HomeMy Public PortalAbout1987_02_03SPEC MINUTES OF SPECIAL MEETING OF LEESBURG TOWN COUNCIL, FEBRUARY 3, 1987 A special meeting of the Leesburg Town Council was held on February 3, • 1987 at 5:45 p.m. in the Council Chambers, 10 Loudoun Street, S.W. , Leesburg, Virginia, pursuant to Notice thereof having been delivered to all council- members prior thereto. Present were Councilmembers Arl Curry, Brian T. Kelley, Jerry S. Pelkey and John W. Tolbert, Jr. also Town Manager Jeffrey H. Minor. The meeting was called to order by Councilmember Kelley. On motion of Mr. Pelkey, seconded by Mr. Curry, Council unanimously appointed Mr. Tolbert as Acting Vice-Mayor in the absence of Mayor Robert Sevila and Vice-Mayor Charles Williams. The purpose of this meeting is to discuss the sales contract from William C. . Thomas, Trustee for an approximate 22-acre tract of land adjacent to Route 860, which tract is owned by the town. 87-0-3 - ORDINANCE - APPROVING A SALES CONTRACT WITH WILLIAM C. THOMAS, TRUSTEE On motion of Mr. Kelley, seconded by Mr. Pelkey, the following ordinance was proposed: WHEREAS, the Town of Leesburg owns in fee simple an approximate 22 acre tract of land adjacent to Route 860; and WHEREAS, this Council by Resolution No. 86-251 has declared this land surplus; and WHEREAS, the tract was advertised for sale in the Loudoun Times-Mirror; and WHEREAS, the town attorney has advised the Council that it has proper title sufficient to convey this tract pursuant to §15. 1-307 of the 1950 Code of Virginia, as amended; and WHEREAS, said tract is comprised of two conforming building lots in the A-3 zoning district; and II/ WHEREAS, William C. Thomas, Trustee, has submitted a sales contract with the requisite $2,000 deposit which represents an offer to pur- chase the tract for $168,500; and WHEREAS, the offer received from William C. Thomas, Trustee, represents the highest purchase price for the tract of all offers received; and WHEREAS, the Council desires to accept the offer from William C. Thomas, Trustee: THEREFORE, ORDAINED by the Council of the Town of Leesburg in Virginia as follows: SECTION I. The sales contract dated January 30, 1987, between the Town of Leesburg and William C. Thomas, Trustee, being the same as transmitted to the Council on February 2, 1987, is approved and the town manager shall execute the sales contract on behalf of the town. SECTION II. The Mayor shall execute such appropriate deeds and instru- ments as prepared by the town attorney to convey said tract to William C. Thomas, Trustee, upon payment of the $166,500 balance of the purchase price. II/ SECTION III. This ordinance shall be in effect upon its passage. Town Manager Jeffrey-Minor reported for the record, as per_ instructions of the Council, that the Town had received two offers - one from Mr. Thomas and one from a Mr. Boyett, as of 4:00 p.m. Friday, January 30, 1987. They were asked to revise their offers and instructed to submit a price of at least $165,000 for the property, unconditional. Mr. Boyett came to the Town Office and met with him, , indicating that his best offer was $150,000. Mr. Thomas came shortly thereafter, making an offer o $168,500 - both offers having been received before 4:00 p.m. , Friday, January 30, 1987. Since then, the staff has revised the con- tract form and Town Attorney George Martin has tightened up the title language. MINUTES OF FEBRUARY 3, 1987 SPECIAL MEETING. That was hand-carried to Mr. Thomas on Tuesday, February 3, 1987 and was ac- cepted with all the conditions and with no contingencies. The ordinance was unanimously adopted : Aye: Councilmembers Curry, Kelley, Pelkey and Acting Vice-Mayor Rolbert. Nay: None. On motion of Mr. Pelkey, seconded by Mr. Curry, the meeting was adjourned.
