1997- 03 -13. City Council Minutes
Mayor Walter W. Parker called the regular monthly meeting of
the Tybee Island City Council to order at 7:30 P.M. on Thursday,
March 13, 1997. The following members of Council were present: Ed
Merves, Jack Youmans, William Remeta, Michael A. Hosti, Mariann
Wildi, and Mallory Pearce. Attorney Dana Braun was present to
represent the City on legal issues as City Attorney Hughes was
out of town.
Mr. Carl Thompson gave the invocation and the Pledge of
Allegiance followed.
Mr. Charlie Waggoner and Mr. Henry Levy asked permission
from Council to proceed with plans for a park or plaza at the
intersection of Butler and Inlet. Mr. Waggoner asked also for
Council to form a committee of Mr. Levy, Mr. George Reese, and
himself. Mr. Levy said that a 3 tier fountain might be donated
and that it would need to be moved and installed at the site by
city employees. Mr. Levy requested an official letter from the
City to the person who will donate the fountain.
Ms. Susan Peters spoke to Council regarding a letter
concerning the inconsistency of parking meters. Mayor Parker said
that City Manager Farmer will review and make recommendations to
the Council.
Mr. Penn Myrick told Council that the folks who serve on the
Planning Commission are good folks who spend a lot of time on the
pros and cons before making recommendations to Council. If a
person is not happy about the recommendation from the Planning
Commission then they can appeal to Council. Mr. Myrick said that
if Council does not go with the recommendations from the Planning
Commission maybe we should just do away with the Planning
Commission. If Planning Commission has no teeth then it is a
waste of time. City Council is going to do what they want to.
Mayor Parker said that he and the Council appreciate what the
Planning Commission does but the they are a fact finding board
that makes recommendations to Council. Youmans agrees stating
that the more people you have look at something the broader view
you have to go on for your decision.
Mrs. Lori Ward passed out information concerning her water
bill (copy attached and becomes part of these minutes). Mrs. Ward
said that she has written two letters to the Mayor and has not
received any response. Mrs. Ward stated that she came home after
5 P.M. and went to start dinner and had no water. She called the
water department, no answer. Then she called the dispatcher to
see if there was a repair going on in her area. A gentleman from
the water department called her back and said that the water was
cut off for non payment. Mrs. Ward said that the bill is due on
the 20th of the month and that she feels that this means from
midnight to midnight on that day. Mrs. Ward said she dropped her
payment in the drop slot after 4:15 P.M. on the 20th. Mrs. Ward
said that she received a threatening phone call from Tanya
Fossitt stating that if she was not in City Hall first thing
Monday morning that her water would be cut again and the meter
locked. Mayor Parker asked why Ms. Fossitt said that the meter
would be padlocked. Mrs. Ward said that she had cut the water

back on herself. Mayor Parker said that the ordinances apply to
all citizens across the board. Youmans stated that he feels sorry
for Mrs. Ward but that he got a letter from the City to clean up
his property. Youmans said that he spent $500.00 trying to
educate the citizens about the City Manager form of government
before the referendum was held in 95, but it passed and now Mr.
Farmer is doing the job he was hired to do, enforce all the
ordinances. Mrs. Ward said that if the City Manager is going to
run the City then why are you people wasting your time. Mr. Ray
Whitten said that he was 15 minutes late paying his water bill
and was charged the $10.00 late fee. Mr. Whitten feels that Mrs.
Ward should be refunded her $35.00.
Mayor Parker said that a Proclamation for the 8th Infantry
will be presented by Mayor Pro Tem Wildi on March 21st.
Mayor Parker opened, asked for comments, and closed the 3
public hearings according to law.
1. Mr. Michael Ryan presented his petition for a height
variance of 7 feet at 1701 Strand. Mr. Ryan said that the extra
height would make a more attractive roof line, that he is in a V
Flood Zone and has to adhere to FEMA elevations. This
construction is in a commercial zone and could be built on the
property line. Mr. Ryan asked that Council please apply common
sense before voting. Ms. Alice Martin stated that she is in favor
of the City Manager form of government and that a City Manager
only carries out policy set by Council. Ms. Martin said that a
petition for a widow's walk was turned down by Council; a
petition from Savannah Beach and Racquet Club for a height
variance was granted by Council; a petition from Mr. Ryan for a
height variance was denied by Council for this same construction.
Ms. Martin said she is concerned about lawsuits stating that what
we do for one person we should do for others. Mr. Henry Levy said
that he can build a flat roof that would be pretty. With all the
new technology a flat roof will not leak. Mr. Levy said that Mr.
Ryan can redesign his building if he wants a pitched roof, but he
sees no hardship. Ms. Sallie Keller said that she does sit on the
Planning Commission and that tonight we have discussed water
bills and the City Manager. Ms. Keller said that rules have never
been enforced. Start today, don't go back, nobody should be
treated any differently. Ms. Keller said that the contractors
know the rules before they start building. Ms. Keller stated that
we are working on the here and now, the Planning Commission did
approve the request for the variance but the vote was not
unanimous. Mr. Penn Myrick said that there is a lot of money
involved when you redesign a building. He stated that lots on the
island are selling for $250,000. The City doesn't mind getting
the money from taxes, but developers are bad news and must go by
the book. Mr. Myrick said that Mr. Ryan bet on the fact that
Council would give him some help to make this building good
looking. Mrs. Jeanne Hutton thanked Dr. Farmer for enforcing the
ordinances consistently. Mrs. Hutton said that there is a problem
with a flat roof, but our ordinance is based on giving height for
additional footage in setbacks. Mrs. Hutton said that the
property behind the construction is impacted.
Mayor Parker introduced Attorney Dana Braun.

Mr. Eric Hogan presented his petition for a 6 foot setback
variance at 18 -20 Captains Row. Mr. Hogan said that he did not
realize the mistake until the as built survey was accomplished.
Mr. Hogan stated that there is a curve in the property line in
front. Mr. Hogan would have to tear out deck portion of the
structure in order to have correct setbacks. Mr. Hogan said that
this variance would not harm anyone. Youmans asked if we had
inspectors to inspect foundations. Mr. Hogan said it looks so
normal. Youmans questioned the site plan. Mr. Hogan said that yes
he had a site plan. Youmans said then the inspectors overlooked
it also, they let you construct the building where it is located.
Mr. Hogan said that he moved the house to the north in order to
save the trees.
Mr. Eric Hogan presented a petition for a minor subdivision
of a duplex at 18 -20 Captains Row stating that an 8 inch fire
wall is in place.
Mayor Parker opened the meeting for business legally
presented. Pearce moved to accept the suggestion of a park /plaza
at the intersection of Butler and Inlet, with the city employees
helping move a donated fountain and prepare the area, plus,
setting a committee of Mr. Waggoner, Mr. Levy, Mr Reese and Ms.
Sallie Day to work on the project. Merves seconded. Youmans said
that adjacent property owners should be consulted and we need to
look at the parking. Vote by Council was unanimous.
Pearce moved to deny the height variance request from Mr.
Ryan. Merves seconded. Pearce said he is confused on the
setbacks. Mr. Ryan said it is 1 and 1/2 feet but on the plans it
is 3 feet. Pearce made comments on aesthetics, but aesthetics are
not up to Council. Youmans stated that it seems Pearce wants to
save the trees and birds and does not care about the house.
Remeta said that he hopes Planning Commission goes forward with
the height issue because it is a hardship after paying
$300,000.00 for the property. Merves said that Ryan is a great
guy and his former landlord, but there are valid points about
changing the height limit. Merves said he does not see a
hardship. Merves noted that he had to run for office, speak with
voters and pledged consistent and fair treatment of citizens, and
to enforce the ordinances. Vote by Council to deny the request
was Merves, Hosti, and Pearce. Opposed to the motion were
Youmans, Remeta, Wildi. Mayor Parker broke the tie by voting to
deny the request.
Remeta moved to approve the request from Mr. Hogan for a 6
foot setback variance. Hosti seconded. Youmans said there is no
hardship but a mistake. Merves stated that it was a mistake on
the part of the City for not noticing the curve before
construction. Youmans said that he is going to vote for it
because the mistake was not the fault of Mr. Hogan. Vote by
Council was unanimous.
Youmans moved to approve a minor subdivision of a duplex at
the request of Mr. Eric Hogan. Remeta seconded. Vote by Council
was unanimous.
Youmans moved to accept the minutes of the January 25th
meeting and of the February 13th meeting. Hosti seconded. Vote by
Council was unanimous.

City Manager Farmer read the bills for the month of February
at the request of Councilmember Remeta. After a short discussion
on Fund Three expenses and a Beach Task Force trip to Sea Island
the bills stood approved.
Youmans moved to purchase a street sweeper in the amount of
$78,993.00 from SMA STITH Equipment Company and a garbage truck
in the amount of $49,018.00 from Mayo Co., Inc. to be financed
over a two year period. Wildi seconded. Vote By Council was
unanimous. (All quotes are attached and become part of these
minutes.)
Mr. Bill Lovett, of Hussey, Gay, Bell and De Young,
Engineers said that a survey and design of the parking lot at the
Tybee Museum would be $4,715. Mr. Lovett said that for the
drainage he would like to divide the island and do one project a
year and that he is putting a plan together to present to City
Manager Farmer next Friday. Remeta asked if the drainage project
was in the budget. City Manager Farmer said no. Remeta said we
need to be careful. City Manager answered that the State will pay
for the paving but that the City must correct the drainage first.
Remeta said we must live within the budget. Wildi said that we
need to talk with the Historical Society. Assistant City Manager
Fripp said that there is money in the 97 budget for another
project that has not been started yet. Farmer said that there is
$30,000 in the budget for Solomon Avenue. Youmans said that if
you don't pave then the water will soak into the ground. Remeta
said we don't know where we are going. Mayor Parker said this is
not a big project. Remeta stated that the gravel looks good.
Wildi said if the money was budgeted for one project then Council
would have to vote to change the project. Farmer said that money
would come from the fund balance in the Special Purpose Local
Option Sales Tax. Youmans said that we have streets that need
paving, if we don't do drainage. Merves asked the cost to the
City. Farmer said about $5,000 for the design and another 5 to 10
thousand for construction. Merves moved to approve the project.
Pearce seconded. Wildi said again that we need to approach the
Historical Society. Mayor Parker asked if we have a proceed date
from DOT. Mrs. Fripp answered she is not sure of their schedule.
Youmans said that people on Meddin do not want it paved. Pat
Locklear said that this all came about because of the Olympics,
and the entire lot will not be paved, this is a boom to the City
because it will not cost anything. Wildi stated that we need
more information and moved to table until next month. Youmans
seconded. Vote by Council was unanimous.
Mr. Bill Lovett handed out information on the elevated water
storage tank to Council. (copy attached and becomes part of these
minutes). Mr. Lovett said that the new tank can be located at the
present 2nd Street site. Mr. Lovett said the good news is that a
smaller tank will cost less money. Mr. Lovett suggests that the
city tie the system together first with a 12 inch line, and
proceed with the bid process. The connection could be completed
by October 98, take down old tank, new tank could be up by summer
of 99. George Reese will handle the electric for the wells.
Pearce moved to accept Mr. Lovett's suggestions of # 3 and 5 as
stated in his letter. Merves seconded. Merves seconded with an

amendment of proceeding with the bid process for the tank. Pearce
accepted the amendment. Youmans said that he would like to see a
total cost including the electrical expense. Voting in favor were
Merves, Hosti, Wildi and Pearce. Opposed were Youmans and Remeta.
Pearce moved to incorporate the fire subscription fees into
an ordinance to be read next month. Wildi seconded. Vote by
Council was unanimous.
City Manager Farmer said that Chatham County can not bill
the first half of 97 taxes because of the program changes needed.
The homestead exemption forms are being handed out and so far one
person has applied and has been approved.
Merves moved to refund Chapel by the Sea Baptist church the
building permit fee in the amount of $35.00. Pearce seconded.
Youmans said we need to run this City like a business. Vote by
Council was 5 in favor (Merves, Remeta, Hosti, Wildi, Pearce); 1
opposed (Youmans).
City Manager Farmer said that we should have about 4
proposals for wireless communications. Youmans said we need to
wait and see what happens with the court cases before we make a
decision. Mayor Parker said that it could go on the water tank.
Remeta said all proceeds should go to the gym fund. Attorney
Braun said that in his legal opinion the Council is not in a
position to vote on the lease option agreement, that a lot of
terms need to be addressed. Attorney Braun stated that Council
could vote to place the antennas on the water tank only. Remeta
moved not to approve lease option, suggest the antennae be placed
the water tanks and negotiate for more than $1,000 a month, no
less than $1,2000, with proceeds going towards gym fund. Youmans
seconded. Vote by council was unanimous.
Merves moved to approve a business license for J &B Sleigh
Rides, Inc., dba Hi & Dri Parasailing. Wildi seconded. Vote by
Council was unanimous. Pearce moved to set the proof of liability
insurance at 1 million dollars. Merves seconded. Vote by Council
was unanimous.
Pearce moved to adopt a resolution in order for the City to
be able to collect revenue through use of credit cards. Wildi
seconded. Vote by Council was unanimous.
Merves moved to remove a meter in front of Ms. Peters home
and replace with a resident parking only sign at #16 15th Street
until this matter can be cleared up by an ordinance change.
Wildi seconded. Vote by Council was 4 in favor (Merves, Hosti,
Wildi, Pearce); 2 opposed (Youmans, Remeta).
As there was no further business to come before Council the
meeting was adjourned.

I am writing in reference to the "GREAT" City Manager of
Tybee Island. (sarcastically).
The new City Manager and I have not agreed on the water bills
that are sent out every other month. In August 1996 I paid a water
bill on the 20th of August (that was the clue date) and dropped it
in the slot at the front door at 4:30 P.M.. This slot has always
been there for the purpose of dropping off-after
October I received my next bill for my water usage. The ours
had
a late charge of $10.00 on it. The next day I went to City Hall
and requested to talk to someone about my bill. I spoke with
Tanya, explained to me that I was late paving my bill in August.
I told her that the bill was dropped off on the 20th in the

Dear Mayor:
As a tax - paying, registered voter. whom by the way voted for you,
I am writing you for the second time about a very important
concern of ours.
My husband and I have been residents of Tybee Island for four
years now. My husband and his family have been here on the
Island for many years. We received our water bill for the months
of October & November and again I have a $10.00 late charge on
the bill. I discussed this late fee with Tanya in October and
was referred to Mr. Farmer and discussed it with him, also. I
then in return wrote you a letter about the situation and
received no response. ( obviously you did not handle it in the
office either.)
I could go into this all over again, but I feel this is probably
another waste of my time. So I have enclosed another copy of my
letter from October. Please consider these letters. This matter
needs to be resolved. We have always been on time and accurate
with our water bill payments. Please take the time to consider
this matter again.

P.S. By the way my bill for some reason has doubled the last
months. My explanation from the water dept. is "We raised the
water prices for the new water tower." I have asked numerous
times to look into this. We also checked for leaks. This is
RIDICULOUS!

P R O C L A M A T I O N
WHEREAS, The Eighth Infantry is an historic and famous fighting
unit of the United States Army; and
WHEREAS, The Eighth Infantry was organized in 1838 under Col.
William J. Worth; and
WHEREAS, The eighth Infantry is holding its annual reunion here
on Tybee Island on March 21st and 22nd this year, thus
living up to their motto, "PATRICAL FIDELITAS" (Loyalty
to Country), and extending its loyalty to Tybee Island;
and
WHEREAS, Tybee Island and, more specifically, Fort Screven, was
the home of the Eighth Infantry, from 1923, when they
returned here from Germany after serving in the Army of
Occupation after the First World War, until they were
sent to Fort Benning, Georgia and Fort Screven was
turned over to the City of Tybee Island to be sold at
Public Auction in 1945; and
WHEREAS, The City of Tybee Island is very proud of Fort Screven,
its National Register listing, and its connection with
the Eighth Infantry; and
WHEREAS, The citizens of Tybee Island are always happy to
welcome back again its old friends, the Eighth
Infantry;
NOW THEREFORE, BE IT RESOLVED, and it is hereby resolved by the
Mayor and Council in Open Meeting Assembled that the City of
Tybee Island, Georgia, does hereby declare March 21st and 22nd,
1997 to be "Eighth Infantry Days" in the city;
AND IT IS FURTHER RESOLVED that the citizens of Tybee Island are
heartily encouraged to extend to the Eighth Infantry Reunion
every possible dignity, courtesy and welcome, as befits their
proud heritage and purpose.

Dear Mr. Farmer.
The street sweeper specifications are enclosed, as requested. This Johnson 600 series is
powered by two diesel engines, one for the sweeper and one for the chassis. The chassis is a 1993
Ford, and is powered by a Cummings engine. The chassis motor has been driven 1,398 miles, and
the sweeper engine has had 256 hours of use. This sweeper can either be driven from a right or left
drive system.
The selling price for this sweeper is $68,000, where the purchasing price was $ 100,000. The
cost of delivery to Tybee Island Georgia is estimated to be $1,000, and can be delivered 3 days after
confirmation of the sale.
This sweeper is in excellent condition, but is being sold because it can not be used on our
site. This sweeper uses water to operate, so it can not sweep cement, and it is also can not access
smaller areas in the plant.
Even though this sweeper does not fit our needs, it works excellent on streets and parking
lots. If you would like a demonstration there are areas that it can be tested outside the plant, or we
can assist you with the operation after the sale. If you have any questions feel free to contact me at

Dear Dr. Farmer
As requested, we have investigated the alternative to replace the existing 100,000 gallon elevated
tank located at Butler Avenue and Second Street with a new 150,000 gallon elevated tank at the
same site. This alternative includes strengthening the water distribution system by connecting the
existing 150,000 gallon elevated tank in the Fort Screven area to the system at Butler Avenue and
Second Street. Under this altemative, you would have three (3) wells and two (2) elevated tanks
in service together.
Our estimate for this alternative is as follows:
1. 150 GALLON ELEVATED STORAGE - PEDESTAL
2. Controls - Existing well #2 and Existing Tank
3. Distribution System - Connection. (includes engineering and inspection)
4. Electrical Upgrade of Wells #1 and #3. (City will contract directly
for this work) [cost estimate provided by George Reese]
5. Removal of existing 100,000 gallon tank
6. Emergency repairs to existing 100,000 gallon tank

The system would be controlled by the elevated tanks. The present system in the Fort Screven
area is controlled by tank probes. We are proposing to abandon the probe system and place a
pressure controller near the bottom of the existing tank riser. RTU's and telephone terminals will
be installed in Well Number 2 (Fort Screven). This equipment is to be installed in Well Number 1
and Well Number 3 under work to be contracted directly by the City.
A breakdown of the estimated costs for a Double- Ellipsoid legged tank and a Pedesphere Tank is
included. Although the legged tank is $70,000 less expensive to construct, we would recommend
the Pedesphere Tank due to the significant reduction in maintenance costs.

RESOLUTION TO ACCEPT CREDIT CARD PAYMENTS
WHEREAS, the governing body of the City of Tybee Island has
determined that the use of credit cards, charge cards, and debit
cards by the public in making payments to the City of Tybee
Island for local ad valorem taxes; water, sewer, and sanitation
fees and penalties; license and business registration fees; and
other obligations due the City; are in the public interest, and
also serve to improve governmental cash flow, reduce governmental
overhead, and improve governmental financial security, AND
WHEREAS, Chapter 1 of Title 50 of the Official Code of
Georgia authorizes but does not require governments to accept
credit card payments,
NOW, THEREFORE, BE IT RESOLVED, that the City Manager is
authorized to enter into appropriate agreements with credit card
issuers or other parties as needed to facilitate the acceptance
of credit card payments for those obligations due the City as
specified above, with the term "credit card" deemed to include
credit cards, charge cards, and debit cards; AND
PROVIDED FURTHER, that, when allowed by the operating rules
and regulations of the credit card or credit card companies
involved, the Cityt impose a surcharge upon the persons making
a payment by credit card so as to wholly or partially offset the
amount of any discount or administrative fees charged to the city
by the credit card or credit card companies involved, said
surcharge to be determined by the City Manager through analysis
of the credit card agreement provisions.
