Business Associ- ation, presented to the Council The Community Improvement Award for 1980, presented to that Association by the Piedmont Environmental Council for the work done since its founding, which was initiated by the Council and the Town of Leesburg. This award was given for maintaining the downtown area of Leesburg as a viable business and community. The Downtown Business Association feels it should be given to the Town for display wherever it sees fit. Mayor Rol- lins received this plaque with appreciation from the Council and asked the Town Manager to see that it is hung in an appropriate place. REPORT ON BIDS FOR THE LEASE OF THE LOG CABIN: Mr. Niccolls reported that five bids were received today for the lease of the log cabin as follows : (1) The Loudoun Museum, which basically proposes to sublease the property to a group of artisans who have also made a separate proposal, calling for the payment of $1, 920. 00 for the first year, with no particular rent specified later, but calling for negotia- tions . (2) Mr. Christopher Goodine, who operates in Pennsylvania aidis a working silversmith. He proposes to pay the Town $1, 200 . 00 a year, or 8% of his gross, whichever is the greater. He proposes to establish a silversmith shop and a retail outlet for hand-made silver and gold articles. ( 3) Loudoun Artisans, who propose to set up the operation de- scribed earlier in public session. They are a group of skilled craftspeople who do weaving, potting and other crafts, who would display their wares in the cabin. (4) The Loudoun Chamber of Commerce, which proposes to es- tablish its offices in the cabin. They propose an annual rent of $1, 800 the first year; $1, 989 the second year; $2 , 178 the third year and $2, 395. 80 the fourth year. (5) A business firm called Photoworks , which proposes to establish a photographic services business in .the cabin, relo- cating their existing facilities just east of the cabin. They propose to pay $2, 160 the first and 'second years; $3,000 the third year and $3, 420 the fourth year. These bids will be studied and forwarded to the Finance and Adminis tration Committee, which will then make a final recommendation for the ; last meeting in June. Mr. Herrell asked the amount offered by the Loudoun Artisans? Mr. Niccolls assumed the amount would be the same as that offered by the Loudoun Museum. If the lease is awarded to the Museum, they would operate under the supervision of the Museum. Mr. Niccolls said the proposal offered by the Town was for four years . Mayor Rollins asked that these pro- posals be forwarded to the Finance and Administration Committee, • with a recommendation to be made for the June 25th meeting. MINUTES OF JUNE 11, 1980 MEETING. 245 MANAGER'S REPORT: (1) Mr. Niccolls pointed out that Item No. 5 in the Activity Report concerning the four-day work week for the Street Department does not change the number of hours worked by those employees - it is a 40-hour 4-day plan - 6 :00 to 4 : 30 . This is an experiment and is intended to inform us whether or not this is a productive work schedule. The employees want to give it a try - they would like to have three-day week-ends through the summer months . Advantages of this schedule mean there are fewer lunch breaks, coffee breaks and start-ups . On the other hand, some people feel it might not be possible to work a 10-hour day in the heat . (2) A summary of the General Assembly legislation affecting Leesburg has been distributed tonight. Some of these will require action later on. ( 3) Earlier this year the Public Works Committee asked that an experimental installation of lower intensity lights be made in the downtown area to determine if cost savings can be made. VEPCO has now installed these sample lights . The first is the northern- most light on King Street near Cornwall - this is a 14 , 000 lumen CO light. There is a 23, 000 lumen light at King and Loudoun. Such CO an installation would save Leesburg in excess of $2, 000 annually (v if it is acceptable to the Council. Q (4) A schedule on utility data has also been distributed. This compares billed water with the amount pumped and the amount Q treated at the sewage treatment plant. This shows some improve- ment in sewer flows - we expect further inprovement through the year. (5) The contractor on Phase IV storm drainage improvements will start work after June 23rd. The Engineering Department has had conferences with affected property owners,. and other necessary coordination has been taken care of. II COUNCILMEMBER INQUIRIES AND COMMENTS : Mr. Hill said he received a telephone call the other night from an irate female, who did not identify herself, concerning the free parking spaces allotted to the town employees on the municipal park- ing lot. He told her this is a fringe benefit . She said she wants to:park more than three hours . He told her there is a parking lot at Vinegar Hill, but she questioned why she should have to walk that far to go to work. He told her he felt the way the town employee parking is handled is proper and justified. Any employer could provide parking for his employees if he wanted to do it. Mrs. Hill said she also had a call concerning this from a lady who identified herself. Mr. Murray also received a call concerning two town trucks parked in the long-term parking when they could be parked in the three-hour spaces. Mr. Niccolls took care of this. Mr. Murray pointed out that there are numerous free parking spaces on Slack Lane and North Street around the County parking lot. Mrs . Hill said her call was about the same thing. She pointed out to the lady that these three-hour meters were at the request of the downtown merchants . MAYOR'S REPORT : Mayor Rollins read to Council a letter from Mr. Charles A. Bos, submitting his resignation from the Board of Architectural Review as a result of his election to the Leesburg Town Council . On mo- tion of Mayor Rollins, seconded by Mr. Tolbert, Council voted unani- mously to accept Mr. Bos ' s resignation effective Midnight, June 30, 1980 : Aye: Councilmembers Cole, Herrell, D. Hill , M. Hill, Murray, Tolbert and Mayor Rollins. Nay : None. MINUTES OF JUNE 11, 1980 MEETING. 246 Mayor Rollins also called to Council 's attention that several appointments will be made at the first meeting in July by the new Council .- Councilmanic member to the Planning Commission, Council- manic member to the Board of Architectural Review, a new appoint- ment to succeed Mr. Bos on the Board of Architectural Review, mem- ber to NVPDC, election of a Mayor Pro-Tem and liaison to the Air- port Commission. He asked that members be thinking about these appointments. Mayor Rollins said he has also received some comments concern- ing employee parking on the municipal lot, and has discussed this matter with Mr. Niccolls . He, personally, finds it difficult to distinguish between employees of the town and other employees who work in Leesburg as to whether or not they should have free parking places. He feels Council will have to consider this - whether or not employees will be allowed to have free spaces and, if so, whether they should be moved to the Vinegar Hill lot. Mr. Herrell felt there is a big difference in an employee of the town and an employee of Peoples National Bank. First, the town owns the municipal parking lot - they are free to give employees free parking - this is a fringe benefit and the town has the right to give it. He did not feel this parking lot is for the benefit of the businesses in the downtown area to make money-- it is there for the purpose of making money and for the town to use as it sees fit. This is why he voted for the Vinegar Hill parking lot - it is for the town to make money. Mr. Tolbert felt each business should provide its own parking lot. Mr. Cole said The Hub has a lot with space for the employees and for customers. Mayor Rollins asked why the town employees should have free park- ing and employees of other businesses have to pay? Mr. Hill felt this is an attraction for employment with the town. The town does not pay the highest salaries in town and there is not that much turnover - the fringe benefits, including this free parking, aie all a part of a package that makes the town employees a harmonious group. Other businesses can do the same thing if they want to do it. Mayor Rollins asked what would be wrong with free parking at the Vinegar Hill lot? Mr. Hill wants the free parking to be of benefit to the employees - give them the option of where they want to park. Mr. Herrell said when he worked for the Telephone Company in D.C. , they rented a whole garage for their employees to park in and didn 't allow anyone other than employees to park in it. Mr. Murray felt there is a big difference in town employees and those living in Purcelleville who work at Peoples Bank or other places - they don 't pay any taxes to the town. This is a fringe benefit and is a selling point. Mr. Hill thought this was an administrative matter to be handled by the Town Manager. Mayor Rollins did not agree with this - it is a matter of an ordinance for the Council to act on. Mr. Niccolls said"anything the Council says is a policy decision within its purview is. " Mayor Rollins asked when availability fees for water and sewer are to be paid? Mr. Niccolls said they must be paid before the town issues a zoning certificate and this certificate must be is- sued before the County will issue a building permit. 80-0-11 - ORDINANCE - AMENDING RESIDENTIAL PERMIT PARKING REGU- LATIONS . On motion of Mrs. Hill, seconded by Mr. Cole, the following ordinance was proposed: ORDAINED by the Council of the Town of Leesburg , Virginia, as follows : SECTION I. Paragraph (d) of Section 10-165 of the Town Code is hereby amended to read as follows : Sec. 10-165 . Residential Permit Parking. (d) Except as otherwise provided herein, it shall be un- lawful for any person to park any vehicle Monday through Friday between the hours of 9 :00 a.m. and 4 :00 p.m. each day for longer than two hours at any MINUTES OF JUNE 11, 1980 MEETING. one time, whether owner of title or not, on any 247 street so designated for residential permit parking only, without the display of a permit in accordance with this section. SECTION II. This ordinance shall be in full force and effect upon the proper placement of signs identifying this change. Mayor Rollins asked what the meaning is of "whether owner of title or not"? Mr. Niccolls said the intent is to make it clear that, whether the owner or some other driver parks the car, no person shall do so. The owner is held responsible - he under- stood the Virginia courts have allowed prosecution of the owner even though there was no necessary evidence that it was the owner that did the driving. He was not sure this language is necessary. On motion of Mr. Murray, seconded by Mr. Tolbert, it was proposed to strike from the ordinance "whether owner of title or not" . Mr. Niccolls said there is similar language in the State Code. The amendment was adopted by a vote of 6 to 1 : Aye : Councilmembers Cole, Herrell, M. Hill , Murray, Tolbert and Mayor Rollins . On motion of Mr. Herrell, seconded by Mr. Cole, the following resolution was proposed: WHEREAS, the Town Council has endorsed August Court Days as an annual event in Leesburg for amusement, culture and commerce; and WHEREAS, the Loudoun Restoration and Preservation Society, Inc. proposes to conduct an August Court Days 1980 celebra- tion within the Town on August 16 and 17 : RESOLVED by the Council of the Town of Leesburg, Virginia, as follows : SECTION I. The closing of King Street from Loudoun to Corn- wall Streets, and the closing of Market Street from Church to Wirt Streets , to motor vehicle traffic for use during August Court Days, 1980, August 16 and 17 , is approved contingent on the following : MINUTES OF JUNE 11, 1980 MEETING. 248 (a) Persons wishing to use these streets without par- ticipating in the August Court Days 1980 celebra- tion shall not be obligated to make any donation for doing so . (b) The Leesburg Volunteer Fire Company and the Loudoun County Rescue Squad shall not be charged any fee for booth space during the two-day event. SECTION II . The Loudoun Restoration and Preservation So- ciety, Inc. is authorized to use the northwest portion of the municipal parking lot for August Court Days activities . SECTION III . The Loudoun Restoration and Preservation So- ciety, Inc. shall carry liability insurance coverage in the amount of $500 , 000 bodily injury and $100, 000 prop- erty damage, with the Town of Leesburg being named as additional insured, for its activities during August Court Days 1980, and a certificate of insurance for this coverage shall be furnished to the Town by July 30, 1980 . SECTION IV. Section 17-63 of the Town Code is hereby waived for both the crafts people and food vendors in connection with the August Court Days 1980 , provided all such crafts people and food vendors have registered with the Loudoun Restoration and Preservation Society, Inc. , and the Society has furnished the Town with a list of those participating in the August Court Days celebration. Mr. Hill asked if these limits comply• :with the minimum limits under the unbrella policy? Mr. Niccolls said they do as far as he knows . He said neither the Fire Company nor the Rescue Squad had booths last year because they wanted to charge for it. It is felt, however, that both of these organizations should not pay for a booth since they are on the scene anyway to offer assistance - they contribute to the Preservation So- ciety ' s effort. Aye: CouncilmembeLs Cole, Herrell , D. Hill, M. Hill, Murray, Tolbert and Mayor Newman. Nay : None. 80-69 - RESOLUTION - ACCEPTANCE OF DEED FROM LOUDOUN COUNTY SCHOOL BOARD FOR SANITARY SEWER AT J. LUPTON SIMPSON MIDDLE SCHOOL. On motion of Mr. Cole , seconded by Mr. Hill, the following resolution was proposed: RESOLVED by the Council of the Town of Leesburg, Virginia, as follows : The Deed dated the 13th day of May, 1980 by and between the Loudoun County School Board and the Town of Leesburg in Virginia, conveying to the Town all of the physical improvements installed by the Board in the streets , rights-of-way and easements in the Board' s lands to which title has been conveyed to the Town is accepted, . with the Town agreeing to be responsible for the mainte- nance and replacement of the sanitary sewer at the J. Lupton Simpson Middle School , and the Mayor is hereby authorized to acknowledge the same on behalf of the Town. Mr. Niccolls explained that this was part of the original agreement. The request for this was made three years ago - it was forgotten so we are now catching up. The resolution was unanimously adopted: Aye : Councilmembers Cole, Herrell, D. Hill, M. Hill, Murray, Tolbert and Mayor Rollins. Nay: None. MINUTES OF JUNE 11, 1980 MEETING. 80-70 - RESOLUTION - AUTHORIZING EXECUTION OF AGREEMENTS WITH 249 THE ESTATE OF WALTER L. PHILLIPS, SR. AND LOUDOUN COUNTY PERMITTING INSTALLATION OF PEDESTRIAN/BICYCLE ACCESSWAYS. On motion of Mr. Hill, seconded by Mr. Cole, the following resolution was proposed: WHEREAS , the Loudoun County School Board requires ele- mentary school students to walk to school if safe ac- cesses are provided and they are within a one-mile walking distance, and WHEREAS , sections of accessway are required across the property for safe passage, NOW, THEREFORE, RESOLVED by the Council of the Town of Leesburg, Virginia, as follows : SECTION I . The mayor is authorized to enter into an agreement with the estate of Walter L. Phillips, Sr. to permit installation of a gravel pedestrian/bicycle CD accessway extending parallel to the future North Street between Exeter Hills and Carrvale Subdivision. CO N SECTION II . The mayor is authorized to enter into an W agreement with Loudoun County to permit installation a of a concrete sidewalk on the north side of North Street Q in the vicinity of North Harrison Street. Mr. Hill asked if there has been any feedback from the residents on Fort Evans Road? Mr. Niccolls said those arrangements have not been completed. Mayor Rollins asked if the town made a commit- ment to build the sidewalks out there? Mr. Hill said this came up in a School Board meeting - it was determined that, if there could be some kind of sidewalks completed in that area, it would cut down on bussing. He suggested that the School Board make a presentation to the town - he thought it would be a cooperative effort. The presentation was made and the committee studied it. The agreement is to put in some temporary walkways. Mayor Rol- lins asked if this would eventually be a concrete sidewalk? Mr. Hill felt it would be in time - this would be an extension of North Street. Mr. Murray asked where the County property is near North Street? Mr. Niccolls said it is between Harrison Street and the Fulton Want property. There is already right- of-way available in front of the Want property. Mayor Rollins said most of the children on Edwards Ferry Road will go to this school and there is no sidewalk there. Mr. Niccolls said a map of the sidewalks needed was shown to the committee - many of these walks are being constructed this summer by developers . Heritage Square will be constructing it on the south side of Edwards Ferry Road between the existing Heritage Square and Leesburg Village Apartments; Carrvale will be constructing the walk on the north side of Edwards Ferry Road from the corporate limits to the extension of Plaza through Carrvale - so there will be sidewalk on both sides of Edwards Ferry Road roughly to the corporate limits . The idea is to funnel those children living in Lowenbach Subdivision north to the gravel walk (on the Phillips land) . There will be short sections of concrete walk installed on Edwards Ferry Road, where there are broken sections now. The town is devising a plan where the School Board said this will get the most children to the walk. He personally felt there will be a bus on Edwards Ferry Road to pick up children on the south side, but they will be able to eliminate a good bit of bussing from Blue Ridge Avenue north, Wildman, Slack Lane, Harrison, North and North King Streets. The one-mile limit extends up North King Street as far as Dr. Gable ' s and these children would be on side- walk all the way to the school . Mayor Rollins asked if Carrvale calls for sidewalks between the road and the wall? Mr. Niccolls said it does and explained in detail . Mayor Rollins asked who will pay forthe construction in Section II of Carrvale? Mr. Niccolls presumed the town would - there has been no proposal for 250 MINUTES OF JUNE 11, 1980 MEETING. it by anyone, but one can be made. Loudoun County owns a piece of land immediately adjacent to the west line of the property across from Lawrence Muse and Joe Kelly said he would like to have it in front of his property. There has been no money specifically appropriated for this - the plan is to use money in the budget in operating accounts for ma- terials and use town labor. It is planned to have it done by August 25th when school starts. The total cost is $13,000 for materials, plus labor. Mr. Herrell asked what the problem is in putting sidewalk on Edwards Ferry Road around Prince Street? Mr. Niccolls said there are serious difficult con- struction problems . The right-of-way down Edwards Ferry Road is narrow and there is an acquisition problem - a lot of front yards are developed into shrubbery and trees - and there is a grade problem - that would really get into a lot of problems. Nay : None. 80-71 - RESOLUTION - MAKING SUPPLEMENTAL APPROPRIATIONS FOR FISCAL YEAR ENDING JUNE 30 , 1980 . On motion of Mr. Murray, seconded by Mr. Tolbert, the following resolution was proposed: RESOLVED by the Council of the Town of Leesburg, Virginia, as follows : ' SECTION I . Mr. Niccolls said it is a fixed unit price contract but the number of units served can change our price. This is changed every six months . Mr. Taylor thought it was just CD for new units - there have been a lot of new houses during CD this fiscal year. Mr. Hill asked when his new higher price CO will start? There being no objection to considering this tonight, on motion of Mr. Hill, seconded by Mr. Murray, the following reso- lution was proposed : RESOLVED by the Council for the Town of Leesburg, Virginia, as follows : The Virginia Department of Highways and Transporta- tion is requested to accept into the Virginia Depart- ment of Highways Secondary System 2. 81 lane miles of Leesburg streets listed on the accompanying Form U-1 , in accordance with the requirements of Section 33.1-43 of the 1950 Code of Virginia, as amended. Mr. Niccolls explained that all of these streets have been in- spected and they are all acceptable. We try to add the streets that have been built and inspected each year before July 1 so that the Highway Department will pay us during the next fiscal year at the rate of $3, 500 per mile, so this is worth roughly $6 , 000 or more to us on an annual basis.
