BETWEEN THE VILLAGE OF KEY BISCAYNE (THE "VILLAGE") AND THE KEY
BISCAYNE PROFESSIONAL FIREFIGHTER'S ASSOCIATION, LOCAL 3638 ("IAFF
LOCAL 3638") PERTAINING TO FIREFIGHTER CANCER TREATMENT
WHEREAS, SB 426 was passed by the Florida Legislature, referred to as the "Florida
Firefighter Cancer Treatment Legislation" ("Act"), creating Florida Statute section 112.1816; and
WHEREAS, the purpose of that legislation was to grant certain benefits to firefighters upon
receiving a diagnosis of cancer, recognizing that the identified cancers were related to work
performed by firefighters in the line of duty for the Village; and
WHEREAS, the Village recognizes that there were firefighters who were undergoing
treatment for one or more of the twenty-one (21) cancers covered by the Act upon the effective
date of the Act, March 1, 2019; and
WHEREAS, it is the intent of the Village to assure that these firefighters receive the
protections and benefits of the Act in addition to the benefit provided below.
IT IS THEREFORE RESOLVED as follows:
1. The firefighters being treated for cancers covered by the Act as of the Act's effective
date of July 1, 2019 shall be provided all benefits under the Act;
2. In addition, such firefighters shall be reimbursed for any leave used related to such
treatment/disability, retroactive to March 1, 2019, pursuant to Article 18, On the Job
Injury, of the 2017-2020 collective bargaining agreement between the Village of Key
Biscayne and IAFF Local 3638.
Agreed to this 29th date of October, 2019.
