A special meeting of the Leesburg Town Council was held in the Council Chambers, 10 Loudoun Street, S.W. , Leesburg, Virginia on December 23, 1985 at 9:00 A.M. , pursuant to Notice thereof having been delivered to all councilmem- bers. Present were: Mayor Robert E. Sevila, Councilmembers Charles A. Bos, Arl Curry, Marylou Hill, Brian T. Kelley, John W. Tolbert, Jr. and Charles J. Williams; also Town Manager Jeffrey H. Minor, Assistant to Manager Stephen F. Owen, Director of Finance Paul E. York, Director of Planning, Zoning and De- velopment Martha Semmes and Principal Planner Thomas R. Poupard. The meeting was called to order by the Mayor, with the invocation given by il Mr. Tolbert, and followed with the Salute to the Flag led by Mr. Tolbert. i 85-235 - RESOLUTION - APPROVING LEESBURG VOLUNTEER FIRE DEPARTMENT, INC. AS BEING ORGANIZED PURSUANT TO SECTION 27-8 OF THE CODE OF VIRGINIA AS AMENDED. On motion of Mrs. Hill, seconded by Mr. Williams, the following resolution was proposed and unanimously adopted: I WHEREAS, Leesburg Volunteer Fire Department, Inc. (LVFD) is a fire fighting organization formed in accordance with Section 27-8- of the Code of Virginia, 1950 as amended; and WHEREAS, the Leesburg Town Council has for many years recognized the exist- ence of and made contributions to LVFD; and WHEREAS, the approval of LVFD by the Leesburg Town Council is required in order for LVFD to receive the benefits of the "Line of Duty Act" as pro- vided in Section 15.1-136 et seq of the Code of Virginia, 1950 as amended; and WHEREAS, the Town has always recognized the important contributions made by the members of LVFD to the/Leesburg community and wishes to make avail- able the benefits of the "Line of Duty Act" as mentioned hereinabove: THEREFORE, RESOLVED by t%e Council of the Town of Leesburg in Virginia as i follows: .. � SECTION I. Leesburg Volunteer ire Department , Inc. is organized pursuant to Section 27-8 of the Code of Virginia, 1950 as amended, and has the full authority to appoint a chief and any other officers it may deem appropriate. SECTION II. The Leesburg Town Council fully recognizes the contributions made to the Town by the members of Leesburg Volunteer Fire Department, Inc. Aye: Councilmembers Bos, Curry, Hill, Kelley, Tolbert, Williams and Mayor Sevila: Nay: None. Mayor Sevila welcomed Mr. and Mrs. William F. Rust to this meeting. On motion of Mrs. Hill, seconded by Mr. Tolbert, the following resolution was proposed: RS-916 - RESOLUTION - ACCEPTING THE DONATTON OF LAND BY WILLIAM F RUST, TR AND MARGARET D RUST HIS WTFF. WHEREAS, William F. Rust, Jr. and Margaret D. Rust, his wife, have offered to donate 60. 7 acres of land lying on the west side of Business U.S. Route 15 and north of Union Cemetery to the Town for public park and recreational purposes; and WHEREAS, this parcel is the first of three tracts of real estate comprising 138 acres which Mr. and Mrs. Rust intend to give to the Town of Leesburg during 1986, to be used and maintained as a public park known as "Ida Lee Park" of Leesburg, Virginia; and WHEREAS, this Council wishes to accept this gracious deed of gift and dedi- 1 cation: 100 MINUTES OF DECEMBER 23, 1986 SPECIAL MEETING. THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows: SECTION I. The donation of the 60. 7 acre parcel shown on a plat prepared by Bengtson, DeBell, Elkin & Titus, dated December 3, 1985, to the Town of Leesburg by William F. Rust and Margaret D. Rust, his wife, is accepted: SECTION II. The Mayor is authorized to acknowledge this acceptance, on be- half of the Town, by executing the deed of gift and dedication which has been reviewed and approved by the Deputy Town Attorney, as transmitted to the Council by memorandum dated December 20, 1985. The Clerk shall attest the Mayor' s signature. SECTION III. On behalf of the citizens of the Town of Leesburg, this Council extends its sincere appreciation to Mr. and Mrs. Rust for this generous donation of future parkland in honor of Mrs. Ida Lee Rust. Mr. Bos commented that this park fulfills a substantial need the town has for a recreational area and it goes a long way toward preserving the north end of Lees- burg in terms of its beauty. He lives close to it but those who live away from it are equally appreciative of this gift because of the generosity of the givers. He thanked them for this gift to the Town. Mr. Williams added that the citizens of Leesburg for generations to come will appreciate this generous gift - it is an ideal preservation to provide our present and future citizens with both passive and active recreational land, as well as the preservation of the wooded areas and the land. He thanked them for this nice gift and asked that God' s blessings be upon them. Mrs. Hill, Mr. Curry and Mr. Kelley all thanked Mr. and Mrs. Rust for this fine gift. Mr. Tolbert also thanked them and commented that "All good things come to those who wait - finally we have a park." Mayor Sevila felt too that a significant recreational need of this community is being met. It is open space, it is relief and is a natural boundary to the north of the town. It is appropriate that this is the Christmas season and this act of generosity makes it even more special. The town looks forward to work- ing with them in the continued planning of the park and the completion of this gift early in 1986. He acknowledged the presence of most of the town' s staff and, in recognition of the significance of this gift, he thanked bothMr. and Mrs. Rust on behalf of all the citizens of the town and the Town Council. Mr. Tolbert added that Mr. Rust ' s mother and grandmother would be proud of them today. Mayor Sevila exhibited a sign prepared by Mr. Rust' s sister in memory of Ida Lee and added that it will be displayed in an appropriate place. With the adoption of this resolution and the execution of the deed, the town actually has an "Ida Lee Park" in 1985. Mr. Rust added that the town should also thank Miss Mary Conrad for the preservation of that land. Mayor Sevila agreed, but felt the real thanks goes to Mr. and Mrs. Rust . This land is beautiful in its natural state, however, realizing the value of this property, he recognizes their generosity in this gift to the town. Mr. Rust commented that they are just trying to have Leesburg re- member that the "LEE" family has been around here for a long time. The resolution was unanimously adopted: Aye: Councilmembers Bos, Curry, Hill, Kelley, Tolbert, Williams and Mayor Sevila. Nay: None. A recess was declared while the deed was executed and pictures were taken. On motion of Mr. Williams, seconded by Mr. Kelley, Council voted unanimously to go into executive session in accordance with Section 2. 1-344(a)(1) of the Code of Virginia of 1950 as amended concerning personnel matters: Council reconvened, with no action taken. 101 MINUTES OF DECEMBER 23, 1986 SPECIAL MEETING. On motion of Mr. Williams, seconded by Mrs. Hill, Council voted unanimously to have the Town Manager draft a letter for the Mayor' s signature showing unani- mous support for the reappointment of Herman Costello to the Board of Zoning Ap- peals: Aye: Councilmembers Bos, Curry, Hill, Kelley, Tolbert, Williams and Mayor Sevila.
