HomeMy Public PortalAbout1986_09_30SPEC MINUTES OF SPECIAL MEETING OF LEESBURG TOWN COUNCIL, SEPTEMBER 30, 1986. 337 A special meeting of the Leesburg Town Council was held on September 30, 1986 at 9:30 p.m. in the Council Chambers, 10 Loudoun Street, S.W. , Leesburg, Virginia, pursuant to Notice thereof having been delivered to all councilmembers prior thereto. Present were: Mayor Robert E. Sevilt, Councilmembers Charles A. Bos, Brian T. Kelley, Jerry S. Pelkey, John W. Tolbert, Jr. and Charles J. Williams; also Acting Town Manager Martha Semmes, Director of Finance Paul E. York, Town Attorney George M. Martin and Deputy Town Attorney Deborah C. Welsh. Absent from the meeting was Councilmember Arl Curry. The meeting was called to order by Mayor Sevila, who reported that members of the press had all been advised of this meeting by the Clerk of Council. On motion of Mr. Williams, seconded by Mr. Pelkey, Council voted unanimously to go into executive session to discuss legal matters pursuant to Section 2. 1-344(6) of the Code of Virginia of 1950, as amended, which permits the Coun- cil to discuss such matters in executive session. To be discussed is the case of Leckey v. Town of Leesburg. It was requested that the following members of staff remain: Acting Town Manager Martha Semmes, Director of Finance Paul York, Town Attorney George M. Martin and Deputy Town Attorney Deborah C. Welsh. Aye: Councilmembers Bos, Kelley, Pelkey, Tolbert, Williams and Mayor Sevila. Nay: None. Council reconvened, with no action taken during the executive session. 86-209 - RESOLUTION - ACCEPTING A COMPROMISE AND AMENDING THE LEASE BY AND BE- TWEEN PROFESSIONAL PILOT SERVICES AND THE TOWN OF LEESBURG. On motion of Mr. Kelley, seconded by Mr. Pelkey, the following resolution was proposed and unanimously adopted: WHEREAS, the issues involved in the suit, At Law No. 8745, between Stephen W. Leckey, t/a Professional Pilot Services, and the Town of Leesburg, et als have been resolved; and WHEREAS, the lease dated June 23, 1986, by and between Professional Pilot 1 II Services and the Town of Leesburg must be amended to conform to the terms of the said compromise: THEREFORE, RESOLVED by the Council of the Town of Leesburg in Virginia as follows: SECTION I. The lease by and between Professional Pilot Services and the Town of Leesburg is hereby amended pursuant to the terms of the letter dated 26 September 1986 from Alfred J. Horvath to Deborah C. Welsh, which sets forth a compromise in the above referenced suit. A copy of said let- ter is attached hereto and made a part hereof. The terms of the said com- promise as set forth in said letter are hereby accepted by the town. SECTION II. The mayor is hereby authorized to execute any and all documents necessary to amend said lease upon the condition that said documents are reviewed and approved by the Town Attorneys and executed, prior to review and approval by the Town Attorneys, by Stephen W. Leckey, t/a Professional Pilot Services. SECTION III. The attorneys for the Town of Leesburg are authorized to com- promise said suit pursuant to the terms of the letter and are authorized to sign the documents necessary to facilitate the compromise of the same.
