HomeMy Public PortalAbout1986_09_02SPEC 1 315 MINUTES OF SPECIAL MEETING OF LEESBURG TOWN COUNCIL, SEPTEMBER 2, 1986. A special meeting of the Leesburg Town Council was held on September 2, 1986 at 6:45 p.m. in the Council Chambers , 10 Loudoun Street, S.W. , Leesburg, Virginia, pursuant to Notice of said meeting having been sent to all Councilmembers and the media. Present were: Mayor Robert E. Sevila, Councilmembers Charles A. Bos, Arl Curry, Brian T. Kelley, Jerry S. Pelkey, Charles J. Williams and John W. Tolbert, Jr. ; also Town Manager Jeffrey H. Minor, Assistant to Town Manager Stephen F. Owen and Deputy Town Attorney Deborah C. Welsh. The meeting was called to order by Mayor Sevila, who announced the purpose of this meeting is to discuss a change in the resolution adopted on August 27, 1986 authorizing an agreement with the Loudoun County Sanitation Authority with respect to the settlement the Town had achieved on the Potomac Park litigation regarding utility jurisdiction. According to the Town's attorneys , the resolution that was adopted was too restrictive for the Sanitation Authority and they would not likely choose to be a signatory to the agreement. On motion of Mr. Williams, seconded by Mr. Tolbert, the following resolution was proposed: 86-185 - RESOLUTION - AUTHORIZING AN AGREEMENT AMONG THE TOWN OF LEESBURG, LOUDOUN COUNTY BOARD OF SUPERVISORS AND XEROX REALTY CORPORATION WHEREAS, a dispute arose between the Town of Leesburg and County of Loudoun concerning the November 15, 1982, Annexation Agreement with respect to the Xerox Realty Corporation rezoning approved by the County December 16, 1985, the Leesburg Area Management Plan amendments approved September 16, 1985, and the timing and source of utility services to the planned Potomac Park development; and WHEREAS, the Leesburg Town Council by Resolution No. 86-101 dated May 28, 1986, and the Loudoun County Board of Supervisors by approved motion on May 22, 1986, agreed to a settlement of the litigation arising out of the dispute hereinabove described, subject to the preparation of a formal written agreement; THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows: The Mayor is authorized and directed to execute the Agreement among Leesburg, Loudoun County and Xerox Realty Corporation attached hereto, subject to revisions approved by the town' s special counsel. Mr. Williams asked if this is acceptable for all concerned? Mr. Minor replied that all suggestions from the County Attorney have been reflected in this version and the map is essentially the one accepted in the settlement several months ago. There is nothing new in the agreement that wasn' t in the exchange of the settle- , ment papers. When they execute this agreement there will no longer be an active appeal. Mr. Sevila added that the agreement compromises the appeal. The resolution was unanimously adopted: Aye: Councilmembers Bos, Williams, Pelkey, Curry, Kelley, Tolbert and Mayor Sevila.
