INITIATION: The regular meeting of the City Council was called to order by Mayor Tyrell at 7:35 P.M. The Mayor then led the 2. Pledge of Allegiance to the Flag. 3. INVOCATION: Invocation was given by Elder Harold Calkins of the Seventh Day Adventist Church, 9664 E. Las Tunas Dr., Temple City. 4. ROLL CALL: PRESENT: Councilmen - Dickason, Fitzjohn, Merritt, Nunamaker, Tyrel ABSENT: Councilmen -None ALSO PRESENT: City Attorney Shatford; City Manager Woollett 5. APPROVAL OF MINUTES: (a) Councilman Fitzjohn moved to approve the minutes of the Regular Meeting of January 14, 1963, seconded by Councilman Merritt, and carried by the following roll call vote: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Nunamaker,Tyrell NOES: Councilmen -None ABSENT: Councilmen -None (b) Councilman Merritt moved to approve the minutes of the Ad- journed Meeting of January 16, 1963, seconded by Councilman Nuna- maker and, carried by the following roll call vote: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Nunamaker,Tyrell NOES: Councilmen -None ABSENT: Councilmen -None Mr. James Fickes, Fickes & Fickes Architects who designed the proposed new library, addressed the Council stating that there was a problem regarding the service room in the basement. Plan Checking specified two exits in order to expand. the basement. The cost of this is more than the budget will stand. The crux of the problem seems to be in the definition of "service area'. Councilman Merritt moved to refer this matter to the staff for clarification, seconded by Councilman Nunamaker and carried by the following roll call vote: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Nunamaker,Tyre11 NOES: Councilmen -None ABSENT: Councilmen -None Mayor Tyrell called upon William H. Germain and Russell W. Holm to come forward to take the Oath of Office as Parks & Recreation Commissioner and Planning Commissioner respectively. After being sworn in by the City Manager, Mayor Tyrell then congratulated Commissioner Germain and Commissioner Holm and welcomed them into the City family. 7. REQUEST FOR ON -SALE BEER LICENSE: JOLLY COACHMAN, 9151 -53 E. Las Tunas Drive. Mr. Woollett stated that since the Agenda was made up both the applicant and the Alcoholic Beverage Control Board have indicated that the application has been withdrawn. City Attorney Shatford informed the Council that the subject is therefore moot. Councilman Nunamaker stated that he felt there should be another hearing to determine whether the nuisance and policing problem has been abated. City Attorney Shatford stated that this must be done at a public hearing to give everyone concerned an oppor- tunity to speak. Councilman Fitzjohn moved to set a public hear- ing at 7:30 P.M. February 21, 1963, seconded by Councilman Nuna- maker and carried by the following roll call vote: AYES: Councilmen- Dickason, Fitzjohn, Merritt, Nunamaker, Tyrell NOES: Councilmen -None ABSENT: Councilmen -None 401 Council Minutes, January 28, 1963, Page 2 Mrs. Joseph Lang, 9133 E. Hermosa Drive asked the Council why it was necessary to hold another public hearing when the subject in question has been put on probation. Mayor Tyrell explained that the purpose of this public hearing would be to determine whether or not the nuisance has been abated. 8. PUBLIC HEARING: 7:45 P.M. - Installation of Curb and Gutter on West Side of Loma Ave. between Las Tunas Dr. and Duffy St. Mr. Woollett explained that the individuals and property owners on the west side of Loma Avenue have been notified of the public hearing. At present there is 53.37 percent of curb and gutter already installed and the remaining property owners, with the exception of one, have signed a petition in favor of curb and gutter. Mayor Tyrell declared the Public Hearing opened and asked if anyone in the audience wished to speak against the installation of curb and gutter on this street. Mr. Biagio Petani, 5753 Loma Ave. stated that he objects on the grounds that is not in a financial position to pay For this work due to the fact that he is elderly and his wife is not well. He felt that as a citizen he should not be forced to pay for some- thing he does not want, although he does agree that it will im- prove the neighborhood. There were no further protests and Councilman Fitzjohn moved to close the public hearing, seconded by Councilman Nunamaker and carried. Mr. Fred Avery, 5731 Loma Ave. asked if this would increase the taxes and if so, how much? Mr. Woollett informed him that it would not increase his tax and that although the contractors pricE less the 50t rebate by the City would amount to approximately $2.0 per ft.the additional cost of paveout, surveying, design, etc. costs about $10 per lineal Foot, which is paid for by the City. Councilman Nunamaker moved to grant the request for curb and gutter on the West side of Loma Avenue between Las Tunas Dr. and Duffy Street, seconded by Councilman Merritt and carried by the following roll call vote: AYES: Councilmen-Dickason, Fitzjohn, Merritt, Nunamaker, Tyrell NOES: Councilmen -None ABSENT: Councilmen -None DISCUSSION OF CURRENT STATUS OF SALE OF TOUT SHEETS WITHIN THE CITY. Lt. Baker gave a brief summary of just what a tout sheet is and explained that the present ordinance is inadequate as it is now worded. Considerable discussion followed and Councilman Dickason moved to refer the matter to City Attorney Shatford for possible rewording, seconded by Councilman Nunamaker and carried by the following roll call vote: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Nunamaker, Tyrell NOES: Councilmen -None ABSENT: Councilmen -None 10. PROPOSED KRLA - TEMPLE CITY CIVIC FORUM: Mr. William McMillan, Director of News 5 Public Affairs of KRLA addressed the Council and gave a brief outline of a proposed Civic Forum to be conductec in this City. The program itself is of half hour duration, how- ever the actual session would be taped for two and one /half hours and then cut to one -half hour. KRLA arranges the entire program and furnishes coffee and donuts to help create a relaxing atmos- phere. A panel of about four people is customary and these people would be chosen according to the subject matter chosen for dis- cussion. A group of townspeople constitute the audience and they in turn fire questions at the panel. This type of program has been successful for the past three years, and about eight a year are presented. Council all agreed it was a fine idea. Councilman Fitzjohn moved to refer all arrangements for the Forum to the staff, seconded by Councilman Dickason and carried by the following roll call vote: 1+02 Council Minutes, Jan. 28, 1963, Page 3 AYES: Councilmen - Dickason, Fitzjohn, Merritt, Nunamaker, Tyrell NOES: Councilmen -None ABSENT:Councilmen -None 11. TEMPLE CITY JR. CHAMBER OF COMMERCE: Request for Financial Assistance on Erection of Entrance Signs on Las Tunas Drive. The City Manager stated that the Traffic Commission has approved the design of the sign and in the absence of Gary Tieman, Vice President of the Junior Chamber of Commerce, read a communication requesting City aid in financing the two entrance signs which would be placed on Las Tunas Drive at Rosemead Blvd. and. Baldwin Avenue. The total cost of the signs would be $3,000. of which one -half would be paid for by local service clubs and the re- maining $1,500 is being requested of the City. After considerablE discussion, it was generally felt that requests of this nature work a hardship on the budget as they crop up from time to time during the year after the budget has already been appropriated. It was felt that the service clubs should try to think ahead and put in a request in the early spring for discussion at the budget hearings. Councilman Merritt moved to refer this item back to the Junior Chamber of Commerce and request that they take it up totally with service clubs. Seconded by Councilman Fitzjohn and carried by the following roll call vote: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Nunamaker, Tyrell NOES: Councilmen -None ABSENT:Councilmen -None Councilman Nunamaker then made a motion to recommend that the various commissions be notified that they do no work for an or- ganization until that club comes up with a plan for raising the money for their project. After an explanation by the City Manager that the Traffic Commis- sion did nothing but investigate the safety factors involved with the design of the sign (as they would investigate any request by a citizen or group for any type of traffic regulation) Councilman Nunamaker withdrew his motion. City Attorney Shatford explained that if a group is planning a project which might involve traffic and safety, then the Traffic Commission must determine whether or not it is acceptable before they can go ahead with the financing of the project. Councilman Nunamaker then made a motion to approve the design of the Entrance Sign, seconded by Councilman Fitzjohn and carried . 12. OLIVE STREET ET AL CASH CONTRACT #41252, Curb and Gutter and Cross Gutters: Mr. Woollett explained that this was a combination of several petitions for curb and gutter and rather than take each one separately they were all put out to bid as one package. The lowest bidder was A -1 Concrete, Inc. at $15,658.40, which brings the cost to $1.70 per lineal foot. This is the lowest price in the Valley and the firm is thoroughly competent. Councilman Dickason moved to award the contract to A -1 Concrete, Inc. in the amount of $15,648.40 and instruct the City Attorney to draw the contract and agreement. Seconded by Councilman Fitzjohn and carried by the following roll call vote: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Nunamaker, Tyrell NOES: Councilmen -None ABSENT:Councilmen -None 13. RESOLUTION NO. 63-259: Warrants & Demands, No. 2.229 through 2261, & Nos. 2264 & 2265, in the sum of $22,621.61. Councilman Merritt moved to adopt Resolution No. 63 -259, seconded by Councilman Dickason and carried by the following roll call vote AYES: Councilmen - Dickason, Fitzjohn, Merritt, Nunamaker, Tyrell NOES: Councilmen -None ABSENT:Councilmen -None 403 Council Minutes, Jan. 28, 1963, Page 4 14. COMMUNICATIONS: a. Temple City Jr. Chamber of Commerce: A request was received for permission to place a banner across Las Tunas Dr. to announce a Seat Belt Clinic, to be held on February 2, 1963. Councilman Fitzjohn moved to grant permission, seconded by Councilman Dicka- son and carried by the following roll call vote: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Nunamaker, Tyrell NOES: Councilmen -None ABSENT:Councilmen -None b. L. P. County Boundary Commission re proposed annexations #313 & #315 City of El Monte. Councilman Dickason moved to re- ceive and file, seconded by Councilman Fitzjohn and carried. c. Benjamin E. Talley: Request to paint numbers on curbs: Mr. Woollett briefed the Council on the present policy of requir- permi ss i on from the Council to perform such work. At the present time permission has been granted to only one individual, a high school boy. The individual applying at this time intends to con- duct this as a commercial enterprise. The request at this time comes as a result of a complaint received by the Sheriff's Dept. that Mr. Talley was painting curbs in the City without a license. Mr. Talley stated that he had operated within the City on previ- ous occasions with only a County license and was not aware that he was in violation. After considerable discussion regarding the amount of curb and gutter in the City and the possibility of a conflict with the young man already authorized to paint numbers, it was felt that there was sufficient need to keep both people busy for a long time. Councilman Fitzjohn moved to grant permission for painting of numbers on curbs to Benjamin E. Talley, seconded by Councilman Merritt and carried by the following roll call vote: AYES: Councilmen - Dickason, Fitzjohn, Merritt, Nunamaker, Tyrell NOES: Councilmen -None ABSENT: Councilmen -None City Manager Woollett instructed Mr. Talley to report to the City Hall twice a week in order to keep the City informed as to the location and area currently being worked. 15. TIME FOR THOSE IN THE AUDIENCE WHO WISH TO SPEAK:. Mr. Ed Zinsky, 5671 Loma Ave. stated that the boy who is now paint ing curb numbers is doing a fine job and wondered if by granting permission to another individual it would put the boy out of busi- ness. The Council assured him that there was enough to keep them both busy. 16. MATTERS FROM CITY OFFICIALS: Councilman Dickason asked if it wouldn't be possible for the City Hall to handle Road Department permits within the City, rather than have people drive way out to Baldwin Park where this is now handled. Mr. Woollett informed him that it was his understanding that this was now being handled at the County Engineer's Office and that he would check into the situation and see whether this was the case. Councilman Fitzjohn asked what was being done regarding the over- night parking ordinance. Many people were receiving citations and he wondered if a permit could not be issued in certain cases. Mr. Woollett stated that the staff would check into the situation and would report at the next meeting. Councilman Dickason brought up the subject of one -way alleys, stating that people are still getting tickets, and wondered if perhaps the center -line stripe was causing confusion. After a brief discussion, Traffic Commissioner Sale came forward and stated that at a meeting of the Traffic Commission and staff held Saturday morning this subject was brought up and it was felt that large block arrows painted on the outside of each alley would help Councilman Fitzjohn moved to refer this matter back to the Traffic Commission, seconded by Councilman Dickason and carried. 404 1 Council Minutes, Jan. 28, 1963, Page 5 Councilman Merritt asked for a report of the intersection lightinc project and Mr. Woollett informed him that he will have a status report for the next meeting. City Manager Woollett had the following items: a. Notice of Proposed Annexation #314, City of El Monte. Councilman Fitzjohn moved to receive and file, seconded by Councilman Nunamaker and carried. b. Approval has been received from the State on Live Oak Avenue construction and we are going ahead with plans and specs which have been furnished and are putting it out to bid, with bid open- ing date set for February 19th. This will make it possible for the contractor to go to work the day after the racing season ends. c. Received an informal petition from property owners on Las Tunas between Muscatel and Burton requesting that this area be annexed to Temple City. This is one of several that are on their way in. Suggested that this be acknowledged and request a recom- mendation from the Planning Commission in conjunction with pro- posed annexation. Councilman Nunamaker so moved, seconded by Councilman Merritt and carried. Mayor Tyrell informed the Council that a bill was received in the amount of $40. for membership to the Committee of Mayors. He questioned the value of such a membership and Councilman Dickason stated that he found it quite informative during his term of of- fice and that he attended a few meetings. However, he felt that unless the meetings were attended there would be no value in be- longing. It was felt that this was an individual preference and it was decided to let the next Mayor decide for himself whether or not to belong. Mayor Tyrell stated that the new dugouts at for the Little League field at Live Oak Park are almost completed and the volunteer fathers who are doing the work are doing a wonderful job. All of this is at no cost to the City. Mayor Tyrell felt that the City should think about adult baseball and night lights. Councilman Fitzjohn stated that it would be in order to recognize the indivic uals who are working on the Little League field. Mayor Tyrell also informed the Council that the new outdoor lights are on at Live Oak Park and look great. Councilman Dickason stated that there was a misunderstanding with regard to his request to have published in the newspapers the weather report for the City. It was not for the data, but the publicity only. Mr. Woollett made reference to the Adult Ballroom Dance Program to be conducted at Live Oak Park, copies of which are in each Councilman's folder. 17.
