A special meeting of the Leesburg Town Council was held in 1 3 5
the Council Chambers , 10 West Loudoun Street, Leesburg, Virginia
on December 13 , 1982 at 5 : 30 p.m. , pursuant to Notice thereof hav-
ing been delivered to all Council members prior thereto. Present
were : Mayor Robert E. Sevila, Councilmembers Charles A. Bos, Ed-
gar L. Coffey, Jr. , Reginald K. Gheen, Marylou Hill, John W. Tol-
bert, Jr. and Howard M. Willis, Jr. ; also Town Manager John Nic-
colls , Assistant Manager Jeffrey H. Minor and Director of Engineer-
ing Andrew G. Shope.
The meeting was called to order by the Mayor , who explained
that the purpose of the meeting is to consider the matter of com-
pletion of the Potomac River Water Treatment Plant. The contractor
is technically in default . Mr. Niccolls has been in touch with the
town ' s special counsel in this matter.
Mr. Niccolls said Terry Ney, of Booth, Prichard and Dudley,
'recommends that Council authorize the issuance of a termination
notice if such becomes necessary after December 17th. This would
allow a seven-day period for the contractor to either complete the
work or to wind down the project. It is, for all intents and pur-
poses, a sure thing that a notice of that type will be issued,
OD though we do not yet have in hand the formal recommendations to be
expected by the 17th. Everybody thinks it is an appropriate and
o necessary thing to do at this time .
OD 82-164 - RESOLUTION - AUTHORIZING THE MANAGER TO TAKE NECESSARY ACTION
La FOR COMPLETION OF THE POTOMAC RIVER WATER PLANT.
Q On motion of Mrs . Hill, seconded by Mr . Willis, the following
resolution was proposed :
WHEREAS , the Potomac River Water Plant is more than 400 days
beyond scheduled completion;
THEREFORE, RESOLVED by the Council of the Town of Leesburg in
Virginia as follows :
SECTION I . The manager shall , upon the recommendation of the
town 's special counsel and consulting engineers, take all neces-
sary and appropriate actions under the general conditions of
the town ' s October 2 , 1979 contract with Mechanical Construc-
tors, Inc. of Springfield, Virginia to complete construction
of the Potomac River Water Plant.
SECTION II . The manager shall enter into contracts , if such
become necessary, recommended by the consulting engineers for
material and services necessary to complete the work in ac-
cordance with the plans and specifications.
Mr. Bos asked if this gives Mr. Niccolls what he needs to proceed
from here into January? Mr . Niccolls said it does. Mr. Gheen under-
stood the town itself would be completing the project - would there
be any conflict or would there have to be competitive bids under the
new Virginia law? Mr. Niccolls said this could be a problem and we
will have to deal with it as it comes up. If they are below $10, 000
each, he believes the competitive bidding rules do not apply. He
believes there is also an emergency contract provision in that law.
He felt most of these contracts will be smaller than that. The
resolution was unanimously adopted :
Aye : Councilmembers Bos , Coffey, Gheen, Hill, Tolbert, Willis
and Mayor Sevila.
Nay: None.
There being no further business, on motion of Mr. Willis, sec-
onded by Mr . Tolbert, the meeting was adjourned.
