We the undersigned, being interested in a fireworks display for Village of Key Biscayne, agree
to pay a price of $50,000 00 for the display agreed upon,.,which will be furnished by Firepower
Displays Unlimited, Inc ('`Firepower")
The undersigned, intending to be legally bound, agree as follows
I Sponsor to make payment in full upon completion of fireworks display
2 Music choreographed to a soundtrack designed and approved by the Village of Key
Biscayne Music must be selected and approved no later than 60 days prior to show (May 4,
1998). Copy of Firepower's contract/agreement with the barge and tug company will be
provided Barge and tug arc provided by Firepower at no cost to Village of Key Biscayne.
Coordination of the fireworks display will be overseen by Gary Avins and/or Firepower
agent who will be on site at all times.
3 If event is on land, .ponsor to furnish police and/or crowd security personnel, provide proper
parking supervision, and insure adequate patrol Of the stifcty zone as marked and secured by
the sponsor until Firepower Displays Unlimited. Inc advises that it is no longer necessary
4 If event is over water, Firepower Displays Unlimited, will be responsible for marine permit
and control of safety zone
5 Firepower Displays Unlimited, Inc to supply (4) multi -channel radio for communication link
between Firepower Displays staff Gary Avins and/or Firepower agent, and Key Biscayne
display coordinator(s).
6 Firepower Displays Unlimited, lnc. reserves the right to terminate the display in the event
persons, vehicles or animals enter the secured safety zone and security is unable or unwilling
to remove them and enforce the safety regulations.
7 Fit epowcr Displays Unlimited, Inc will furnish all applicable fireworks, equipment, licenses,
permits and $2,000,000 liability insurance, naming Village of Key Biscayne as additional
insured, and pyrotechnicians for your electronically tired display

8. Subject to limits of Sec. 768.28, F.S., Village shall hold harmless Firepower Displays
Unlimited, Inc. from any claims that do not arise out of damages in any way caused by
Firepower or Firepower's agents, employees, equipment or pymteehnic material
9. If show is cancelled by Village of Key Biscayne, Village is responsible for any permit fees, if
applicable.
10 If wind exceeds 20 miles per hour, fireworks display will be postponed to an agreed date
between sponsor and Firepower Displays Unlimited, Inc.
I I Rain date policy is a follows. Postponement time is I I :30am day of display. If
postpancment occurs after that time, there will be a charge of 10% of the contract price
12 Charges incurred by Firepower for the barge, if show is cancelled by Village of Key
Biscayne, are the responsibility of the Village of Key Biscayne, but shall not exceed
$3,000.00 dollars
13. Firepower Displays requires that a meetint be scheduled no later than 30 days prior to
jh,e event to coordinate the logistics, with the Key Biscayne event iaff, fi an _ oli
f)epartmcnt and Firepower Disply staff.
Firepower Displays Unlimited, Inc , upon acceptance of this contract in writing, agrees to iuifrll
the contract in a workmanlike and professional manner
