Present: Mayor, Gary Acromite; Councilmembers, Ann Thies, Robert Mitchell, Wilfred Scherer, Philip Zietlow; Clerk -Treasurer, Donna Roehl; Public Works Director, James Dillman; Zoning Administrator, Loren Kohnen; Attorney, Ron Batty; Engineer, Glenn Cook 1. ADDITIONAL AGENDA ITEMS Moved by Acromite, seconded by Thies to discuss the Hennepin County landfill siting process and to remove Willow Dr. water line approval from the consent agenda. Motion declared carried 49 2. MINUTES OF MARCH 19, 1991 Ann Thies asked that fee schedule for dog impounds, Item 5, Page 35 include $50. fee plus $3.00 administration charge for second offense, plus $10. per time for dogs taken into custody without being impounded. Philip Zietlow asked thatPage 36, Hunter Farms Park,include "no motorized vehicles in park." He also asked that Item 7, Page 36 indicate that there was a 40% return of surveys. Moved by Scherer, seconded by Acromite to approve minutes of March 19, 1991, as amended. Motion declared carried 3. MINUTES OF MARCH 26, 1991 Moved by Scherer, seconded by Acromite to approve minutes of March 26, 1991, as presented. Motion declared carried 4. POLICE DEPARTMENT Hennepin Parks Moved by Thies,seconded by Acromite to table the matter until April 16, 1991. Motion declared carried .* CONSENT AGENDA Gary Acromite asked that Item 11, Tax Pool resolution, be table for discussion at a later meeting. 6. PUBLIC WORKS DEPARTMENT • Northern States Power Co. Moved by Scherer, seconded by Acromite to adopt Resolution 91-17, approving the street lighting layout for Cherry Hills 4th Addition. Motion declared carried * Northern States Power Co. Moved by Scherer, seconded by Acromite to adopt resolution 91-18, allowing Northern States Power to l.uy service in Cherry Hills 4th Addition. Motion declared carried • Minnegasco Moved by Scherer, seconded by Acromite to adopt Resolution 91-19, alloying, Minnegasco to bury gas lines in Cherry Hills 4th Addition. Motion declared carried Road Material Bids Jim Dillman stated that bids for road material for 1991 had been received at 10:00 A.M. on April 2, 1991 and he recommended that low bidders be awarded the bids according to list supplied to council. He stated that Twinco has not signed the development contract and he recommended that a feasibility study costing about $1000 be done, which would be credited back to the project if it was completed. Ron Batty stated that he assumed the city would receive a signed agreement very soon. Moved by Mitchell, seconded by Acromite to authorize a feasibility study be done for the Willow Dr. improvement, north of Hwy. 55. Motion declared carried Willow Dr. Water line Glenn Cook explained that the water line to the Twinco property had been completed at a cost of $18,744.50. He recommended acceptance of the project and final payment to Vogt Sewer and. Water. Motion by Acromite, seconded by Zietlow to approve final payment to Vogt Sewer and Water for Willow Dr. north water line in the amount of $ 1530.50 for total amount of $18,744.50. Motion declared carried Pioneer Tr. Improvement Glenn Cook explained the need to correct the intersection of Pioneer T. and Hwy. 55 and due to the fact that a Conditional Use Permit application had been received for the prop- erty to the west of the Kellin Farm and west of Pioneer Tr.: a road realignment could be done to correct the intersection. Moved by Mitchell, seconded by Thies to authorize a feasibility study be done for the Pioneer Tr. and Hwy. 55 intersection and improvement of Pioneer Tr. in that same area. Motion declared carried City Road Reoort Jim Dillman reviewed his report for 1991 road. improvements: Chippewa Rd-, East of Co. Rd. 19 He stated that completing the road by sealcoating would cost $80,000. He reported that when the Woodlake Landfill contract was negotiated in 1984, 2. cents per cu. yd. vas for road purposes, this was put into the General Fund and later the total amount collected changed although the council could still consider using 2 cents of that amount for road purposes. Donna Roehl stated that it would he easy to determine the 2 cents per cu. yd. if council wished to know the amount and everything collected, except the amount required for future problems, is kept in one fund. Maple Street Jim Dillman reported that some of the work on Maple St. was completed in 1990 at the time park work was done. He explained that a prior agreement with. owners of J.B. Farms requires that they pay $15,000 toward the road improvement, which may cost $28,000. 51 Medina Rd. Jim Dillman explained that Plymouth plans to improve Medina Rd. from Brockton Ln. to Hwy. 101 and he asked if Medina should complete the section from Holy Name nr. to Brockton Ln., this would provide another paved road to the east. He stated that the cost would be approximately $52,000 and that there are four property owners that can be assessed. Willow Dr., South of Co. Rd. 24 Jim Dillman reported that Willow Dr., south of Co. Rd. 24, is in need of repair and that some decision should be made as to what type of road it should be. He stated that the worst section is in. the area of Crosby Creek, to Ann Thies' driveway and if not kept up it could return to gravel status. Philip Zietlow stated that the highest priorty should be given to getting rid of dusty roads. Robert Mitchell stated that the city may need to make an investment to repair the road so as not to lose it entirely. He asked that Jim Dillman review the capital improvement list to determine where all of the road improvements have been schedule::. Jim Dillman stated that he would like some decision regarding Maple St. and Chippewa Rd. Moved by Mitchell, seconded by Acromite to approve sealcoating of Chippewa Rd. at an approxi- mate cost of $80,000, the Maple St. improvement and information on Medina Rd. and L e long range plans for Willow Dr. Motion declared carried * Yard Waste Disposal Moved by Scherer, seconded by Acromite to adopt Resolution 91-20, regarding dates for yard waste disposal and rules regarding disposal. Motion declared carried * Cherry Hill Farms, 4th Addition, Street and Utility Improvements Moved by Scherer, seconded by Acromite to adopt Resolution 91-21, approving plans and speci- fications for street and utility improvements in Cherry Hills Farm, 4th Additicr; with bids to be taken on April 30, 1991 at 10:00 A.M. Motion declared. carried 7. PLANNING AND ZONING DEPARTMENT * Kenneth Belcarde, Preliminary Subdivision Approval Moved by Scherer, seconded by Acromite to adept Resolution 91-22, %:ranting preliminary sub- division approval to Kenneth Belgarde to subdivide 17.44 acres at 2605 Willow Dr. Motion declared carried William Busch, Setback Variances Loren Kohnen explained. that Willi house at 2925 Willowood Farm; a 50 from the lake and a 35 ft. setback setback is required. Moved by Zietlow, seconded by Acromite to authorize preparation of a resolution granting setback variances to William Busch to construct a house at 2925 Willo`,rood Farm, according to conditions recommended by the Planning Commission. Motion declared carried 8. COMMUNITY DEVELOPMENT BLOCK GRANT PUBLIC HEARING, 11:10 P.M. Anne Theis, Medina Taxpayer, asked if money could still be used in the Independence Beach area. Donna Roehl explained that household income has not been determined from the 1990 census and that she had been advised by Hennepin County to use funds for other purposes as there have been many changes in the Independence Beach area in the past 10 years and it may not qualify under low and moderate income guidelines. She stated that a number of possibilities for using the funds have been discussed with Hennepin County, among them social programs. Moved by Scherer, seconded by Acromite to close the public hearing. Motion declared carried Public Hearing was closed at 11:15 p.M. Moved by Scherer, seconded by Acromite to ask staff to prepare recommendations for April 16, including topographical mapping, housing rehabilitation, and senior transportation. Motion declared carried 9. LANDFILL SITING PROCESS Ron Batty explained that Tad Jude had presented a resolution to the county board regarding ending the landfill siting process in Hennepin County and Senator Merriam had introduced a bill before the State Senate for the same purpose. He was concerned that if all options for landfill siting were rescinded, Woodlake may be looked at as the only alternative, although Hennepin County has agreed to a February, 1996 closing. Robert Mitchell stated that during the Woodlake negotiations the county would not agree that they would never site another landfill in Medina. Gary Acromite thanked Ron Batty for keeping the council informed on the matter. Moved by Mitchell, seconded by Thies to adopt Resolution 91-23, opposing abandonment of the landfill siting process in Hennepin County. Motion declared carried 10. PAYMENT OF BILLS Moved by Scherer, seconded by Zietlow to pay the bills; Order Checks # 9519-9588 in the amount of $94,957.20 and Payroll Checks # 12087-12109 in the amount of $14,552.71.
